60. Hunting
٦٠۔ كِتَابُ الصَّيْدِ وَالذَّبَائِحِ
[Machine] "It has died, then it moved, so Abu Huraira asked him, and he said, 'Eat it all.' Zaid ibn Thabit asked him, and he said, 'Don't eat it, for surely the dead can move.'"
أَنَّهَا قَدْ مَاتَتْ فَتَحَرَّكَتْ فَسَأَلَ أَبَا هُرَيْرَةَ ؓ لَهُ فَقَالَ كُلْهَا فَسَأَلَ زَيْدَ بْنَ ثَابِتٍ فَقَالَ لَهُ لَا تَأْكُلْهَا فَإِنَّ الْمَيْتَةَ قَدْ تَتَحَرَّكُ
عَنْ زَيْدٍ
a wolf attacked a sheep so they slaughtered it with a Marwah, and the Prophet allowed it to be eaten. (Using translation from Nasāʾī 4407)
أَنَّ ذِئْبًا نَهَبَ فِي شَاةٍ فَذَكَّوْهَا بِمَرْوَةٍ فَرَخَّصَ النَّبِيُّ ﷺ بِأَكْلِهَا
[Machine] The Prophet Muhammad ﷺ was asked about a sheep that was breastfeeding and a wolf attacked it, but the sheep managed to survive. The Prophet ﷺ commanded that it be slaughtered.
سُئِلَ رَسُولُ اللهِ ﷺ عَنْ شَاةٍ نَيَّبَ فِيهَا الذِّئْبُ فَأُدْرِكَتْ وَبِهَا حَيَاةٌ فَذُكِّيَتْ فَأَمَرَ النَّبِيُّ ﷺ بِأَكْلِهَا
A man of Banu Harith was pasturing a pregnant she-camel in one of the ravines of Uhud, (he saw that) it was about to die; he could find nothing to slaughter it; he took a stake and stabbed it in the upper part of its breast until he made its blood flow. He then came to the Prophet ﷺ and informed him about that, and he ordered him to eat it. (Using translation from Abū Dāʾūd 2823)
أَنَّهُ كَانَ يَرْعَى لِقْحَةً بِشِعْبٍ مِنْ شِعَابِ أُحُدٍ فَأَخَذَهَا الْمَوْتُ فَلَمْ يَجِدْ شَيْئًا يَنْحَرُهَا بِهِ فَأَخَذَ وَتِدًا فَوَجَأَ بِهِ فِي لَبَّتِهَا حَتَّى أُهَرِيقَ دَمُهَا ثُمَّ جَاءَ إِلَى النَّبِيِّ ﷺ فَأَخْبَرَهُ بِذَلِكَ فَأَمَرَهُ بِأَكْلِهَا
[Machine] She was about to die, so we slaughtered her and divided her. Then the Prophet ﷺ came and said, "O Aisha, what did your she-camel do?" She replied, "She was about to die, so we slaughtered her and divided her, and all that remains of her is the shoulder." He said, "The whole sheep belongs to you, except for the shoulder." It is also narrated from Az-Zuhri, from Ibn Al-Musayyab, that he used to say, "Zakat is when the eye twinkles, the tail moves, and the leg runs," and it means that it is recommended to give charity from one's wealth.
تَمُوتَ فَذَبَحْنَاهَا فَقَسَمْنَاهَا فَجَاءَ النَّبِيُّ ﷺ فَقَالَ يَا عَائِشَةُ مَا فَعَلَتْ شَاتُكُمْ؟ قَالَتْ أَرَادَتْ أَنْ تَمُوتَ فَذَبَحْنَاهَا فَقَسَمْنَاهَا وَلَمْ يَبْقَ عِنْدَنَا مِنْهَا إِلَّا كَتِفٌ قَالَ الشَّاةُ كُلُّهَا لَكُمْ إِلَّا الْكَتِفَ وَيُذْكَرُ عَنِ الزُّهْرِيِّ عَنِ ابْنِ الْمُسَيِّبِ أَنَّهُ كَانَ يَقُولُ الذَّكَاةُ بِحَقٍّ الْعَيْنُ تَطْرِفُ وَالذَّنَبُ يَتَحَرَّكُ وَالرِّجْلُ تَرْتَكِضُ وَبِمَعْنَاهُ قَالَ عُبَيْدُ بْنُ عُمَيْرٍ وَطَاوُسٌ وَقَتَادَةُ
