The Messenger of Allah said: "Whichever woman married without the permission of her Wali her marriage is invalid, her marriage is invalid, her marriage is invalid. If he entered into her, then the Mahr is for her in lieu of what he enjoyed from her private part. If they disagree, then the Sultan is the Wali for one who has no Wali."
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ إِذْنِ وَلِيِّهَا فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَإِنْ دَخَلَ بِهَا فَلَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا فَإِنِ اشْتَجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لاَ وَلِيَّ لَهُ
the Messenger of Allah said: “Any woman whose marriage is not arranged by her guardian, her marriage is invalid, her marriage is invalid, her marriage is invalid. If (the man) has had intercourse with her, then the Mahr belongs to her in return for his intimacy with her. And if there is any dispute then the ruler is the guardian of the one who does not have a guardian.”
قَالَ رَسُولُ اللَّهِ ﷺ أَيُّمَا امْرَأَةٍ لَمْ يُنْكِحْهَا الْوَلِيُّ فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَإِنْ أَصَابَهَا فَلَهَا مَهْرُهَا بِمَا أَصَابَ مِنْهَا فَإِنِ اشْتَجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لاَ وَلِيَّ لَهُ
[AI] The Prophet ﷺ said: "Any woman who is married without the permission of her guardian, her marriage is invalid, her marriage is invalid, her marriage is invalid. If they dispute, Abu Asim said: and he said it once: if they argue, then the ruler is the guardian of the one who has no guardian. If he (the ruler) decides in her favor, then she has the dowry for what he has permitted from her private parts." Abu Asim said: He (the Prophet) repeated this statement forty-six times.

[AI] The Messenger of Allah ﷺ said, "If a woman is married without the permission of her guardian, then her marriage is invalid. Her marriage is invalid. Her marriage is invalid. If he consummates the marriage, she is entitled to her dowry according to what he has consummated. If they disagree, then the ruler is the guardian of one who has no guardian." Ibn Jurayj said, "I met Al-Zuhri and asked him about this hadith, but he did not know it. Sulaiman ibn Musa praised it." Abdullah said, "My father said, 'The ruler is the judge because he is in charge of matters of marriage and rulings.'"

ذِكْرُ بُطْلَانِ النِّكَاحِ الَّذِي نُكِحَ بِغَيْرِ وَلِيٍّ
[AI] The Messenger of Allah ﷺ said, "Any woman who is married without the permission of her guardian, her marriage is invalid, her marriage contract is invalid twice, and she is entitled to what she was given from the dowry. If there is a dispute between them, then that is taken to the ruler, and the ruler is a guardian for the one who has no guardian."
قَالَ رَسُولُ اللَّهِ ﷺ «أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ إِذَنِ وَلِيِّهَا فَنِكَاحُهَا بَاطِلٌ مَرَّتَيْنِ وَلَهَا مَا أَعْطَاهَا بِمَا أَصَابَ مِنْهَا فَإِنْ كَانَتْ بَيْنَهُمَا خُصُومَةٌ فَذَاكَ إِلَى السُّلْطَانِ وَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ»
[AI] The Messenger of Allah (PBUH) said, "Any woman who marries without the consent of her guardian, her marriage is invalid, her marriage is invalid, and if he has intercourse with her, she is entitled to the dowry for what he had made lawful from her private part. And if they dispute, then the ruler is the guardian of the one who has no guardian."
قَالَ رَسُولُ اللهِ ﷺ «أَيُّمَا امْرَأَةٍ تَزَوَّجَتْ بِغَيْرِ وَلِيٍّ فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَإِنْ دَخَلَ بِهَا فَلَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا وَإِنِ اشْتَجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ»
[AI] The Messenger of Allah ﷺ said, "Any woman who is married without the permission of her guardian, then her marriage is null and void. And the one who gave her permission from what he has made lawful for her, then if they quarrel, it is to be resolved by the ruler. And the ruler is the guardian of one who does not have a guardian."
قَالَ رَسُولُ اللهِ ﷺ «أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ أَمْرِ مَوْلَاهَا فَإِنَّمَا نِكَاحُهَا بَاطِلٌ وَإِنَّمَا الَّذِي أَعْطَاهَا بِمَا اسْتَحَلَّ مِنْهَا فَإِنِ اشْتَجَرُوا فَذَلِكَ إِلَى السُّلْطَانِ وَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ»
[AI] The Messenger of Allah ﷺ said: "A woman should not be married without the permission of her guardian (wali). If she is married without her guardian's permission, then her marriage is invalid. If this invalid marriage happens three times, then she is entitled to the dowry (mahr) equal to what she had received from the previous marriages. If they argue about it, then the ruler is the guardian for the one who has no guardian."

Abu Ali Al-Hafiz, who is Al-Naysaburi and Abu Yusuf Al-Raqqi, said: "This is from the scholars of the people of the Arabian Peninsula and their experts."

If a man has intercourse with her, she is entitled to her dowry for what he has done to her. And if they dispute, then the ruler is the guardian of one who has no guardian. And it is narrated from Mujalid from Al-Sha'bi from Ali and Abdullah and Shurayh, they said: There is no marriage without a guardian, except for a woman whose guardian hinders her, so she goes to the ruler or to the judge. And it is also narrated from Ziyad bin Al-Aqqa that Uthman bin Affan wrote: If the father is competent, then tell him to marry her. If he refuses, then marry her and ask for Allah's guidance. And Allah knows best.

"أيُّمَا امْرَأة نُكِحَتْ بِغَيرٍ إِذن وَليَّهَا فِنَكَاحُهَا بَاطِلٌ، فَنَكَاحُهَا بَاطِلٌ، فَنِكَاحُهَا بَاطِلٌ، فَإِنْ دَخَلَ بِهَا فَلَها المهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا، فَإِن اشْتَجَرُوا فالسُّلطَانُ وَلِيُّ مَنْ لا وَلِيَّ له".
"أيمَا امْرَأة نَكَحَت بغَيرِ إِذْن وَلِيِّها فِنَكَاحُهَا بَاطِلٌ، فَإِنْ كان دَخَلَ بِهَا فَلَهَا صَدَاقُهَا بمَا اسْتَحَلَّ مِنْ فَرْجهَا، وَيُفَرقُ بَينَهُمَا، وَانْ كَانَ لم يَدْخُل بِهَا فُرق بَينَهُمَا والسّلطَانُ وَلِى مَنْ لا وَلِى لَهُ".
"لَا تُنكحُ الْمَرْأَةُ إِلَّا بإذنِ وَلِيِّهَا، فَإِنْ نُكِحَتْ فَهُوَ بَاطلٌ، فَهُو بَاطِلٌ، فَهُوَ بَاطِلٌ، فَإِنْ دُخِلَ بِهَا فَلَهَا الْمَهْرُ بِمَا أَصَابَ مِنْهَا، فَإِنْ تَشَاجَرُوا فَالسُّلْطَانُ وَلِىُّ مَنْ لَا وَلِى لَه".
