"The Messenger of Allah said: 'No man is bound by a transaction involving the sale of something that he does not possess.''' (Using translation from Nasāʾī 4612)  

الكبرى للنسائي:٦١٦١ – أَخْبَرَنَا عُثْمَانُ بْنُ عَبْدِ اللهِ قَالَ حَدَّثَنَا سَعِيدُ بْنُ سُلَيْمَانَ عَنْ عَبَّادِ بْنِ الْعَوَّامِ عَنْ سَعِيدِ بْنِ أَبِي عَرُوبَةَ عَنْ أَبِي رَجَاءٍ قَالَ عُثْمَانُ هُوَ مُحَمَّدُ بْنُ سَيْفٍ عَنْ مَطَرٍ الْوَرَّاقِ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ

قَالَ رَسُولُ اللهِ ﷺ «لَيْسَ عَلَى الرَّجُلِ بَيْعٌ فِيمَا لَا يَمْلِكُ»

[Machine] From the Prophet ﷺ , he said: "A man does not have the right to divorce in that which he does not possess, nor does he have the right to emancipate in that which he does not possess, nor does he have the right to sell in that which he does not possess."
