Ibn ʿUmar divorced his wife while she was having her menses. ʿUmar asked the Prophet ﷺ who said, "Order him (your son) to take her back, and then divorced her before her period of the 'Iddah has elapsed." I asked Ibn ʿUmar, "Will that divorce (during the menses) be counted?" He replied, "If somebody behaves foolishly (will his foolishness be an excuse for his misbehavior)?"

طَلَّقَ ابْنُ عُمَرَ امْرَأَتَهُ وَهْىَ حَائِضٌ فَسَأَلَ عُمَرُ النَّبِيَّ ﷺ فَأَمَرَهُ أَنْ يُرَاجِعَهَا ثُمَّ يُطَلِّقَ مِنْ قُبُلِ عِدَّتِهَا قُلْتُ فَتَعْتَدُّ بِتِلْكَ التَّطْلِيقَةِ قَالَ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ

Command him to take her back, then divorce her when she is pure or she is pregnant.

أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهْىَ حَائِضٌ فَذَكَرَ ذَلِكَ عُمَرُ لِلنَّبِيِّ ﷺ فَقَالَ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لْيُطَلِّقْهَا طَاهِرًا أَوْ حَامِلاً

Command him to take her back until she is pure and then she enters the second menses and then becomes pure. Then either divorce her (finally) or retain her.

أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهْىَ حَائِضٌ فَسَأَلَ عُمَرُ عَنْ ذَلِكَ رَسُولَ اللَّهِ ﷺ فَقَالَ مُرْهُ فَلْيُرَاجِعْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ حَيْضَةً أُخْرَى ثُمَّ تَطْهُرَ ثُمَّ يُطَلِّقَ بَعْدُ أَوْ يُمْسِكَ

I said to Ibn'Umar (Allah be pleased with them): A person divorcedhis wife while she was in the state of menses, whereupon he said: Do you know 'Abdullah b. Umar (Allah be pleased with them), for he divorced his wife in the state of menses. 'Umar (Allah be pleased with him) came to Allah's Apostle ﷺ and asked him, and he (the Holy Prophet) commanded him that he should take her back, and she started her 'Idda. I said to him: When a person divorces his wife, and she is in the state of menses, should that pronouncement of divorce be counted? He said: Why not, was he hopless or foolish?

قُلْتُ لاِبْنِ عُمَرَ رَجُلٌ طَلَّقَ امْرَأَتَهُ وَهْىَ حَائِضٌ فَقَالَ أَتَعْرِفُ عَبْدَ اللَّهِ بْنَ عُمَرَ فَإِنَّهُ طَلَّقَ امْرَأَتَهُ وَهْىَ حَائِضٌ فَأَتَى عُمَرُ النَّبِيَّ ﷺ فَسَأَلَهُ فَأَمَرَهُ أَنْ يَرْجِعَهَا ثُمَّ تَسْتَقْبِلَ عِدَّتَهَا قَالَ فَقُلْتُ لَهُ إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ وَهْىَ حَائِضٌ أَتَعْتَدُّ بِتِلْكَ التَّطْلِيقَةِ فَقَالَ فَمَهْ أَوَإِنْ عَجَزَ وَاسْتَحْمَقَ

I divorced my wife while she was in the state of menses. 'Umar (Allah he pleased wish him) came toAllah's Apostle ﷺ and made mention of that to him, whereupon Allah's Apostle ﷺ told that be should take her back, and when she is pure he may divorce her. if he would so wish. I (one of the narrators) said to Ibn 'Umar (Allah be pleased with them): Did you count (this pronouncement of divorce) in her case? He said: What (after all) prevents him from doing so? Do you find him (Ibn Umar) either helpless or foolish?

سَمِعْتُ ابْنَ عُمَرَ يَقُولُ طَلَّقْتُ امْرَأَتِي وَهْىَ حَائِضٌ فَأَتَى عُمَرُ النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ النَّبِيُّ ﷺ لِيُرَاجِعْهَا فَإِذَا طَهَرَتْ فَإِنْ شَاءَ فَلْيُطَلِّقْهَا قَالَ فَقُلْتُ لاِبْنِ عُمَرَ أَفَاحْتَسَبْتَ بِهَا قَالَ مَا يَمْنَعُهُ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ

Ibn ‘Umar said that he divorced his wife while she was menstruating. ‘Umar mentioned the matter to the Prophet ﷺ. He (the Prophet) said “Order him, he must take her back and divorce her when she is purified (from menstrual discharge) or she is pregnant.”

أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَذَكَرَ ذَلِكَ عُمَرُ لِلنَّبِيِّ ﷺ فَقَالَ رَسُولُ اللَّهِ ﷺ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لْيُطَلِّقْهَا إِذَا طَهُرَتْ أَوْ وَهِيَ حَامِلٌ

Yunus bin Jubair said “I asked ‘Abd Allah bin ‘Umar “A man divorced his wife while she was menstruating? He said do you know ‘Abd Allah bin ‘Umar? He said, yes. ‘Abd Allah bin ‘Umar divorced his wife while she was menstruating. So, ‘Umar came to the Prophet ﷺ and asked him (about this matter). He said Command him to take her back in marriage he may the divorce her in the beginning of the waiting period. I (Ibn Jubair) asked him “Will this divorce be counted? He said “Why not?” If he was helpless and showed his foolishness (that would have been counted).

فَإِنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَأَتَى عُمَرُ النَّبِيَّ ﷺ فَسَأَلَهُ فَقَالَ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لْيُطَلِّقْهَا فِي قُبُلِ عِدَّتِهَا قَالَ قُلْتُ فَيُعْتَدُّ بِهَا قَالَ فَمَهْ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ

"I asked Ibn Umar about a man who divorced his wife while she was menstruating. So he said: 'Don't you know Abdullah bin Umar?' Indeed he divorced his wife while she was menstruating, so Umar asked the Prophet about that, and he ordered him to take her back.'" He said: "I said: And that divorce is counted? He said: And that divorce is counted? He said: 'What else would you think if he was helpless and foolish?'"

هَلْ تَعْرِفُ عَبْدَ اللَّهِ بْنَ عُمَرَ فَإِنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَسَأَلَ عُمَرُ النَّبِيَّ ﷺ فَأَمَرَهُ أَنْ يُرَاجِعَهَا قَالَ قُلْتُ فَيُعْتَدُّ بِتِلْكَ التَّطْلِيقَةِ قَالَ فَمَهْ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ

His father divorced his wife during her menses, so Umar asked the Prophet about that and he said: "Tell him to take her back, then let him divorce her while she is pure or pregnant."

أَنَّهُ طَلَّقَ امْرَأَتَهُ فِي الْحَيْضِ فَسَأَلَ عُمَرُ النَّبِيَّ ﷺ فَقَالَ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لْيُطَلِّقْهَا طَاهِرًا أَوْ حَامِلاً

"Tell him to take her back, then divorce her while she is pure (not menstruating) or pregnant."

أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَذَكَرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لْيُطَلِّقْهَا وَهِيَ طَاهِرٌ أَوْ حَامِلٌ

"I asked Ibn 'Umar about a man who divorced his wife while she was menstruating. He said: 'Do you know 'Abdullah bin 'Umar?' He divorced his wife while she was menstruating, and 'Umar asked the Prophet about that, and he told him to take her back, then wait for the right time. I said to him: 'Was that divorce counted?' He said: 'Be quiet! What do you think if some becomes helpless and behaves foolishly?'"

"I said to Ibn 'Umar: 'A man divorced his wife while she was menstruating.' He said: 'Do you know 'Abdullah bin 'Umar? He divorced his wife when she was menstruating, and 'Umar went to the Prophet and asked him about that, and he told him to take her back then wait for the right time.' I said to him: 'Was that divorce counted?' He said: 'Be quiet! What do you think if some becomes helpless and behaves foolishly?'"

قُلْتُ لاِبْنِ عُمَرَ رَجُلٌ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَقَالَ أَتَعْرِفُ عَبْدَ اللَّهِ بْنَ عُمَرَ فَإِنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَأَتَى عُمَرُ النَّبِيَّ ﷺ يَسْأَلُهُ فَأَمَرَهُ أَنْ يُرَاجِعَهَا ثُمَّ يَسْتَقْبِلَ عِدَّتَهَا قُلْتُ لَهُ إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ وَهِيَ حَائِضٌ أَيَعْتَدُّ بِتِلْكَ التَّطْلِيقَةِ فَقَالَ مَهْ وَإِنْ عَجَزَ وَاسْتَحْمَقَ

"I divorced my wife when she was menstruating. 'Umar went to the Prophet and told him about that. The Prophet said: 'Tell him to take her back, then when she becomes pure, if he wants to, let him divorce her.'" I said to Ibn 'Umar: "Did that count as one divorce?" He said: "Why not? What do you think if some becomes helpless and behaves foolishly."

"I asked Ibn 'Umar about a man who divorced his wife when she was menstruating. He said: 'Do you know 'Abdullah bin 'Umar? He divorced his wife when she was menstruating then 'Umar came to the Prophet ﷺ (and told him what had happened). He ordered him to take her back.' I said: 'Will that be counted (as a divorce)?' He said: 'Do You think he was helpless and behaving foolishly? [i.e., Yes, it counts (as a divorce).]."'

تَعْرِفُ عَبْدَ اللَّهِ بْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَأَتَى عُمَرُ النَّبِيَّ ﷺ فَأَمَرَهُ أَنْ يُرَاجِعَهَا قُلْتُ أَيُعْتَدُّ بِتِلْكَ قَالَ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ

he divorced his wife when she was menstruating, and 'Umar mentioned that to the Prophet ﷺ. He said: "Tell him to take her back then divorce her when she is pure (not menstruating) or pregnant."

أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَذَكَرَ ذَلِكَ عُمَرُ لِلنَّبِيِّ ﷺ فَقَالَ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُطَلِّقْهَا وَهِيَ طَاهِرٌ أَوْ حَامِلٌ

[AI] "When the Prophet ﷺ divorced the wife of Ibn Umar, he said, 'Let him take her back and then divorce her while she is in a state of purity.' Abu Muhammad said, 'This was narrated by Ibn Al-Mubarak, Wakie, or Hamil.'"

لِلنَّبِيِّ ﷺ حِينَ طَلَّقَ ابْنُ عُمَرَ امْرَأَتَهُ فَقَالَ «مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُطَلِّقْهَا وَهِيَ طَاهِرَةٌ» قَالَ أَبُو مُحَمَّد «رَوَاهُ ابْنُ الْمُبَارَكِ وَوَكِيعٌ أَوْ حَامِلٌ»

His father divorced his wife during her menses, so Umar asked the Prophet about that and he said: "Tell him to take her back, then let him divorce her while she is pure or pregnant." (Using translation from Tirmidhī 1176)

أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَسَأَلَ عُمَرُ النَّبِيَّ ﷺ فَقَالَ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُطَلِّقْهَا طَاهِرًا أَوْ حَامِلًا

[AI] Do you know Abdullah ibn Umar? He divorced his wife while she was menstruating, so Umar went to the Messenger of Allah ﷺ and informed him about it. The Messenger of Allah ﷺ told him to send her back and if it becomes clear to him that he divorced her, he should divorce her during her purity (when she is not menstruating). Ibn Bakr said, or during her purity. So, I asked Ibn Umar, "Is his divorce considered valid in this case?" He replied, "Yes. What if he becomes impotent or foolish?"

أَتَعْرِفُ عَبْدَ اللهِ بْنَ عُمَرَ؟ فَإِنَّهُ طَلَّقَ امْرَأَتَهُ حَائِضًا فَانْطَلَقَ عُمَرُ إِلَى رَسُولِ اللهِ ﷺ فَأَخْبَرَهُ بِذَلِكَ فَقَالَ رَسُولُ اللهِ ﷺ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ إِنْ بَدَا لَهُ طَلَاقُهَا طَلَّقَهَا فِي قُبُلِ عِدَّتِهَا قَالَ ابْنُ بَكْرٍ أَوْ فِي قُبُلِ طُهْرِهَا فَقُلْتُ لِابْنِ عُمَرَ أَيُحْسَبُ طَلَاقُهُ ذَلِكَ طَلَاقًا؟ قَالَ نَعَمْ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ؟

he divorced his wife when she was menstruating, and 'Umar mentioned that to the Prophet ﷺ. He said: "Tell him to take her back then divorce her when she is pure (not menstruating) or pregnant." (Using translation from Ibn Mājah 2023)

[AI] I heard Ibn Umar saying that he divorced his wife while she was menstruating. Umar then asked the Prophet ﷺ about it and he said, "Tell him to take her back and, when she becomes pure, divorce her." Bahz said, "Should I consider this as one divorce or not?"

he divorced his wife when she was menstruating, and 'Umar mentioned that to the Prophet ﷺ. He said: "Tell him to take her back then divorce her when she is pure (not menstruating) or pregnant." (Using translation from Ibn Mājah 2023)

"I divorced my wife when she was menstruating. 'Umar went to the Prophet and told him about that. The Prophet said: 'Tell him to take her back, then when she becomes pure, if he wants to, let him divorce her.'" I said to Ibn 'Umar: "Did that count as one divorce?" He said: "Why not? [AI] "Indeed, Abdullah bin Umar divorced his wife while she was menstruating. He went to Umar and asked him about it, so Umar instructed him to reconcile with her and then divorce her during her waiting period. Abdullah bin Umar said, 'What if he is unable and loses control (of his desires)?' Umar said, 'Yes.' Abdullah bin Umar asked, 'What if he ejaculates?'"

فَإِنَّ عَبْدَ اللهِ بْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَأَتَى عُمَرُ ؓ النَّبِيَّ ﷺ فَسَأَلَهُ فَأَمَرَهُ أَنْ يُرَاجِعَهَا ثُمَّ يُطَلِّقَهَا فِي قُبُلِ عِدَّتِهَا قَالَ قُلْتُ فَيَعْتَدُّ بِهَا قَالَ نَعَمْ قَالَ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ

"I asked Ibn 'Umar about a man who divorced his wife while she was menstruating. He said: 'Do you know 'Abdullah bin 'Umar?' He divorced his wife while she was menstruating, and 'Umar asked the Prophet about that, and he told him to take her back, then wait for the right time. I said to him: 'Was that divorce counted?' He said: 'Be quiet! What do you think if some becomes helpless and behaves foolishly?'" (Using translation from Nasāʾī 3399)

تَعْرِفُ ابْنَ عُمَرَ؟ إِنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَسَأَلَ عُمَرُ النَّبِيَّ ﷺ فَأَمَرَهُ أَنْ يُرَاجِعَهَا قُلْتُ فَيُعْتَدُّ بِتِلْكَ التَّطْلِيقَةِ؟ قَالَ فَمَهْ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ

"مرْهُ فَليُراجِعْهَا ثم لِيُطَلِّقْهَا طَاهِرًا أَوْ حَامِلًا".
