I asked Ibn 'Abbas (about the verse relating to intentional homicide in Surat An-Nisa') He said: When the verse "Those who invoke not with Allah any other god, nor slay such life as Allah had made sacred, except for just cause" was revealed, the polytheists of Mecca said: We have killed the soul prohibited by Allah, invoked another god along with Allah for worship, and committed shameful deeds. So Allah revealed the verse "unless he repents, believes, and works righteous deeds, for Allah will change the evil of such persons into good." This is meant for them. As regards the verse "if a man kills a believer intentionally, his recompense is Hell" He said: If a man knows the command of Islam and intentionally kills a believer, his repentance wil not be accepted. I then mentioned it to Mujahid. He said: "Except the one who is ashamed (of his sin)."  

أبو داود:٤٢٧٣حَدَّثَنَا يُوسُفُ بْنُ مُوسَى حَدَّثَنَا جَرِيرٌ عَنْ مَنْصُورٍ عَنْ سَعِيدِ بْنِ جُبَيْرٍ أَوْ حَدَّثَنِي الْحَكَمُ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَالَ سَأَلْتُ ابْنَ عَبَّاسٍ فَقَالَ

لَمَّا نَزَلَتِ الَّتِي فِي الْفُرْقَانِ { وَالَّذِينَ لاَ يَدْعُونَ مَعَ اللَّهِ إِلَهًا آخَرَ وَلاَ يَقْتُلُونَ النَّفْسَ الَّتِي حَرَّمَ اللَّهُ إِلاَّ بِالْحَقِّ } قَالَ مُشْرِكُو أَهْلِ مَكَّةَ قَدْ قَتَلْنَا النَّفْسَ الَّتِي حَرَّمَ اللَّهُ وَدَعَوْنَا مَعَ اللَّهِ إِلَهًا آخَرَ وَأَتَيْنَا الْفَوَاحِشَ فَأَنْزَلَ اللَّهُ { إِلاَّ مَنْ تَابَ وَآمَنَ وَعَمِلَ عَمَلاً صَالِحًا فَأُولَئِكَ يُبَدِّلُ اللَّهُ سَيِّئَاتِهِمْ حَسَنَاتٍ } فَهَذِهِ لأُولَئِكَ قَالَ وَأَمَّا الَّتِي فِي النِّسَاءِ { وَمَنْ يَقْتُلْ مُؤْمِنًا مُتَعَمِّدًا فَجَزَاؤُهُ جَهَنَّمُ } الآيَةُ قَالَ الرَّجُلُ إِذَا عَرَفَ شَرَائِعَ الإِسْلاَمِ ثُمَّ قَتَلَ مُؤْمِنًا مُتَعَمِّدًا فَجَزَاؤُهُ جَهَنَّمُ لاَ تَوْبَةَ لَهُ فَذَكَرْتُ هَذَا لِمُجَاهِدٍ فَقَالَ إِلاَّ مَنْ نَدِمَ

(25.168) "And whoever kills a believer intentionally, his recompense is Hell. (4.93) So I asked Ibn ʿAbbas who said, "When the Verse that is in Sura-al-Furqan was revealed, the pagans of Mecca said, 'But we have slain such life as Allah has made sacred, and we have invoked other gods along with Allah, and we have also committed fornication.' So Allah revealed:-- 'Except those who repent, believe, and do good-- (25.70) So this Verse was concerned with those people. As for the Verse in Surat-an-Nisa (4-93), it means that if a man, after understanding Islam and its laws and obligations, murders somebody, then his punishment is to dwell in the (Hell) Fire forever." Then I mentioned this to Mujahid who said, "Except the one who regrets (one's crime) . "

Ibn Abza said to me, "Ask Ibn ʿAbbas regarding the Statement of Allah: 'And whoever murders a believer intentionally, his recompense is Hell.' (4.69) And also His Statement: '...nor kill such life as Allah has forbidden, except for a just cause .....except those who repent, believe, and do good deeds.' " (25.68-70) So I asked Ibn ʿAbbas and he said, "When this (25.68-69) was revealed, the people of Mecca said, "We have invoked other gods with Allah, and we have murdered such lives which Allah has made sacred, and we have committed illegal sexual intercourse. So Allah revealed: 'Except those who repent, believe, and do good deeds and Allah is Oft-Forgiving, Most Merciful.' (25.70)

[Machine] Regarding these two verses, their command is concerning those in Surah Al-Furqan who do not invoke any deity besides Allah and do not kill a soul which Allah has forbidden except for a just cause, and also in Surah An-Nisa, "And whoever kills a believer intentionally, his recompense is Hell." I asked Ibn Abbas about this, and he said, "When the verse in Surah Al-Furqan was revealed, the polytheists of Makkah said, 'We have killed the soul which Allah has forbidden, and we have associated partners with Allah, and we have committed indecent actions.' Then the verse was revealed, 'Except for those who repent, believe, and do righteous deeds.'" And he said, "This is referring to those people." As for the verse in Surah An-Nisa, "And whoever kills a believer intentionally," it refers to a man who embraced Islam, performed the deeds of Islam, and then intentionally killed a believer. His recompense is Hell, and there is no repentance for him. I mentioned this to Mujahid, and he said, "It is correct according to the condition of the two sheikhs (referring to Bukhari and Muslim), as long as he has not been expelled." (According to the condition of Bukhari and Muslim)

[Machine] I asked Ibn Abbas, "Is there repentance for the one who intentionally kills a believer?" He said, "No." I then said, "So where is the statement [in the Quran], 'And those who do not invoke with Allah another deity or kill the soul which Allah has forbidden [to be killed], except by right, and do not commit unlawful sexual intercourse. And whoever should do that will meet a penalty. Multiplied for him is the punishment on the Day of Resurrection, and he will abide therein humiliated - except for those who repent, believe, and do righteous work. For them Allah will replace their evil deeds with good. And ever is Allah Forgiving and Merciful.]?" He said, "This is a Makkan verse that was abrogated by a Madinan verse." [Quran, 25:68] "But whoever kills a believer intentionally - his recompense is Hell, wherein he will abide eternally, and Allah has become angry with him and has cursed him and has prepared for him a great punishment." And we have committed indecencies." So Allah revealed [25:70] "Except for those who repent, believe, and do righteous deeds; for them Allah will replace their evil deeds with good." For those, he said, regarding the verse in An-Nisa [4:93] "And whoever kills a believer intentionally" until His statement [4:93] "Great sin", the man said, when a person embraces Islam and learns its laws and then kills a believer intentionally, his punishment is Hellfire and there is no repentance for him. So I mentioned that to Mujahid, and he said, except for one who feels remorse.
