I asked Ibn ʿUmar,"(What is said regarding) a man divorces his wife during her period?" He said, "Do you know Ibn ʿUmar? Ibn ʿUmar divorced his wife while she was menstruating. ʿUmar then went to the Prophet ﷺ and mentioned that to him. The Prophet ﷺ ordered him to take her back and when she became clean, he could divorce her if he wanted." I asked (Ibn ʿUmar), "Was that divorce counted as one legal divorce?" He said, "If one becomes helpless and foolish (will he be excused? Of course not). "  

قُلْتُ لاِبْنِ عُمَرَ رَجُلٌ طَلَّقَ امْرَأَتَهُ وَهْىَ حَائِضٌ فَقَالَ تَعْرِفُ ابْنَ عُمَرَ إِنَّ ابْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهْىَ حَائِضٌ فَأَتَى عُمَرُ النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَأَمَرَهُ أَنْ يُرَاجِعَهَا فَإِذَا طَهُرَتْ فَأَرَادَ أَنْ يُطَلِّقَهَا فَلْيُطَلِّقْهَا قُلْتُ فَهَلْ عَدَّ ذَلِكَ طَلاَقًا قَالَ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ  

Command him to take her back and when she is pure, then divorce her. I said to Ibn 'Umar Allah be pleased with them): Did you count that pronouncement of divorce? He said: Why not?  

طَلَّقْتُ امْرَأَتِي وَهْىَ حَائِضٌ فَأَتَى عُمَرُ النَّبِيَّ ﷺ فَأَخْبَرَهُ فَقَالَ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ إِذَا طَهَرَتْ فَلْيُطَلِّقْهَا قُلْتُ لاِبْنِ عُمَرَ أَفَاحْتَسَبْتَ بِتِلْكَ التَّطْلِيقَةِ قَالَ فَمَهْ  

"I divorced my wife when she was menstruating. 'Umar went to the Prophet and told him about that. The Prophet said: 'Tell him to take her back, then when she becomes pure, if he wants to, let him divorce her.'" I said to Ibn 'Umar: "Did that count as one divorce?" He said: "Why not? What do you think if some becomes helpless and behaves foolishly."  

طَلَّقْتُ امْرَأَتِي وَهِيَ حَائِضٌ فَأَتَى النَّبِيَّ ﷺ عُمَرُ فَذَكَرَ لَهُ ذَلِكَ فَقَالَ النَّبِيُّ ﷺ مُرْهُ أَنْ يُرَاجِعَهَا فَإِذَا طَهُرَتْ يَعْنِي فَإِنْ شَاءَ فَلْيُطَلِّقْهَا قُلْتُ لاِبْنِ عُمَرَ فَاحْتَسَبْتَ مِنْهَا فَقَالَ مَا يَمْنَعُهَا أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ  

Yunus bin Jubair said “I asked ‘Abd Allah bin ‘Umar “A man divorced his wife while she was menstruating? He said do you know ‘Abd Allah bin ‘Umar? He said, yes. ‘Abd Allah bin ‘Umar divorced his wife while she was menstruating. So, ‘Umar came to the Prophet ﷺ and asked him (about this matter). He said Command him to take her back in marriage he may the divorce her in the beginning of the waiting period. I (Ibn Jubair) asked him “Will this divorce be counted? He said “Why not?” If he was helpless and showed his foolishness (that would have been counted).  

فَإِنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَأَتَى عُمَرُ النَّبِيَّ ﷺ فَسَأَلَهُ فَقَالَ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لْيُطَلِّقْهَا فِي قُبُلِ عِدَّتِهَا قَالَ قُلْتُ فَيُعْتَدُّ بِهَا قَالَ فَمَهْ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ  

[Machine] I heard Ibn Umar saying that Ibn Umar divorced his wife while she was experiencing menstruation. Omar mentioned this to the Prophet Muhammad ﷺ , and the Messenger of Allah ﷺ said to him that he should take her back until she becomes clean, then divorces her. I said, "Should he take her back while she is believed to be impure?" He replied, "Yes, then divorce her."  

سَمِعْتُ ابْنَ عُمَرَ يَقُولُ طَلَّقَ ابْنُ عُمَرَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَذَكَرَ ذَلِكَ عُمَرُ لِلنَّبِيِّ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ لِيُرَاجِعْهَا حَتَّى تَطْهُرَ ثُمَّ لِيُطَلِّقْهَا قَالَ قُلْتُ احْتُسِبَ بِهَا قَالَ فَمَهْ  

Command him to take her back and when she is pure, then divorce her. I said to Ibn 'Umar Allah be pleased with them): Did you count that pronouncement of divorce? He said: Why not? (Using translation from Muslim 1471p)  

طَلَّقْتُ امْرَأَتِي وَهِيَ حَائِضٌ فَأَتَى عُمَرُ النَّبِيَّ ﷺ فَأَخْبَرَهُ فَقَالَ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ إِذَا طَهُرَتْ فَلْيُطَلِّقْهَا قُلْتُ لِابْنِ عُمَرَ أَحَسِبَ تِلْكَ التَّطْلِيقَةَ قَالَ فَمَهْ  

I divorced my wife while she was in the state of menses. 'Umar (Allah he pleased wish him) came toAllah's Apostle ﷺ and made mention of that to him, whereupon Allah's Apostle ﷺ told that be should take her back, and when she is pure he may divorce her. if he would so wish. I (one of the narrators) said to Ibn 'Umar (Allah be pleased with them): Did you count (this pronouncement of divorce) in her case? He said: What (after all) prevents him from doing so? Do you find him (Ibn Umar) either helpless or foolish? (Using translation from Muslim 1471n)  

سَمِعْتُ ابْنَ عُمَرَ يَقُولُ طَلَّقْتُ امْرَأَتِي وَهِيَ حَائِضٌ فَأَتَى عُمَرُ النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ لِيُرَاجِعْهَا فَإِذَا طَهُرَتْ فَإِنْ شَاءَ فَلْيُطَلِّقْهَا قَالَ فَقُلْتُ لِابْنِ عُمَرَ أَفَتَحْتَسِبُ بِهَا؟ قَالَ مَا يَمْنَعُهُ نَعَمْ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ  

[Machine] I heard Ibn Umar saying that he divorced his wife while she was menstruating. Umar then asked the Prophet ﷺ about it and he said, "Tell him to take her back and, when she becomes pure, divorce her." Bahz said, "Should I consider this as one divorce or not?"  

سَمِعْتُ ابْنَ عُمَرَ يَقُولُ إِنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَسَأَلَ عُمَرُ النَّبِيَّ ﷺ فَقَالَ مُرْهُ فَلْيُرَاجِعْهَا فَإِذَا طَهُرَتْ فَلْيُطَلِّقْهَا قَالَ بَهْزٌ أَتُحْتَسَبُ؟  

"I divorced my wife when she was menstruating. 'Umar went to the Prophet and told him about that. The Prophet said: 'Tell him to take her back, then when she becomes pure, if he wants to, let him divorce her.'" I said to Ibn 'Umar: "Did that count as one divorce?" He said: "Why not? What do you think if some becomes helpless and behaves foolishly." (Using translation from Nasāʾī 3555)  

طَلَّقْتُ امْرَأَتِي وَهِيَ حَائِضٌ فَأَتَى النَّبِيَّ ﷺ عُمَرُ فَذَكَرَ لَهُ ذَلِكَ فَقَالَ النَّبِيُّ ﷺ «فَلْيُرَاجِعْهَا فَإِذَا طَهُرَتْ يَعْنِي فَإِنْ شَاءَ فَلْيُطَلِّقْهَا » قُلْتُ لِابْنِ عُمَرَ فَاحْتَسِبْ بِهَا قَالَ مَا يَمْنَعُهُ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ  

[Machine] I divorced my wife while she was menstruating. Umar ibn al-Khattab came to the Prophet ﷺ and mentioned this to him. The Prophet ﷺ advised him to wait until she becomes clean (from menstruation), then divorce her. I then asked Ibn Umar about it, and he said, "What prevents you? What if he becomes impotent or confused by the wording of the Hadith of Ghandar?"  

طَلَّقْتُ امْرَأَتِي وَهِيَ حَائِضٌ فَأَتَى عُمَرُ بْنُ الْخَطَّابِ ؓ النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ النَّبِيُّ ﷺ لِيُرَاجِعْهَا فَإِذَا طَهُرَتْ فَلْيُطَلِّقْهَا قَالَ فَقُلْتُ لِابْنِ عُمَرَ فَاحْتَسَبْتَ بِهَا قَالَ فَمَا يَمْنَعُهُ أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ لَفْظُ حَدِيثِ غُنْدَرٍ
