[Machine] About the scholars who [have a ruling that] is concluded with their saying from the people of Madinah: they used to say concerning a man who has partners in a house, and the partners give him the option of intercession except for one man who wants to take his rightful share of the intercession, they said to him: that is not for him. Either he takes it all or he leaves it all. And they used to say concerning a group who inherit from their father money and one of them dies and leaves behind a child, and one of his children sells his right from that money, the child and his uncles become partners in the intercession according to their respective shares if the money is not divided and the boundaries are set. And Abdur-Rahman ibn Abi Zinad mentioned that Muhammad ibn Umarah al-Hazmi said: Abu Bakr ibn Muhammad ibn Amr ibn Hazm ruled with that.
عَنِ الْفُقَهَاءِ الَّذِينَ يُنْتَهَى إِلَى قَوْلِهِمْ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ فِي الرَّجُلِ لَهُ شُرَكَاءُ فِي دَارٍ فَيُسَلِّمُ لَهُ الشُّرَكَاءُ الشُّفْعَةَ إِلَّا رَجُلًا وَاحِدًا أَرَادَ أَنْ يَأْخُذَ بِقَدْرِ حَقِّهِ مِنَ الشُّفْعَةِ قَالُوا لَيْسَ ذَلِكَ لَهُ إِمَّا أَنْ يَأْخُذَهَا جَمِيعًا وَإِمَّا أَنْ يَتْرُكَهَا جَمِيعًا وَكَانُوا يَقُولُونَ فِي النَّفَرِ يَرِثُونَ مِنْ أَبِيهِمْ مَالًا فَيَمُوتُ أَحَدُهُمْ وَيَتْرُكُ وَلَدًا فَيَبِيعُ أَحَدُ وَلَدِهِ حَقَّهُ مِنْ ذَلِكَ الْمَالِ فَالْوَلَدُ وَأَعْمَامُهُ شُرَكَاؤُهُ فِي الشُّفْعَةِ عَلَى قَدْرِ حِصَصِهِمْ إِذَا كَانَ الْمَالُ لَمْ يُقْسَمْ وَتَقَعُ فِيهِ الْحُدُودُ وَذَكَرَ عَبْدُ الرَّحْمَنِ بْنُ أَبِي الزِّنَادِ عَنْ مُحَمَّدِ بْنِ عُمَارَةَ الْحَزْمِيِّ أَنَّ أَبَا بَكْرِ بْنَ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ قَضَى بِذَلِكَ
