[Machine] We raided and suffered until the army divided the dates, even two dates, so while we were on the shore of the sea, he threw a dead whale and people took whatever they wanted from its meat or fat, and it was like a palm trunk. It reached me that when people came to the Messenger of Allah ﷺ, they informed him and he said to them, "Do you have anything from it?"  

غَزَوْنَا فَجُعْنَا حَتَّى إِنَّ الْجَيْشَ يَقْتَسِمُ التَّمْرَةَ وَالتَّمْرَتَيْنِ فَبَيْنَا نَحْنُ عَلَى شَطِّ الْبَحْرِ إِذْ رَمَى بِحُوتٍ مَيْتٍ فَاقْتَطَعَ النَّاسُ مِنْهُ مَا شَاءُوا مِنْ لَحْمِهِ أَوْ شَحْمِهِ وَهُوَ مِثْلُ الظَّرِبِ فَبَلَغَنِي أَنَّ النَّاسَ لَمَّا قَدِمُوا عَلَى رَسُولِ اللهِ ﷺ أَخْبَرُوهُ فَقَالَ لَهُمْ أَمَعَكُمْ مِنْهُ شَيْءٌ ؟  

[Machine] The Prophet ﷺ sent us with three hundred riders, and our leader was Abu Ubaydah ibn al-Jarrah seeking the caravan of the Quraysh. We camped on the coast until our provisions ran out, and we ate the leaves of trees. Then, the sea threw a creature called "al-'anbar" to us, and we ate from it for half a month until our bodies became healthy. Abu Ubaydah took a rib from his own body and tied it to the longest camel in the army and the tallest man carried it on his back. He passed under it and he had slaughtered three camels, then three more, until Abu Ubaydah prohibited him. Qays bin Sa'd used to narrate this hadith.  

بَعَثَنَا النَّبِيُّ ﷺ فِي ثَلَاثِمِائَةِ رَاكِبٍ وَأَمِيرُنَا أَبُو عُبَيْدَةَ بْنُ الْجَرَّاحِ يَطْلُبُ عِيرَ قُرَيْشٍ فَأَقَمْنَا عَلَى السَّاحِلِ حَتَّى فَنِيَ زَادُنَا فَأَكَلْنَا الْخَبَطَ ثُمَّ إِنَّ الْبَحْرَ أَلْقَى لَنَا دَابَّةً يُقَالُ لَهَا الْعَنْبَرُ فَأَكَلْنَا مِنْهُ نِصْفَ شَهْرٍ حَتَّى صَلُحَتْ أَجْسَامُنَا وَأَخَذَ أَبُو عُبَيْدَةَ ضِلَعًا مِنْ أَضْلَاعِهِ فَنَصَبَهُ وَنَظَرَ إِلَى أَطْوَلِ بَعِيرٍ فِي الْجَيْشِ وَأَطْوَلِ رَجُلٍ فَحَمَلَهُ عَلَيْهِ فَجَازَ تَحْتَهُ وَقَدْ كَانَ رَجُلٌ نَحَرَ ثَلَاثَ جَزَائِرَ ثُمَّ ثَلَاثًا ثُمَّ نَهَاهُ أَبُو عُبَيْدَةَ وَكَانَ يَرْوِيهِ قَيْسُ بْنُ سَعْدٍ أَخْرَجَاهُ فِي الصَّحِيحِ كَمَا مَضَى  

[Machine] The floating fish on the water is permissible.  

السَّمَكَةُ الطَّافِيَةُ عَلَى الْمَاءِ حَلَالٌ  

[Machine] The locust and the whale are both intelligent.  

الْجَرَادُ وَالنُّونُ ذَكِيٌّ كُلُّهُ  

[Machine] Whales and locusts are all intelligent.  

الْحِيتَانُ وَالْجَرَادُ ذَكِيٌّ كُلُّهُ  

[Machine] He boarded the ship with a group of his companions and they found a floating fish on the water. They asked him about it and he replied, "Is it still good and hasn't changed?" They said, "Yes." He said, "Then eat it and give me my share." And he was fasting in this way.  

أَنَّهُ رَكِبَ فِي الْبَحْرِ فِي رَهْطٍ مِنْ أَصْحَابِهِ فَوَجَدُوا سَمَكَةً طَافِيَةً عَلَى الْمَاءِ فَسَأَلُوهُ عَنْهَا فَقَالَ أَطَيِّبَةٌ هِيَ لَمْ تَغَيَّرْ؟ قَالُوا نَعَمْ قَالَ فَكُلُوهَا وَارْفَعُوا نَصِيبِي مِنْهَا وَكَانَ صَائِمًا هَكَذَا  

[Machine] "There is no harm in the taffy being from the fish."  

لَا بَأْسَ بِالطَّافِي مِنَ السَّمَكِ  

[Machine] Hūrayra and Zayd ibn Thābit reported that they did not consider it wrong to eat what the sea throws up.  

هُرَيْرَةَ وَزَيْدِ بْنِ ثَابِتٍ ؓ أَنَّهُمَا كَانَا لَا يَرَيَانِ بِأَكْلِ مَا لَفَظَ الْبَحْرُ بَأْسًا  

[Machine] The sea threw a large dead fish, so we went to Abu Hurairah and asked him. He commanded us to eat it, but we were reluctant because of Abu Hurairah's youth. So we went to Marwan and he sent for Zaid bin Thabit and asked him. He said it is permissible, so eat it.  

رَمَى الْبَحْرُ بِسَمَكٍ كَبِيرٍ مَيِّتٍ فَأَتَيْنَا أَبَا هُرَيْرَةَ ؓ فَاسْتَفْتَيْنَاهُ فَأَمَرَنَا بِأَكْلِهِ فَرَغِبْنَا عَنْ فُتْيَا أَبِي هُرَيْرَةَ فَأَتَيْنَا مَرْوَانَ فَأَرْسَلَ إِلَى زَيْدِ بْنِ ثَابِتٍ ؓ فَسَأَلَهُ فَقَالَ حَلَالٌ فَكُلُوهُ  

[Machine] His hunting is what he catches, and his food is what he throws.  

صَيْدُهُ مَا اصْطِيدَ وَطَعَامُهُ مَا رَمَى بِهِ  

[Machine] "I arrived from Bahrain until I reached al-Rabadha, when some people from Iraq, who were forbidden from hunting, asked me about buying and eating a floating fish they found on the water. I instructed them to buy it and eat it, even though they were forbidden. Then I arrived in Madinah and doubt crept into my heart about what I had instructed them. So, I mentioned this to Umar ibn al-Khattab, and he asked me, 'What did you instruct them?' I replied, 'I instructed them to buy it and eat it.' He said, 'If you had instructed them otherwise, you would have done wrong, as if you had deceived them.'"  

أَقْبَلْتُ مِنَ الْبَحْرَيْنِ حَتَّى إِذَا كُنْتُ بِالرَّبَذَةِ سَأَلَنِي نَاسٌ مِنْ أَهْلِ الْعِرَاقِ وَهُمْ مُحْرِمُونَ عَنْ صَيْدٍ وَجَدُوهُ عَلَى الْمَاءِ طَافٍ فَسَأَلُونِي عَنِ اشْتِرَائِهِ وَأَكْلِهِ فَأَمَرْتُهُمْ أَنْ يَشْتَرُوهُ وَيَأْكُلُوهُ وَهُمْ مُحْرِمُونَ ثُمَّ قَدِمْتُ الْمَدِينَةَ فَكَأَنَّهُ وَقَعَ فِي قَلْبِي شَكٌّ مِمَّا أَمَرْتُهُمْ فَذَكَرْتُ ذَلِكَ لِعُمَرَ بْنِ الْخَطَّابِ ؓ فَقَالَ وَمَا أَمَرْتَهُمْ بِهِ؟ قَالَ أَمَرْتُهُمْ بِهِ أَنْ يَشْتَرُوهُ وَيَأْكُلُوهُ قَالَ لَوْ أَمَرْتَهُمْ بِغَيْرِ ذَلِكَ لَفَعَلْتُ أَيْ كَأَنَّهُ تَوَعَّدَهُ  

[Machine] In His saying {Lawful to you is game from the sea and its food as provision for you} [Quran 5:96], He said, game refers to what is caught, and its food refers to what is thrown.  

فِي قَوْلِهِ {أُحِلَّ لَكُمْ صَيْدُ الْبَحْرِ وَطَعَامُهُ مَتَاعًا لَكُمْ} [المائدة 96] قَالَ صَيْدُهُ مَا صِيدَ وَطَعَامُهُ مَا قَذَفَ  

[Machine] His hunting is what he catches, and his food is what the sea brings to him.  

صَيْدُهُ مَا اصْطِيدَ وَطَعَامُهُ مَا لَفَظَ بِهِ الْبَحْرُ  

[Machine] "Naafi' then sent me, Abdullah ibn Umar, to Abdurrahman ibn Abi Hurairah saying, 'Indeed, there is no harm in eating it, so go ahead and eat.'"  

نَافِعٌ فَأَرْسَلَنِي عَبْدُ اللهِ بْنُ عُمَرَ إِلَى عَبْدِ الرَّحْمَنِ بْنِ أَبِي هُرَيْرَةَ إِنَّهُ لَا بَأْسَ بِهِ فَكُلْهُ  

A similar tradition has also been transmitted by Abu Bardah on the authority of his father from the Prophet ﷺ. (Using translation from Abū Dāʾūd 2657)   

مِثْلَ ذَلِكَ
