25. Chapter
٢٥۔ كِتَابُ الشُّفْعَةِ
[Machine] "The Messenger of Allah ﷺ said, 'The neighbor has more right to be given a drink.' Abu Qilabah said, 'Al-Asma'i Al-Arabi said, The drink should be appropriate.' The Sheikh disputed him, Ibrahim ibn Maisarah disagreed with him with his chain of narrators."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْجَارُ أَحَقُّ بِسَقَبِهِ قَالَ أَبُو قِلَابَةَ قَالَ الْأَصْمَعِيُّ الْعَرَبُ تَقُولُ السَّقَبُ اللَّزِيقُ قَالَ الشَّيْخُ خَالَفَهُ إِبْرَاهِيمُ بْنُ مَيْسَرَةَ بِإِسْنَادِهِ
[Machine] The Messenger of Allah ﷺ said, "The neighbor has the most right to their neighbor's kindness."
قَالَ رَسُولُ اللهِ ﷺ الْجَارُ أَحَقُّ بِسَقَبِهِ
[Machine] He has Sa'd, and I swear to Allah, I will not increase you to more than four hundred dinars, either cut or intact. So Abu Rafi' said, "Glory to Allah! I have prevented them from five hundred cash. If only I had not heard the Messenger of Allah, ﷺ , say, 'The neighbor has more right to his neighbor's drain water.'"
لَهُ سَعْدٌ ؓ وَاللهِ لَا أَزِيدُكَ عَلَى أَرْبَعِمِائَةِ دِينَارٍ إِمَّا مُقَطَّعَةً وَإِمَّا مُنَجَّمَةً فَقَالَ أَبُو رَافِعٍ سُبْحَانَ اللهِ لَقَدْ مَنَعْتُهُمَا مِنْ خَمْسِمِائَةٍ نَقْدًا فَلَوْلَا أَنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ الْجَارُ أَحَقُّ بِسَقَبِهِ مَا بِعْتُكَ
[Machine] That the Messenger of Allah ﷺ emphasized the importance of good neighborly relations, and Samurah narrated that the Prophet ﷺ said, "The neighbor of a house has more right to the house than others."
أَنَّ رَسُولَ اللهِ ﷺ قَضَى بِالْجِوَارِ وَعَنْ سَمُرَةَ أَنَّ النَّبِيَّ ﷺ قَالَ جَارُ الدَّارِ أَحَقُّ بِالدَّارِ مِنْ غَيْرِهِ
The Prophet ﷺ said: The neighbour is most entitled to the right of pre-emption, and he should wait for its exercise even if he is absent, when the two properties have one road. (Using translation from Abū Dāʾūd 3518)
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ الْجَارُ أَحَقُّ بِشُفْعَةِ أَخِيهِ يَنْتَظِرُ وَإِنْ كَانَ غَائِبًا إِذَا كَانَ طَرِيقُهُمَا وَاحِدًا
[Machine] Translation: "That this hadith is not memorized was told to him and he was asked, 'From where did you say that?' He replied, 'I only said.'"
أَنْ لَا يَكُونَ هَذَا الْحَدِيثُ مَحْفُوظًا قِيلَ لَهُ وَمِنْ أَيْنَ قُلْتَ؟ قَالَ إِنَّمَا
مِنْ حُسْنِهَا فَرَرْتُ
This hadith is narrated on the authority of Yahya b. Sa'id with the same chain of transmitters but with this variation that he said that ('A'isha did not observe fast but in Sha'ban) out of regard for the Messenger of Allah ﷺ. (Using translation from Muslim 1146b)
أَنَّهُ قَالَ ذَلِكَ
[Machine] About the Prophet ﷺ , he said, "This is a rejected/reprehensible narration."
عَنِ النَّبِيِّ ﷺ قَالَ هَذَا حَدِيثٌ مُنْكَرٌ
