١٦۔ كِتَابُ الْبُيُوعِ ص ١
[Machine] The Messenger of Allah ﷺ passed by a dish of food and put his hand into it. His fingers became wet, so he said, "What is this, O owner of the food?" The food's owner said, "It has been rained on, O Messenger of Allah." The Prophet ﷺ replied, "So why didn't you put it on top of the food so that people could see it?" Then he said, "Whoever deceives us is not one of us." Muslim has also reported a hadith from Suhayl, from his father, from Abu Hurairah, that the Prophet ﷺ said, "Whoever deceives us is not one of us." As for the explanation of these narrations, it has not been mentioned, but all of them are authentic according to the standards of Muslim's narration.
أَنَّ رَسُولَ اللَّهِ ﷺ مَرَّ عَلَى صَبِرَةٍ مِنْ طَعَامٍ فَأَدْخَلَ يَدَهُ فِيهِ فَنَالَتْ أَصَابِعُهُ بَلَلًا فَقَالَ «مَا هَذَا يَا صَاحِبَ الطَّعَامِ؟» فَقَالَ أَصَابَتْهُ السَّمَاءُ يَا رَسُولَ اللَّهِ قَالَ أَفَلَا جَعَلْتَهُ فَوْقَ الطَّعَامِ حَتَّى يَرَاهُ النَّاسُ ثُمَّ قَالَ «مَنْ غَشَّنَا فَلَيْسَ مِنِّي» وَقَدْ أَخْرَجَ مُسْلِمٌ حَدِيثَ سُهَيْلٍ عَنْ أَبِيهِ عَنْ أَبِي هُرَيْرَةَ أَنَّ النَّبِيَّ ﷺ قَالَ «مَنْ غَشَّنَا فَلَيْسَ مِنَّا» وَأَمَّا شَرْحُ الْحَالِ فِي هَذِهِ الْأَحَادِيثِ فَلَمْ يُخَرِّجَاهُ وَكُلُّهَا صَحِيحَةٌ عَلَى شَرْطِ مُسْلِمٍ رواه مسلم مختصرا
[Machine] The Messenger of Allah ﷺ went out to Al-Baqi' and saw some food being sold in dirty containers. He put his hand in and took out something he disliked and said, "Whoever deceives us is not one of us."
خَرَجَ رَسُولُ اللَّهِ ﷺ إِلَى الْبَقِيعِ فَرَأَى طَعَامًا يُبَاعُ فِي غَرَائِرَ فَأَدْخَلَ يَدَهُ فَأَخْرَجَ شَيْئًا كَرِهَهُ فَقَالَ «مَنْ غَشَّنَا فَلَيْسَ مِنَّا»
[Machine] "O Abdullah, did you buy it?" I said, "Yes." He said, "Did he explain to you what is in it?" I said, "And what is in it? It is a visible fat and healthy." He said, "Did you intend to use it for travel or intended to use it for meat?" I said, "I intended to use it for Hajj." He said, "Return it." Then its owner said, "You only wanted this, may Allah rectify you. It would have caused me harm." He said, "Indeed, I heard the Messenger of Allah ﷺ saying, 'It is not permissible for anyone to sell something unless he clarifies what is in it, and it is not permissible for anyone who knows that to conceal it.'"
يَا عَبْدَ اللَّهِ اشْتَرَيْتَ؟ قُلْتُ نَعَمْ قَالَ بَيَّنَ لَكَ مَا فِيهَا؟ قُلْتُ وَمَا فِيهَا إِنَّهَا لَسَمِينَةٌ ظَاهِرَةُ الصِّحَّةِ؟ قَالَ أَرَدْتَ بِهَا سَفَرًا أَوْ أَرَدْتَ بِهَا لَحْمًا؟ قُلْتُ أَرَدْتُ بِهَا الْحَجَّ قَالَ فَارْتَجِعْهَا فَقَالَ صَاحِبُهَا مَا أَرَدْتَ إِلَّا هَذَا أَصْلَحَكَ اللَّهُ تُفْسِدُ عَلَيَّ قَالَ فَإِنِّي سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «لَا يَحِلُّ لِأَحَدٍ أَنْ يَبِيعَ شَيْئًا إِلَّا بَيَّنَ مَا فِيهِ وَلَا يَحِلُّ لِمَنْ عَلِمَ ذَلِكَ إِلَّا بَيَّنَهُ»
[Machine] The Prophet ﷺ was asked, "Which earning is the best or most excellent?" He replied, "The work of a person's own hands and every lawful transaction." Al-Dhahabi remained silent about summarizing it.
سُئِلَ رَسُولُ اللَّهِ ﷺ أَيُّ الْكَسْبِ أَطْيَبُ أَوْ أَفْضَلُ؟ قَالَ «عَمَلُ الرَّجُلِ بِيَدِهِ وَكُلُّ بَيْعٍ مَبْرُورٍ» سكت عنه الذهبي في التلخيص
[Machine] The Messenger of Allah ﷺ was asked, "Which earnings are the best?" He replied, "Earnings that are earned through lawful means."
سُئِلَ رَسُولُ اللَّهِ ﷺ أَيُّ الْكَسْبِ أَفْضَلُ؟ قَالَ «كَسْبٌ مَبْرُورٌ»
[Machine] It was asked, "O Messenger of Allah, which type of earnings is the best?" He said, "The earnings of a man through his own hand and every transaction that is free from deceit." And this is a third difference from Wail ibn Dawood, except that the two sheikhs did not exclude it from Mas'oodi, and its place is in truthfulness. Al-Dhahabi remained silent about it in his summary.
قِيلَ يَا رَسُولَ اللَّهِ أَيُّ الْكَسْبِ أَطْيَبُ؟ قَالَ «كَسْبُ الرَّجُلِ بِيَدِهِ وَكُلُّ بَيْعٍ مَبْرُورٍ» وَهَذَا خِلَافٌ ثَالِثٌ عَلَى وَائِلِ بْنِ دَاوُدَ إِلَّا أَنَّ الشَّيْخَيْنِ لَمْ يُخَرِّجَا عَنِ الْمَسْعُودِيِّ وَمَحَلُّهُ الصِّدْقِ سكت عنه الذهبي في التلخيص
[Machine] Narrated by Abdullah bin Muslima Al-Qa'nabi, narrated by Abdul Aziz bin Muhammad, on the authority of Amr bin Abi Amr, on the authority of Ikrimah, on the authority of Ibn Abbas, that a man had a dispute with his opponent for ten dinars, and he said, "By Allah, I will not let you go until you settle me or bring me a camel." The Prophet ﷺ took the responsibility and brought him the amount he had promised. The Prophet ﷺ then asked him, "Where did you get this gold from?" He replied, "From a mine." The Prophet ﷺ said, "We are not in need of it; it does not contain any goodness." So the Messenger of Allah ﷺ settled the matter on his behalf.
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مَسْلَمَةَ الْقَعْنَبِيُّ حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ عَنْ عَمْرِو بْنِ أَبِي عَمْرٍو عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ أَنَّ رَجُلًا لَزِمَ غَرِيمًا لَهُ بِعَشَرَةِ دَنَانِيرَ فَقَالَ وَاللَّهِ لَا أُفَارِقُكَ حَتَّى تَقْضِيَنِي أَوْ تَأْتِيَنِي بِحَمِيلٍ قَالَ فَتَحَمَّلَ بِهَا النَّبِيُّ ﷺ فَأَتَاهُ بِقَدْرِ مَا وَعَدَهُ فَقَالَ لَهُ النَّبِيُّ ﷺ «مِنْ أَيْنَ أَصَبْتَ هَذَا الذَّهَبَ؟» قَالَ مِنْ مَعْدِنٍ قَالَ «لَا حَاجَةَ لَنَا فِيهَا لَيْسَ فِيهَا خَيْرٌ» فَقَضَاهَا عَنْهُ رَسُولُ اللَّهِ ﷺ
[Machine] The Prophet ﷺ said, "There will come a time for people when no one will remain who has not consumed riba (usury), and if he does not consume it, its dust will reach him." Our scholars have differed in hearing from Al-Hasan through Abu Hurairah, so if his hearing from him is proven to be authentic, then...
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَيَأْتِيَنَّ عَلَى النَّاسِ زَمَانٌ لَا يَبْقَى فِيهِ أَحَدٌ إِلَّا أَكَلَ الرِّبَا فَإِنْ لَمْ يَأْكُلْهُ أَصَابَهُ مِنْ غُبَارِهِ» وَقَدِ اخْتَلَفَ أَئِمَّتُنَا فِي سَمَاعِ الْحَسَنِ عَنْ أَبِي هُرَيْرَةَ فَإِنْ صَحَّ سَمَاعُهُ مِنْهُ فَ
[Machine] "The Messenger of Allah ﷺ prohibited hoarding food." Muslim narrated a hadith from Muhammad ibn Ishaq, who narrated from Muhammad ibn Amr ibn Ata, who narrated from Sa'id ibn Al-Musayyib, who narrated from Ma'mar ibn Abdullah ibn Nadlah, that the Messenger of Allah ﷺ said, "Only a sinner hoards." This hadith is one of the arguments used to establish that a narration from a companion is not valid unless it is narrated by two successors. Ma'mar does not have any narrators other than Sa'id ibn Al-Musayyib. As for the narration of Al-Qasim from Abu Umamah, the wording is not the same. It has been narrated in regards to forbidding hoarding of food and refraining from assisting Muslims in times of hardship. It is essential to mention these narrations in this context, as the Muslims were inclined towards them at that time. Thus, Ibn Al-Jawzi omitted it in his summary.
«نَهَى رَسُولُ اللَّهِ ﷺ أَنْ يُحْتَكَرَ الطَّعَامُ» قَدْ أَخْرَجَ مُسْلِمٌ حَدِيثَ مُحَمَّدِ بْنِ إِسْحَاقَ عَنْ مُحَمَّدِ بْنِ عَمْرِو بْنِ عَطَاءٍ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ عَنْ مَعْمَرِ بْنِ عَبْدِ اللَّهِ بْنِ نَضْلَةَ أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا يَحْتَكِرُ إِلَّا خَاطِئٌ» وَهَذَا الْحَدِيثُ أَحَدُ مَا يُنْقَضُ عَلَيْهِ أَنْ لَا يَصِحَّ حَدِيثُ صَحَابِيٍّ لَا يَرْوِي عَنْهُ تَابِعِيَّانِ فَإِنَّ مَعْمَرًا هَذَا لَيْسَ لَهُ رَاوٍ غَيْرُ سَعِيدِ بْنِ الْمُسَيِّبِ وَأَمَّا حَدِيثُ الْقَاسِمِ عَنْ أَبِي أُمَامَةَ فَلَيْسَ بِذَلِكَ اللَّفْظِ وَقَدْ رُوِيَ فِي الزَّجْرِ عَنِ احْتِكَارِ الطَّعَامِ وَالتَّقَاعُدِ عَنْ مُوَاسَاةِ الْمُسْلِمِينَ فِي الضِّيقِ الْأَخْبَارُ لَابُدَّ مِنْ ذِكْرِهَا فِي هَذَا الْمَوْضِعِ كَمَا دَفَعَ الْمُسْلِمُونَ إِلَيْهِ فِي الْوَقْتِ فَمِنْهَاسكت عنه الذهبي في التلخيص
[Machine] The Messenger of Allah ﷺ said, "The hoarder is cursed." And Ali ibn Salim is weak.
قَالَ رَسُولُ اللَّهِ ﷺ «الْمُحْتَكِرُ مَلْعُونٌ» وَمِنْهَاعلي بن سالم ضعيف
[Machine] The Messenger of Allah ﷺ said, "Whoever hoards food for forty nights, he is free from Allah and Allah is free from him. And whoever among the people of a town wakes up in the morning while there is a hungry person among them, then the punishment of Allah is lifted from them." This hadith is narrated by Amr bin Al-Hassan Al-Aqili and Asbah bin Zaid Al-Juhani has a leniency in it.
قَالَ رَسُولُ اللَّهِ ﷺ «مَنِ احْتَكَرَ طَعَامًا أَرْبَعِينَ لَيْلَةً فَقَدْ بَرِئَ مِنَ اللَّهِ وَبَرِئَ اللَّهُ مِنْهُ وَأَيُّمَا أَهْلِ عَرْصَةٍ أَصْبَحَ فِيهِمُ امْرُؤٌ جَائِعًا فَقَدْ بَرِئَتْ مِنْهُمْ ذِمَّةُ اللَّهِ» وَمِنْهَاعمرو بن الحصين العقيلي تركوه وأصبع بن زيد الجهني فيه لين
[Machine] The Messenger of Allah ﷺ said, "Whoever hoards with the intention of exploiting it against the Muslims, then he is a wrongdoer and has violated the trust of Allah." And from it, Asili used to steal the tradition.
قَالَ رَسُولُ اللَّهِ ﷺ «مَنِ احْتَكَرَ يُرِيدُ أَنْ يَتَغَالىَ بِهَا عَلَى الْمُسْلِمِينَ فَهُوَ خَاطِئٌ وَقَدْ بَرِئَ مِنْهُ ذِمَّةُ اللَّهِ» وَمِنْهَاالعسيلي كان يسرق الحديث
[Machine] The Messenger of Allah ﷺ passed by a man in the marketplace selling food at a price lower than the market price. He said, "You sell in our market at a price lower than ours?" The man replied, "Yes." The Messenger of Allah asked, "With patience and fairness?" The man replied, "Yes." The Messenger of Allah said, "Rejoice! For the one who brings goods to our market is like the one who fights in the cause of Allah, and the one who monopolizes in our market is like the one who denies the Book of Allah." This Hadith is considered weak in its narration and its chain of narrators is obscure.
مَرَّ رَسُولُ اللَّهِ ﷺ بِرَجُلٍ بِالسُّوقِ يَبِيعُ طَعَامًا بِسِعْرٍ هُوَ أَرْخَصُ مِنْ سِعْرِ السُّوقِ فَقَالَ «تَبِيعُ فِي سُوقِنَا بِسِعْرٍ هُوَ أَرْخَصُ مِنْ سِعْرِنَا؟» قَالَ نَعَمْ قَالَ «صَبْرًا وَاحْتِسَابًا؟» قَالَ نَعَمْ قَالَ «أَبْشِرْ فَإِنَّ الْجَالِبَ إِلَى سُوقِنَا كَالْمُجَاهِدِ فِي سَبِيلِ اللَّهِ وَالْمُحْتَكِرُ فِي سُوقِنَا كَالْمُلْحِدِ فِي كِتَابِ اللَّهِ» وَمِنْهَاخبر منكر وإسناد مظلم
[Machine] I heard the Messenger of Allah ﷺ say, "Whoever enters into any dealings with the prices of Muslims and cheats them, it is the right of Allah to throw him into the depths of Hell, placing his head at the lowest point." I sought and included these six hadiths in their proper place in this book, taking into account the difficulties that people face. Allah will alleviate them, even if it is not a condition of this book. I do not know any addition, so reflect on these six hadiths.
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «مَنْ دَخَلَ فِي شَيْءٍ مِنْ أَسْعَارِ الْمُسْلِمِينَ لَيُغْلِيَ عَلَيْهِمْ كَانَ حَقًّا عَلَى اللَّهِ أَنْ يَقْذِفَهُ فِي مُعْظَمِ جَهَنَّمَ رَأْسُهُ أَسْفَلُهُ» هَذِهِ الْأَحَادِيثُ السِّتَّةُ طَلَبْتُهَا وَخَرَّجْتُهَا فِي مَوْضِعِهَا مِنْ هَذَا الْكِتَابِ احْتِسَابًا لِمَا فِيهِ النَّاسُ مِنَ الضِّيقِ وَاللَّهُ يَكْشِفُهَا وَإِنْ لَمْ يَكُنْ مِنْ شَرْطِ هَذَا الْكِتَابِ لا أعرف زيدا فتأمل هذه الستة أحاديث
[Machine] I asked Hassan bin Ali what he remembers from the Messenger of Allah ﷺ . He said, "I heard him saying, 'Leave that which causes doubt for that which does not cause doubt. Verily, goodness brings tranquility, and evil brings doubt.'"
سَأَلْتُ الْحَسَنَ بْنَ عَلِيٍّ مَا يَذْكُرُ مِنْ رَسُولِ اللَّهِ ﷺ قَالَ سَمِعْتُهُ يَقُولُ «دَعْ مَا يَرِيبُكَ إِلَى مَا لَا يَرِيبُكَ فَإِنَّ الْخَيْرَ طُمَأْنِينَةٌ وَإِنَّ الشَّرَّ رِيبَةٌ»
[Machine] I said to Hassan ibn Ali: "Tell me about an incident you witnessed during the time of the Messenger of Allah ﷺ and what you understood from it." He replied, "A man came to the Messenger of Allah ﷺ , and I heard him say, 'Leave what causes you doubt for that which does not cause you doubt, for indeed, evil is uncertainty and good is tranquility.' This is a narration from my father, Ummamah al-Bahili." Al-Dhahabi remained silent about it in this context.
قُلْتُ لِلْحَسَنِ بْنِ عَلِيٍّ مِثْلُ مَنْ كُنْتَ فِي عَهْدِ رَسُولِ اللَّهِ ﷺ وَمَاذَا عَقَلْتَ عَنْهُ؟ قَالَ أَتَى رَجُلٌ رَسُولَ اللَّهِ ﷺ فَسَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «دَعْ مَا يَرِيبُكَ إِلَى مَا لَا يَرِيبُكَ فَإِنَّ الشَّرَّ رِيبَةٌ وَالْخَيْرَ طُمَأْنِينَةٌ» شَاهِدُهُ حَدِيثُ أَبِي أُمَامَةَ الْبَاهِلِيِّسكت عنه الذهبي في هذا الموضع
that a man asked the Messenger of Allah ﷺ, "What is Īmān (faith)?" He said, "If you are happy with your good deeds and are saddened by your bad deeds, then you are a believer." The man said, “O Messenger of Allah, then what is sin?” He said, "If something ˹you do˺ troubles you within, then you should abandon it." (Using translation from Aḥmad 22166)
أَنَّ رَجُلًا سَأَلَ النَّبِيَّ ﷺ مَا الْإِيمَانُ؟ قَالَ «إِذَا سَرَّتْكَ حَسَنَتُكَ وَسَاءَتْكَ سَيِّئَتُكَ فَأَنْتَ مُؤْمِنٌ» قَالَ يَا رَسُولَ اللَّهِ مَا الْإِثْمُ؟ قَالَ «إِذَا حَاكَ فِي صَدْرِكَ شَيْءٌ فَدَعْهُ» سكت عنه الذهبي في هذا الموضع
I asked Messenger of Allah ﷺ about virtue and vice. He said: Virtue is a kind disposition and vice is what rankles in your heart and that you disapprove that people should come to know of it. (Using translation from Muslim 2553a)
سَأَلْتُ النَّبِيَّ ﷺ عَنِ الْبِرِّ وَالْإِثْمِ قَالَ «الْبِرُّ حُسْنُ الْخُلُقِ وَالْإِثْمُ مَا حَاكَ فِي صَدْرِكَ وَكَرِهْتَ أَنْ يَطَّلِعَ عَلَيْهِ النَّاسُ»
[Machine] The translation of the provided Arabic text is as follows: "That the Messenger of Allah ﷺ woke up one night and he was asked: What kept you awake? He replied, 'I found a fallen date and ate it. Then I remembered that there was a date from the Sadaqah (charity) dates at our place. So, I do not know whether that date was from the Sadaqah dates or from my family's dates, and that is what kept me awake.'"
أَنَّ رَسُولَ اللَّهِ ﷺ تَضَوَّرَ ذَاتَ لَيْلَةٍ فَقِيلَ لَهُ مَا أَسْهَرَكَ؟ قَالَ «إِنِّي وَجَدْتُ تَمْرَةً سَاقِطَةً فَأَكَلْتُهَا ثُمَّ تَذَكَّرْتُ تَمْرًا كَانَ عِنْدَنَا مِنْ تَمْرِ الصَّدَقَةِ فَلَا أَدْرِي أَمِنْ ذَلِكَ كَانَتِ التَّمْرَةُ أَوْ مِنْ تَمْرِ أَهْلِي فَذَلِكَ أَسْهَرَنِي»
The Messenger of Allah ﷺ said, "I do not know whether Tubba was a cursed or not. And, I do not know whether Dhu al-Qarnayn was a Prophet or not. And, I do not know whether hudud (capital punishments) ˹serve˺ as expiation for those are deserve them."
قَالَ رَسُولُ اللَّهِ ﷺ «مَا أَدْرِي أَتُبَّعُ لَعِينًا كَانَ أَمْ لَا وَمَا أَدْرِي ذُو الْقَرْنَيْنِ نَبِيًّا كَانَ أَمْ لَا وَمَا أَدْرِي الْحُدُودُ كَفَّارَاتٌ لِأَهْلِهَا أَمْ لَا»
[Machine] From the Messenger of Allah, peace and blessings be upon him: "Whoever buys merchandise, they are obligated to have the option of keeping it until the seller separates from it. If the owner wishes, they may take it. However, if the owner separates from it, they no longer have the option."
عَنْ رَسُولِ اللَّهِ ﷺ «مَنِ اشْتَرَى بَيْعًا فَوَجَبَ بِالْخِيَارِ فَهُوَ لَهُ مَا لَمْ يُفَارِقْهُ صَاحِبُهُ إِنْ شَاءَ أَخَذَهُ فَإِنْ فَارَقَهُ فَلَا خِيَارَ لَهُ»
[Machine] A man bought a slave from another man during the time of the Prophet Muhammad ﷺ . He possessed him and owned him freely. Then he returned him due to a defect that was found in him. The man said when the slave was returned to him, "O Messenger of Allah, he has been utilizing my slave since he acquired him." The Prophet ﷺ said, "The transaction is undertaken with guarantee."
أَنَّ رَجُلًا اشْتَرَى مِنْ رَجُلٍ غُلَامًا فِي زَمَنِ النَّبِيِّ ﷺ فَكَانَ عِنْدَهُ مَا شَاءَ اللَّهُ ثُمَّ رَدَّهُ مِنْ عَيْبٍ وُجِدَ بِهِ فَقَالَ الرَّجُلُ حِينَ رَدَّ عَلَيْهِ الْغُلَامُ يَا رَسُولَ اللَّهِ إِنَّهُ كَانَ اسْتَغَلَّ غُلَامِي مُنْذُ كَانَ عِنْدَهُ فَقَالَ النَّبِيُّ ﷺ «الْخَرَاجُ بِالضَّمَانِ» صحيح
[Machine] A man bought a servant during the time of the Prophet Muhammad ﷺ. The servant had a defect that the man was not aware of, and he took advantage of him. Later, when the man discovered the defect, he returned the servant and argued with him before the Prophet ﷺ. The man said, "O Messenger of Allah, he was in my possession for a long time." The Messenger of Allah ﷺ then said, "The defective merchandise is under warranty."
أَنَّ رَجُلًا اشْتَرَى غُلَامًا فِي زَمَنِ النَّبِيِّ ﷺ وَبِهِ عَيْبٌ لَمْ يُعْلِمْ بِهِ فَاسْتَغَلَّهُ ثُمَّ عَلِمَ الْعَيْبَ فَرَدَّهُ فَخَاصَمَهُ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّهُ اسْتَغَلَّهُ مُنْذُ زَمَانٍ فَقَالَ رَسُولُ اللَّهِ ﷺ «الْغَلَّةُ بِالضَّمَانِ»
[Machine] The Messenger of Allah ﷺ said, "Indeed, the taxes should be paid with surety." And the narration of Aasim states, "The Messenger of Allah ﷺ has decreed that taxes should be paid with surety." This was narrated by Thawri, Ibn Al-Mubarak, and Yahya ibn Sa'id, from Ibn Abi Dhi'b. As for the narration of Thawri,
قَالَ رَسُولُ اللَّهِ ﷺ «إِنَّ الْخَرَاجَ بِالضَّمَانِ» وَحَدِيثُ عَاصِمٍ «قَضَى رَسُولُ اللَّهِ ﷺ أَنَّ الْخَرَاجَ بِالضَّمَانِ» رَوَاهُ الثَّوْرِيُّ وَابْنُ الْمُبَارَكِ وَيَحْيَى بْنُ سَعِيدٍ عَنِ ابْنِ أَبِي ذِئْبٍ «أَمَّا حَدِيثُ الثَّوْرِيِّ»
That the Messenger of Allah ﷺ judged: "The produce is for the responsible one." (Using translation from Tirmidhī 1285)
أَنَّ رَسُولَ اللَّهِ ﷺ «قَضَى أَنَّ الْخَرَاجَ بِالضَّمَانِ» وَأَمَّا حَدِيثُ ابْنِ الْمُبَارَكِ
[Machine] The Messenger of Allah ﷺ said, "Al-Kharaj (land tax) is with responsibility." As for the saying of Yahya ibn Sa'id...
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «الْخَرَاجُ بِالضَّمَانِ» وَأَمَّا حَدِيثُ يَحْيَى بْنِ سَعِيدٍ
That the Messenger of Allah ﷺ judged: "The produce is for the responsible one." (Using translation from Tirmidhī 1285)
أَنَّ رَسُولَ اللَّهِ ﷺ «قَضَى أَنَّ الْخَرَاجَ بِالضَّمَانِ»
[Machine] The Prophet Muhammad ﷺ said: "The two parties in a transaction have the option to cancel as long as they do not separate. Each one should take from the transaction what pleases them." He repeated this statement three times.
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا وَيَأْخُذُ كُلُّ وَاحِدٍ مِنْهُمَا مِنَ الْبَيْعِ مَا يَهْوَى» قَالَهَا ثَلَاثًا
[Machine] When Salman arrived at the city, he went to the Messenger of Allah ﷺ with a gift on a plate and placed it before him. The Prophet ﷺ asked, "What is this, O Salman?" He replied, "It is a charity for you and your companions." The Prophet ﷺ said, "I do not eat charity." So Salman took it back. The next day, he came with the same gift and placed it before the Prophet ﷺ . He asked, "What is this?" Salman replied, "It is a gift for you." The Prophet ﷺ then said to his companions, "Eat." They asked, "For whom is it?" The Prophet ﷺ answered, "For a group of people. Ask them to write for you." Salman said, "They wrote for me that I should plant this and that number of palm trees for them, and Salman will take care of them until they bear fruit." He (Salman) did as they requested. The Prophet ﷺ came and planted all the palm trees except for one, which Umar planted, and Salman took care of it from his own date farm, except for that one palm tree. The Prophet ﷺ asked, "Who planted this tree?" They replied, "Umar." The Messenger of Allah ﷺ said, "I planted it from my own hands, and Umar carried it from its first year."
أَنَّ سَلْمَانَ لَمَّا قَدِمَ الْمَدِينَةَ أَتَى رَسُولَ اللَّهِ ﷺ بِهَدِيَّةٍ عَلَى طَبَقٍ فَوَضَعَهَا بَيْنَ يَدَيْهِ فَقَالَ «مَا هَذَا يَا سَلْمَانُ؟» قَالَ صَدَقَةٌ عَلَيْكَ وَعَلَى أَصْحَابِكَ قَالَ «إِنِّي لَا آكُلُ الصَّدَقَةَ» فَرَفَعَهَا ثُمَّ جَاءَهُ مِنَ الْغَدِ بِمِثْلِهَا فَوَضَعَهَا بَيْنَ يَدَيْهِ فَقَالَ «مَا هَذَا؟» قَالَ هَدِيَّةٌ لَكَ فَقَالَ رَسُولُ اللَّهِ ﷺ لِأَصْحَابِهِ «كُلُوا» قَالَ «لِمَنْ أَنْتَ؟» قَالَ لِقَوْمٍ قَالَ «فَاطْلُبْ إِلَيْهِمْ أَنْ يُكَاتِبُوكَ» قَالَ فَكَاتَبُونِي عَلَى كَذَا وَكَذَا نَخْلَةٍ أَغْرِسُهَا لَهُمْ وَيَقُومُ عَلَيْهَا سَلْمَانُ حَتَّى تُطْعِمَ قَالَ فَفَعَلُوا قَالَ فَجَاءَ النَّبِيُّ ﷺ فَغَرَسَ النَّخْلَ كُلَّهُ أَلَا نَخْلَةً وَاحِدَةً غَرَسَهَا عُمَرُ وَأَطْعَمَ نَخْلُهُ مِنْ سَنَتِهِ إِلَّا تِلْكَ النَّخْلَةِ قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ غَرَسَهَا؟» قَالُوا عُمَرُ «فَغَرَسَهَا رَسُولُ اللَّهِ ﷺ مِنْ يَدِهِ فَحَمَلَهَا مِنْ عَامِهَا»
[Machine] A man from the Jewish community bought him (a person), so he brought him to the city. He said, "So I came to the Messenger of Allah ﷺ with a gift, and I said, 'This is a charity.' He said to his companions, 'Eat,' but he (the Messenger of Allah) did not eat. Then he (the person) mentioned the Hadith similar to it, according to the condition of Muslim.
أَنَّ رَجُلًا مِنَ الْيَهُودِ اشْتَرَاهُ فَقَدِمَ بِهِ الْمَدِينَةَ قَالَ فَأَتَيْتُ رَسُولَ اللَّهِ ﷺ بِهَدِيَّةٍ فَقُلْتُ هَذِهِ صَدَقَةٌ فَقَالَ لِأَصْحَابِهِ «كُلُوا» وَلَمْ يَأْكُلْ ثُمَّ ذَكَرَ الْحَدِيثَ نَحْوَهُعلى شرط مسلم
On his father's authority, said that his grandfather 'Abd Allah b. 'Amr reported the Messenger of Allah ﷺ as saying: The proviso of a loan combined with a sale is not allowable, nor two conditions relating to one transaction, nor profit arising from something which is not in one's charge, nor selling what is not in your possession. (Using translation from Abū Dāʾūd 3504)
قَالَ رَسُولُ اللَّهِ ﷺ «لَا يَحِلُّ سَلَفٌ وَبَيْعٌ وَلَا شَرْطَانِ فِي بَيْعٍ وَلَا رِبْحُ مَا لَمْ يُضْمَنْ وَلَا بَيْعُ مَا لَيْسَ عِنْدَكَ»
[Machine] I said, "O Messenger of Allah, I hear from you things that I fear I may forget. May I have permission to write them down?" He said, "Yes." I then wrote down from the Messenger of Allah, peace be upon him, that when 'Attab bin Usaid was sent to the people of Makkah, he said, "Inform them that it is not permissible to have two transactions in one sale, nor to sell what one does not possess, nor to give a loan and conduct a sale simultaneously, nor to have multiple conditions in a sale."
قُلْتُ يَا رَسُولَ اللَّهِ إِنِّي أَسْمَعُ مِنْكَ أَشْيَاءَ أَخَافُ أَنْ أَنْسَاهَا أَفَتَأْذَنُ لِي أَنْ أَكْتُبَهَا؟ قَالَ «نَعَمْ» قَالَ فَكَانَ فِيمَا كَتَبَ عَنْ رَسُولِ اللَّهِ ﷺ أَنَّهُ لَمَّا بَعَثَ عَتَّابَ بْنَ أُسَيْدٍ إِلَى أَهْلِ مَكَّةَ قَالَ «أَخْبِرْهُمْ أَنَّهُ لَا يَجُوزُ بَيْعَانِ فِي بَيْعٍ وَلَا بَيْعُ مَا لَا يَمْلِكُ وَلَا سَلَفٌ وَبَيْعٌ وَلَا شَرْطَانِ فِي بَيْعٍ»
[Machine] "And he was one of the companions of the Prophet ﷺ . Ali ibn Hamsad al-Adl narrated to us, Ismail ibn Ishaq al-Qadi and Hassan ibn Ali ibn Ziyad narrated to us, they said: Ismail ibn Abi Uwais narrated to us, my brother Abu Bakr narrated to us, from Sulaiman ibn Bilal, from Muhammad ibn Abi Atiq, from Ibn Shihab, from Umara ibn Khuzaimah, that his uncle informed him that he was one of the companions of the Messenger of Allah ﷺ . The Messenger of Allah ﷺ bought a horse from a man from the Bedouins, so the Messenger of Allah ﷺ followed him to pay the price for the horse. The Messenger of Allah ﷺ walked faster while the Bedouin walked slower. Some men intercepted the Bedouin and offered to buy the horse from him, not knowing that the Messenger of Allah ﷺ had already bought it. Some of them increased the bid, so when they did, the Bedouin called out, "O Messenger of Allah, if you intend to buy this horse, then take it; otherwise, I will sell it to them." The Messenger of Allah ﷺ stood up when he heard the call of the Bedouin and went to him. The Messenger of Allah ﷺ asked him, "Didn't I buy it from you?" He replied, "No, by Allah, I didn't sell it to you." The people started to resort to the Messenger of Allah ﷺ and the Bedouin, while they were moving back. Then the Bedouin said, "Come here, witness that I have sold it to you." Khuzaimah said, "I bear witness that you have sold it to him." Then the Messenger of Allah ﷺ approached Khuzaimah and asked, "What do you bear witness to?" He replied, "I bear witness to your truthfulness." Then the Messenger of Allah ﷺ said, "The testimony of Khuzaimah is the testimony of two men."
وَكَانَ مِنْ أَصْحَابِ النَّبِيِّ ﷺ وَحَدَّثَنَا عَلِيُّ بْنُ حَمْشَاذٍ الْعَدْلُ حَدَّثَنَا إِسْمَاعِيلُ بْنُ إِسْحَاقَ الْقَاضِي وَالْحَسَنُ بْنُ عَلِيِّ بْنِ زِيَادٍ قَالَا حَدَّثَنَا إِسْمَاعِيلُ بْنُ أَبِي أُوَيْسٍ حَدَّثَنَا أَخِي أَبُو بَكْرٍ عَنْ سُلَيْمَانَ بْنِ بِلَالٍ عَنْ مُحَمَّدِ بْنِ أَبِي عَتِيقٍ عَنِ ابْنِ شِهَابٍ عَنْ عُمَارَةَ بْنِ خُزَيْمَةَ أَنَّ عَمَّهُ أَخْبَرَهُ وَكَانَ مِنْ أَصْحَابِ رَسُولِ اللَّهِ ﷺ أَنَّ رَسُولَ اللَّهِ ﷺ ابْتَاعَ فَرَسًا مِنْ رَجُلٍ مِنَ الْأَعْرَابِ فَاسْتَتْبَعَهُ رَسُولُ اللَّهِ ﷺ لِيَقْضِيَ ثَمَنَ فَرَسِهِ فَأَسْرَعَ رَسُولُ اللَّهِ ﷺ الْمَشْيَ وَأَبْطَأَ الْأَعْرَابِيُّ فَطَفِقَ رِجَالٌ يَعْتَرِضُونَ الْأَعْرَابِيَّ وَيُسَاوِمُونَهُ الْفَرَسَ وَلَا يَشْعُرُونَ أَنَّ رَسُولَ اللَّهِ ﷺ قَدِ ابْتَاعَهُ حَتَّى زَادَ بَعْضُهُمُ الْأَعْرَابِيَّ فِي السَّوْمِ فَلَمَّا زَادُوا نَادَى الْأَعْرَابِيُّ يَا رَسُولَ اللَّهِ إِنْ كُنْتَ مُبْتَاعًا هَذَا الْفَرَسَ فَابْتَعْهُ وَإِلَّا بِعْتُهُ فَقَامَ رَسُولُ اللَّهِ ﷺ حِينَ سَمِعَ نِدَاءَ الْأَعْرَابِيِّ حَتَّى أَتَى الْأَعْرَابِيَّ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَوَ لَيْسَ قَدِ ابْتَعْتُ مِنْكَ؟» قَالَ لَا وَاللَّهِ مَا بِعْتُكَهُ قَالَ «بَلِ ابْتَعْتُهُ مِنْكَ» فَطَفِقَ النَّاسُ يَلُوذُونَ بِرَسُولِ اللَّهِ ﷺ وَبِالْأَعْرَابِيِّ وَهُمَا يَتَرَاجَعَانِ فَطَفِقَ الْأَعْرَابِيُّ يَقُولُ هَلُمَّ شَهِيدًا أَنِّي بَايَعْتُكَ فَقَالَ خُزَيْمَةُ أَشْهَدُ إِنَّكَ بَايَعْتَهُ فَأَقْبَلَ رَسُولُ اللَّهِ ﷺ عَلَى خُزَيْمَةَ فَقَالَ «بِمَ تَشْهَدُ؟» فَقَالَ بِتَصْدِيقِكَ فَجَعَلَ رَسُولُ اللَّهِ ﷺ «شَهَادَةَ خُزَيْمَةَ شَهَادَةَ رَجُلَيْنِ»
[Machine] That the Messenger of Allah ﷺ purchased a horse from Sawwah ibn al-Harith al-Muharibi, but he denied it. Khuzaymah ibn Thabit testified for him, so the Messenger of Allah ﷺ said to him, "What made you give witness for him, despite not being present?" He said, "You have spoken the truth, O Messenger of Allah, but I believed you based on what you said, and I know that you do not speak anything except the truth." Then he said, "Whoever testifies for him and I testify against him, it will be sufficient for him."
أَنَّ رَسُولَ اللَّهِ ﷺ ابْتَاعَ مِنْ سَوَاءَ بْنِ الْحَارِثِ الْمُحَارِبِيِّ فَرَسًا فَجَحَدَهُ فَشَهِدَ لَهُ خُزَيْمَةُ بْنُ ثَابِتٍ فَقَالَ لَهُ رَسُولُ اللَّهِ ﷺ «مَا حَمَلَكَ عَلَى الشَّهَادَةِ وَلَمْ تَكُنْ مَعَهُ؟» قَالَ صَدَقْتَ يَا رَسُولَ اللَّهِ وَلَكِنْ صَدَّقْتُكَ بِمَا قُلْتَ وَعَرَفْتُ أَنَّكَ لَا تَقُولُ إِلَّا حَقًّا فَقَالَ «مَنْ شَهِدَ لَهُ خُزَيْمَةُ وَأَشْهَدَ عَلَيْهِ فَحَسْبُهُ»
We sold slave-mothers during the time of the Messenger of Allah ﷺ and of AbuBakr. When Umar was in power, he forbade us and we stopped. (Using translation from Abū Dāʾūd 3954)
«بِعْنَا أُمَّهَاتِ الْأَوْلَادِ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ وَأَبِي بَكْرٍ فَلَمَّا كَانَ عُمَرُ نَهَانَا فَانْتَهَيْنَا»
[Machine] "We used to sell slaves during the time of the Prophet Muhammad (pbuh)."
كُنَّا «نَبِيعُ أُمَّهَاتِ الْأَوْلَادِ عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ» صحيح
[Machine] "He said, the Messenger of Allah ﷺ said: 'Any woman who gives birth from her master, she becomes free after his death.'"
أَنَّهُ قَالَ قَالَ رَسُولُ اللَّهِ ﷺ «أَيُّمَا امْرَأَةٍ وَلَدَتْ مِنْ سَيِّدُهَا فَهِيَ حُرَّةٌ بَعْدَ مَوْتِهِ»
the Messenger of Allah ﷺ forbade selling fruits until they have changed the color, and selling grapes until they have turned black, and selling grains until they have hardened. (Using translation from Ibn Mājah 2217)
أَنَّ رَسُولَ اللَّهِ ﷺ «نَهَى عَنْ بَيْعِ الْحَبِّ حَتَّى يَشْتَدَّ وَعَنْ بَيْعِ الْعِنَبِ حَتَّى يَسْوَدَّ وَعَنْ بَيْعِ التَّمْرِ حَتَّى يَحْمَرَّ وَيَصْفَرَّ»
[Machine] I heard Abu Sa'id Al-Sa'idi and Ibn Abbas issuing a fatwa that a dinar should be exchanged for two dinars. Abu Usaid Al-Sa'idi replied to him angrily, saying, "I did not think that anyone knew of my close relationship with the Messenger of Allah ﷺ and would say such a thing to me, O Abu Usaid." Ibn Abbas then said, "I only said what I used to say before, as I have not heard anything about it." Abu Usaid said, "I testify that I heard from the Messenger of Allah ﷺ saying, 'A dinar should be exchanged for a dinar, and a dirham for a dirham, and a measure of wheat for a measure of wheat, and a measure of barley for a measure of barley, and a measure of salt for a measure of salt. There should be no surplus or deficiency in any of these exchanges.'" Ibn Abbas said, "This is something I used to say, and I did not hear anything contrary to it."
سَمِعْتُ أَبَا سَعِيدٍ السَّاعِدِيَّ وَابْنَ عَبَّاسٍ يُفْتِي الدِّينَارُ بِالدِّينَارَيْنِ فَقَالَ لَهُ أَبُو أُسَيْدٍ السَّاعِدِيُّ وَأَغْلَظَ لَهُ قَالَ فَقَالَ ابْنُ عَبَّاسٍ مَا كُنْتُ أَظُنُّ أَنَّ أَحَدًا يَعْرِفُ قَرَابَتِي مِنْ رَسُولِ اللَّهِ ﷺ يَقُولُ لِي مِثْلَ هَذَا يَا أَبَا أُسَيْدٍ فَقَالَ أَبُو أُسَيْدٍ أَشْهَدُ لَسَمِعْتُ مِنْ رَسُولِ اللَّهِ ﷺ يَقُولُ «الدِّينَارُ بِالدِّينَارِ وَالدِّرْهَمُ بِالدِّرْهَمِ وَصَاعُ حِنْطَةٍ بِصَاعِ حِنْطَةٍ وَصَاعُ شَعِيرٍ بِصَاعِ شَعِيرٍ وَصَاعُ مِلْحٍ بِصَاعِ مِلْحٍ لَا فَضْلَ بَيْنَهُمَا فِي شَيْءٍ مِنْ ذَلِكَ» فَقَالَ ابْنُ عَبَّاسٍ إِنَّمَا هَذَا شَيْءٌ كُنْتُ أَقُولُهُ وَلَمْ أَسْمَعْ فِيهِ بِشَيْءٍ
[Machine] "O Messenger of Allah, Fulan has a palm tree, and I constructed my wall using it. So please command him to give me the palm tree in exchange for my wall." The Prophet ﷺ told Fulan, "Give it to him in return for a palm tree in Paradise." However, Fulan refused and Abu Al-Dahdah came to him saying, "Sell your palm tree to him in exchange for his wall." Fulan agreed and sold it to him. Abu Al-Dahdah then went to the Prophet ﷺ and informed him, saying, "O Messenger of Allah, I have acquired the palm tree in exchange for my wall." The Prophet ﷺ said multiple times, "How much shade and clusters (of dates) in Paradise belongs to Abu Al-Dahdah." Then, Abu Al-Dahdah went to his wife and said, "O Um Dahdah, vacate the wall, for I have sold it in exchange for a palm tree in Paradise." She responded, "Indeed, you have made a profitable sale or an equivalent word."
يَا رَسُولَ اللَّهِ إِنَّ لِفُلَانٍ نَخْلَةً وَأَنَا أُقِيمُ حَائِطِي بِهَا فَمُرْهُ أَنْ يُعْطِيَنِيَ أُقِيمُ حَائِطِي بِهَا فَقَالَ لَهُ النَّبِيُّ ﷺ «أَعْطِهَا إِيَّاهُ بِنَخْلَةٍ فِي الْجَنَّةِ» فَأَبَى وَأَتَاهُ أَبُو الدَّحْدَاحِ فَقَالَ بِعْنِي نَخْلَكَ بِحَائِطِي قَالَ فَفَعَلَ قَالَ فَأَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي قَدِ ابْتَعْتُ النَّخْلَةَ بِحَائِطِي فَجَعَلَهَا لَهُ فَقَالَ النَّبِيُّ ﷺ «كَمْ مِنْ عِذْقٍ رَدَاحٍ لِأَبِي الدَّحْدَاحِ فِي الْجَنَّةِ» مِرَارًا فَأَتَى امْرَأَتَهُ فَقَالَ يَا أُمَّ الدَّحْدَاحِ اخْرُجِي مِنَ الْحَائِطِ فَإِنِّي بِعْتُهُ بِنَخْلَةٍ فِي الْجَنَّةِ فَقَالَتْ قَدْ رَبِحْتَ الْبَيْعَ أَوْ كَلِمَةً نَحْوَهَا
[Machine] A man came to the Messenger of Allah ﷺ and said, "Indeed, so-and-so has a date palm tree in my wall, and it annoys me and harms me in its place in my wall." So the Messenger of Allah ﷺ sent a message to him and said, "Sell it to me, your date palm tree that is in so-and-so's wall." He said, "No." He said, "Give it to me." He said, "No." He said, "Then exchange it with a date palm tree in Jannah (Paradise)." He said, "No." So the Messenger of Allah ﷺ said, "I have not seen anyone more stingy than you who withholds saying salaam (greeting of peace)."
أَنَّ رَجُلًا أَتَى رَسُولَ اللَّهِ ﷺ فَقَالَ إِنَّ لِفُلَانٍ فِي حَائِطِي عِذْقًا وَقَدْ آذَانِي وَشَقَّ عَلَيَّ مَكَانُ عِذْقِهِ فَأَرْسَلَ إِلَيْهِ رَسُولُ اللَّهِ ﷺ فَقَالَ بِعْنِي عِذْقَكَ الَّذِي فِي حَائِطِ فُلَانٍ قَالَ لَا قَالَ «هَبْهُ» قَالَ لَا قَالَ «فَبِعْنِيهِ بِعِذْقٍ فِي الْجَنَّةِ» قَالَ لَا فَقَالَ رَسُولُ اللَّهِ ﷺ «مَا رَأَيْتُ أَبْخَلَ مِنْكَ إِلَّا الَّذِي يَبْخَلُ بِالسَّلَامِ»
[Machine] The Messenger of Allah ﷺ said, "It is enough for a person to be considered a liar that he narrates everything he hears, and it is enough for a person to be considered greedy that he says, 'I will take my right and leave nothing of it.'" This is a reliable chain of narration, as the fathers of Hilal bin Al-Ala are trustworthy imams, and Hilal himself is the leader of the people of the Arabian Peninsula in his time. The fathers of Hilal are reliable.
قَالَ رَسُولُ اللَّهِ ﷺ «كَفَى بِالْمَرْءِ مِنَ الْكَذِبِ أَنْ يُحَدِّثَ بِكُلِّ مَا سَمِعَ وَكَفَىَ بِالْمَرْءِ مِنَ الشُّحِّ أَنْ يَقُولَ آخُذُ حَقِّي لَا أَتْرُكُ مِنْهُ شَيْئًا» هَذَا إِسْنَادٌ صَحِيحٌ فَإِنَّ آبَاءَ هِلَالِ بْنِ الْعَلَاءِ أَئِمَّةٌ ثِقَاتٌ وَهِلَالٌ إِمَامُ أَهْلِ الْجَزِيرَةِ فِي عَصْرِهِ صحيح وآباء هلال ثقات
the Prophet ﷺ bought Safiyyah for seven slaves. (Sahih) (One of the narrators) 'Abdur-Rahman said: "From Dihyah Kalbi.' (Using translation from Ibn Mājah 2272)
أَنَّ النَّبِيَّ ﷺ «اشْتَرَى صَفِيَّةَ مِنْ دِحْيَةَ الْكَلْبِيِّ بِسَبْعَةِ أَرْؤُسٍ»
[Machine] The Messenger of Allah ﷺ said, "During the custody of the slave, there are three nights." Sa'id said, "I asked Qatadah, 'How does this happen?'" He replied, "If the buyer finds a defect in the merchandise, he can return it within those days without asking for proof. However, after those days pass, he can only return it with proof that he bought it and that defect was present. Otherwise, the seller can swear that he did not sell it, and that is his defense." Sa'id and Hammam reported this narration from Qatadah, and likewise Yunus ibn 'Ubaid from Al-Hasan.
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «فِي عُهْدَةِ الرَّقِيقِ ثَلَاثُ لَيَالٍ» قَالَ سَعِيدٌ فَقُلْتُ لِقَتَادَةَ كَيْفَ يَكُونُ هَذَا؟ قَالَ إِذَا وَجَدَ الْمُشْتَرِي عَيْبًا بِالسِّلْعَةِ فَإِنَّهُ يَرُدُّهَا فِي تِلْكَ الْأَيَّامِ وَلَا يَسْأَلُ الْبَيِّنَةَ فَإِذَا مَضَتْ عَلَيْهِ أَيَّامٌ فَلَيْسَ لَهُ أَنْ يَرُدَّهَا إِلَّا ببَيِّنَةٍ أَنَّهُ اشْتَرَاهَا وَذَلِكَ الْعَيْبُ بِهَا وَإِلَّا فَيَمِينُ الْبَائِعِ أَنَّهُ لَمْ يَبِعْهُ وَبِهِ دَاءٌ هَكَذَا قَالَ سَعِيدٌ وَهَمَّامٌ عَنْ قَتَادَةَ وَكَذَلِكَ رَوَاهُ يُونُسُ بْنُ عُبَيْدٍ عَنِ الْحَسَنِسكت عنه الذهبي في التلخيص
[Machine] The Messenger of Allah ﷺ said, "There is no marriage contract that is valid above four (wives)." As for the disagreement between Hisham al-Dasiti and the two of them.
قَالَ رَسُولُ اللَّهِ ﷺ «لَا عُهْدَةَ فَوْقَ أَرْبَعٍ» وَأَمَّا خِلَافُ هِشَامٍ الدَّسْتُوَائِيِّ إِيَّاهُمَا
The Prophet ﷺ said: The contractual obligation of a slave is three days. (Using translation from Abū Dāʾūd 3506)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «عُهْدَةُ الرَّقِيقِ أَرْبَعُ لَيَالٍ»
[Machine] Hibban ibn Munqidh was a weak man who had been hit in his head, causing a lump. The Messenger of Allah ﷺ selected good items for him to buy, he bought three. His tongue was heavy, so the Messenger of Allah ﷺ told him to sell and say: "No decrease in the price." I used to hear him saying "no decrease in the price." He used to buy something and bring it to his family, and they would say it is expensive. He would say: "Verily, the Messenger of Allah ﷺ has chosen me in my trade."
كَانَ حِبَّانُ بْنُ مُنْقِذٍ رَجُلًا ضَعِيفًا وَكَانَ قَدْ سُفِعَ فِي رَأْسِهِ مَأْمُومَةً فَجَعَلَ لَهُ رَسُولُ اللَّهِ ﷺ الْخِيَارَ فِيمَا اشْتَرَى ثَلَاثًا وَكَانَ قَدْ ثَقُلَ لِسَانُهُ فَقَالَ لَهُ رَسُولُ اللَّهِ ﷺ بِعْ وَقُلْ لَا خِلَابَةَ فَكُنْتُ أَسْمَعْهُ يَقُولُ لَا خِذَابَةَ لَا خِذَابَةَ وَكَانَ يَشْتَرِي الشَّيْءَ وَيَجِيءُ بِهِ أَهْلَهُ فَيَقُولُونَ هَذَا غَالٍ فَيَقُولُ إِنَّ رَسُولَ اللَّهِ ﷺ قَدْ خَيَّرَنِي فِي بَيْعِيصحيح
[Machine] She used to repay her debts. It was said to her, "Why do you have debts and you have no means to pay?" She said, "I heard the Messenger of Allah ﷺ say, 'No slave has the intention to repay his debt except that Allah will assist him in doing so, so I seek that assistance.'"
أَنَّهَا كَانَتْ تَدَّانُ فَقِيلَ لَهَا مَا لَكِ وَالدَّيْنِ وَلَيْسَ عِنْدَكَ قَضَاءٌ؟ فَقَالَتْ سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «مَا مِنْ عَبْدٍ كَانَتْ لَهُ نِيَّةٌ فِي أَدَاءِ دَيْنِهِ إِلَّا كَانَ لَهُ مِنَ اللَّهِ عَوْنٌ فَأَنَا أَلْتَمِسُ ذَلِكَ الْعَوْنَ»
[Machine] I heard the Messenger of Allah ﷺ say, "No servant has the intention to fulfill his debt except that Allah will provide him with assistance, and I seek that assistance." And his witness to this hadith is Maymunah.
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «مَا مِنْ عَبْدٍ كَانَتْ لَهُ نِيَّةٌ فِي أَدَاءِ دَيْنِهِ إِلَّا كَانَ لَهُ مِنَ اللَّهِ عَوْنٌ فَأَنَا أَلْتَمِسُ ذَلِكَ الْعَوْنَ» وَشَاهِدُهُ حَدِيثُ مَيْمُونَةَ
[Machine] She used to repay regularly, and it was said to her about that, she said, "I will not abandon the debt because it has assistance from Allah, and I seek that assistance."
أَنَّهَا كَانَتْ تَدَّانُ فَتُكْثِرُ فَقِيلَ لَهَا فِي ذَلِكَ فَقَالَتْ «لَا أَدَعُ الدَّيْنَ لِأَنَّ لَهُ مِنَ اللَّهِ عَوْنًا فَأَنَا أَلْتَمِسُ ذَلِكَ الْعَوْنَ»
