١٦۔ كِتَابُ الْبُيُوعِ ص ١
[Machine] The Messenger of Allah ﷺ said, "The collateral is not withheld from you, and you bear the penalty."
قَالَ رَسُولُ اللَّهِ ﷺ «لَا يُغْلَقُ الرَّهْنُ لَكَ غُنْمُهُ وَعَلَيْكَ غُرْمُهُ»
The Messenger of Allah ﷺ having said: Allah, Most High, says: "I make a third with two partners as long as one of them does not cheat the other, but when he cheats him, I depart from them." (Using translation from Abū Dāʾūd 3383)
قَالَ رَسُولُ اللَّهِ ﷺ يَقُولُ اللَّهُ «أَنَا ثَالِثُ الشَّرِيكَيْنِ مَا لَمْ يَخُنْ أَحَدُهُمَا صَاحِبَهُ فَإِذَا خَانَ خَرَجْتُ مِنْ بَيْنِهِمَا» وَ
[Machine] From the Prophet ﷺ , he said, "Whoever gives a gift, he is more deserving of it as long as he has not taken anything from it."
عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ وَهَبَ هِبَةً فَهُوَ أَحَقُّ بِهَا مَا لَمْ يَثِبْ مِنْهَا»
[Machine] From the Prophet ﷺ , he said: "When a gift is given to someone who is a close relative, it is not to be taken back."
عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا كَانَتِ الْهِبَةُ لِذِي رَحِمٍ مُحَرَّمٍ لَمْ يَرْجِعْ فِيهَا»
[Machine] When the Messenger of Allah ﷺ wanted to expel the Banu Nadir, they said, "O Messenger of Allah, you have ordered us to leave and we have debts to the people that have not yet been settled." He said, "Leave and hurry."
لَمَّا أَرَادَ رَسُولُ اللَّهِ ﷺ أَنْ يُخْرِجَ بَنِي النَّضِيرِ قَالُوا يَا رَسُولَ اللَّهِ إِنَّكَ أَمَرْتَ بِإِخْرَاجِنَا وَلَنَا عَلَى النَّاسِ دُيُونٌ لَمْ تَحِلَّ قَالَ «ضَعُوا وَتَعَجَّلُوا»
[Machine] The Messenger of Allah ﷺ said, "Makkah is a sanctuary that cannot be sold or rented out, and its houses cannot be leased."
قَالَ رَسُولُ اللَّهِ ﷺ «مَكَّةُ مُنَاخٌ لَا تُبَاعُ رِبَاعُهَا وَلَا تُؤَاجَرُ بُيُوتُهَا»
[Machine] The Prophet ﷺ said, "Makkah is sacred, and its inhabitants’ properties are sacred, and the rewards of performing good deeds in its houses are also sacred." It is confirmed in narrations that the Messenger of Allah ﷺ entered Makkah in a state of peace, so from there, Abdullah ibn Abi Ziyad became a slave of Allah.
قَالَ النَّبِيُّ ﷺ «مَكَّةُ حَرَامٌ وَحَرَامٌ بَيْعُ رِبَاعِهَا وَحَرَامٌ أَجْرُ بُيُوتِهَا» قَدْ صَحَّتِ الرِّوَايَاتُ أَنَّ رَسُولَ اللَّهِ ﷺ دَخَلَ مَكَّةَ صُلْحًا فَمِنْهَاعبيد الله بن أبي زياد لين
[Machine] That the messenger of Allah, peace be upon him, when he set out to conquer Makkah, said to Abu Huraira, "Cheer for the Ansar." So he said, "O Ansar, respond to the messenger of Allah, peace be upon him." So they came as if they were on a meeting. Then he said, "Take this path, and no one should come near you except that you guarantee his safety." So the messenger of Allah, peace be upon him, set out and Allah granted him victory. The messenger of Allah, peace be upon him, then circumambulated the Kaaba and prayed two Rak'ahs, then he went out through the gate near Safa and climbed on Safa. He addressed the people while the Ansar were below him. The Ansar said to one another, "The man has been taken by mercy towards his people and his desire to return to his city." Allah sent revelation regarding what the Ansar said, and the messenger of Allah, peace be upon him, said, "O Ansar, you say that the man has been taken by mercy towards his people and his desire to return to his city." He said, "Who am I then? By Allah, I am certainly the slave of Allah and His messenger. The life of you is my life, and your death is my death." They said, "By Allah, O messenger of Allah, we did not say that except out of fear that they may attack us." He said, "You are truthful in the sight of Allah and His messenger." He said, "By Allah, there is none among them except that we have slaughtered them with tears." And this is from Sahih Bukhari.
أَنَّ رَسُولَ اللَّهِ ﷺ حِينَ سَارَ إِلَى مَكَّةَ لِيَفْتَحَهَا قَالَ لِأَبِي هُرَيْرَةَ «اهْتِفْ بِالْأَنْصَارِ» فَقَالَ يَا مَعْشَرَ الْأَنْصَارِ أَجِيبُوا رَسُولَ اللَّهِ ﷺ فَجَاءُوا كَأَنَّمَا كَانُوا عَلَى مِيعَادٍ ثُمَّ قَالَ اسْلُكُوا هَذِهِ الطَّرِيقَ وَلَا يَشْرُفَنَّ لَكُمْ أَحَدٌ إِلَّا أَمَّنْتُمُوهُ فَسَارَ رَسُولُ اللَّهِ ﷺ فَفَتَحَهَا اللَّهُ عَلَيْهِ فَطَافَ رَسُولُ اللَّهِ ﷺ بِالْبَيْتِ فَصَلَّى رَكْعَتَيْنِ ثُمَّ خَرَجَ مِنَ الْبَابِ الَّذِي يَلِي الصَّفَا فَصَعِدَ الصَّفَا فَخَطَبَ النَّاسَ وَالْأَنْصَارُ أَسْفَلَ مِنْهُ فَقَالَتِ الْأَنْصَارُ بَعْضُهُمْ لِبَعْضٍ أَمَّا الرَّجُلُ فَأَخَذَتْهُ الرَّأْفَةُ بِقَوْمِهِ وَالرَّغْبَةُ فِي قَرْيَتِهِ وَأَنْزَلَ اللَّهُ الْوَحْيَ بِمَا قَالَتِ الْأَنْصَارُ فَقَالَ «يَا مَعْشَرَ الْأَنْصَارِ تَقُولُونَ أَمَّا الرَّجُلُ فَقَدْ أَخَذَتْهُ الرَّأْفَةُ بِقَوْمِهِ وَالرَّغْبَةُ فِي قَرْيَتِهِ» قَالَ «فَمَنْ أَنَا إِذًا كَلَّا وَاللَّهِ إِنِّي عَبْدُ اللَّهِ وَرَسُولُهُ حَقًّا فَالْمَحْيَا مَحْيَاكُمْ وَالْمَمَاتُ مَمَاتُكُمْ» قَالُوا وَاللَّهِ يَا رَسُولَ اللَّهِ مَا قُلْنَا ذَلِكَ إِلَّا مَخَافَةَ أَنْ يُعَادُونَا قَالَ «أَنْتُمْ صَادِقُونَ عِنْدَ اللَّهِ وَعِنْدَ رَسُولِهِ» قَالَ «فَوَاللَّهِ مَا مِنْهُمْ أَحَدٌ إِلَّا بَلَّ نَحْرَهُ بِالدُّمُوعِ» وَمِنْهَاصحيح
[Machine] On the day of the conquest of Mecca, the Messenger of Allah ﷺ granted security to all except for four men and two women. He said, "Kill them even if you find them clinging to the curtains of the Kaaba." The four men were Ikrimah ibn Abi Jahl, Abdallah ibn Khatal, Maqis ibn Subabah, and Abdallah ibn Sa'd ibn Abi Sarh.
لَمَّا كَانَ يَوْمُ فَتْحِ مَكَّةَ أَمَّنَ رَسُولُ اللَّهِ ﷺ النَّاسَ إِلَّا أَرْبَعَةَ نَفَرٍ وَامْرَأَتَيْنِ وَقَالَ «اقْتُلُوهُمْ وَإِنْ وَجَدْتُمُوهُمْ مُتَعَلِّقِينَ بِأَسْتَارِ الْكَعْبَةِ عِكْرِمَةُ بْنُ أَبِي جَهْلٍ وَعَبْدُ اللَّهِ بْنُ خَطَلٍ وَمَقِيسُ بْنُ صُبَابَةَ وَعَبْدُ اللَّهِ بْنُ سَعْدِ بْنِ أَبِي سَرْحٍ» صحيح
[Machine] He is called a thief, so I asked him, "What is this name?" He said, "It is a name given to me by the Messenger of Allah ﷺ, and I will not abandon it." I asked him, "Why did he name you like that?" He said, "I came to the city and informed them that the slaves had sold me and consumed their wealth. So they brought me to the Prophet ﷺ and he said, 'You are a thief.' He sold me for four female camels and asked the wealthy people who bought me, 'What will you do with him?' They said, 'We will set him free.' He said, 'Then we are not more righteous than you in the Hereafter.' So they set me free among them, and my name remained."
يُقَالُ لَهُ سَرَّقٌ فَقُلْتُ لَهُ مَا هَذَا الِاسْمُ؟ قَالَ اسْمٌ سَمَّانِيهِ رَسُولُ اللَّهِ ﷺ وَلَنْ أَدَعَهُ قُلْتُ وَلِمَ سَمَّاكَ؟ قَالَ قَدِمْتُ الْمَدِينَةَ فَأَخْبَرْتُهُمْ أَنَّ مَوَالِيَّ بَاعُونِي وَاسْتَهْلَكْتُ أَمْوَالَهُمْ فَأَتَوْا بِي النَّبِيَّ ﷺ فَقَالَ «أَنْتَ سَرَّقٌ» وَبَاعَنِي بِأَرْبَعِ أَبْعِرَةٍ فَقَالَ لِلْغُرَمَاءِ الَّذِينَ اشْتَرُونِي «مَا تَصْنَعُونَ بِهِ؟» قَالُوا نُعْتِقُهُ قَالُوا فَلَسْنَا بِأَزْهَدَ فِي الْآخِرَةِ مِنْكُمْ فَأَعْتَقُونِي بَيْنَهُمْ وَبَقِيَ اسْمِي
[Machine] The Prophet ﷺ received some captured prisoners, and he instructed me to sell two of them. So I sold them and separated them from each other. Then I went to the Prophet ﷺ and informed him, and he said, "Find them and bring them back, and sell them together, and do not separate them."
قَدِمَ النَّبِيَّ ﷺ سَبْيٌ فَأَمَرَنِي بِبَيْعِ أَخَوَيْنِ فَبِعْتُهُمَا وَفَرَّقْتُ بَيْنَهُمَا ثُمَّ أَتَيْتُ النَّبِيَّ ﷺ فَأَخْبَرْتُهُ فَقَالَ «أَدْرِكْهُمَا فَارْتَجِعْهُمَا وَبِعْهُمَا جَمِيعًا وَلَا تُفَرِّقْ بَيْنَهُمَا»
[Machine] "He sold a female slave and her child, and separated between them, so the Messenger of Allah ﷺ prohibited him from doing so." This is another narration with an authentic chain of narration.
أَنَّهُ «بَاعَ جَارِيَةً وَوَلَدَهَا فَفَرَّقَ بَيْنَهُمَا فَنَهَاهُ رَسُولُ اللَّهِ ﷺ عَنْ ذَلِكَ» هَذَا مَتْنٌ آخَرُ بِإِسْنَادٍ صَحِيحٍ صحيح
[Machine] The Messenger of Allah ﷺ said, "Cursed is the one who causes division." This is a authentic narration and they did not mention its narrator. Its explanation is mentioned in the hadith of Abu Ayyub Al-Ansari, which is authentic.
قَالَ رَسُولُ اللَّهِ ﷺ «مَلْعُونٌ مَنْ فَرَّقَ» هَذَا إِسْنَادٌ صَحِيحٌ وَلَمْ يُخَرِّجَاهُ وَتَفْسِيرُهُ فِي حَدِيثِ أَبِي أَيُّوبَ الْأَنْصَارِيِّ الَّذِي صحيح
"I narrated heard the Messenger of Allah ﷺ saying: 'Whoever seperates a mother from her child, Allah seperates him and his most beloved on the Day of Judgement.'" (Using translation from Tirmidhī 1283)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ فَرَّقَ بَيْنَ وَالِدَةٍ وَوَلَدِهَا فَرَّقَ اللَّهُ بَيْنَهُ وَبَيْنَ أَحِبَّتِهِ يَوْمَ الْقِيَامَةِ»
[Machine] He heard Ubada ibn as-Samit saying: The Messenger of Allah ﷺ forbade separating a mother from her child. It was said, "O Messenger of Allah, until when?" He said: "Until the boy reaches puberty and the girl attains menstruation."
أَنَّهُ سَمِعَ عُبَادَةَ بْنَ الصَّامِتِ يَقُولُ نَهَى رَسُولُ اللَّهِ ﷺ أَنْ يُفَرَّقَ بَيْنَ الْأُمِّ وَوَلَدِهَا فَقِيلَ يَا رَسُولَ اللَّهِ إِلَى مَتَى؟ قَالَ «حَتَّى يَبْلُغَ الْغُلَامُ وَتَحِيضَ الْجَارِيَةُ»
[Machine] "He said that the Messenger of Allah ﷺ prohibited the sale of spoils of war until they are distributed, and he prohibited the trampling of women slaves until they have been determined of what is in their bellies, and he said, 'Do not irrigate the crops of others,' and he prohibited the consumption of the meat of domestic donkeys, and the meat of every predatory animal with fangs."
أَنَّهُ قَالَ نَهَى رَسُولُ اللَّهِ ﷺ يَوْمَ خَيْبَرَ عَنْ بَيْعِ الْغَنَائِمِ حَتَّى تُقْسَمَ وَعَنِ الْحَبَالَى أَنْ يُوطَأْنَ حَتَّى يَضَعْنَ مَا فِي بُطُونِهِنَّ وَقَالَ «لَا تَسْقِ زَرْعَ غَيْرِكَ وَعَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ وَعَنْ لَحْمِ كُلِّ ذِي نَابٍ مِنَ السِّبَاعِ»
That Allah's Prophet ﷺ said: "Whoever has a partner in an orchard, then he is not to sell his share of that until he proposes that to his partner." (Using translation from Tirmidhī 1312)
أَنَّ النَّبِيَّ ﷺ قَالَ «مَنْ كَانَ لَهُ شَرِيكٌ فِي حَائِطٍ فَلَا يَبِعْ نَصِيبَهُ مِنْ ذَلِكَ حَتَّى يَعْرِضَهُ عَلَى شَرِيكِهِ» صحيح
That the Messenger of Allah ﷺ said: "Indeed Allah loves tolerance in selling, tolerance in buying, and tolerance in repaying." He said: There is something on this topic from Jabir. (Using translation from Tirmidhī 1319)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «إِنَّ اللَّهَ يُحِبُّ سَمْحَ الْبَيْعِ سَمْحَ الشِّرَاءِ سَمْحَ الْقَضَاءِ»
That the Messenger of Allah ﷺ said: "When you see someone selling or buying in the Masjid then say: 'May Allah not profit your business.' And when you see someone announcing about something lost then say: 'May Allah not return it to you.'" The Hadith of Abu Hurairah is Hasan Gharib. This is acted upon according to some of the people of knowledge. They dislike selling and buying in the Masjid. This is the view of Ahmad and Ishaq. Some of the people of knowledge permitted selling and buying in the Masjid. (Using translation from Tirmidhī 1321)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ إِذَا رَأَيْتُمْ مَنْ يَبِيعُ أَوْ يَبْتَاعُ فِي الْمَسْجِدِ فَقُولُوا لَا أَرْبَحَ اللَّهُ تِجَارَتَكَ وَإِذَا رَأَيْتُمْ مَنْ يَنْشُدُ ضَالَّةً فِيهِ فَقُولُوا لَا رَدَّ اللَّهُ عَلَيْكَ
The Messenger of Allah ﷺ commanded him to equip an army, but the camels were insufficient. So he commanded him to keep back the young camels of sadaqah, and he was taking a camel to be replaced by two when the camels of sadaqah came. (Using translation from Abū Dāʾūd 3357)
أَنَّ رَسُولَ اللَّهِ ﷺ أَمَرَهُ أَنْ يُجَهِّزَ جَيْشًا فَنَفَدَتِ الْإِبِلُ «فَأَمَرَنِي رَسُولُ اللَّهِ ﷺ أَنْ آخُذَ مِنْ قَلَائِصِ الصَّدَقَةِ فَكُنْتُ آخُذُ الْبَعِيرَ بِالْبَعِيرَيْنِ»
that the Messenger of Allah ﷺ prohibited ˹doing˺ "sadal" (wrapping garments around oneself and having arms tucked inside during prayer). (Using translation from Aḥmad 8582)
أَنَّ رَسُولَ اللَّهِ ﷺ «نَهَى عَنِ السَّلَفِ فِي الْحَيَوَانِ»
[Machine] That the Prophet ﷺ forbade selling sick animals with sick animals.
أَنَّ النَّبِيَّ ﷺ «نَهَى عَنْ بَيْعِ الْكَالِئِ بِالْكَالِئِ»
[Machine] On the authority of the Prophet Muhammad ﷺ , he forbade the exchange of harmful things with harmful things.
عَنِ النَّبِيِّ ﷺ أَنَّهُ «نَهَى عَنْ بَيْعِ الْكَالِئِ بِالْكَالِئِ هُوَ النَّسِيئَةُ بِالنَّسِيئَةِ» ذؤيب واه
[Machine] "The messenger of Allah ﷺ prohibited quarreling, arguing, and turning away." Professor Abu Al-Walid said that nothing from it should be sold until it turns red or yellow."
«نَهَى رَسُولُ اللَّهِ ﷺ عَنِ الْمُحَاقَلَةِ وَالْمُخَاضَرَةِ وَالْمُنَابَذَةِ» قَالَ الْأُسْتَاذُ أَبُو الْوَلِيدِ الْمُخَاضَرَةُ أَنْ لَا يُبَاعَ شَيْءٌ مِنْهَا حَتَّى يَحْمَرَّ أَوْ يَصْفَرَّ
“Whoever harms others, Allah (SWT) will harm him; and whoever causes hardship to other Allah will cause hardship to him.” (Using translation from Ibn Mājah 2342)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا ضَرَرَ وَلَا ضِرَارَ مَنْ ضَارَّ ضَارَّهُ اللَّهُ وَمَنْ شَاقَّ شَاقَّ اللَّهُ عَلَيْهِ»
[Machine] "A man died, so we washed him, shrouded him, perfumed him, and placed him before the Messenger of Allah ﷺ , where the deceased are placed near the station of Gabriel. Then we sought permission from the Messenger of Allah ﷺ to offer the funeral prayer for him. He joined us, taking steps with us, and then he said: 'Is your companion in debt?' They replied: 'Yes, two dinars.' So he fell behind and a man among us, known as Abu Qatadah, said: 'O Messenger of Allah, I will take care of it.' Then the Messenger of Allah ﷺ said: 'They are upon you and in your possession, and the deceased is absolved of them.' He prayed for him and when the Messenger of Allah ﷺ met Abu Qatadah, he would say: 'What have you done with the two dinars?' This continued until the last time, and Abu Qatadah said: 'I have settled them, O Messenger of Allah.' He ﷺ said: 'Now, when his skin has cooled down.'"
مَاتَ رَجُلٌ فَغَسَّلْنَاهُ وَكَفَّنَّاهُ وَحَنَّطْنَاهُ وَوَضَعْنَاهُ لِرَسُولِ اللَّهِ ﷺ حَيْثُ تُوضَعُ الْجَنَائِزُ عِنْدَ مَقَامِ جِبْرِيلَ ثُمَّ آذَنَّا رَسُولَ اللَّهِ ﷺ بِالصَّلَاةِ عَلَيْهِ فَجَاءَ مَعَنَا خُطًى ثُمَّ قَالَ «لَعَلَّ عَلَى صَاحِبِكُمْ دَيْنًا؟» قَالُوا نَعَمْ دِينَارَانِ فَتَخَلَّفَ فَقَالَ لَهُ رَجُلٌ مِنَّا يُقَالُ لَهُ أَبُو قَتَادَةَ يَا رَسُولَ اللَّهِ هُمَا عَلَيَّ فَجَعَلَ رَسُولُ اللَّهِ ﷺ يَقُولُ «هُمَا عَلَيْكَ وَفِي مَالِكَ وَالْمَيِّتُ مِنْهُمَا بَرِيءٌ» فَقَالَ نَعَمْ فَصَلَّى عَلَيْهِ فَجَعَلَ رَسُولُ اللَّهِ ﷺ إِذَا لَقِيَ أَبَا قَتَادَةَ يَقُولُ «مَا صَنَعَتِ الدِّينَارَانِ؟» حَتَّى كَانَ آخِرَ ذَلِكَ قَالَ قَدْ قَضَيْتُهُمَا يَا رَسُولَ اللَّهِ قَالَ «الْآنَ حِينَ بَرَدَتْ عَلَيْهِ جِلْدُهُ»
[Machine] The Prophet ﷺ said, "A pledge is both taken and given." Al-A'mash said, "I mentioned this to Ibrahim, but he disliked benefiting from it." This is a reliable narration according to the condition of the two sheikhs (Al-Bukhari and Muslim), and it was not rejected by Ath-Thawri and Shu'bah. I affirm its authenticity in accepting the increase of trust according to the condition of Al-Bukhari and Muslim.
عَنِ النَّبِيِّ ﷺ قَالَ «الرَّهْنُ مَحْلُوبٌ وَمَرْكُوبٌ» قَالَ الْأَعْمَشُ فَذَكَرْتُ ذَلِكَ لِإِبْرَاهِيمَ فَكَرِهَ أَنْ يَنْتَفِعَ بِشَيْءٍ مِنْهُ «هَذَا إِسْنَادٌ صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ» وَلَمْ يُخَرِّجَاهُ لِإِجْمَاعِ الثَّوْرِيِّ وَشُعْبَةَ عَلَى تَوْقِيفِهِ عَنِ الْأَعْمَشِ وَأَنَا عَلَى أَصْلِي أَصَّلْتُهُ فِي قَبُولِ الزِّيَادَةِ مِنَ الثِّقَةِعلى شرط البخاري ومسلم
[Machine] The Prophet ﷺ cursed the one who withholds his wealth from Mu'adh and sells it for a debt against him.
أَنَّ رَسُولَ اللَّهِ ﷺ «حَجَرَ عَلَى مُعَاذٍ مَالَهُ وَبَاعَهُ فِي دَيْنٍ عَلَيْهِ»
[Machine] That the Messenger of Allah ﷺ considered the following individuals to be the least significant on the Day of Uhud: Zaid bin Harithah, Bara bin Azib, Zaid bin Arqam, Saad, Abu Sa'id Al-Khudri, Abdullah bin Umar, and Jabir bin Abdullah.
أَنَّ رَسُولَ اللَّهِ ﷺ «اسْتَصْغَرَ نَاسًا يَوْمَ أُحُدٍ مِنْهُمْ زَيْدُ بْنُ حَارِثَةَ يَعْنِي نَفْسَهُ وَالْبَرَاءُ بْنُ عَازِبٍ وَزَيْدُ بْنُ أَرْقَمَ وَسَعْدٌ وَأَبُو سَعِيدٍ الْخُدْرِيُّ وَعَبْدُ اللَّهِ بْنُ عُمَرَ وَذَكَرَ جَابِرَ بْنَ عَبْدِ اللَّهِ»
[Machine] The Prophet ﷺ said, "The pen has been lifted from three: the child until he reaches puberty, the insane person until he regains his sanity, and the sleeper until he wakes up."
عَنِ النَّبِيِّ ﷺ قَالَ «رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةَ؛ الصَّبِيِّ حَتَّى يَحْتَلِمَ وَعَنِ الْمَعْتُوهِ حَتَّى يُفِيقَ وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ»
[Machine] And he said to Umar, "O Commander of the believers, did you order the stoning of this person?" Umar replied, "Yes." He said, "Don't you remember that the Messenger of Allah ﷺ said, 'The pen has been lifted from three: the insane person until he comes to his senses, the sleeper until he wakes up, and the child until he reaches puberty.'" Umar said, "You are correct," and he decided not to carry out the punishment. Abu Abdullah said, "Regarding stoning the insane man or woman, there is a difference of opinion among the scholars that I am not knowledgeable about."
وَقَالَ لِعُمَرَ يَا أَمِيرَ الْمُؤْمِنِينَ أَمَرْتَ بِرَجْمِ هَذِهِ؟ قَالَ نَعَمْ قَالَ أَمَا تَذْكُرُ أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ رُفِعَ الْقَلَمُ عَنْ ثَلَاثٍ عَنِ الْمَجْنُونِ الْمَغْلُوبِ عَلَى عَقْلِهِ وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ قَالَ صَدَقْتَ فَخَلَّى عَنْهَا قَالَ أَبُو عَبْدِ اللَّهِ «بِالْحَجْرِ عَلَى الْمَجْنُونِ وَالْمَجْنُونَةِ مِمَّا لَا أَعْلَمُ فِيهِ خِلَافًا بَيْنَ الْعُلَمَاءِ»
"This Verse 'And making peace is better.' was revealed concerning a man who had been married to a woman for a long time, and she had given birth to his children and he wanted to exchange her (for a new wife). She agreed that he would stay with her (the new wife) and would not give her (the first wife) a share of his time. (i.e.) not spend the nights with her)." (Using translation from Ibn Mājah 1974)
نَزَلَتْ هَذِهِ الْآيَةُ {وَالصُّلْحُ خَيْرٌ} [النساء 128] فِي رَجُلٍ كَانَتْ تَحْتَهُ امْرَأَةٌ قَدْ طَالَتْ صُحْبَتُهَا وَوَلَدَتْ مِنْهُ أَوْلَادًا فَأَرَادَ أَنْ يَسْتَبْدِلَ بِهَا فَرَاضَتْهُ عَلَى أَنْ تَقَرَّ عِنْدَهُ وَلَا يَقْسِمَ لَهَا
[Machine] That Sauda (the Prophet's wife) made her day for Aisha, and I suppose that this verse was revealed concerning her: "And if a woman fears from her husband contempt or evasion." [Quran 4:128]
أَنَّ سَوْدَةَ جَعَلَتْ يَوْمَهَا لِعَائِشَةَ وَأَحْسِبُ فِي ذَلِكَ نَزَلَتْ {وَإِنِ امْرَأَةٌ خَافَتْ مِنْ بَعْلِهَا نُشُوزًا أَوْ إِعْرَاضًا} [النساء 128]
[Machine] "The truce between the Prophet ﷺ and the people of Makkah in Hudaybiyah lasted for four years."
كَانَتِ «الْهُدْنَةُ بَيْنَ النَّبِيِّ ﷺ وَبَيْنَ أَهْلِ مَكَّةَ بِالْحُدَيْبِيَةِ أَرْبَعَ سِنِينَ»
[Machine] I heard the Messenger of Allah ﷺ say, "I am the leader and the leader is the protector for those who believe in me, embrace Islam, and migrate for the sake of a house in the gardens of Paradise."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «أَنَا زَعِيمٌ وَالزَّعِيمُ الْحَمِيلُ لِمَنْ آمَنَ بِي وَأَسْلَمَ وَهَاجَرَ بِبَيْتٍ فِي رَبَضِ الْجَنَّةِ»
[Machine] My mother lost her father and came to the city, and the people proposed to her. She said, "I will not marry except to a man who takes care of this orphan for me." So a man from the Ansar married her. The Messenger of Allah ﷺ used to present the young men of the Ansar every year, and he would marry off those who reached the age of marriage. So I was presented one year, and a young man married me, and then divorced me. I said, "O Messenger of Allah, you have married me off, and he divorced me." He said, "Marry him." So I married him, and I prevailed over him.
أُيِّمَتْ أُمِّي وَقَدِمَتِ الْمَدِينَةَ فَخَطَبَهَا النَّاسُ فَقَالَتْ لَا أَتَزَوَّجُ إِلَّا بِرَجُلٍ يَكْفُلُ لِي هَذَا الْيَتِيمَ فَتَزَوَّجَهَا رَجُلٌ مِنَ الْأَنْصَارِ قَالَ فَكَانَ رَسُولُ اللَّهِ ﷺ «يَعْرِضُ غِلْمَانَ الْأَنْصَارِ فِي كُلِّ عَامٍ فَيُلْحِقُ مَنْ أَدْرَكَ مِنْهُمْ» قَالَ فَعُرِضْتُ عَامًا فَأَلْحَقَ غُلَامًا وَرَدَّنِي فَقُلْتُ يَا رَسُولَ اللَّهِ لَقَدْ أَلْحَقْتَهُ وَرَدَدْتَنِي وَلَوْ صَارَعْتُهُ لَصَرَعْتُهُ قَالَ «فَصَارِعْهُ» فَصَارَعْتُهُ فَصَرَعْتُهُ فَأَلْحَقَنِي
[Machine] He was the Prophet's partner in trade at the beginning of Islam. When the day of victory came, he said, "Welcome to my brother and partner, who does not deceive or disappoint." And he mentioned the rest of the speech.
أَنَّهُ كَانَ شَرِيكَ النَّبِيِّ ﷺ فِي أَوَّلِ الْإِسْلَامِ فِي التِّجَارَةِ فَلَمَّا كَانَ يَوْمُ الْفَتْحِ قَالَ «مَرْحَبًا بِأَخِي وَشَرِيكِي لَا يُدَارِي وَلَا يُمَارِي» وَذَكَرَ بَاقِي الْحَدِيثِ
[Machine] Translation: The Messenger of Allah, peace be upon him, protected Al-Baqi' and said, "There is no sanctity except for Allah and His Messenger." They both agreed on the hadith of Yunus from Az-Zuhri through its chain of narrators: "There is no sanctity except for Allah and His Messenger." They did not exclude it from it, and it is authentic in its chain of narration according to the conditions of Bukhari and Muslim. And they narrated it until its end.
أَنَّ رَسُولَ اللَّهِ ﷺ حَمَى الْبَقِيعَ وَقَالَ «لَا حِمَى إِلَّا لِلَّهِ وَلِرَسُولِهِ» قَدِ اتَّفَقَا عَلَى حَدِيثِ يُونُسَ عَنِ الزُّهْرِيِّ بِإِسْنَادِهِ «لَا حِمَى إِلَّا لِلَّهِ وَلِرَسُولِهِ» وَلَمْ يُخَرِّجَاهُ هَكَذَا وَهُوَ صَحِيحُ الْإِسْنَادِ على شرط البخاري ومسلم وأخرجا منه آخره
the Messenger of Allah forbade selling water. (Using translation from Nasāʾī 4660)
أَنَّ رَسُولَ اللَّهِ ﷺ «نَهَى عَنْ بَيْعِ الْمَاءِ»
أَنَّ النَّبِيَّ ﷺ «نَهَى عَنْ بَيْعِ فَضْلِ الْمَاءِ»
[Machine] About the Prophet ﷺ , he said, "The sharing of a well does not prevent drinking from it." Abdur-Rahman said, "I heard my father saying that sharing means a well owned by multiple people where the water is distributed among them, and everyone benefits from it without preventing others from their fair share."
عَنِ النَّبِيِّ ﷺ «لَا يُمْنَعُ نَقْعُ الْبِئْرِ وَهُوَ الرَّهْوُ» قَالَ عَبْدُ الرَّحْمَنِ سَمِعْتُ أَبِيَ يَقُولُ إِنَّ الرَّهْوَ أَنْ تَكُونَ الْبِئْرُ بَيْنَ شُرَكَاءَ فِيهَا الْمَاءُ فَيَكُونَ لِلرَّجُلِ فِيهَا فَضْلٌ فَلَا يَمْنَعُ صَاحِبَهُ
[Machine] The Prophet of Allah ﷺ said, "It is decreed for one steeped in sin and transgression that the Most High sends calamities upon him and restrains his provisions like the distance of two heels."
أَنَّ رَسُولَ اللَّهِ ﷺ «قَضَى فِي سَيْلِ مَهْزُورٍ وَمُذْنِبٍ أَنَّ الْأَعْلَىَ يُرْسِلُ إِلَى الْأَسْفَلِ وَيَحْبِسُ قَدْرَ كَعْبَيْنِ»
[Machine] I heard the Prophet ﷺ saying, "Whoever receives a good deed about his brother without asking for it or supervising himself, he should accept it and not reject it. Indeed, it is a provision that Allah has bestowed upon him."
سَمِعْتُ النَّبِيَّ ﷺ يَقُولُ «مَنْ بَلَغَهُ مَعْرُوفٌ عَنْ أَخِيهِ مِنْ غَيْرِ مَسْأَلَةٍ وَلَا إِشْرَافِ نَفْسٍ فَلْيَقْبَلْهُ وَلَا يَرُدَّهُ فَإِنَّمَا هُوَ رِزْقٌ سَاقَهُ اللَّهُ إِلَيْهِ»
[Machine] The translation of the given sentence is:
The Messenger of Allah ﷺ said, "Do not persist in asking for something, for by Allah, nobody asks me for anything and I give it to him from myself, even though I dislike it, but he will be blessed in what I give him."
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا تُلْحِفُوا فِي الْمَسْأَلَةِ فَوَاللَّهِ لَا يَسْأَلُنِي أَحَدٌ مِنْكُمْ شَيْئًا فَتُخْرِجُهُ لَهُ مِنِّي الْمَسْأَلَةُ فَأُعْطِيهِ إِيَّاهُ وَأَنَا كَارِهٌ فَيُبَارَكُ لَهُ فِي الَّذِي أُعْطِيهِ»
[Machine] A man gifted the Messenger of Allah ﷺ with a female camel, and in return, the Messenger rewarded him with six young camels. However, the man became angry and said, "O Messenger of Allah, who will excuse me from this camel? It was as if I saw her in the face of one of her people, so I stood firm and refused to accept any gift except from a Qurayshi, an Ansari, a Thaqafi, or a Dausi."
أَنَّ رَجُلًا أَهْدَى رَسُولَ اللَّهِ ﷺ لِقْحَةً فَأَثَابَهُ مِنْهَا بِسِتِّ بَكَرَاتٍ فَتَسَخَّطَهَا الرَّجُلُ فَقَالَ رَسُولُ اللَّهِ ﷺ «مَنْ يَعْذِرُنِي مِنْ فُلَانٍ أَهْدَى إِلَيَّ لِقْحَةً فَكَأَنِّي أَنْظُرُ إِلَيْهَا فِي وَجْهِ بَعْضِ أَهْلِهِ فَأَثِبْتُهُ مِنْهُ بِسِتِّ بَكَرَاتٍ فَتَسَخَّطَهَا لَقَدْ هَمَمْتُ أَنْ لَا أَقْبَلَ هَدِيَّةً إِلَّا أَنْ تَكُونَ مِنْ قُرَيْشِيٍّ أَوْ أَنْصَارِيٍّ أَوْ ثَقَفِيٍّ أَوْ دَوْسِيٍّ»
[Machine] My family sent me with a gift of milk to the Messenger of Allah ﷺ . When I presented it to him, he told me, "Milk it and leave the one who calls for the milk." Al-Dhahabi did not mention it in his summary.
بَعَثَنِي أَهْلِي بِلَقُوحٍ إِلَى رَسُولِ اللَّهِ ﷺ أَهْدَوْهَا لَهُ فَقَالَ لِي «احْلُبْهَا وَدَعْ دَاعِيَ اللَّبَنِ» سكت عنه الذهبي في التلخيص
[Machine] Abu narrated to me that Umm Khalid bint Khalid said, "The Prophet ﷺ was brought garments with a small black shirt in them. He asked, 'Who would dress this?' The people remained silent, so the Messenger of Allah ﷺ said, 'Bring Umm Khalid to me.' She was then brought to him, and he dressed me with it using his own hands while saying, 'Adorn yourself and be beautiful.' He said this twice while looking at a mark on the shirt that had yellow and red colors, and he said, 'O Umm Khalid, this is good fortune in the tongue of Abyssinia.'"
ثنا أَبِي حَدَّثَتْنِي أُمُّ خَالِدِ بِنْتُ خَالِدٍ قَالَتْ أُتِيَ النَّبِيُّ ﷺ بِثِيَابٍ فِيهَا خَمِيصَةٌ سَوْدَاءُ صَغِيرَةٌ فَقَالَ «مَنْ تَرَوْنَ أَكْسُو هَذِهِ؟» فَسَكَتَ الْقَوْمُ فَقَالَ رَسُولُ اللَّهِ ﷺ «إِيْتُونِي بِأُمِّ خَالِدٍ» قَالَتْ فَأَتَى بِي فَأَلْبَسَنِيهَا بِيَدِهِ وَقَالَ «أَبْلِي وَأَخْلِقِي» يَقُولُهَا مَرَّتَيْنِ وَجَعَلَ يَنْظُرُ إِلَى عَلَمٍ فِي الْخَمِيصَةِ أَصْفَرَ وَأَحْمَرَ وَيَقُولُ «يَا أُمَّ خَالِدٍ هَذَا سَنَا سَنَا» وَالسَّنَا بِلِسَانِ الْحَبَشَةِ الْحَسَنُ
The Immigrants (Muhajirun) said: Messenger of Allah! the Helpers (Ansar) got the entire reward. He said: no, so long as you pray to Allah for them and praise them. (Using translation from Abū Dāʾūd 4812)
أَنَّ الْمُهَاجِرِينَ قَالُوا لِلنَّبِيِّ ﷺ ذَهَبَ الْأَنْصَارُ بِالْأَجْرِ كُلِّهِ قَالَ «لَا مَا دَعَوْتُمُ اللَّهَ لَهُمْ وَأَثْنَيْتُمْ»
"The Messenger of Allah said: 'Whoever seeks refuge with (the name of) Allah, grant him refuge; whoever asks of you in (the name of) Allah, give him; whoever seeks protection with (the name of Allah, give him protection. Whoever does you a favor, then reciprocate, and if you cannot, then supplicate for him until you think that you have repaid him."' (Using translation from Nasāʾī 2567)
أَنَّ النَّبِيَّ ﷺ قَالَ «مَنْ سَأَلَكُمْ بِاللَّهِ فَأَعْطُوهُ وَمَنِ اسْتَعَاذَكُمْ بِاللَّهِ فَأَعِيذُوهُ وَمَنْ آتَى إِلَيْكُمْ مَعْرُوفًا فَكَافِئُوهُ فَإِنْ لَمْ تَجِدُوا فَادْعُوا لَهُ حَتَّى تَعْلَمُوا أَنَّكُمْ كَافَيْتُمُوهُ وَمَنِ اسْتَجَارَكُمْ بِاللَّهِ فَأَجِيرُوهُ»
[Machine] A man came to the Prophet (SAW) with a donkey while he was walking. The Prophet (SAW) said, "Ride on it O Messenger of Allah." The man replied, "The owner of the animal has more right to ride on its back, unless you give it to me." The Prophet (SAW) said, "I have given it to you."
أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ بِحِمَارٍ وَهُوَ يَمْشِي فَقَالَ ارْكَبْ يَا رَسُولَ اللَّهِ فَقَالَ «إِنَّ صَاحِبَ الدَّابَّةِ أَحَقُّ بِصَدْرِ دَابَّتِهِ إِلَّا أَنْ تَجْعَلَهُ لِي» قَالَ قَدْ فَعَلْتُ
