60.2 [Machine] The teacher eats from the prey he has killed.

٦٠۔٢ بَابُ الْمُعَلَّمِ يَأْكُلُ مِنَ الصَّيْدِ الَّذِي قَدْ قَتَلَ

I asked Messenger of Allah ﷺ about the Mi'rad. He said, "If you hit the game with its sharp edge, eat it, but if the Mi'rad hits the game with its shaft with a hit by its broad side do not eat it, for it has been beaten to death with a piece of wood. (i.e. unlawful)." I asked, "If I let loose my trained hound after a game?" He said, "If you let loose your trained hound after game, and mention the name of Allah, then you can eat." I said, "If the hound eats of the game?" He said "Then you should not eat of it, for the hound has hunted the game for itself and not for you." I said, "Some times I send my hound and then I find some other hound with it?" He said "Don't eat the game, as you have mentioned the Name of Allah on your dog only and not on the other." سَأَلْتُ رَسُولَ اللهِ ﷺ عَنِ الْمِعْرَاضِ فَقَالَ إِذَا أَصَابَ بِحَدِّهِ فَكُلْ وَإِذَا أَصَابَ بِعَرْضِهِ فَقَتَلَ فَإِنَّهُ وَقِيذٌ فَلَا تَأْكُلْ قَالَ قُلْتُ إِنِّي أُرْسِلُ كَلْبِي قَالَ إِذَا أَرْسَلْتَ كَلْبَكَ وَذَكَرْتَ اسْمَ اللهِ فَكُلْ قَالَ قُلْتُ فَإِنْ أَكَلَ؟ قَالَ فَلَا تَأْكُلْ فَإِنَّمَا حَبَسَ عَلَى نَفْسِهِ وَلَمْ يَحْبِسْ عَلَيْكَ قَالَ قُلْتُ أُرْسِلُ كَلْبِي وَأَجِدُ مَعَهُ كَلْبًا آخَرَ؟ قَالَ لَا تَأْكُلْ فَإِنَّمَا سَمَّيْتَ عَلَى كَلْبِكَ وَلَمْ تُسَمِّ عَلَى الْآخَرِ

I asked the Prophet ﷺ about the game killed by a Mi'rad (i.e. a sharp-edged piece of wood or a piece of wood provided with a sharp piece of iron used for hunting). He said, "If the game is killed with its sharp edge, eat of it, but if it is killed with its shaft, with a hit by its broad side then the game is (unlawful to eat) for it has been beaten to death." I asked him about the game killed by a trained hound. He said, "If the hound catches the game for you, eat of it, for killing the game by the hound, is like its slaughtering. But if you see with your hound or hounds another dog, and you are afraid that it might have shared in hunting the game with your hound and killed it, then you should not eat of it, because you have mentioned Allah's name on (sending) your hound only, but you have not mentioned it on some other hound. سَأَلْتُ رَسُولَ اللهِ ﷺ عَنْ صَيْدِ الْكَلْبِ فَقَالَ مَا أَمْسَكَ عَلَيْكَ وَلَمْ يَأْكُلْ مِنْهُ فَكُلْهُ فَإِنَّ أَخْذَهُ ذَكَاتُهُ وَإِنْ وَجَدْتَ عِنْدَهُ كَلْبًا غَيْرَهُ فَخَشِيتَ أَنْ يَكُونَ أَخَذَهُ مَعَهُ وَقَدْ قَتَلَهُ فَلَا تَأْكُلْهُ فَإِنَّكَ إِنَّمَا ذَكَرْتَ اسْمَ اللهِ عَلَى كَلْبِكَ وَلَمْ تَذْكُرْهُ عَلَى غَيْرِهِ وَسَأَلْتُهُ عَنْ صَيْدِ الْمِعْرَاضِ فَقَالَ مَا أَصَبْتَ بِحَدِّهِ فَكُلْهُ وَمَا أَصَبْتَ بِعَرْضِهِ فَهُوَ وَقِيذٌ

[Machine] He asked the Messenger of Allah (PBUH) about hunting, so he said: "If you send your dog, remember the name of Allah. If you reach it and it does not kill, then slaughter it and mention the name of Allah. If you reach it and it has already killed but has not eaten, then eat it, for it has caught it for you. If you find it has already eaten from it, then do not eat anything from it, for it has taken it for itself." The two narrators mentioned this Hadith in Sahih from the Hadith of Zakariya and Aasim, and Muslim narrated it from Yahya bin Ayyub from Ibn Al-Mubarak.

أَنَّهُ سَأَلَ رَسُولَ اللهِ ﷺ عَنِ الصَّيْدِ فَقَالَ إِذَا أَرْسَلْتَ كَلْبَكَ فَاذْكُرِ اسْمَ اللهِ فَإِنْ أَدْرَكْتَهُ وَلَمْ يَقْتُلْ فَاذْبَحْ وَاذْكُرِ اسْمَ اللهِ وَإِنْ أَدْرَكْتَهُ قَدْ قَتَلَ وَلَمْ يَأْكُلْ فَكُلْ فَقَدْ أَمْسَكَهُ عَلَيْكَ فَإِنْ وَجَدْتَهُ قَدْ أَكَلَ مِنْهُ فَلَا تَطْعَمْ مِنْهُ شَيْئًا فَإِنَّمَا أَمْسَكَهُ عَلَى نَفْسِهِ وَذَكَرَ الْحَدِيثَ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ زَكَرِيَّا وَعَاصِمٍ وَرَوَاهُ مُسْلِمٌ عَنْ يَحْيَى بْنِ أَيُّوبَ عَنِ ابْنِ الْمُبَارَكِ

I asked Messenger of Allah ﷺ. "We hunt with the help of these hounds." He said, "If you let loose your trained hounds after a game, and mention the name of Allah, then you can eat what the hounds catch for you, even if they killed the game. But you should not eat of it if the hound has eaten of it, for then it is likely that the hound has caught the game for itself. And if other hounds join your hound in hunting the game, then do not eat of it." (Using translation from Bukhārī 5483)

سَأَلْتُ رَسُولَ اللهِ ﷺ قُلْتُ إِنَّا قَوْمٌ نَصِيدُ بِهَذِهِ الْكِلَابِ قَالَ إِذَا أَرْسَلْتَ كِلَابَكَ الْمُعَلَّمَةَ وَذَكَرْتَ اسْمَ اللهِ عَلَيْهَا فَكُلْ مِمَّا أَمْسَكْنَ عَلَيْكَ وَإِنْ قَتَلْنَ إِلَّا أَنْ يَأْكُلَ الْكَلْبُ فَإِنْ أَكَلَ فَلَا تَأْكُلْ فَإِنِّي أَخَافُ أَنْ يَكُونَ إِنَّمَا أَمْسَكَ عَلَى نَفْسِهِ وَإِنْ خَالَطَهَا كِلَابٌ مِنْ غَيْرِهَا فَلَا تَأْكُلْ

[Machine] I asked, "O Messenger of Allah, what if I eat from it?" He said, "If you eat from it, then do not eat it, for it is not edible." Abu Sa'eed ibn Abi 'Amr informed us, Abu al-'Abbas al-Asamm reported to us, Rabee' said: "Al-Shafi'i said, and it is possible to infer that it is permissible to eat from it even if a dog eats from it." This is the view of Ibn 'Umar, Sa'd ibn Abi Waqqas, and some of our companions. We only left this because of the narration mentioned by al-Sha'abi from 'Adi ibn Hatim, that he heard the Prophet, ﷺ , saying, "If he eats it, do not eat it." And when the report is established from the Prophet, ﷺ , leaving it for something is not permissible.

قُلْتُ يَا رَسُولَ اللهِ إِنْ أَكَلَ مِنْهُ؟ قَالَ إِنْ أَكَلَ مِنْهُ فَلَا تَأْكُلْ فَإِنَّهُ لَيْسَ بِمُعَلَّمٍ 18878 أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ أَنْبَأَ الرَّبِيعُ قَالَ قَالَ الشَّافِعِيُّ وَيَحْتَمِلُ الْقِيَاسُ أَنْ يَأْكُلَ وَإِنْ أَكَلَ مِنْهُ الْكَلْبُ وَهَذَا قَوْلُ ابْنِ عُمَرَ وَسَعْدِ بْنِ أَبِي وَقَّاصٍ وَبَعْضِ أَصْحَابِنَا وَإِنَّمَا تَرَكْنَا هَذَا لِلْأَثَرِ الَّذِي ذَكَرَ الشَّعْبِيُّ عَنْ عَدِيِّ بْنِ حَاتِمٍ ؓ أَنَّهُ سَمِعَ النَّبِيَّ ﷺ يَقُولُ فَإِنْ أَكَلَ فَلَا تَأْكُلْ وَإِذَا ثَبَتَ الْخَبَرُ عَنِ النَّبِيِّ ﷺ لَمْ يَجُزْ تَرْكُهُ لِشَيْءٍ

[Machine] If one of you sends his trained dog and mentions the name of Allah, then he should eat from what the dog catches, whether he has eaten from it or not. As for the narration in it about Sa'id ibn Abi Waqqas, Malik has mentioned it in Al-Muwatta with a broken chain of transmission.  

البيهقي:١٨٨٧٩قَالَ الشَيْخُ رَحِمَهُ اللهُ وَأَمَّا الرِّوَايَةُ فِيهِ عَنِ ابْنِ عُمَرَ فَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ بِبَغْدَادَ أنبأ إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ ثنا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ ثنا ابْنُ نُمَيْرٍ عَنْ عُبَيْدِ اللهِ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ ؓ قَالَ

إِذَا أَرْسَلَ أَحَدُكُمْ كَلْبَهُ الْمُعَلَّمَ وَذَكَرَ اسْمَ اللهِ فَلْيَأْكُلْ مِمَّا أَمْسَكَ عَلَيْهِ أَكَلَ مِنْهُ أَوْ لَمْ يَأْكُلْ وَأَمَّا الرِّوَايَةُ فِيهِ عَنْ سَعْدِ بْنِ أَبِي وَقَّاصٍ ؓ فَقَدْ ذَكَرَهَا عَنْهُ مَالِكٌ فِي الْمُوَطَّإِ مُنْقَطِعًا

[Machine] Every, even if he eats half of it, meaning the dog, and this is also sent.  

البيهقي:١٨٨٨٠وَأَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ أنبأ أَبُو الْحَسَنِ السِّرَاجُ أنبأ أَبُو خَلِيفَةَ ثنا أَبُو عُمَرَ الْحَوْضِيُّ عَنْ شُعْبَةَ عَنْ عَبْدِ رَبِّهِ بْنِ سَعِيدٍ عَنْ بُكَيْرِ بْنِ عَبْدِ اللهِ عَنْ سَعْدٍ قَالَ

كُلْ وَإِنْ أَكَلَ نِصْفَهُ يَعْنِي الْكَلْبَ وَهَذَا أَيْضًا مُرْسَلٌ

[Machine] I said, "Surely, we have stray dogs that wander around, they catch us and eat and leave some behind." He said, "Eat all, even if they leave only half. This is connected and narrated from Ali, Salman al-Farsi, and Abu Hurairah. It is also narrated from Ibn Abbas with a difference in their opinions."

سَعْدًا قُلْتُ إِنَّ لَنَا كِلَابًا ضَوَارِيَ فَيُمْسِكْنَ عَلَيْنَا وَيَأْكُلْنَ وَيُبْقِينَ قَالَ كُلْ وَإِنْ لَمْ يُبْقِينَ إِلَّا نِصْفَهُ وَهَذَا مَوْصُولٌ وَرُوِيَ فِيهِ عَنْ عَلِيٍّ وَسَلْمَانَ الْفَارِسِيِّ وَأَبِي هُرَيْرَةَ ؓ وَرُوِي عَنِ ابْنِ عَبَّاسٍ ؓ بِخِلَافِ أَقَاوِيلِهِمْ

[Machine] The Persian used to say, "If you send your educated dog, it will eat two-thirds of it and leave behind one-third. Eat whatever is left." It is narrated from Sa'id from Qatadah that Ibn Abbas used to dislike that and would say, "If it was educated, it wouldn't eat." It was narrated that it is permissible to eat the dog from the Prophet ﷺ if the hadith is authentic.  

البيهقي:١٨٨٨٢أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ ثنا مُحَمَّدُ بْنُ بِشْرٍ عَنْ سَعِيدِ بْنِ أَبِي عَرُوبَةَ عَنْ قَتَادَةَ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ أَنَّ سَلْمَانَ

الْفَارِسِيَّ ؓ كَانَ يَقُولُ إِذَا أَرْسَلْتَ كَلْبَكَ الْمُعَلَّمَ فَأَكَلَ ثُلُثَيْهِ وَبَقِيَ ثُلُثُهُ فَكُلْ مَا بَقِيَ وَعَنْ سَعِيدٍ عَنْ قَتَادَةَ أَنَّ ابْنَ عَبَّاسٍ ؓ كَانَ يَكْرَهُ ذَلِكَ وَيَقُولُ لَوْ كَانَ مُعَلَّمًا مَا أَكَلَ وَرُوِيَ فِي إِبَاحَةِ أَكْلِهِ عَنِ النَّبِيِّ ﷺ إِنْ صَحَّ الْحَدِيثُ

The Messenger of Allah ﷺ said about the game hunted by a dog: If you set off your dog and have mentioned Allah's name, eat (it), even if it eats any of it; and eat what your hands return you. (Using translation from Abū Dāʾūd 2852)   

البيهقي:١٨٨٨٣أَخْبَرَنَا أَبُو عَلِيٍّ الْحُسَيْنُ بْنُ مُحَمَّدٍ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا مُحَمَّدُ بْنُ عِيسَى ثنا هُشَيْمٌ أنبأ دَاوُدُ بْنُ عَمْرٍو عَنْ بُسْرِ بْنِ عُبَيْدِ اللهِ عَنْ أَبِي إِدْرِيسَ الْخَوْلَانِيِّ عَنْ أَبِي ثَعْلَبَةَ ؓ قَالَ

قَالَ النَّبِيُّ ﷺ فِي صَيْدِ الْكَلْبِ إِذَا أَرْسَلْتَ كَلْبَكَ وَذَكَرْتَ اسْمَ اللهِ فَكُلْ وَإِنْ أَكَلَ مِنْهُ وَكُلْ مَا رَدَّتْ يَدُكَ أَوْ قَالَ كُلْ مَا رَدَّتْ عَلَيْكَ يَدُكَ

[Machine] "O Messenger of Allah, I have hunting dogs, so advise me regarding hunting with them." The Prophet ﷺ replied, "If you have hunting dogs, then eat from what they catch." The person asked, "Even if they eat from it?" The Prophet ﷺ said, "If they eat from it, this is according to the narration of Dawud bin 'Amr, except that the narration of Abu Tha'labah does not mention eating. The hadith of Sha'bi, narrated from 'Adi, is more authentic than the hadith of Dawud bin 'Amr Dimashqi and the hadith of 'Amr bin Shu'aib. Allah knows best, and Shu'bah narrated from his slave, Rabee'ah bin Sa'id, from 'Amr bin Shu'aib, from a man from the Banu Hudhayl that he asked the Prophet ﷺ about a hunting dog. He replied, "Eat from it, whether it has eaten or not." So, the hadith of 'Amr is an explanation of this hadith."  

البيهقي:١٨٨٨٤وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا مُحَمَّدُ بْنُ الْمِنْهَالِ الضَّرِيرُ ثنا يَزِيدُ بْنُ زُرَيْعٍ ثنا حَبِيبٌ الْمُعَلِّمُ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ أَعْرَابِيًّا يُقَالُ لَهُ أَبُو ثَعْلَبَةَ ؓ قَالَ

يَا رَسُولَ اللهِ إِنَّ لِي كِلَابًا مُكَلَّبَةً فَأَفْتِنِي فِي صَيْدِهَا فَقَالَ النَّبِيُّ ﷺ إِذَا كَانَ لَكَ كِلَابٌ مُكَلَّبَةٌ فَكُلْ مِمَّا أَمْسَكْنَ عَلَيْكَ قَالَ ذَكِيٌّ أَوْ غَيْرُ ذَكِيٍّ قَالَ وَإِنْ أَكَلَ مِنْهُ؟ قَالَ وَإِنْ أَكَلَ مِنْهُ هَذَا مُوَافِقٌ لِحَدِيثِ دَاوُدَ بْنِ عَمْرٍو إِلَّا أَنَّ حَدِيثَ أَبِي ثَعْلَبَةَ ؓ مُخَرَّجٌ فِي الصَّحِيحَيْنِ مِنْ حَدِيثِ رَبِيعَةَ بْنِ يَزِيدَ الدِّمَشْقِيِّ عَنْ أَبِي إِدْرِيسَ الْخَوْلَانِيِّ عَنْ أَبِي ثَعْلَبَةَ وَلَيْسَ فِيهِ ذِكْرُ الْأَكْلِ وَحَدِيثُ الشَّعْبِيِّ عَنْ عَدِيٍّ أَصَحُّ مِنْ حَدِيثِ دَاوُدَ بْنِ عَمْرٍو الدِّمَشْقِيِّ وَمِنْ حَدِيثِ عَمْرِو بْنِ شُعَيْبٍ وَاللهُ أَعْلَمُ وَقَدْ رَوَى شُعْبَةُ عَنْ عَبْدِ رَبِّهِ بْنِ سَعِيدٍ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ رَجُلٍ مِنْ هُذَيْلٍ أَنَّهُ سَأَلَ النَّبِيَّ ﷺ عَنِ الْكَلْبِ يَصْطَادُ قَالَ كُلْ أَكَلَ أَوْ لَمْ يَأْكُلْ فَصَارَ حَدِيثُ عَمْرٍو بِهَذَا مَعْلُولًا
