[Machine] Abu Ubayd said in the Hadith of Uthman: "When the two arrows are thrown, there should be no reciprocity." Al-Asmami said, "Reciprocity is when someone is imprisoned. He said, "When the boundaries are set, no one should be imprisoned against his rights, and the basis of this is the chain." Abu Ubayd said, "By the One in whose hand is this Hadith, it is a fiqhi matter that Uthman ibn Affan did not consider intercession for the neighbor except for the mixed participant, and this is clear in another Hadith of his." Abu Ubayd said, "It was narrated to us by Abdullah ibn Idris from Muhammad ibn Umamah from Abu Bakr ibn Hazm or from Abdullah ibn Abu Bakr ibn Hazm, doubt from Abu Ubayd from Aban ibn Uthman from Uthman, he said, "There is no intercession regarding a well or a pregnant camel, and Araff cuts off every intercession." Ibn Idris said, "Araff means landmarks." Al-Asmami said, "It means landmarks and boundaries." He said, "This is the saying of the people of Hijaz, when you say, 'I have divided and delineated the land.'" Ibn Idris said, "His statement 'There is no intercession regarding a well or a pregnant camel,' I believe the pregnant camel is the female camel, and we have narrated that from Saeed ibn Al-Musayyib, Sulaiman ibn Yasir, and Umar ibn Abdul Aziz."  

البيهقي:١١٥٧٧أَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ أنبأ أَبُو الْحَسَنِ الْكَارِزِيُّ ثنا عَلِيُّ بْنُ عَبْدِ الْعَزِيزِ قَالَ

قَالَ أَبُو عُبَيْدٍ فِي حَدِيثِ عُثْمَانَ ؓ إِذَا وَقَعَتِ السُّهْمَانُ فَلَا مُكَابَلَةَ قَالَ الْأَصْمَعِيُّ الْمُكَابَلَةُ تَكُونُ مِنَ الْحَبْسِ يَقُولُ إِذَا حُدَّتِ الْحُدُودُ فَلَا يُحْبَسُ أَحَدٌ عَنْ حَقِّهِ وَأَصْلُ هَذَا مِنَ الْكَبْلِ وَهُوَ الْقَيْدُ قَالَ أَبُو عُبَيْدٍ وَالَّذِي فِي هَذَا الْحَدِيثِ مِنَ الْفِقْهِ أَنَّ عُثْمَانَ بْنَ عَفَّانَ ؓ كَانَ لَا يَرَى الشُّفْعَةَ لِلْجَارِ إِنَّمَا يَرَاهَا لِلْخَلِيطِ الْمُشَارِكِ وَهُوَ بَيِّنٌ فِي حَدِيثٍ لَهُ آخَرَ قَالَ أَبُو عُبَيْدٍ حَدَّثَنَاهُ عَبْدُ اللهِ بْنُ إِدْرِيسَ عَنْ مُحَمَّدِ بْنِ عُمَارَةَ عَنْ أَبِي بَكْرِ بْنِ حَزْمٍ أَوْ عَنْ عَبْدِ اللهِ بْنِ أَبِي بَكْرِ بْنِ حَزْمٍ الشَّكُّ مِنْ أَبِي عُبَيْدٍ عَنْ أَبَانَ بْنِ عُثْمَانَ عَنْ عُثْمَانَ ؓ قَالَ لَا شُفْعَةَ فِي بِئْرٍ وَلَا فَحْلٍ وَالَأرَفُ يَقْطَعُ كُلَّ شُفْعَةٍ قَالَ ابْنُ إِدْرِيسَ الَأرَفُ الْمَعَالِمُ وَقَالَ الْأَصْمَعِيُّ هِيَ الْمَعَالِمُ وَالْحُدُودُ قَالَ وَهَذَا كَلَامُ أَهْلِ الْحِجَازِ يُقَالُ مِنْهُ أَرَفْتَ الدَّارَ وَالْأَرْضَ تَأْرِيفًا إِذَا قَسَّمْتَهَا وَحَدَّدْتَهَا قَالَ ابْنُ إِدْرِيسَ وَقَوْلُهُ لَا شُفْعَةَ فِي بِئْرٍ وَلَا فَحْلٍ أَظُنُّ الْفَحْلَ فَحْلَ النَّخْلِ وَرُوِّينَا فِي ذَلِكَ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ وَسُلَيْمَانَ بْنِ يَسَارٍ وَعُمَرَ بْنِ عَبْدِ الْعَزِيزِ
