25. Chapter
٢٥۔ كِتَابُ الشُّفْعَةِ
[Machine] The Prophet ﷺ said, "There is no intercession for one who is absent, young, or has a partner, if the partner has preceded him in the purchase." Abu Sa'd narrated to us, and Abu Ahmad informed us, narrating from Muhammad ibn Sa'id ibn Mihran, who narrated from 'Umar ibn Shabba, who narrated from Muhammad ibn Al-Harith, with a similar chain of narration. And he added, "Intercession is like the blackness of a horse's eyeliner."
قَالَ النَّبِيُّ ﷺ لَا شُفْعَةَ لِغَائِبٍ وَلَا صَغِيرٍ وَلَا شَرِيكٍ عَلَى شَرِيكٍ إِذَا سَبَقَهُ بِالشِّرَاءِ 11588 وَأَخْبَرَنَا أَبُو سَعْدٍ قَالَ وَأنبأ أَبُو أَحْمَدَ ثنا مُحَمَّدُ بْنُ سَعِيدِ بْنِ مِهْرَانَ ثنا عُمَرُ بْنُ شَبَّةَ ثنا مُحَمَّدُ بْنُ الْحَارِثِ بِإِسْنَادِهِ نَحْوَهُ وَزَادَ وَالشُّفْعَةُ كَحَلِّ الْعِقَالِ
[Machine] On the authority of the Prophet ﷺ he said: "There is no intercession for a child or for an absent person. And if a partner precedes his partner in intercession, then there is no intercession. And intercession is like the mark of a camel's nose rope."
عَنِ النَّبِيِّ ﷺ قَالَ لَا شُفْعَةَ لِصَبِيٍّ وَلَا لِغَائِبٍ وَإِذَا سَبَقَ الشَّرِيكُ شَرِيكَهُ بِالشُّفْعَةِ فَلَا شُفْعَةَ وَالشُّفْعَةُ كَحَلِّ الْعِقَالِ
[Machine] The Prophet ﷺ said, "Intercession does not inherit nor is it inherited. Muhammad ibn Al-Harith Al-Basri is abandoned, and Muhammad ibn Abdur-Rahman Al-Baylmani is weak, weakened by Yahya ibn Ma'een and others from the scholars of Hadith. It has been narrated in opposition to the first Hadith a weak Hadith from Jabir, that the young boy will be raised on his intercession until he reaches puberty, and both of them are denied."
قَالَ رَسُولُ اللهِ ﷺ الشُّفْعَةُ لَا تَرِثُ وَلَا تُورَثُ مُحَمَّدُ بْنُ الْحَارِثِ الْبَصْرِيُّ مَتْرُوكٌ وَمُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ الْبَيْلَمَانِيُّ ضَعِيفٌ ضَعَّفَهُمَا يَحْيَى بْنُ مَعِينٍ وَغَيْرُهُ مِنْ أَئِمَّةِ أَهْلِ الْحَدِيثِ وَقَدْ رُوِيَ فِي مُعَارَضَةِ الْحَدِيثِ الْأَوَّلِ حَدِيثٌ ضَعِيفٌ عَنْ جَابِرٍ مَرْفُوعًا الصَّبِيُّ عَلَى شُفْعَتِهِ حَتَّى يُدْرِكَ وَكِلَاهُمَا مُنْكَرَانِ
[Machine] The Messenger of Allah ﷺ said, "The young boy will be given the chance to intercede until he reaches puberty. If he reaches puberty, then if he wants, he can take it, and if he wants, he can leave it." Abdullah ibn Bazia took this narration as unique, even though he is weak, and those lower than him refer to our sheikhs, and they cannot be used as evidence.
قَالَ رَسُولُ اللهِ ﷺ الصَّبِيُّ عَلَى شُفْعَتِهِ حَتَّى يُدْرِكَ فَإِذَا أَدْرَكَ فَإِنْ شَاءَ أَخَذَ وَإِنْ شَاءَ تَرَكَ تَفَرَّدَ بِهِ عَبْدُ اللهِ بْنُ بَزِيعٍ وَهُوَ ضَعِيفٌ وَمَنْ دُونَهُ إِلَى شَيْخِ شَيْخِنَا لَا يُحْتَجُّ بِهِمَا
[Machine] That the Messenger of Allah ﷺ said, "There is no intercession for a Christian." Abu Ahmad said, "The narrations of Nāʼil are very confusing, especially when he reports from Al-Thawri 11593." Ali ibn Ahmad ibn Abdan informed us, Sulayman ibn Ahmad Al-Lakhmi narrated to us, Hussein ibn Ali Al-Sarraj Al-Qadi narrated to us, Muhammad ibn Sinan Al-Qazzaz narrated to us, Nāʼil ibn Najih mentioned it except that he said, "He mentioned it once to the Prophet ﷺ and not another." The Shaykh said, "The hadith is from Sufyan, from Humaid Al-Tawiyl, from Hassan who said, 'There is no intercession for a Jew or a Christian.' Abu Bakr Al-Ardastani informed us, Abu Nasr Al-Iraqi narrated to us, Sufyan Al-Jawhari narrated to us, Ali ibn Al-Hasan Al-Hilali narrated to us, Abdullah ibn Al-Walid narrated from Sufyan and mentioned it. This is the correct statement of Al-Hassan and we have also narrated from Iyas ibn Muawiya that he ruled in favor of intercession for a dhimmi."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا شُفْعَةَ لِلنَّصْرَانِيِّ قَالَ أَبُو أَحْمَدَ أَحَادِيثُ نَائِلٍ مُظْلِمَةٌ جِدًّا وَخَاصَّةً إِذَا رَوَى عَنِ الثَّوْرِيِّ 11593 وَأَخْبَرَنَا عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنبأ سُلَيْمَانُ بْنُ أَحْمَدَ اللَّخْمِيُّ ثنا الْحُسَيْنُ بْنُ عَلِيٍّ السَّرَّاجُ الْقَاضِي ثنا مُحَمَّدُ بْنُ سِنَانٍ الْقَزَّازُ ثنا نَائِلُ بْنُ نَجِيحٍ فَذَكَرَهُ إِلَّا أَنَّهُ قَالَ رَفَعَهُ مَرَّةً إِلَى النَّبِيِّ ﷺ وَلَمْ يَرْفَعْهُ أُخْرَى قَالَ الشَّيْخُ وَالْحَدِيثُ عِنْدَ سُفْيَانَ عَنْ حُمَيْدٍ الطَّوِيلِ عَنِ الْحَسَنِ قَالَ لَيْسَ لِلْيَهُودِيِّ وَالنَّصْرَانِيِّ شُفْعَةٌ أَخْبَرَنَاهُ أَبُو بَكْرٍ الْأَرْدَسْتَانِيُّ أَنْبَأَ أَبُو نَصْرٍ الْعِرَاقِيُّ ثنا سُفْيَانُ الْجَوْهَرِيُّ ثنا عَلِيُّ بْنُ الْحَسَنِ الْهِلَالِيُّ ثنا عَبْدُ اللهِ بْنُ الْوَلِيدِ عَنْ سُفْيَانَ فَذَكَرَهُ هَذَا هُوَ الصَّوَابُ مِنْ قَوْلِ الْحَسَنِ وَقَدْ رُوِّينَا عَنْ إِيَاسِ بْنِ مُعَاوِيَةَ أَنَّهُ قَضَى بِالشُّفْعَةِ لِذِمِّيٍّ
[Machine] "That the absent one, when he arrives, sees the young one on his behalf when he grows up, he said, and there is no intercession in animals."
أَنَّ الْغَائِبَ عَلَى شُفْعَتِهِ إِذَا قَدِمَ وَيَرَى الصَّغِيرَ عَلَى شُفْعَتِهِ إِذَا كَبِرَ قَالَ وَلَيْسَ فِي الْحَيَوَانِ شُفْعَةٌ
