قَالَ نَهَى رَسُولُ اللَّهِ ﷺ عن التلقي وأن يبيع مهاجر لأعرابي وأن يسوم الرجل على سوم أخيه وعن التصرية والنجش
Messenger of Allah ﷺ forbade (1) the meeting of the caravan (of goods) on the way, (2) and that a residing person buys for a bedouin, (3) and that a woman stipulates the divorce of the wife of the would-be husband, (4) and that a man tries to cause the cancellation of a bargain concluded by another. He also forbade An-Najsh (see Hadith 824) and that one withholds the milk in the udder of the animal so that he may deceive people on selling it.
نَهَى رَسُولُ اللَّهِ ﷺ عَنِ التَّلَقِّي وَأَنْ يَبْتَاعَ الْمُهَاجِرُ لِلأَعْرَابِيِّ وَأَنْ تَشْتَرِطَ الْمَرْأَةُ طَلاَقَ أُخْتِهَا وَأَنْ يَسْتَامَ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ وَنَهَى عَنِ النَّجْشِ وَعَنِ التَّصْرِيَةِ
Abu Huraira (Allah be pleased with him) reported that Messenger of Allah ﷺ forbade the (people) meeting the caravan (for entering into business transaction with them), and the selling of goods by a townsman on behalf of a man of the desert, and seeking by a woman the divorce of her sister (from her husband), and outbidding (against one another), and tying up the udders (of animals), and buying of (things) in opposition to one's brother.
أَنَّ رَسُولَ اللَّهِ ﷺ نَهَى عَنِ التَّلَقِّي لِلرُّكْبَانِ وَأَنْ يَبِيعَ حَاضِرٌ لِبَادٍ وَأَنْ تَسْأَلَ الْمَرْأَةُ طَلاَقَ أُخْتِهَا وَعَنِ النَّجْشِ وَالتَّصْرِيَةِ وَأَنْ يَسْتَامَ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ
"The Messenger of Allah forbade meeting (the traders on the way) a Muhajhir selling for a Bedouin, keeping the milk in the udder of an animal (so as to increase its price), artificially inflating prices, a man to urge the cancellation of sale already agreed upon and a woman to ask that her sister (in faith) be divorced."

نَهَى النَّبِيُّ ﷺ عَنِ التَّلَقِّي وَأَنْ يَبِيعَ مُهَاجِرٌ لِأَعْرَابِيٍّ وَعَنِ التَّصْرِيَةِ وَالنَّجْشِ وَأَنْ يُسَاوِمَ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ وَأَنْ تَسْأَلَ الْمَرْأَةُ طَلَاقَ أُخْتِهَا
[AI] About the Prophet ﷺ regarding a man who approaches his wife while she is menstruating, he said, "He should give charity with a full dinar or half a dinar, and likewise…"
عَنِ النَّبِيِّ ﷺ فِي الَّذِي يَأْتِي امْرَأَتَهُ وَهِيَ حَائِضٌ قَالَ يَتَصَدَّقُ بِدِينَارٍ أَوْ بِنِصْفِ دِينَارٍ وَكَذَلِكَ
[AI] Abdullah ibn Umar and Abu Hurairah reported that they heard the Messenger of Allah ﷺ saying while standing on the steps of his pulpit, "A time will come when some people will stop attending Friday prayers, or Allah will seal their hearts, and they will become among the heedless."
أَنَّ عَبْدَ اللهِ بْنَ عُمَرَ وَأَبَا هُرَيْرَةَ حَدَّثَاهُ أَنَّهُمَا سَمِعَا رَسُولَ اللهِ ﷺ يَقُولُ وَهُوَ عَلَى أَعْوَادِ مِنْبَرِهِ لَيَنْتَهِيَنَّ أَقْوَامٌ عَنْ وَدْعِهِمُ الْجُمُعَاتِ أَوْ لَيَخْتِمَنَّ اللهُ عَلَى قُلُوبِهِمْ ثُمَّ لَيَكُونُنَّ مِنَ الْغَافِلِينَ
[AI] The Messenger of Allah ﷺ prohibited that a migrant sells to an Arab, that a woman asks for the divorce of her sister, that a man feels ashamed of bidding against his brother, and prohibited slander and cursing. This is the narration of Hafs bin 'Umar.
نَهَى رَسُولُ اللهِ ﷺ عَنِ التَّلَقِّي وَأَنْ يَبِيعَ مُهَاجِرٌ لِأَعْرَابِيٍّ وَأَنْ تَسْأَلَ الْمَرْأَةُ طَلَاقَ أُخْتِهَا وَأَنْ يَسْتَامَ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ وَعَنِ التَّصْرِيَةِ وَالنَّجْشِ لَفْظُ حَدِيثِ حَفْصِ بْنِ عُمَرَ
[AI] He said: The Messenger of Allah ﷺ prohibited the sale of unborn animals. Ibn Wahb said: Malik said to me, and that is what we see, and Allah knows best, that if a man buys a slave or a female slave or engages in renting, and then he says to the one he bought or rented from, I will give you a dinar or a dirham or more than that or less, on the condition that I take the merchandise or ride the animal that I rented from you, then what I gave you is part of the price of the merchandise or the rent of the animal. But if I leave the house or the rent, then what I gave you is null and void without any obligation. The sheikh said: thus narrated Malik bin Anas this hadith in the Muwatta, but he did not mention the narrator.
أَنَّهُ قَالَ نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الْعُرْبَانِ قَالَ ابْنُ وَهْبٍ فَقَالَ لِي مَالِكٌ وَذَلِكَ فِيمَا نَرَى وَاللهُ أَعْلَمُ أَنْ يَشْتَرِيَ الرَّجُلُ الْعَبْدَ أَوِ الْأَمَةَ أَوْ يَتَكَارَى الْكِرَاءَ ثُمَّ يَقُولُ لِلَّذِي اشْتَرَى أَوْ تَكَارَى مِنْهُ أُعْطِيكَ دِينَارًا أَوْ دِرْهَمًا أَوْ أَكْثَرَ مِنْ ذَلِكَ أَوْ أَقَلَّ عَلَى أَنِّي إِنْ أَخَذْتُ السِّلْعَةَ أَوْ رَكِبْتُ مَا تَكَارَيْتُ مِنْكَ فَالَّذِي أَعْطَيْتُكَ هُوَ مِنْ ثَمَنِ السِّلْعَةِ أَوْ مِنْ كِرَاءِ الدَّابَّةِ وَإِنْ تَرَكْتُ الْبَيْتَ أَوِ الْكِرَاءَ فَمَا أَعْطَيْتُكَ فَهُوَ لَكَ بَاطِلٌ بِغَيْرِ شَيْءٍ قَالَ الشَّيْخُ هَكَذَا رَوَى مَالِكُ بْنُ أَنَسٍ هَذَا الْحَدِيثَ فِي الْمُوَطَّأِ لَمْ يُسَمِّ مَنْ
[AI] The Messenger of Allah, ﷺ , sent Umar ibn Al-Khattab to collect charity. Ibn Jameel, Khalid ibn Al-Walid, and Al-Abbas refused to give charity. The Messenger of Allah, ﷺ , said, "Ibn Jameel will not face any consequences unless he is in need, and Allah will enrich him. As for Khalid, you have wronged him. He has dedicated his arms and effort in the path of Allah. As for Al-Abbas, he is my uncle, and the same applies to him." Then he asked, "Have you not heard that a man resembles his father or his paternal uncle?"
بَعَثَ رَسُولُ اللهِ ﷺ عُمَرَ بْنَ الْخَطَّابِ ؓ عَلَى الصَّدَقَةِ فَمَنَعَ ابْنُ جَمِيلٍ وَخَالِدُ بْنُ الْوَلِيدِ وَالْعَبَّاسُ فَقَالَ رَسُولُ اللهِ ﷺ مَا يَنْقِمُ ابْنُ جَمِيلٍ إِلَّا أَنْ كَانَ فَقِيرًا فَأَغْنَاهُ اللهُ وَأَمَّا خَالِدٌ فَإِنَّكُمْ تَظْلِمُونَ خَالِدًا؛ فَقَدِ احْتَبَسَ أَدْرَاعَهُ وَأَعْتَادَهُ فِي سَبِيلِ اللهِ وَأَمَّا الْعَبَّاسُ عَمُّ رَسُولِ اللهِ ﷺ فَهِيَ عَلَيَّ وَمِثْلُهَا ثُمَّ قَالَ أَمَا شَعَرْتَ أَنَّ عَمَّ الرَّجُلِ صِنْوُ الْأَبِ أَوْ صِنْوُ أَبِيهِ؟
[AI] The Messenger of Allah ﷺ said, "Charity is not permissible for the rich or for one who is satisfied with little." 13156
قَالَ رَسُولُ اللهِ ﷺ لَا تَحِلُّ الصَّدَقَةُ لِغَنِيٍّ وَلَا لِذِي مِرَّةٍ سَوِيٍّ 13156
[AI] He was asked while on the pulpit about a man who divorced his wife three times, then someone else married her, closed the door, removed the veil, and revealed her face, then divorced her. He said, "She is not permissible for the first man until the other man tastes her honey." This is the wording of the Hadith of Al-'Abdiyy. Al-'Abdiyy also said it in his narration, as did Abu Ahmad Al-Zubayri. The authentic narration is from 'Abd Al-Rahman bin Mahdi, and it was narrated by Waki' once from Sufyan, who narrated from 'Alqamah, from Razeen bin Sulaiman Al-Ahmarri. He was contradicted by Shu'bah in his chain of narrators, so he narrated it from 'Alqamah bin Marthad, from Salim bin Razeen, from Salim bin 'Abdullah, from Sa'id bin Al-Musayyib, from Ibn 'Umar. The Prophet informed us of this and it was narrated by Abu 'Abdullah Al-Hafiz and Abu Bakr Ahmad bin Al-Hasan. They said, "Abu Al-Abbas Muhammad bin Ya'qub informed us, Muhammad bin Ishaq informed me, and I am the successor of Yahya bin Ma'in." They said, "Ghandar informed us, Shu'bah mentioned it to us, and I received it from Muhammad bin Isma'il Al-Bukhari that he weakened the Hadith of Shu'bah and Sufyan together. And Abi Zar'ah said that the Hadith of Sufyan is the most authentic."
ﷺ سُئِلَ وَهُوَ عَلَى الْمِنْبَرِ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثًا فَتَزَوَّجَهَا غَيْرُهُ وَأَغْلَقَ الْبَابَ وَأَرْخَى السِّتْرَ وَكَشَفَ الْخِمَارَ ثُمَّ فَارَقَهَا قَالَ لَا تَحِلُّ لِلْأَوَّلِ حَتَّى يَذُوقَ عُسَيْلَتَهَا الْآخَرُ لَفْظُ حَدِيثِ الْعَبْدِيِّ وَكَمَا قَالَ الْعَبْدِيُّ فِي إِسْنَادِهِ قَالَهُ أَيْضًا أَبُو أَحْمَدَ الزُّبَيْرِيُّ وَالصَّحِيحُ رِوَايَةُ عَبْدِ الرَّحْمَنِ بْنِ مَهْدِيٍّ وَرَوَاهُ وَكِيعٌ مَرَّةً عَنْ سُفْيَانَ فَقَالَ عَنْ عَلْقَمَةَ عَنْ رَزِينِ بْنِ سُلَيْمَانَ الْأَحْمَرِيِّ 15199 وَخَالَفَهُ شُعْبَةُ فِي إِسْنَادِهِ فَرَوَاهُ عَنْ عَلْقَمَةَ بْنِ مَرْثَدٍ عَنْ سَالِمِ بْنِ رَزِينٍ عَنْ سَالِمِ بْنِ عَبْدِ اللهِ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ عَنِ ابْنِ عُمَرَ ؓ عَنِ النَّبِيِّ ﷺ أَخْبَرَنَاه أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ قَالَا نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ نَا مُحَمَّدُ بْنُ إِسْحَاقَ أَنَا خَلَف وَيَحْيَى بْنِ مَعِين قَالاَ نَا غَنْدَر نَا شُعْبَة فَذَكَرَه وَبَلَغَنِي عَنْ مُحَمَّدٌ بْنِ إِسْمَاعِيلِ البُخَارِي أَنَّهُ وَهَنَ حَدِيث شُعْبَة وَسُفْيَان جَمِيعاً وَعَنْ أَبِي زَرْعَةَ أَنَّهُ قَالَ حَدِيثُ سُفْيَان أَصَح 15200 فَقَدْ
[AI] The Messenger of Allah ﷺ said to me, "O Abdullah bin Samurah, do not ask for leadership, for if you are given it because of asking, you will be held accountable for it. And if you are given it without asking, you will be aided in it. And if you are sworn in an oath and then see something better than it, expiate for your oath and go to what is better."
قَالَ لِي رَسُولُ اللهِ ﷺ يَا عَبْدَ الرَّحْمَنِ بْنَ سَمُرَةَ لَا تَسْأَلِ الْإِمَارَةَ فَإِنَّكَ إِنْ أُعْطِيتَهَا عَنْ مَسْأَلَةٍ وُكِلْتَ إِلَيْهَا وَإِنْ أُعْطِيتَهَا مِنْ غَيْرِ مَسْأَلَةٍ أُعِنْتَ عَلَيْهَا وَإِذَا حَلَفْتَ عَلَى يَمِينٍ فَرَأَيْتَ غَيْرَهَا خَيْرًا مِنْهَا فَكَفِّرْ عَنْ يَمِينِكَ وَائْتِ الَّذِي هُوَ خَيْرٌ
[AI] The Prophet ﷺ said, "The compensatory gift should be paid according to the value of the slave being freed, and also according to the value of the slave who has been killed unjustly." Abu Dawud added in his narration, "Ali and Marwan both said the same thing." Abu Ali At-Tughlabi said, "So I asked Ahmad Ibn Hanbal about this hadith, and he said, 'I refer to the hadith of Barirah, that the Messenger of Allah ﷺ ordered her to remain under the ruling of slavery until he ordered her freedom. And likewise..."
أَنَّ النَّبِيَّ ﷺ قَالَ يُؤَدِّي الْمُكَاتَبُ بِقَدْرِ مَا عَتَقَ مِنْهُ دِيَةَ الْحُرِّ وَبِقَدْرِ مَا رَقَّ مِنْهُ دِيَةَ الْعَبْدِ زَادَ أَبُو دَاوُدَ فِي رِوَايَتِهِ قَالَ وَكَانَ عَلِيٌّ ؓ وَمَرْوَانُ يَقُولَانِ ذَلِكَ قَالَ أَبُو عَلِيٍّ التَّغْلِبِيُّ فَسَأَلْتُ أَحْمَدَ بْنَ حَنْبَلٍ عَنْ هَذَا الْحَدِيثِ فَقَالَ أَنَا أَذْهَبُ إِلَى حَدِيثِ بَرِيرَةَ أَنَّ رَسُولَ اللهِ ﷺ أَمَرَ بِشِرَائِهَا يَعْنِي أَنَّهَا بَقِيَتْ عَلَى حُكْمِ الرِّقِّ حَتَّى أَمَرَ بِشِرَائِهَا وَكَذَلِكَ
