٦٠۔٣ بَابُ الْبُزَاةِ الْمُعَلَّمَةِ إِذَا أَكَلَتْ

[Machine] He ﷺ said, "If you have not trained a dog or a hawk, then you send them and mention the name of Allah. Whatever they catch for you, say 'Bismillah' and eat from it, even if they kill it. If they kill it and do not eat from it, then it is only holding onto it for you, so gather between them in prohibition, except that the mention of the hawk in this narration is not mentioned by the scholars we have mentioned from Ash-Sha'bi. It is only mentioned by Mujalid, and Allah knows best. It is also mentioned from Sa'id ibn Al-Musayyib from Salman Al-Farsi that he said, 'If you send your dog, hawk, or falcon for hunting and it eats from it, then eat from it. And if it eats half of it, then that is a gathering of both in permissibility.' And it is mentioned from Sa'id ibn Jubayr from Ibn 'Abbas that he said, 'If the dog eats, do not eat. And if the hawk eats, then eat. Because you can strike the dog, but you cannot strike the hawk. So this is the difference between them, and Allah knows best. And in the hadith of Ath-Thawri from Salim Al-Aftas from Sa'id ibn Jubayr, he said, 'If the falcon eats, do not eat.' And this is in contradiction to the first statement. And it was narrated from Ar-Rabi ibn Sabih about the falcon or the hawk, if it eats, he disliked it, and from 'Ikrimah, he said, 'If the falcon and the hawk eat, do not eat.'  

البيهقي:١٨٨٨٥أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا عُثْمَانُ بْنُ أَبِي شَيْبَةَ ثنا عَبْدُ اللهِ بْنُ نُمَيْرٍ ثنا مُجَالِدٌ عَنِ الشَّعْبِيِّ عَنْ عَدِيِّ بْنِ حَاتِمٍ ؓ أَنَّ النَّبِيَّ

ﷺ قَالَ مَا عَلَّمْتَ مِنْ كَلْبٍ أَوْ بَازٍ ثُمَّ أَرْسَلْتَهُ وَذَكَرْتَ اسْمَ اللهِ فَكُلْ مِمَّا أَمْسَكَ عَلَيْكَ قُلْتُ وَإِنْ قَتَلَ؟ قَالَ إِذَا قَتَلَهُ وَلَمْ يَأْكُلْ مِنْهُ شَيْئًا فَإِنَّمَا أَمْسَكَهُ عَلَيْكَ فَجَمَعَ بَيْنَهُمَا فِي الْمَنْعِ إِلَّا أَنَّ ذِكْرَ الْبَازِي فِي هَذِهِ الرِّوَايَةِ لَمْ يَأْتِ بِهِ الْحُفَّاظُ الَّذِينَ قَدَّمْنَا ذِكْرَهُمْ عَنِ الشَّعْبِيِّ وَإِنَّمَا أَتَى بِهِ مُجَالِدٌ وَاللهُ أَعْلَمُ وَيُذْكَرُ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ عَنْ سَلْمَانَ الْفَارِسِيِّ ؓ أَنَّهُ قَالَ إِذَا أَرْسَلْتَ كَلْبَكَ أَوْ بَازَكَ أَوْ صَقْرَكَ عَلَى الصَّيْدِ فَأَكَلَ مِنْهُ فَكُلْ وَإِنْ أَكَلَ نِصْفَهُ فَهَذَا جَمَعَ بَيْنَهُمَا فِي الْإِبَاحَةِ وَيُذْكَرُ عَنْ سَعِيدِ بْنِ جُبَيْرٍ عَنِ ابْنِ عَبَّاسٍ ؓ قَالَ إِذَا أَكَلَ الْكَلْبُ فَلَا تَأْكُلْ وَإِذَا أَكَلَ الصَّقْرُ فَكُلْ؛ لِأَنَّ الْكَلْبَ تَسْتَطِيعُ أَنْ تَضْرِبَهُ وَالصَّقْرَ لَا تَسْتَطِيعُ فَهَذَا فَرْقٌ بَيْنَهُمَا وَاللهُ أَعْلَمُ وَفِي حَدِيثِ الثَّوْرِيِّ عَنْ سَالِمٍ الْأَفْطَسِ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَالَ إِذَا أَكَلَ الْبَازِي فَلَا تَأْكُلْ وَهَذَا بِخِلَافِ الْأَوَّلِ وَرُوِيَ عَنِ الرَّبِيعِ بْنِ صُبَيْحٍ فِي الْبَازِي أَوِ الصَّقْرِ إِذَا أَكَلَ قَالَ كَرِهَهُ عَطَاءٌ وَعَنْ عِكْرِمَةَ قَالَ إِذَا أَكَلَ الْبَازُ وَالصَّقْرُ فَلَا تَأْكُلْ

[Machine] Regarding the jurists who disapprove of the opinion of the people of Medina, they used to say that if a dog or a falcon or a trained hawk killed an animal, it is permissible to consume its meat.
