60. Hunting
٦٠۔ كِتَابُ الصَّيْدِ وَالذَّبَائِحِ
[Machine] A Bedouin man gave a deer as a gift to the Messenger of Allah ﷺ . The Messenger asked, "Where did you find this?" The man replied, "I shot it yesterday, but I couldn't catch it. It eluded me until evening, so I returned. In the morning, I followed its tracks and found it in a cave or amongst rocks. This is my portion and I recognize it." The Messenger said, "You spent the night alone, and I am not safe from the possibility that you had companions aiding you in this matter. I have no need for it."
أَنَّ أَعْرَابِيًّا أَهْدَى لِرَسُولِ اللهِ ﷺ ظَبْيًا فَقَالَ مِنْ أَيْنَ أَصَبْتَ هَذَا؟ قَالَ رَمَيْتُهُ أَمْسِ فَطَلَبْتُهُ فَأَعْجَزَنِي حَتَّى أَدْرَكَنِي الْمَسَاءُ فَرَجَعْتُ فَلَمَّا أَصْبَحْتُ اتَّبَعْتُ أَثَرَهُ فَوَجَدْتُهُ فِي غَارٍ أَوْ فِي أَحْجَارٍ وَهَذَا مِشْقَصِي فِيهِ أَعْرِفُهُ قَالَ بَاتَ عَنْكَ لَيْلَةً وَلَا آمَنُ أَنْ تَكُونَ هَامَّةٌ أَعَانَتْكَ عَلَيْهِ لَا حَاجَةَ لِي فِيهِ
[Machine] A man came to the Prophet ﷺ with game and said, "I shot it last night and found my arrow in it from the next morning, and I recognized my arrow." The Prophet ﷺ said, "The night is a creation from the creations of Allah and it is great. Perhaps it helped you with something, so throw it away from you." Abu Bakr Muhammad ibn Muhammad informed us of the two of them, Abu al-Hasan al-Fasawi narrated to us, Abu Ali al-Lulu'i narrated to us, and Abu Dawud mentioned them.
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ بِصَيْدٍ فَقَالَ إِنِّي رَمَيْتُهُ مِنَ اللَّيْلِ فَأَعْيَانِي وَوَجَدْتُ سَهْمِي فِيهِ مِنَ الْغَدِ وَقَدْ عَرَفْتُ سَهْمِي فَقَالَ اللَّيْلُ خَلْقٌ مِنْ خَلْقِ اللهِ ﷻ عَظِيمٌ لَعَلَّهُ أَعَانَكَ عَلَيْهِ شَيْءٌ انْبِذْهَا عَنْكَ أَخْبَرَنَا بِهِمَا أَبُو بَكْرٍ مُحَمَّدُ بْنُ مُحَمَّدٍ أَنْبَأَ أَبُو الْحَسَنِ الْفَسَوِيُّ ثنا أَبُو عَلِيٍّ اللُّؤْلُؤِيُّ ثنا أَبُو دَاوُدَ فَذَكَرَهُمَا
[Machine] About the Prophet, ﷺ , when the game is unavailable to you but you stumble upon it, and Haawwam al-Ardh and Abu Razeen - this is his name, Mas'ood, the freed slave of the brother of Salamah - he is not the slave of the Messenger of Allah, ﷺ , and this Hadith is Mursal, narrated by Al-Bukhari.
عَنِ النَّبِيِّ ﷺ إِذَا غَابَ عَنْكَ الصَّيْدُ فَصَادَفْتَهُ وَذَكَرَ هَوَامَّ الْأَرْضِ وَأَبُو رَزِينٍ هَذَا اسْمُهُ مَسْعُودٌ مَوْلَى شَقِيقِ بْنِ سَلَمَةَ وَلَيْسَ بِأَبِي رَزِينٍ مَوْلَى رَسُولِ اللهِ ﷺ وَالْحَدِيثُ مُرْسَلٌ قَالَهُ الْبُخَارِيُّ
[Machine] "O Allah, indeed I aim at the prey, and I become deaf and I secure it. So how do you see?" Ibn Abbas said, "Whenever you secure it, leave what you have let go."
اللهُ إِنِّي أَرْمِي الصَّيْدَ فَأُصْمِي وَأُنْمِي فَكَيْفَ تَرَى؟ فَقَالَ ابْنُ عَبَّاسٍ ؓ كُلْ مَا أَصْمَيْتَ وَدَعْ مَا أَنْمَيْتَ
[Machine] So I wrote it in a paper, and I came to him to ask him. And when I found people surrounding him asking him, they kept asking him about everything in my paper and what I didn't ask him about. So a Bedouin man asked him and said, "I am a servant, I have camels that belong to my family, and a man comes to me asking for water, should I give him water?". He said, "Yes". The man asked, "What if I fear that he will ruin them?". He said, "Give him enough water that will not cause harm to them, then inform your family". The man said, "But I am a blind man, I can't see, and I have sheep". He said, "As long as you can't see, eat from them, and as long as you can't breed them, don't let them breed". I said to the judge, "What does 'issma' mean?". He said, "Sterility". I asked, "What does 'inma' mean?". He said, "Whatever is hidden from you". And it was narrated from another source attributed to ibn Abbas as a weakness.
فَكَتَبْتُهَا فِي صَحِيفَةٍ فَأَتَيْتُهُ لِأَسْأَلَهُ فَإِذَا عِنْدَهُ نَاسٌ يَسْأَلُونَهُ فَسَأَلُوهُ حَتَّى سَأَلُوهُ عَنْ جَمِيعِ مَا فِي صَحِيفَتِي وَمَا سَأَلْتُهُ عَنْ شَيْءٍ فَسَأَلَهُ رَجُلٌ أَعْرَابِيٌّ فَقَالَ إِنِّي مَمْلُوكٌ أَكُونُ فِي إِبِلِ أَهْلِي فَيَأْتِينِي الرَّجُلُ يَسْتَسْقِينِي فَأَسْقِيهِ قَالَ لَا قَالَ فَإِنْ خَشِيتُ أَنْ يَهْلِكَ؟ قَالَ فَاسْقِهِ مَا يُبَلِّغُهُ ثُمَّ أَخْبِرْ بِهِ أَهْلَكَ قَالَ فَإِنِّي رَجُلٌ أَرْمِي فَأُصْمِي وَأُنْمِي قَالَ مَا أَصْمَيْتَ فَكُلْ وَمَا أَنْمَيْتَ فَلَا تَأْكُلْ قُلْتُ لِلْحَكَمِ مَا الْإِصْمَاءُ؟ قَالَ الْإِقْعَاصُ قُلْتُ فَمَا الْإِنْمَاءُ؟ قَالَ مَا تَوَارَى عَنْكَ وَقَدْ رُوِيَ هَذَا مِنْ وَجْهٍ آخَرَ عَنِ ابْنِ عَبَّاسٍ ؓ مَرْفُوعًا وَهُوَ ضَعِيفٌ
Imam Shafi'i said, "I do not consider something to be sinful that is killed by dogs while you are watching it, and I do not consider something to be resurrected that disappeared from your sight after its killing." Imam Shafi'i, may Allah have mercy on him, said, "Except if it comes from the Prophet Muhammad ﷺ , because then I doubt it, and if it goes against his command, I reject it completely. There is no room for personal opinion or analogy. Allah has granted an excuse for his ﷺ saying." The sheikh said, "This is what Imam Shafi'i, may Allah have mercy on him, is uncertain about."
قَالَ الشَّافِعِيُّ مَا أَصْمَيْتَ مَا قَتَلَتْهُ الْكِلَابُ وَأَنْتَ تَرَاهُ وَمَا أَنْمَيْتَ مَا غَابَ عَنْكَ مَقْتَلُهُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَلَا يَجُوزُ عِنْدِي فِيهِ إِلَّا هَذَا إِلَّا أَنْ يَكُونَ جَاءَ عَنِ النَّبِيِّ ﷺ شَيْءٌ فَإِنِّي أَتَوَهَّمُهُ فَيَسْقُطَ كُلُّ شَيْءٍ خَالَفَ أَمْرَ النَّبِيِّ ﷺ وَلَا يَقُومَ مَعَهُ رَأْيٌ وَلَا قِيَاسٌ فَإِنَّ اللهَ قَطَعَ الْعُذْرَ لِقَوْلِهِ ﷺ قَالَ الشَّيْخُ وَهَذَا الَّذِي تَوَهَّمَهُ الشَّافِعِيُّ رَحِمَهُ اللهُ فِيمَا
The Prophet ﷺ said, "If you let loose your hound after a game and mention Allah's Name on sending it, and the hound catches the game and kills it, then you can eat of it. But if the hound eats of it, then you should not eat thereof, for the hound has caught it for itself. And if along with your hound, joined other hounds, and Allah's Name was not mentioned at the time of their sending, and they catch an animal and kill it, you should not eat of it, for you will not know which of them has killed it. And if you have thrown an arrow at the game and then find it (dead) two or three days later and, it bears no mark other than the wound inflicted by your arrow, then you can eat of it. But if the game is found (dead) in water, then do not eat of it." (Using translation from Bukhārī 5484)
أَنَّ النَّبِيَّ ﷺ قَالَ إِذَا أَرْسَلْتَ كَلْبَكَ فَسَمَّيْتَ فَأَمْسَكَ عَلَيْكَ فَقَتَلَ فَكُلْ فَإِنْ أَكَلَ مِنْهُ فَلَا تَأْكُلْ فَإِنَّمَا أَمْسَكَ عَلَى نَفْسِهِ وَإِذَا خَالَطَ كِلَابًا لَمْ تَذْكُرِ اسْمَ اللهِ عَلَيْهَا فَأَمْسَكْنَ وَقَتَلْنَ فَلَا تَأْكُلْ فَإِنَّكَ لَا تَدْرِي أَيُّهَا قَتَلَ وَإِنْ رَمَيْتَ الصَّيْدَ فَوَجَدْتَهُ بَعْدَ يَوْمٍ أَوْ يَوْمَيْنِ لَيْسَ بِهِ إِلَّا أَثَرُ سَهْمِكَ فَإِنْ شِئْتَ أَنْ تَأْكُلَ فَكُلْ وَإِنْ وَقَعَ فِي الْمَاءِ فَلَا تَأْكُلْ
[Machine] He asked the Messenger of Allah ﷺ about hunting, so he mentioned the Hadith and said, "When you throw your arrow, mention the name of Allah, and if you find it (the hunted animal), eat it, except if you find it in water, for you do not know if the water killed it or if your arrow did. If you find it after a night or two and do not find any other signs except the mark of your arrow, then if you wish, you may eat from it, so eat."
أَنَّهُ سَأَلَ رَسُولَ اللهِ ﷺ عَنِ الصَّيْدِ فَذَكَرَ الْحَدِيثَ قَالَ فَقَالَ رَسُولُ اللهِ ﷺ إِذَا رَمَيْتَ بِسَهْمِكَ فَاذْكُرِ اسْمَ اللهِ فَإِنْ أَدْرَكْتَهُ فَكُلْ إِلَّا أَنْ تَجِدَهُ قَدْ وَقَعَ فِي مَاءٍ فَإِنَّكَ لَا تَدْرِي الْمَاءُ قَتَلَهُ أَوْ سَهْمُكَ فَإِنْ وَجَدْتَهُ بَعْدَ لَيْلَةٍ أَوْ لَيْلَتَيْنِ فَلَمْ تَجِدْ فِيهِ أَثَرًا غَيْرَ أَثَرِ سَهْمِكَ فَشِئْتَ أَنْ تَأْكُلَ مِنْهُ فَكُلْ
Messenger of Allah, one of us shoots at the game, and follows its mark for two or three days, and then finds it dead, and there is his arrow (pierced) in it, may he eat it? He said: Yes, if he wishes, or he said: he may eat if he wishes. (Using translation from Abū Dāʾūd 2853)
أَنَّهُ قَالَ يَا رَسُولَ اللهِ إِنَّ أَحَدَنَا يَرْمِي فَيَقْتَفِي أَثَرَهُ الْيَوْمَ وَالْيَوْمَيْنِ فَيَجِدُهُ مَيِّتًا وَفِيهِ سَهْمُهُ أَيَأْكُلُ؟ قَالَ نَعَمْ إِنْ شَاءَ أَوْ قَالَ يَأْكُلُ إِنْ شَاءَ
[Machine] "O Messenger of Allah, I am hunting and I search for the trace after a night. He said, 'If you see the trace of your arrow on it, and seven have not eaten from it, then eat it." Shu'bah said, "I mentioned that to Abu Bishr, and he said, 'Ibn Jubayr reported from Addi ibn Hatim that the Prophet ﷺ said, 'If you see your arrow in it and do not see any other trace on it, and you know that you have killed it, then eat it.' 18908 And Ibn Abdan informed us Ahmad ibn Ubayd narrated to us Ahmad ibn Ali al-Khazzar narrated to us Ali ibn al-Jaad al-Jawhari narrated to us Shu'bah mentioned it in a similar way except that he said Shu'bah mentioned it like that. But said, 'Saeed ibn Jubayr reported from Addi ibn Hatim that the Prophet ﷺ said, 'If you recognize your arrow in it and do not see any other trace on it, and you know that you have killed it, then eat it.'"
يَا رَسُولَ اللهِ إِنِّي أَرْمِي الصَّيْدَ فَأَطْلُبُ الْأَثَرَ بَعْدَ لَيْلَةٍ قَالَ إِذَا رَأَيْتَ أَثَرَ سَهْمِكَ فِيهِ لَمْ يَأْكُلْ مِنْهُ سَبْعٌ فَكُلْ قَالَ شُعْبَةُ فَذَكَرْتُ ذَلِكَ لِأَبِي بِشْرٍ فَقَالَ قَالَ ابْنُ جُبَيْرٍ عَنْ عَدِيِّ بْنِ حَاتِمٍ ؓ أَنَّ النَّبِيَّ ﷺ قَالَ إِذَا رَأَيْتَ سَهْمَكَ فِيهِ لَمْ تَرَ فِيهِ أَثَرًا غَيْرَهُ وَتَعْلَمُ أَنَّهُ قَتَلَهُ فَكُلْهُ 18908 وَأَخْبَرَنَا ابْنُ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ ثنا أَحْمَدُ بْنُ عَلِيٍّ الْخَزَّارُ ثنا عَلِيُّ بْنُ الْجَعْدِ الْجَوْهَرِيُّ ثنا شُعْبَةُ فَذَكَرَهُ بِنَحْوِهِ إِلَّا أَنَّهُ قَالَ قَالَ شُعْبَةُ فَحَدَّثْتُ بِهِ أَبَا بِشْرٍ فَقَالَ إِنَّمَا قَالَ سَعِيدُ بْنُ جُبَيْرٍ عَنْ عَدِيِّ بْنِ حَاتِمٍ ؓ عَنِ النَّبِيِّ ﷺ إِذَا عَرَفْتَ سَهْمَكَ فِيهِ وَلَمْ تَرَ فِيهِ أَثَرَ غَيْرِهِ وَتَعْلَمُ أَنَّهُ قَتَلَهُ فَكُلْ
"I said: 'O Messenger of Allah! I shoot some game and then find my arrow in it the next day.' He said: 'If you know that your arrow killed it, and you dont see any marks of predators, then eat it.'" (Using translation from Tirmidhī 1468)
قُلْتُ يَا رَسُولَ اللهِ أَرْمِي الصَّيْدَ فَأَجِدُهُ مِنَ الْغَدِ فِيهِ سَهْمِي قَالَ إِذَا وَجَدْتَ فِيهِ سَهْمَكَ وَعَلِمْتَ أَنَّهُ قَتَلَهُ وَلَمْ تَرَ فِيهِ أَثَرَ سَبُعٍ فَكُلْ
[Machine] The Messenger of Allah ﷺ said: "If you shoot your arrow and it disappears for three nights, then you find it, anything that has not been touched, (you may eat it)."
قَالَ رَسُولُ اللهِ ﷺ إِذَا رَمَيْتَ سَهْمَكَ فَغَابَ ثَلَاثَ لَيَالٍ فَأَدْرَكْتَهُ فَكُلْ مَا لَمْ يُنْتِنْ
[Machine] About the Prophet Muhammad ﷺ who catches his prey after three days, he said that he would not eat it unless he waits.
عَنْ رَسُولِ اللهِ ﷺ فِي الَّذِي يُدْرِكُ صَيْدَهُ بَعْدَ ثَلَاثٍ قَالَ يَأْكُلُهُ إِلَّا أَنْ يُنْتِنَ
[Machine] "O Messenger of Allah, advise me regarding my bow." He said, "Every arrow that returns to you, your bowstring has hit the target." He said, "And if it disappears from me?" He said, "If it goes missing and you don't find any other traces except your own arrow." He said, "Advise me regarding the vessels of the Magians if I am compelled to use them." He said, "Wash them and then eat in them."
يَا رَسُولَ اللهِ أَفْتِنِي فِي قَوْسِي قَالَ كُلْ مَا رَدَّتْ عَلَيْكَ قَوْسُكَ قَالَ ذَكِيٌّ وَغَيْرُ ذَكِيٍّ؟ قَالَ وَإِنْ تَغَيَّبَ عَنِّي؟ قَالَ وَإِنْ تَغَيَّبَ عَنْكَ مَا لَمْ يَصِلَّ أَوْ تَجِدْ فِيهِ أَثَرَ غَيْرِ سَهْمِكَ قَالَ أَفْتِنِي فِي آنِيَةِ الْمَجُوسِ إِذَا اضْطُرِرْتُ إِلَيْهَا قَالَ اغْسِلْهَا وَكُلْ فِيهَا
[Machine] I said, "O Messenger of Allah, give me your opinion about my bow." He said, "Whenever you see traces of your arrow on it, say it is pure. But if it hides from your sight, and you can only see the trace of your arrow or it reaches the target, say it is impure." Abu Musa said, "That means it has changed." The scholar, may Allah have mercy on him, said, "It has been reported to me from Abu Suleiman Al-Khattabi, may Allah have mercy on him, that he said: His statement 'what did not reach' means what did not penetrate. And the change of its smell is called as 'sall al-lahm' (literally: the meat fell). And two languages originated from it. And this is according to the meaning of recommended without prohibition, because the change of its smell does not prohibit its consumption." He said, "And it has been narrated that the Prophet (peace and blessings be upon him) ate Ihala, which is the meat that has changed its smell."
قُلْتُ يَا رَسُولَ اللهِ أَفْتِنِي فِي قَوْسِي قَالَ كُلْ مَا رَدَّتْ عَلَيْكَ قَوْسُكَ قُلْتُ فَإِنْ تَوَارَى عَنِّي؟ قَالَ وَإِنْ تَوَارَى عَنْكَ بَعْدَ أَنْ لَا تَرَى فِيهِ إِلَّا أَثَرَ سَهْمِكَ أَوْ يَصِلَّ قَالَ أَبُو مُوسَى يَعْنِي يَتَغَيَّرُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَبَلَغَنِي عَنْ أَبِي سُلَيْمَانَ الْخَطَّابِيِّ رَحِمَهُ اللهُ أَنَّهُ قَالَ قَوْلُهُ مَا لَمْ يَصِلَّ فَإِنَّهُ يُرِيدُ مَا لَمْ يُنْتِنْ وَتَغَيَّرَ رِيحُهُ يُقَالُ صَلَّ اللَّحْمُ وَأَصَلَّ لُغَتَانِ وَهَذَا عَلَى مَعْنَى الِاسْتِحْبَابِ دُونَ التَّحْرِيمِ؛ لِأَنَّ تَغَيُّرَ رِيحِهِ لَا يُحَرِّمُ أَكْلَهُ قَالَ وَقَدْ رُوِيَ أَنَّ النَّبِيَّ ﷺ أَكَلَ إِهَالَةً سَنِخَةً وَهِيَ الْمُتَغَيِّرَةُ الرِّيحِ
[Machine] The Messenger of Allah ﷺ was invited to have barley bread and a roasted lamb.
لَقَدْ دُعِيَ رَسُولُ اللهِ ﷺ عَلَى خُبْزِ شَعِيرٍ وَإِهَالَةٍ سَنِخَةٍ
[Machine] The Prophet (PBUH) went out until he reached Al-Rawha and saw a tied-up donkey. Muhammad ibn Abi Bakr added to his narration about some of its courtyards and they both said together. They said, "O Messenger of Allah, this is a tied-up donkey." The Messenger of Allah (PBUH) said, "Leave it, for the one who has touched it will come." Then a man from Buhz came and said, "O Messenger of Allah, I touched this, so what should we do with it?" The Messenger of Allah (PBUH) commanded Abu Bakr to distribute it among the companions. He then continued until he reached a place between Al-Arj and Al-Ruwaida when he found a deer tied up in the shade, with an arrow in it. The Messenger of Allah (PBUH) commanded a man to stay with it until the last of the people passed by and not to let it go. And Abu al-Hassan Al-Muqri' narrated to us that Al-Hassan ibn Muhammad informed him, who informed him that Abdul Wahhab Al-Thaqafi said, "I heard Yahya ibn Sa'id saying, 'Muhammad ibn Ibrahim informed me, who informed me that 'Umayr ibn Salamah Ad-Damri told him about Al-Bahzi that the Prophet (PBUH) went out while in a state of Ihram, until he reached some of the courtyards of Al-Rawha. There he found a wild donkey tied up and the people mentioned it to the Messenger of Allah (PBUH)." And Al-Hadeeth was mentioned.
أَنَّ النَّبِيَّ ﷺ خَرَجَ حَتَّى أَتَى الرَّوْحَاءَ رَأَى حِمَارًا عَقِيرًا زَادَ مُحَمَّدُ بْنُ أَبِي بَكْرٍ فِي حَدِيثِهِ فِي بَعْضِ أَفْنَائِهَا وَقَالَا جَمِيعًا فَقِيلَ يَا رَسُولَ اللهِ هَذَا حِمَارٌ عَقِيرٌ قَالَ رَسُولُ اللهِ ﷺ دَعُوهُ فَإِنَّ الَّذِي أَصَابَهُ سَيَجِيءُ فَجَاءَ رَجُلٌ مِنْ بَهْزٍ قَالَ يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ هَذَا فَشَأْنُكُمْ بِهِ فَأَمَرَ رَسُولُ اللهِ ﷺ أَبَا بَكْرٍ ؓ فَقَسَمَهُ بَيْنَ الرِّفَاقِ ثُمَّ سَارَ حَتَّى إِذَا كَانَ بِالْإِثَابَةِ بَيْنَ الْعَرْجِ وَالرُّوَيْثَةِ إِذَا ظَبْيٌ حَاقِفٌ فِي ظِلٍّ فِيهِ سَهْمٌ فَأَمَرَ رَسُولُ اللهِ ﷺ رَجُلًا أَنْ يُقِيمَ عِنْدَهُ حَتَّى يُجِيزَ آخِرُ النَّاسِ لَا يَعْرِضُ لَهُ 18916 وَأَخْبَرَنَا أَبُو الْحَسَنِ الْمُقْرِئُ أنبأ الْحَسَنُ بْنُ مُحَمَّدٍ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ أَبِي بَكْرٍ ثنا عَبْدُ الْوَهَّابِ الثَّقَفِيُّ قَالَ سَمِعْتُ يَحْيَى بْنُ سَعِيدٍ يَقُولُ أَخْبَرَنِي مُحَمَّدُ بْنُ إِبْرَاهِيمَ عَنْ عِيسَى بْنِ طَلْحَةَ أَنَّ عُمَيْرَ بْنَ سَلَمَةَ الضَّمْرِيَّ أَخْبَرَهُ عَنِ الْبَهْزِيِّ أَنَّ النَّبِيَّ ﷺ خَرَجَ وَهُوَ مُحْرِمٌ حَتَّى إِذَا كَانَ بِبَعْضِ أَفْنَاءِ الرَّوْحَاءِ إِذَا حِمَارُ وَحْشٍ عَقِيرٌ فَذَكَرَهُ الْقَوْمُ لِرَسُولِ اللهِ ﷺ قَالَ وَذَكَرَ الْحَدِيثَ
