٣٥۔ كِتَابُ الْوَصَايَا
[Machine] Al-Shafi'i said, and it has been narrated in regards to the settlement of debts before the will, a hadith from the Prophet ﷺ that the people of hadith do not establish anything like it. Al-Shafi'i said, Sufyan narrated from Abu Ishaq from Harith from Ali from the Prophet ﷺ that he ruled in favor of the debt before the will. The scholar said, the rejection of the people of hadith to establish this is because Harith al-Awar is unique in narrating this from Ali, and Harith's report cannot be relied upon due to criticism by the preservers. قَالَ الشَّافِعِيُّ وَقَدْ رُوِيَ فِي تَبْدِيَةِ الدَّيْنِ قَبْلَ الْوَصِيَّةِ حَدِيثٌ عَنِ النَّبِيِّ ﷺ لَا يُثْبِتُ أَهْلُ الْحَدِيثِ مِثْلَهُ قَالَ الشَّافِعِيُّ ثنا سُفْيَانُ عَنْ أَبِي إِسْحَاقَ عَنِ الْحَارِثِ عَنْ عَلِيٍّ عَنِ النَّبِيِّ ﷺ قَضَى بِالدَّيْنِ قَبْلَ الْوَصِيَّةِ قَالَ الشَّيْخُ امْتِنَاعُ أَهْلِ الْحَدِيثِ عَنْ إِثْبَاتِ هَذَا لِتَفَرُّدِ الْحَارِثِ الْأَعْوَرِ بِرِوَايَتِهِ عَنْ عَلِيٍّ ؓ وَالْحَارِثُ لَا يُحْتَجُّ بِخَبَرِهِ لِطَعْنِ الْحُفَّاظِ فِيهِ وَكَذَلِكَ
The Prophet ﷺ ruled that debts must be paid before carrying out bequests, and you recite the words, “after payment of legacies he (or she) may have bequeathed or debts” [an-Nisaʿ 4:12]. Brothers from the same mother and father inherit from one another, but brothers from different mothers do not. (Using translation from Aḥmad 1091)
إِنَّكُمْ تَقْرَءُونَ {مِنْ بَعْدِ وَصِيَّةٍ يُوصَى بِهَا أَوْ دَيْنٍ} [النساء 12] وَإِنَّ اللهَ ﷻ قَضَى بِالدَّيْنِ قَبْلَ الْوَصِيَّةِ وَإِنَّ أَعْيَانَ بَنِي الْأُمِّ يَتَوَارَثُونَ دُونَ بَنِي الْعَلَّاتِ
[Machine] The Messenger of Allah ﷺ said: "Debt must be settled before making a will, and the heir has no right to make a will." This narration was reported by Yahya ibn Abi Unaysah from Abu Ishaq from Asim, and Yahya is considered weak in reliability.
قَالَ رَسُولُ اللهِ ﷺ الدَّيْنُ قَبْلَ الْوَصِيَّةِ وَلَيْسَ لِوَارِثٍ وَصِيَّةٌ كَذَا أَتَى بِهِ يَحْيَى بْنُ أَبِي أُنَيْسَةَ عَنْ أَبِي إِسْحَاقَ عَنْ عَاصِمٍ وَيَحْيَى ضَعِيفٌ
[Machine] It was said to him, "How do you command performing 'Umrah before Hajj, while Allah says '...and complete the Hajj and 'Umrah for Allah...'?" He replied, "How do you prioritize debt before the will, and the will before debt?" They said, "We prioritize debt." He said, "That is it." Al-Shafi'i said, meaning that prioritizing is permissible.
أَنَّهُ قِيلَ لَهُ كَيْفَ تَأْمُرُ بِالْعُمْرَةِ قَبْلَ الْحَجِّ وَاللهُ ﷻ يَقُولُ {وَأَتَمُّوا الْحَجَّ وَالْعُمْرَةَ لِلَّهِ} [البقرة 196]؟ فَقَالَ كَيْفَ تَقْرَءُونَ الدَّيْنَ قَبْلَ الْوَصِيَّةِ وَالْوَصِيَّةُ قَبْلَ الدَّيْنِ؟ قَالَ الْوَصِيَّةُ قَبْلَ الدَّيْنِ قَالَ فَبِأَيِّهِمَا تَبْدَءُونَ؟ قَالُوا بِالدَّيْنِ قَالَ فَهُوَ ذَلِكَ قَالَ الشَّافِعِيُّ يَعْنِي أَنَّ التَّقْدِيمَ جَائِزٌ
