"I asked Ibn Umar about a man who divorced his wife while she was menstruating. So he said: 'Don't you know Abdullah bin Umar?' Indeed he divorced his wife while she was menstruating, so Umar asked the Prophet about that, and he ordered him to take her back.'" He said: "I said: And that divorce is counted? He said: And that divorce is counted? He said: 'What else would you think if he was helpless and foolish?'"

Ibn ʿUmar divorced his wife while she was having her menses. ʿUmar asked the Prophet ﷺ who said, "Order him (your son) to take her back, and then divorced her before her period of the 'Iddah has elapsed." I asked Ibn ʿUmar, "Will that divorce (during the menses) be counted?" He replied, "If somebody behaves foolishly (will his foolishness be an excuse for his misbehavior)?"

One who was blameless (as a narrator) narrated to me for twenty years that Ibn 'Umar (Allah be pleased with him) pronounced three divorces to his wife while she was in the state of menses. He was commanded to take her back. I neither blamed them (the narrators) nor recognised the hadith (to be perfectly genuine) until I met Abu Ghallab Yunus b. Jubair al-Bahili and he was very authentic, and he narrated to me that he had asked Ibn 'Umar (Allah be pleased with there) and he narrated it to him that he made one pronouncement of divorce to his wife as she was in the state of menses, but he was commanded to take her back. I said: Was it counted (as one pronouncement)? He said: Why not, was I helpless or foolish?

I said to Ibn'Umar (Allah be pleased with them): A person divorcedhis wife while she was in the state of menses, whereupon he said: Do you know 'Abdullah b. 'Umar (Allah be pleased with him) came to Allah's Apostle ﷺ and asked him, and he (the Holy Prophet) commanded him that he should take her back, and she started her 'Idda. I said to him: When a person divorces his wife, and she is in the state of menses, should that pronouncement of divorce be counted? He said: Why not, was he hopless or foolish?

"I divorced my wife when she was menstruating. 'Umar went to the Prophet and told him about that. The Prophet said: 'Tell him to take her back, then when she becomes pure, if he wants to, let him divorce her.'" I said to Ibn 'Umar: "Did that count as one divorce?" He said: "Why not? What do you think if some becomes helpless and behaves foolishly."

Yunus bin Jubair said “I asked ‘Abd Allah bin ‘Umar “A man divorced his wife while she was menstruating? He said do you know ‘Abd Allah bin ‘Umar? He said, yes. ‘Abd Allah bin ‘Umar divorced his wife while she was menstruating. So, ‘Umar came to the Prophet ﷺ and asked him (about this matter). He said Command him to take her back in marriage he may the divorce her in the beginning of the waiting period. I (Ibn Jubair) asked him “Will this divorce be counted? He said “Why not?” If he was helpless and showed his foolishness (that would have been counted).  

أبو داود:٢١٨٤حَدَّثَنَا الْقَعْنَبِيُّ حَدَّثَنَا يَزِيدُ يَعْنِي ابْنَ إِبْرَاهِيمَ عَنْ مُحَمَّدِ بْنِ سِيرِينَ حَدَّثَنِي يُونُسُ بْنُ جُبَيْرٍ قَالَ سَأَلْتُ عَبْدَ اللَّهِ بْنَ عُمَرَ قَالَ قُلْتُ رَجُلٌ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ قَالَ تَعْرِفُ عَبْدَ اللَّهِ بْنَ عُمَرَ قُلْتُ نَعَمْ قَالَ

He divorced his wife when she was menstruating then 'Umar came to the Prophet ﷺ (and told him what had happened). He ordered him to take her back.' I said: 'Will that be counted (as a divorce)?' He said: 'Do You think he was helpless and behaving foolishly? [i.e., Yes, it counts (as a divorce).]."'

Abdullah bin Umar said, 'What if he is unable and loses control (of his desires)?' Umar said, 'Yes.' Abdullah bin Umar asked, 'What if he ejaculates?'"

فَإِنَّ عَبْدَ اللهِ بْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَأَتَى عُمَرُ ؓ النَّبِيَّ ﷺ فَسَأَلَهُ فَأَمَرَهُ أَنْ يُرَاجِعَهَا ثُمَّ يُطَلِّقَهَا فِي قُبُلِ عِدَّتِهَا قَالَ قُلْتُ فَيَعْتَدُّ بِهَا قَالَ نَعَمْ قَالَ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ  

رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ حَجَّاجِ بْنِ مِنْهَالٍ إِلَّا أَنَّهُ قَالَ قُلْتُ فَيُعْتَدُّ بِتِلْكَ التَّطْلِيقَةِ؟ قَالَ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ

"I asked Ibn 'Umar about a man who divorced his wife while she was menstruating. He said: 'Do you know 'Abdullah bin 'Umar?' He divorced his wife while she was menstruating, and 'Umar asked the Prophet about that, and he told him to take her back, then wait for the right time. I said to him: 'Was that divorce counted?' He said: 'Be quiet! What do you think if some becomes helpless and behaves foolishly?'" (Using translation from Nasāʾī 3399)   

البيهقي:١٤٩١٩وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو بَكْرِ بْنُ إِسْحَاقَ أنا مُحَمَّدُ بْنُ أَيُّوبَ أنا أَبُو الرَّبِيعِ وَمُسَدَّدٌ قَالَا نا حَمَّادُ بْنُ زَيْدٍ عَنْ أَيُّوبَ عَنْ مُحَمَّدِ بْنِ سِيرِينَ عَنْ يُونُسَ بْنِ جُبَيْرٍ قَالَ سَأَلْتُ ابْنَ عُمَرَ قُلْتُ رَجُلٌ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ قَالَ

تَعْرِفُ ابْنَ عُمَرَ؟ إِنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَسَأَلَ عُمَرُ النَّبِيَّ ﷺ فَأَمَرَهُ أَنْ يُرَاجِعَهَا قُلْتُ فَيُعْتَدُّ بِتِلْكَ التَّطْلِيقَةِ؟ قَالَ فَمَهْ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ
