١٦۔١١ وَأَمَّا حَدِيثُ مَعْمَرِ بْنِ رَاشِدٍ

[Machine] The translation of the given Arabic text is: The Messenger of Allah ﷺ said, "Whoever gives shelter to a lost person, he himself remains lost until he shows them the way (i.e., helps them find their way)." This narration has an authentic chain of narrators, and it has not been included in Sahih Bukhari.

[Machine] "The Messenger of Allah ﷺ was asked about lost and found items. He said, 'They should be announced and not concealed or kept hidden. If the rightful owner comes forward, it should be returned to him, otherwise, it belongs to Allah and He gives it to whom He wills.'"

أَنَّ رَسُولَ اللَّهِ ﷺ سُئِلَ عَنِ اللُّقَطَةِ فَقَالَ «تُعَرَّفُ وَلَا تُغَيَّبُ وَلَا تُكْتَمُ فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَهُوَ مَالُ اللَّهِ يُؤْتِيهِ مَنْ يَشَاءُ»

هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ مُسْلِمٍ وَلَمْ يُخَرِّجَاهُ على شرط مسلم

[Machine] "Indeed, the Messenger of Allah ﷺ said about a treasure found by a man, 'If you find it in an inhabited town or on a well-known path, then announce it. But if you find it in a ruined village or in an uninhabited area or on a path less traveled, then it belongs to you along with one fifth of its value.' I have extensively mentioned the evidence in this book for the correct narrations of 'Amr ibn Shuayb, if the narrator is trustworthy and no better narrations are attributed to him. I have sought clear evidence in hearing from Shuayb ibn Muhammad from 'Abdullah ibn 'Amr, yet I have not found it until now."

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ فِي كَنْزٍ وَجَدَهُ رَجُلٌ «إِنْ كُنْتَ وَجَدْتَهُ فِي قَرْيَةٍ مَسْكُونَةٍ أَوْ فِي سَبِيلٍ مَيْتَاءَ فَعَرِّفْهُ وَإِنْ كُنْتَ وَجَدْتَهُ فِي خَرِبَةٍ جَاهِلِيَّةٍ أَوْ فِي قَرْيَةٍ غَيْرِ مَسْكُونَةٍ أَوْ غَيْرِ سَبِيلٍ مَيْتَاءَ فَفِيهِ وَفِي الرِّكَازِ الْخُمُسُ» قَدْ أَكْثَرْتُ فِي هَذَا الْكِتَابِ الْحُجَجَ فِي تَصْحِيحِ رِوَايَاتِ عَمْرِو بْنِ شُعَيْبٍ إِذَا كَانَ الرَّاوِي عَنْهُ ثِقَةً وَلَا يُذْكَرُ عَنْهُ أَحْسَنَ مِنْ هَذِهِ الرِّوَايَاتِ وَكُنْتُ أَطْلُبُ الْحُجَّةَ الظَّاهِرَةَ فِي سَمَاعِ شُعَيْبِ بْنِ مُحَمَّدٍ عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو فَلَمْ أَصِلْ إِلَيْهَا إِلَى هَذَا الْوَقْتِ صحيح

A muhrim who has intercourse during Hajj

[AI] A man came to Abdullah b. Amr, asking him about a muhrim who had intercourse with his wife. He pointed to Abdullah b. Umar and said, “Go to that one and ask him.” Shuayb said: The man did not recognize him, so I went with him, and he asked Ibn Umar. He said, “Your Hajj is invalid.” The man said, “So what should I do?” He said, “Enter ihram with the people, do what they do, and when you reach the coming year, perform Hajj and offer a sacrificial animal.” He then returned to Abdullah b. Amr while I was with him, and he said, “Go to Ibn Abbas and ask him.” Shuayb said: So I went with him to Ibn Abbas, and he asked him, and he said to him the same as Ibn Umar had said. He returned to Abdullah b. Amr while I was with him and informed him of what Ibn Abbas had said. Then he said, “What do you say?” He replied, “My view is like what the two of them said.”

This is a hadith of trustworthy narrators; its transmitters are memorizers. It is as if it takes one by the hand in establishing the soundness of Shuayb b. Muhammad’s hearing from his grandfather Abdullah b. Amr. This is the end of what my independent effort has led me to add in the Book of Sale beyond what the two imams, Abu Abdullah al-Bukhari and Abu al-Husayn al-Qushayri, compiled. Allah is the Helper in what I establish through tracing the reports of the two imams, and He is sufficient for me and the best disposer of affairs.

أَنَّ رَجُلًا أَتَى عَبْدَ اللَّهِ بْنَ عَمْرٍو يَسْأَلُهُ عَنْ مُحْرِمٍ وَقَعَ بِامْرَأَةٍ، فَأَشَارَ إِلَى عَبْدِ اللَّهِ بْنِ عُمَرَ، فَقَالَ: اذْهَبْ إِلَى ذَاكَ فَسَلْهُ. قَالَ شُعَيْبٌ: فَلَمْ يَعْرِفْهُ الرَّجُلُ، فَذَهَبْتُ مَعَهُ، فَسَأَلَ ابْنَ عُمَرَ، فَقَالَ: بَطَلَ حَجُّكَ. فَقَالَ الرَّجُلُ: فَمَا أَصْنَعُ؟ قَالَ: «أَحْرِمْ مَعَ النَّاسِ وَاصْنَعْ مَا يَصْنَعُونَ وَإِذَا أَدْرَكْتَ قَابِلًا فَحُجَّ وَأَهْدِ». فَرَجَعَ إِلَى عَبْدِ اللَّهِ بْنِ عَمْرٍو وَأَنَا مَعَهُ، فَقَالَ: اذْهَبْ إِلَى ابْنِ عَبَّاسٍ فَسَلْهُ. قَالَ شُعَيْبٌ: فَذَهَبْتُ مَعَهُ إِلَى ابْنِ عَبَّاسٍ، فَسَأَلَهُ، فَقَالَ لَهُ كَمَا قَالَ ابْنُ عُمَرَ. فَرَجَعَ إِلَى عَبْدِ اللَّهِ بْنِ عَمْرٍو وَأَنَا مَعَهُ، فَأَخْبَرَهُ بِمَا قَالَ ابْنُ عَبَّاسٍ، ثُمَّ قَالَ: مَا تَقُولُ أَنْتَ؟ فَقَالَ: قُولِي مِثْلُ مَا قَالَا.

«هَذَا حَدِيثُ ثِقَاتٍ رُوَاتُهُ حُفَّاظٌ، وَهُوَ كَالْآخِذِ بِالْيَدِ فِي صِحَّةِ سَمَاعِ شُعَيْبِ بْنِ مُحَمَّدِ عَنْ جَدِّهِ عَبْدِ اللَّهِ بْنِ عَمْرٍو. هَذَا آخِرُ مَا أَدَّى إِلَيْهِ اجْتِهَادِي مِنَ الزِّيَادَةِ فِي كِتَابِ الْبَيْعِ عَلَى مَا خَرَّجَهُ الْإِمَامَانِ أَبُو عَبْدِ اللَّهِ الْبُخَارِيُّ وَأَبُو الْحُسَيْنِ الْقُشَيْرِيُّ، وَقَدْ ذَكَرْتُ فِي ضِمْنِ هَذَا الْكِتَابِ كُتُبًا قَدْ تَرْجَمَهَا الْبُخَارِيُّ فِي آخِرِ كِتَابِ الْبُيُوعِ، فَمِنْهَا: كِتَابُ السَّلَمِ، وَكِتَابُ الشَّفَعَةِ، وَكِتَابُ الْإِجَارَةِ، وَكِتَابُ الْحَوَالَةِ، وَكِتَابُ الْحَرْثِ، وَكِتَابُ الْمُزَارَعَةِ، وَكِتَابُ الْمُسَاقَاةِ، وَكِتَابُ الْعَطَايَا، وَكِتَابُ الْهِبَاتِ، وَكِتَابُ الْقِرَاضِ، وَكِتَابُ اللُّقَطَةِ، وَكِتَابُ الْمَظَالِمِ، وَكِتَابُ التَّعَفُّفِ عَنِ الْمَسْأَلَةِ، وَكِتَابُ الرَّهْنِ، وَكِتَابُ الشَّرِكَةِ، وَكِتَابُ الْعِتْقِ، وَكِتَابُ الْمُكَاتَبِ، وَكِتَابُ الشَّهَادَاتِ، وَكِتَابُ الصُّلْحِ، وَكِتَابُ الشُّرُوطِ، وَكِتَابُ الْوَصَايَا، وَكِتَابُ الْوَقْفِ. وَإِنَّمَا شَرَحْتُهَا فِي آخِرِ هَذَا الْكِتَابِ لِئَلَّا يَتَوَّهَمَ مُتَوَهِّمٌ أَنِّي أَخْلَيْتُ كِتَابَ الْبُيُوعِ عَنْ هَذِهِ الْكُتُبِ، وَاللَّهُ الْمُعِينُ عَلَى مَا أُؤَصِّلُهُ مِنْ تَتَبُّعِ آثَارِ الْإِمَامَيْنِ، وَهُوَ حَسْبِي وَنِعْمَ الْوَكِيلُ.
