٣٠۔ كِتَابُ الْبُيُوعِ ص ٥
A man of the Ansar called Abu Madhkur declared that his slave called Ya'qub would be free after his death, but he had no other property. So the Messenger of Allah ﷺ called him and said: Who will buy him ? Nu'aim b. 'Abd Allah b. al-Nahham bought him for eight hundred dirhams. When he handed them over to him, he (Prophet) said: If any of you is poor, he should begin from himself ; if anything is left over, give it to your family; if anything is left over, give it to your relatives ; if anything is left over (when they received something), then here and here. يُقَالُ لَهُ يَعْقُوبُ لَمْ يَكُنْ لَهُ مَالٌ غَيْرَهُ فَدَعَا بِهِ رَسُولُ اللهِ ﷺ فَقَالَ مَنْ يَشْتَرِيهِ؟ مَنْ يَشْتَرِيهِ؟ فَاشْتَرَاهُ نُعَيْمُ بْنُ عَبْدِ اللهِ بِثَمَانِمِائَةِ دِرْهَمٍ فَدَفَعَهَا إِلَيْهِ فَقَالَ «إِذَا كَانَ أَحَدُكُمْ فَقِيرًا فَلْيَبْدَأْ بِنَفْسِهِ فَإِنْ كَانَ فَضْلًا فَعَلَى عِيَالِهِ فَإِنْ كَانَ فَضْلًا فَعَلَى قَرَابَتِهِ» أَوْ قَالَ عَلَى ذِي رَحِمِهِ فَإِنْ كَانَ فَضْلًا فَهَاهُنَا وَهَاهُنَا

30.88 [Machine] The sale of correspondence offices
٣٠۔٨٨ بَيْعُ الْمُكَاتَبَةَ
Return to your people ; if you like that I make payment for the purchase of your freedom on your behalf and I shall have the right to inherit from you, I shall do so. Barirah mentioned it to her people, but they refused and said: If she wants to purchase your freedom for reward from Allah, she may do so, but the right to inherit from her shall be ours. She mentioned it to the Messenger of Allah ﷺ. The Messenger of Allah ﷺ said: Purchase her (freedom) and set her free, for the right of inheritance belongs to only to the one who set a person free. The Messenger of Allah ﷺ then stood up and said: If anyone makes a condition which is not in Allah's Book, he has no right to it, even if he stipulates it hundred times. Allah's condition is more valid and binding. (Using translation from Abū Dāʾūd 3929)
أَنْ أَقْضِيَ عَنْكِ كِتَابَتَكِ وَيَكُونَ وَلَاؤُكِ لِي فَعَلْتُ فَذَكَرَتْ ذَلِكَ بَرِيرَةُ لِأَهْلِهَا فَأَبَوْا وَقَالُوا إِنْ شَاءَتْ أَنْ تَحْتَسِبَ عَلَيْكِ فَلْتَفْعَلْ وَيَكُونَ لَنَا وَلَاؤُكِ فَذَكَرْتُ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ لَهَا رَسُولُ اللهِ ﷺ «ابْتَاعِي فَأَعْتِقِي؛ فَإِنَّمَا الْوَلَاءَ لِمَنْ أَعْتَقَ» ثُمَّ قَامَ رَسُولُ اللهِ ﷺ فَقَالَ «مَا بَالُ أَقْوَامٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللهِ مَنِ اشْتَرَطَ شَرْطًا لَيْسَ فِي كِتَابِ اللهِ فَلَيْسَ لَهُ وَإِنِ شَرَطَ مِائَةَ مَرَّةٍ وَشَرْطُ اللهِ أَحَقُّ وَأَوْثَقُ»
30.89 [Machine] Selling Correspondence Before Anything is Written
٣٠۔٨٩ بَيْعُ الْمُكَاتَبَةِ قَبْلَ أَنْ تَقْضِيَ مِنْ كِتَابَتِهَا شَيْئًا

يَا عَائِشَةُ إِنِّي كَاتَبْتُ أَهْلِي عَلَى تِسْعِ أَوَاقٍ فِي كُلِّ عَامٍ وُقِيَّةٌ فَأَعِينِينِي وَلَمْ تَكُنْ قَضَتْ مِنْ كِتَابَتِهَا شَيْئًا فَقَالَتْ لَهَا عَائِشَةُ وَنَفِسَتْ فِيهَا ارْجِعِي إِلَى أَهْلِكِ فَإِنْ أَحَبُّوا أَنْ أُعْطِيَهُمْ ذَلِكَ جَمِيعًا وَيَكُونَ وَلَاؤُكِ لِي فَعَلْتُ فَذَهَبَتْ بَرِيرَةُ إِلَى أَهْلِهَا فَعَرَضَتْ ذَلِكَ عَلَيْهِمْ فَأَبَوْا وَقَالُوا إِنْ شَاءَتْ أَنْ تَحْتَسِبَ عَلَيْكِ فَلْتَفْعَلْ وَيَكُونَ ذَلِكَ لَنَا فَذَكَرَتْ ذَلِكَ عَائِشَةُ لِرَسُولِ اللهِ ﷺ فَقَالَ «لَا يَمْنَعُكِ ذَلِكَ مِنْهَا ابْتَاعِي وَأَعْتِقِي؛ فَإِنّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ» فَفَعَلَتْ وَقَامَ رَسُولُ اللهِ ﷺ فَحَمِدَ اللهَ ثُمَّ قَالَ «أَمَّا بَعْدُ فَمَا بَالُ أُنَاسٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللهِ مَنِ اشْتَرَطَ شَرْطًا لَيْسَ فِي كِتَابِ اللهِ فَهُوَ بَاطِلٌ وَإِنْ كَانَ مِائَةُ شَرْطٍ قَضَاءُ اللهِ أَحَقُّ وَشَرْطُ اللهِ أَوْثَقُ وَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ»

٣٠۔٩١ بَيْعُ الْمَاءِ

أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ الْمَاءِ
[Machine] I heard the Messenger of Allah ﷺ forbidding the selling of water and giving preference to Abdullah.
سَمِعْتُ رَسُولَ اللهِ ﷺ يَنْهَى عَنْ بَيْعِ الْمَاءِ وَاللَّفْظُ لِعَبْدِ اللهِ
30.92 [Machine] Sale of Water Rights
٣٠۔٩٢ بَيْعُ فَضْلِ الْمَاءِ
the Messenger of Allah forbade selling surplus water. The keeper of al-Wahat sold the surplus water of al-Wahat, and 'Abdullah bin 'Arm disapproved of that. (Using translation from Nasāʾī 4662)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ فَضْلِ الْمَاءِ قَالَ وَبَاعَ قَيِّمُ الْوَهْطِ فَضْلَ مَاءِ الْوَهْطِ فَكَرِهَهُ عَبْدُ اللهِ بْنُ عَمْرِو بْنِ الْعَاصِ
"do not sell surplus water, for the Prophet forbade the sale of surplus water." (Using translation from Nasāʾī 4663)
أَخْبَرَهُ أَنَّ إِيَاسَ بْنَ عَبْدٍ صَاحِبَ النَّبِيِّ ﷺ قَالَ لَا تَبِيعُوا فَضْلَ الْمَاءِ؛ فَإِنَّ النَّبِيَّ ﷺ نَهَى عَنْ بَيْعِ فَضْلِ الْمَاءِ

٣٠۔٩٣ بَيْعُ الْخَمْرِ
A person presented to Messenger of Allah ﷺ a small water-skin of wine. Messenger of Allah ﷺ said to him: Do you know that Allah has forbidden it? He said: No. He then whispered to another man. Messenger of Allah ﷺ asked him what he had whispered. He said: I advised him to sell that, whereupon he (the Holy Prophet) said: Verily He Who has forbidden its drinking has forbidden its sale also. He (the narrator) said: He opened the waterskin until what was contained in it was spilt. (Using translation from Muslim 1579a)
ابْنُ عَبَّاسٍ أَهْدَى رَجُلٌ لِرَسُولِ اللهِ ﷺ رَاوِيَةَ خَمْرٍ فَقَالَ لَهُ النَّبِيُّ ﷺ «هَلْ عَلِمْتَ أَنَّ اللهَ حَرَّمَهَا؟» يَعْنِي وَكَلِمَةً مَعْنَاهَا فَسَارَّ إِنْسَانًا إِلَى جَنْبِهِ فَقَالَ لَهُ النَّبِيُّ ﷺ «بِمَ سَارَرْتَهُ؟» قَالَ أَمَرْتُهُ أَنْ بِبَيْعِهَا فَقَالَ رَسُولُ اللهِ ﷺ «إِنَّ الَّذِي حَرَّمَ شُرْبَهَا حَرَّمَ بَيْعَهَا» فَفَتَحَ الْمَزَادَتَيْنِ حَتَّى ذَهَبَ مَا فِيهِمَا
"When the Verses of Riba were revealed, the Messenger of Allah ﷺ stood up on the Minbar and recited them to the people, then he forbade dealing in wine." (Using translation from Nasāʾī 4665)
لَمَّا نَزَلَتْ آيَاتُ الرِّبَا قَامَ رَسُولُ اللهِ ﷺ عَلَى الْمِنْبَرِ فَتَلَاهُنَّ عَلَى النَّاسِ ثُمَّ حَرَّمَ التِّجَارَةَ فِي الْخَمْرِ

٣٠۔٩٤ بَيْعُ الْكَلْبِ
The Prophet ﷺ prohibited taking the price of a dog, the earnings of a soothsayer and the money earned by prostitution. (Using translation from Bukhārī 5346)
نَهَى رَسُولُ اللهِ ﷺ عَنْ ثَمَنِ الْكَلْبِ وَمَهْرِ الْبَغِيِّ وَحُلْوَانِ الْكَاهِنِ
"The Messenger of Allah said - among the things that be forbade - 'And the price of a dog." (Using translation from Nasāʾī 4667)
قَالَ رَسُولُ اللهِ ﷺ فِي أَشْيَاءَ حَرَّمَهَا وَثَمَنُ الْكَلْبِ
30.95 [Machine] What is excluded from it?
٣٠۔٩٥ مَا اسْتُثْنِيَ مِنْهُ
[Machine] "That the Prophet ﷺ prohibited the price of dogs and images, except for hunting dogs. Al-Nasai said: This hadith is disliked."
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ ثَمَنِ السِّنَّوْرِ وَالْكَلْبِ إِلَّا كَلْبَ صَيْدٍ قَالَ النَّسَائِيُّ هَذَا الْحَدِيثُ مُنْكَرٌ
30.96 [Machine] The Sale of a Pig
٣٠۔٩٦ بَيْعُ الْخِنْزِيرِ
That he heard the Messenger of Allah ﷺ say in the year of the Conquest when he was in Mecca: Allah has forbidden the sale of wine, animals which have dead natural death, swine and idols. He was asked: Messenger of Allah, what do you think of the fat of animals which had died a natural death, for it was used for caulking ships, greasing skins, and making oil for lamps? He replies: No, it is forbidden. Thereafter, the Messenger of Allah ﷺ said: May Allah curse the Jews! When Allah declared the fat of such animals lawful, they melted it, then sold it, and enjoyed the price they received. (Using translation from Abū Dāʾūd 3486)
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ عَامَ الْفَتْحِ وَهُوَ بِمَكَّةَ «إِنَّ اللهَ وَرَسُولَهُ حَرَّمَ بَيْعَ الْخَمْرِ وَالْمَيْتَةِ وَالْخِنْزِيرِ وَالْأَصْنَامِ» فَقِيلَ يَا رَسُولَ اللهِ أَرَأَيْتَ شُحُومَ الْمَيْتَةِ؛ فَإِنَّهُ تُطْلَى بِهَا السُّفُنُ وَتُدْهَنُ بِهَا الْجُلُودُ وَيَسْتَصْبِحُ بِهَا النَّاسُ فَقَالَ «لَا هُوَ حَرَامٌ» فَقَالَ رَسُولُ اللهِ ﷺ عِنْدَ ذَلِكَ قَاتَلَ اللهُ الْيَهُوَدَ؛ إِنَّ اللهَ لَمَّا حَرَّمَ عَلَيْهِمْ شُحُومَهَا أَجْمَلُوهُ ثُمَّ بَاعُوهُ فَأَكَلُوا ثَمَنَهُ

٣٠۔٩٧ بَيْعُ ضِرَابِ الْجَمَلِ
"The Messenger of Allah forbade charging stud fees for a camel, the sale of water, the renting of land for cultivation. Selling one's land and water, this is what the Prophet forbade." (Using translation from Nasāʾī 4670)
أَنَّهُ سَمِعَ جَابِرًا يَقُولُ نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ ضِرَابِ الْجَمَلِ وَعَنْ بَيْعِ الْمَاءِ وَبَيْعِ الْأَرْضِ لِتُحْتَرَثَ يَبِيعُ الرَّجُلُ أَرْضَهُ وَمَاءَهُ فَعَنْ ذَلِكَ نَهَى النَّبِيُّ ﷺ
The Messenger of Allah ﷺ forbade (taking hire for) a stallion's covering. (Using translation from Abū Dāʾūd 3429)
نَهَى رَسُولُ اللهِ ﷺ عَنْ عَسْبِ الْفَحْلِ
"A man from Banu As-Sa'q, one of Banu Kilab, came to the Messenger of Allah and asked him about charging stud fees for a stallion. He forbade him to do that, but he said: 'We give payment for that. "' (Using translation from Nasāʾī 4672)
جَاءَ رَجُلٌ مِنْ بَنِي الصَّعْقِ أَحَدِ بَنِي كِلَابٍ إِلَى رَسُولِ اللهِ ﷺ فَسَأَلَهُ عَنْ عَسْبِ الْفَحْلِ فَنَهَاهُ عَنْ ذَلِكَ فَقَالَ إِنَّا نُكْرَمُ عَلَى ذَلِكَ
"The Messenger of Allah forbade the earnings of a cupper, the price of a dog and stud fees for a stallion." (Using translation from Nasāʾī 4673)
سَمِعْتُ أَبَا هُرَيْرَةَ يَقُولُ نَهَى رَسُولُ اللهِ ﷺ عَنْ كَسْبِ الْحَجَّامِ وَعَنْ ثَمَنِ الْكَلْبِ وَعَسْبِ الْفَحْلِ
The Messenger of Allah ﷺ forbade (taking hire for) a stallion's covering. (Using translation from Abū Dāʾūd 3429)
نَهَى رَسُولُ اللهِ ﷺ عَنْ عَسْبِ الْفَحْلِ
[Machine] The Messenger of Allah ﷺ prohibited the price of a dog and the price of a he-goat. 6227 And it was narrated by 'Ali ibn Maymun from Ibn Fudayl from Al-A'mash through him.
نَهَى رَسُولُ اللهِ ﷺ عَنْ ثَمَنِ الْكَلْبِ وَعَسْبِ التَّيْسِ 6227 وَعَنِ عَلِيِّ بْنِ مَيْمُونٍ عَنِ ابْنِ فُضَيْلٍ عَنِ الْأَعْمَشِ بِهِ
30.98 [Machine] The man buys something and goes bankrupt, while the purchase remains in his possession.
٣٠۔٩٨ الرَّجُلُ يَبْتَاعُ الْبَيْعَ فَيُفْلِسُ، وَيُوجَدُ الْمَتَاعُ بِعَيْنِهِ
"If a person becomes bankrupt, then a man finds the goods that he sold to him with him, he has more right to them than anyone else." (Using translation from Nasāʾī 4676)
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ أَيُّمَا امْرِئٍ أَفْلَسَ ثُمَّ وَجَدَ رَجُلٌ عِنْدَهُ سِلْعَتَهُ بِعَيْنِهَا فَهُوَ أَوْلَى بِهَا مِنْ غَيْرِهِ
if a man becomes bankrupt, then a specific item is found with him, and is recognized, then it belongs to the one who sold it to him. (Using translation from Nasāʾī 4677)
عَنِ النَّبِيِّ ﷺ عَنِ الرَّجُلِ يُعْدِمُ إِذَا وُجِدَ عِنْدَهُ الْمَتَاعُ بِعَيْنِهِ وَعَرَفَهُ أَنَّهُ لِصَاحِبِهِ الَّذِي بَاعَهُ
In the time of the Messenger of Allah ﷺ a man suffered loss affecting fruits he had bought and owed a large debt, so the Messenger of Allah ﷺ said: Give him sadaqah (alms). So the people gave him sadaqah (alms), but as that was not enough to pay the debt in full, the Messenger of Allah ﷺ said: Take what you find. But that is all you may have. (Using translation from Abū Dāʾūd 3469)
أُصِيبَ رَجُلٌ فِي عَهْدِ رَسُولِ اللهِ ﷺ فِي ثِمَارٍ ابْتَاعَهَا فَكَثُرَ دَيْنُهُ فَقَالَ رَسُولُ اللهِ ﷺ «تَصَدَّقُوا عَلَيْهِ فَتَصَدَّقُوا عَلَيْهِ فَلَمْ يَبْلُغْ ذَلِكَ وَفَاءَ دَيْنِهِ» فَقَالَ رَسُولُ اللهِ ﷺ خُذُوا مَا وَجَدْتُمْ وَلَيْسَ لَكُمْ إِلَّا ذَلِكَ
30.99 [Machine] The man sells the merchandise and deserves it deserving upon him.
٣٠۔٩٩ الرَّجُلُ يَبِيعُ السِّلْعَةَ فَيَسْتَحِقُّهَا مُسْتَحِقٌّ عَلَيْهِ
the Messenger of Allah ruled that if a man found (his goods) in the possession of a man who was not guilty, then if he wished he could give the man what he had paid for it, or if he wished he could go after the one who had stolen it. Abu Bakr and 'Umar passed similar judgments. (Using translation from Nasāʾī 4679)
أَنَّ رَسُولَ اللهِ ﷺ قَضَى أَنَّهُ إِذَا وَجَدَهَا فِي يَدِ الرَّجُلِ غَيْرِ الْمُتَّهَمِ فَإِنْ شَاءَ أَخَذَهَا بِمَا اشْتَرَاهَا وَإِنْ شَاءَ اتَّبَعَ سَارِقَهُ وَقَضَى بَعْدَهُ بِذَلِكَ أَبُو بَكْرٍ وَعُمَرُ
there was the governor of Al-Yamamah, and Marwan wrote to him saying that Mu'awiyah had written to him, saying that any man who had something stolen from him had more right to it wherever he found it. Then Marwan wrote saying that to me (Usaid). I wrote to Marwan saying that the Prophet had ruled that if the one who bought it from the one who stole it is ot guilty of anything (and did not realize that it was stolen goods), then the owner has the choice: If he wishes, he may buy it from the one who bought it from the thief, or if he wishes he may go after the thief. Abu Bakr, 'Umar and 'Uthman also passed judgment along these lines. Marwan sent my letter to Mu'awiyah, and Mu'awiyah wrote to Marwan (saying): 'Neither you nor Usaid are in a position to tell me what to do, rather I am the one who tells you what to do because I am superior in rank to you, so do what I tell you.' Marwan sent the letter of Mu'awiyah to me, and I said: I will not judge according to Mu'awiyah's opinion as long as I am the governor."' (Using translation from Nasāʾī 4680)
أَنَّ أَيَّمَا رَجُلٍ سُرِقَ مِنْهُ سَرِقَةٌ فَهُوَ أَحَقُّ بِهَا حَيْثُ مَا وَجَدَهَا ثُمَّ كَتَبَ بِذَلِكَ مَرْوَانُ إِلَيَّ فَكَتَبْتُ إِلَى مَرْوَانَ أَنَّ النَّبِيَّ ﷺ قَضَى بِأَنَّهُ «إِذَا كَانَ الَّذِي ابْتَاعَهَا مِنَ الَّذِي سَرَقَهَا غَيْرُ مُتَّهَمٍ فَخُيِّرَ سَيِّدُهَا فَإِنْ شَاءَ أَخَذَ الَّذِي سُرِقَ مِنْهُ بِثَمَنِهِ وَإِنْ شَاءَ اتَّبَعَ سَارِقَهُ» ثُمَّ قَضَى بِذَلِكَ بَعْدَهُ أَبُو بَكْرٍ وَعُمَرُ وَعُثْمَانُ فَبَعَثَ مَرْوَانُ بِكِتَابِي إِلَى مُعَاوِيَةَ فَكَتَبَ مُعَاوِيَةُ إِلَى مَرْوَانَ إِنَّكَ لَسْتَ أَنْتَ وَلَا أُسَيْدٌ بِقَاضِيَيْنِ وَلَكِنِّي أُقَاضِي فِيمَا وُلِّيْتُ عَلَيْكُمَا فَأَنْفِذْ لِمَا أَمَرْتُكَ بِهِ فَبَعَثَ مَرْوَانُ إِلَيَّ بِكِتَابِ مُعَاوِيَةَ فَقُلْتُ لَا أَقْضِي بِهِ مَا وُلِّيْتُ بِمَا قَالَ مُعَاوِيَةُ
"A man has more right to his own wealth when he finds it, and the buyer should pursue the one who sold it to him." (Using translation from Nasāʾī 4681)
قَالَ رَسُولُ اللهِ ﷺ «الرَّجُلُ أَحَقُّ بِعَيْنِ مَالِهِ إِذَا وَجَدَهُ وَيَتْبَعُ الْبَيْعُ مَنْ بَاعَهُ»
30.100 [Machine] The man sells the commodity from a man, then sells it as is from another.
٣٠۔١٠٠ الرَّجُلُ يَبِيعُ السِّلْعَةَ مِنْ رَجُلٍ، ثُمَّ يَبِيعُهَا بِعَيْنِهَا مِنْ آخَرَ
[Machine] The Messenger of Allah ﷺ said, "Whichever woman is married by two guardians, she belongs to the first of them, and whoever sells something by two men, it belongs to the first of them." Ibn Sa'd narrated to me, Qatan ibn Ibrahim said, Hafs said, Ibrahim told us, on the authority of Sa'id, on the authority of Qatadah, on the authority of Al-Hasan, on the authority of 'Uqbah ibn 'Amir and Samurah ibn Jundub, who reported that the Messenger of Allah ﷺ said, "His example is equal."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِيَ لِلْأَوَّلِ مِنْهُمَا وَمَنْ بَاعَ بَيْعًا مِنْ رَجُلَيْنِ فَهُوَ لِلْأَوَّلِ مِنْهُمَا» 6235 أَخْبَرَنِي قَطَنُ بْنُ إِبْرَاهِيمَ قَالَ حَدَّثَنَا حَفْصٌ قَالَ حَدَّثَنَا إِبْرَاهِيمُ عَنْ سَعِيدٍ عَنْ قَتَادَةَ عَنِ الْحَسَنِ عَنْ عُقْبَةَ بْنِ عَامِرٍ وَسَمُرَةَ بْنِ جُنْدُبٍ قَالَا قَالَ رَسُولُ اللهِ ﷺ مِثْلَهُ سَوَاءً
30.101 [Machine] Borrowing
٣٠۔١٠١ الِاسْتِقْرَاضُ
"The Prophet borrowed forty thousand from me, then some wealth came to him, and he paid me back and said: 'May Allah bless your family and your wealth for you: the reward for lending is praise and repayment." (Using translation from Nasāʾī 4683)
اسْتَقْرَضَ مِنِّي النَّبِيُّ ﷺ أَرْبَعِينَ أَلْفًا فَجَاءَهُ مَالٌ فَدَفَعَهُ إِلَيَّ وَقَالَ «بَارَكَ اللهُ لَكَ فِي أَهْلِكَ وَمَالِكَ إِنَّمَا جَزَاءُ السَّلَفِ الْحَمْدُ وَالْأَدَاءُ»
30.102 [Machine] Intensification in religion.
٣٠۔١٠٢ التَّغْلِيظُ فِي الدِّينِ
"We were sitting with the Messenger of Allah when he raised his head toward the sky, and put his palm on his forehead, then he said: 'Subhan Allah, what a stern warning has been revealed! We fell silent and were scared. The following day I asked him: 'O Messenger of Allah, what is this stern warning that has been revealed? He said: 'By the One in Whose hand is my soul, if a man were to be killed in the cause of Allah then brought back to life, then killed, but he owed a debt, he would not enter paradise until his debt was paid off," (Using translation from Nasāʾī 4684)
كُنَّا جُلُوسًا عِنْدَ رَسُولِ اللهِ ﷺ فَرَفَعَ رَأْسَهُ إِلَى السَّمَاءِ ثُمَّ وَضَعَ رَاحَتَهُ عَلَى جَبْهَتِهِ ثُمَّ قَالَ «سُبْحَانَ اللهِ مَاذَا نُزِّلَ مِنَ التَّشْدِيدِ؟» فَسَكَتْنَا وَفَرِقْنَا فَلَمَّا كَانَ مِنَ الْغَدِ سَأَلْتُهُ يَا رَسُولَ اللهِ مَا هَذَا التَّشْدِيدُ الَّذِي نُزِّلَ؟ فَقَالَ «وَالَّذِي نَفْسِي بِيَدِهِ لَوْ أَنَّ رَجُلًا قُتِلَ فِي سَبِيلِ اللهِ ثُمَّ أُحْيِيَ ثُمَّ قُتِلَ ثُمَّ أُحْيِيَ ثُمَّ قُتِلَ وَعَلَيْهِ دِينٌ مَا دَخَلَ الْجَنَّةَ حَتَّى يُقْضَى عَنْهُ دَيْنُهُ»
[Machine] We were with the Prophet ﷺ at a funeral, and he said, "Oh! Here is someone from the family of so-and-so." He said this three times, and then a man stood up and said, "O Messenger of Allah, what prevented you from responding to me the first two times? Indeed, I did not inform you about him except with something good. Verily, so-and-so, one of them, has died while burdened by a debt." And this has been narrated by more than one person from Ash-Sha`bi from Samurah. It has also been narrated from Ash-Sha`bi from the Prophet ﷺ as a Marfu` Hadith, and we do not know anyone who has reported it from Sam'an other than Sa'id bin Masruq.
كُنَّا مَعَ النَّبِيِّ ﷺ فِي جَنَازَةٍ فَقَالَ «أَهَاهُنَا مِنْ بَنِي فُلَانٍ أَحَدٌ» ثَلَاثًا فَقَامَ رَجُلٌ فَقَالَ النَّبِيُّ ﷺ «مَا مَنَعَكَ فِي الْمَرَّتَيْنِ الْأُولَيَيْنِ أَنْ لَا تَكُونَ أَجَبْتَنِي؟ أَمَا إِنِّي لَمْ أُنَوِّهْ بِكَ إِلَّا بِخَيْرٍ إِنَّ فُلَانًا لِرَجُلٍ مِنْهُمْ مَاتَ مَأْسُورًا بِدَيْنِهِ» وَقَدْ رَوَاهُ غَيْرُ وَاحِدً عَنِ الشَّعْبِيِّ عَنْ سَمُرَةَ وَقَدْ رُوِيَ أَيْضًا عَنِ الشَّعْبِيِّ عَنِ النَّبِيِّ ﷺ مُرْسَلًا وَلَا نَعْلَمُ أَحَدًا قَالَ فِي هَذَا الْحَدِيثِ عَنْ سَمْعَانَ غَيْرَ سَعيْدِ بْنِ مَسْرُوقٍ
30.103 [Machine] Facilitation in it
٣٠۔١٠٣ التَّسْهِيلُ فِيهِ
[Machine] I heard my dear friend and prophet ﷺ say, "No one incurs a debt and Allah knows that they intend to repay it, except that Allah will settle it for them in this world."
سَمِعْتُ خَلِيلِي وَصَفِيِّي ﷺ يَقُولُ «مَا مِنْ أَحَدٍ يَدَّانُ دَيْنًا فَعَلِمَ اللهُ أَنَّهُ يُرِيدُ قَضَاءَهُ إِلَّا أَدَّاهُ اللهُ عَنْهُ فِي الدُّنْيَا»
"O Mother of the Believers, why have you taken a loan when you do not have the means to pay if off?" She said: "I heard the Messenger of Allah say: 'Whoever takes a loan intending to pay it back, Allah, the Mighty and Sublime, will help him."' (Using translation from Nasāʾī 4687)
أَنَّ مَيْمُونَةَ زَوْجَ النَّبِيِّ ﷺ اسْتَدَانَتْ فَقِيلَ لَهَا يَا أُمَّ الْمُؤْمِنِينَ تَسْتَدِينِينَ وَلَيْسَ عِنْدَكِ وَفَاءٌ؟ قَالَتْ إِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ أَخَذَ دَيْنًا وَهُوَ يُرِيدُ أَنْ يُؤَدِّيَهُ أَعَانَهُ اللهُ
30.104 [Machine] The Sight of the Rich
٣٠۔١٠٤ مَطْلُ الْغَنِيِّ
“(Wrongdoing) is when a rich man takes a long time to repay a debt, and if one of you is referred to a rich man (to collect a debt), he should accept that referral.” (Using translation from Ibn Mājah 2403)
عَنِ النَّبِيِّ ﷺ قَالَ إِذَا أُتْبِعَ أَحَدُكُمْ عَلَى مَلِيءٍ فَلْيَتْبَعْ وَالظُّلْمُ مَطْلُ الْغَنِيِّ
"The Messenger of Allah said: 'if one who can afford it delay repayment, his honor and punishment become permissible."' (Using translation from Nasāʾī 4689)
قَالَ رَسُولُ اللهِ ﷺ لَيُّ الْوَاجِدِ يُحِلُّ عِرْضَهُ وَعُقُوبَتَهُ
"The Messenger of Allah said: 'if one who can afford it delay repayment, his honor and punishment become permissible."' (Using translation from Nasāʾī 4689)
عَنْ رَسُولِ اللهِ ﷺ قَالَ لَيُّ الْوَاجِدِ يُحِلُّ عِرْضَهُ وَعُقُوبَتَهُ

٣٠۔١٠٥ الْحَوَالَةُ
The Messenger of Allah ﷺ as saying: Delay in payment (of debt) by a rich man is injunctive, but when one of you is referred to a wealthy man, he should accept the reference. (Using translation from Abū Dāʾūd 3345)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَطْلُ الْغَنِيِّ ظُلْمٌ وَإِذَا أُتْبِعَ أَحَدُكُمْ عَلَى مَلِيءٍ فَلْيَتْبَعْ
30.106 [Machine] Debt Guarantee
٣٠۔١٠٦ الْكَفَالَةُ بِالدَّيْنِ
"Your companion owes a debt. " Abu Qutdah said: "I will guarantee it for him. "The prophet said: "In full?" He said: "In full." (Sahah) (Using translation from Nasāʾī 4692)
أَنَّ رَجُلًا مِنَ الْأَنْصَارِ أُتِيَ بِهِ النَّبِيُّ ﷺ؛ لَيُصَلِّي عَلَيْهِ فَقَالَ إِنَّ «عَلَى صَاحِبِكُمْ دِينًا» فَقَالَ أَبُو قَتَادَةَ أَنَا أَكْفُلُ بِهِ قَالَ «بِالْوَفَاءِ؟» قَالَ بِالْوَفَاءِ
30.107 [Machine] Encouragement in accepting the decree
٣٠۔١٠٧ التَّرْغِيبُ فِي حُسْنِ الْقَضَاءِ
"The best of you is the one who is best in repaying." (Using translation from Nasāʾī 4693)
عَنْ رَسُولِ اللهِ ﷺ قَالَ «خِيَارُكُمْ أَحْسَنُكُمْ قَضَاءً»
30.108 [Machine] Good treatment and gentleness in demanding.
٣٠۔١٠٨ حُسْنُ الْمُعَامَلَةِ، وَالرِّفْقُ فِي الْمُطَالَبَةِ
"There was a man who never did any good deed, but he used to lend to people and he would say to this messenger: "Take what can be paid easily and leave what is difficult, let them off, and perhaps Allah, the Mighty and Sublime, said to him: 'Did you ever do any good did? He said: No, but I had a slave and I used to lend to people. When I sent him to collect the debts I said to him: Take what can he paid easily and leave what is difficult; let them off, and perhaps Allah will let us off. Allah, the Most High, said: 'I have let you off."' (Using translation from Nasāʾī 4694)
عَنْ رَسُولِ اللهِ ﷺ قَالَ إِنَّ رَجُلًا لَمْ يَعْمَلْ خَيْرًا قَطُّ وَكَانَ يُدَايِنُ النَّاسَ فَيَقُولُ لِرَسُولِهِ خُذْ مَا يَسُرَ وَاتْرُكْ مَا عَسُرَ وَتَجَاوَزْ؛ لَعَلَّ اللهَ أَنْ يَتَجَاوَزَ عَنَّا فَلَمَّا هَلَكَ قَالَ اللهُ لَهُ عَمِلْتَ خَيْرًا قَطُّ؟ قَالَ لَا إِلَّا أَنَّهُ كَانَ لِي غُلَامٌ فَكُنْتُ أُدَايِنُ النَّاسَ فَإِذَا بَعَثْتُهُ يَتَقَاضَى قُلْتُ لَهُ خُذْ مَا يَسُرَ وَاتْرُكْ مَا عَسُرَ وَتَجَاوَزْ لَعَلَّ اللهَ يَتَجَاوَزُ عَنَّا قَالَ اللهُ تَعَالَى قَدْ تَجَاوَزْنَا عَنْكَ
The prophet said: "A man used to lend to people, but if he realized that someone was going through hardship, he would say to his slave: 'Let him off, perhaps Allah, the Most High, will let us off.' And when he met Allah, He let him off." (Using translation from Nasāʾī 4695)
أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ إِنَّ النَّبِيَّ ﷺ قَالَ كَانَ رَجُلٌ يُدَايِنُ النَّاسَ وَكَانَ إِذَا رَأَى إِعْسَارَ الْمُعْسِرِ قَالَ لِفَتَاهُ تَجَاوَزْ عَنْهُ؛ لَعَلَّ اللهَ يَتَجَاوَزُ عَنَّا فَلَقِيَ اللهَ فَتَجَاوَزَ عَنْهُ
I heard the Messenger of Allah ﷺ say: “Allah admitted to Paradise a man who was easy-going in buying and selling, when paying off debt and when asking for a debt that was owed to him.” (Using translation from Aḥmad 485)
قَالَ رَسُولُ اللهِ ﷺ أَدْخَلَ اللهُ الْجَنَّةَ رَجُلًا كَانَ سَهْلًا مُشْتَرِيًا وَبَائِعًا وَقَاضِيًا وَمُقْتَضِيًا
30.109 [Machine] The company without capital
٣٠۔١٠٩ الشَّرِكَةُ بِغَيْرِ رَأْسِ مَالٍ
"I formed a partnership with 'Ammar and Sa'd on the day of Badr. Sa'd brought two prisoners but 'Ammar and I did not bring anything." (Using translation from Nasāʾī 3937)
اشْتَرَكْتُ أَنَا وَعَمَّارٌ وَسَعْدٌ يَوْمَ بَدْرٍ فَجَاءَ سَعْدٌ بِأَسِيرَيْنِ وَلَمْ أَجِئْ أَنَا وَعَمَّارٌ بِشَيْءٍ
30.110 [Machine] The company in Al-Raqiq.
٣٠۔١١٠ الشَّرِكَةُ فِي الرَّقِيقِ
"Whoever sets free his share of a slave should set him free completely from his own wealth, if he has enough wealth to cover the price of the slave." (Using translation from Nasāʾī 4698)
أَنَّ النَّبِيَّ ﷺ قَالَ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ أُتِمَّ مَا بَقِيَ فِي مَالِهِ إِنْ كَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَ الْعَبْدِ
"The Messenger of Allah said: 'Whoever sets free his share of a slave, and he has sufficient wealth to set him free completely by paying the price of the slave, then he should set him free with his own wealth."' (Using translation from Nasāʾī 4699)
قَالَ رَسُولُ اللهِ ﷺ «مَنْ أَعْتَقَ شِرْكًا لَهُ فِي مَمْلُوكٍ وَكَانَ لَهُ مِنَ الْمَالِ مَا يَبْلُغُ ثَمَنَهُ بِقِيمَةِ الْعَدْلِ فَهُوَ عَتِيقٌ مِنْ مَالِهِ»
30.111 [Machine] The company in the palm trees
٣٠۔١١١ الشَّرِكَةُ فِي النَّخِيلِ
"Any one of you who has land, or date palm trees, he should not sell them until he offers them to his partner first." (Using translation from Nasāʾī 4700)
أَنَّ النَّبِيَّ ﷺ قَالَ «أَيُّكُمْ كَانَتْ لَهُ أَرْضٌ أَوْ نَخْلٌ فَلَا يَبِعْهَا حَتَّى يَعْرِضَهَا عَلَى شَرِيكِهِ»
30.112 [Machine] The company in the quadrilateral.
٣٠۔١١٢ الشَّرِكَةُ فِي الرِّبَاعِ
Jabir bin 'Abdullah (Allah be pleased with them) said that the Messenger of Allah ﷺ decreed pre-emption in every joint ownership and not divided-the one-it may be a dwelling or a garden. It is not lawful for him (for the partner) to sell that until his partner gives his consent. He (the partner) is entitled to buy it when he desires and he can abandon it if he so likes. And if he (the one partner) sells it without getting the consent of the (other partner), he has the greatest right to it. (Using translation from Muslim 1608b)
قَضَى رَسُولُ اللهِ ﷺ بِالشُّفْعَةِ فِي كُلِّ شِرْكٍ لَمْ يُقْسَمْ رَبْعَةٍ أَوْ حَائِطٍ لَا يَحِلُّ لَهُ أَنْ يَبِيعَهُ حَتَّى يُؤْذِنَ شَرِيكَهُ فَإِنْ شَاءَ أَخَذَ وَإِنْ شَاءَ تَرَكَ فَإِنْ بَاعَ وَلَمْ يُؤْذِنْهُ فَهُوَ أَحَقُّ بِهِ 6255 وَعَنْ يُوسُفَ بْنِ سَعِيدٍ عَنْ حَجَّاجِ بْنِ مُحَمَّدٍ عَنِ ابْنِ جُرَيْجٍ بِهِ
30.113 [Machine] The mention of intercession and its rules
٣٠۔١١٣ ذِكْرُ الشُّفَعِ وَأَحْكَامِهَا
[Machine] The Messenger of Allah ﷺ said, "The neighbor has the most right to your companionship." (Hadith 6257) And Mahmoud Ibn Ghaylan narrated from Abu Nuaim from Sufyan Ath-Thawri from Ibrahim Ibn Maysarah with it.
