٣٠۔ كِتَابُ الْبُيُوعِ ص ٦
"O Messenger of Allah, not one else has any share in my land, but there are neighbors." He said: "The neighbor has more right to property that is near." (Using translation from Nasāʾī 4703)
يَا رَسُولَ اللهِ ﷺ أَرْضِي لَيْسَ لِأَحَدٍ فِيهَا شِرْكٌ وَلَا قِسْمٌ إِلَّا الْجِوَارَ فَقَالَ رَسُولُ اللهِ ﷺ «الْجَارُ أَحَقُّ بِسَقَبِهِ»
[Machine] The Prophet ﷺ said, "The partner is a mediator, and mediation is in everything." (6260) And Muhammad ibn Ali ibn Maymun al-Raqqi narrated from Muhammad ibn Yusuf al-Firiyabi from Israel from Abdul Aziz ibn Rufai from Ibn Abi Mulayka from the Prophet ﷺ.
عَنِ النَّبِيِّ ﷺ قَالَ «الشَّرِيكُ شَفِيعٌ وَالشُّفْعَةُ فِي كُلِّ شَيْءٍ» 6260 وَعَنْ مُحَمَّدِ بْنِ عَلِيِّ بْنِ مَيْمُونٍ الرَّقِّيِّ عَنْ مُحَمَّدِ بْنِ يُوسُفَ الْفِرْيَابِيِّ عَنْ إِسْرَائِيلَ عَنْ عَبْدِ الْعَزِيزِ بْنِ رُفَيْعٍ عَنْ ابْنِ أَبِي مُلَيْكَةَ عَنِ النَّبِيِّ ﷺ
the Messenger of Allah ﷺ ruled concerning preemption of land that has not been divided; if the boundaries have been set then there is no preemption. (Using translation from Ibn Mājah 2497)
أَنَّ رَسُولَ اللهِ ﷺ قَضَى بِالشُّفْعَةِ فِيمَا لَمْ يُقْسَمْ فَإِذَا وَقَعَتِ الْحُدُودُ فَلَا شُفْعَةَ
The Messenger of Allah ﷺ decreed the right to buy the neighboring property applicable to everything which is not divided, but when boundaries are fixed and separate roads made, there is no option. (Using translation from Abū Dāʾūd 3514)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الشُّفْعَةُ فِي كُلِّ مَالٍ لَمْ يُقْسَمْ فَإِذَا وَقَعَتِ الْحُدُودُ وَصُرِفَتِ الطُّرُقُ فَلَا شُفْعَةَ»
"The Messenger of Allah decreed the principle of pre-emption, and the (rights of) neighbors." (Using translation from Nasāʾī 4705)
قَضَى رَسُولُ اللهِ ﷺ بِالشُّفْعَةِ وَالْجِوَارِ
The Prophet ﷺ said: The neighbour is most entitled to the right of pre-emption, and he should wait for its exercise even if he is absent, when the two properties have one road. (Using translation from Abū Dāʾūd 3518)
عَنِ النَّبِيِّ ﷺ قَالَ «الْجَارُ أَحَقُّ بِشُفْعَةِ جَارِهِ يَنْتَظِرُ بِهَا وَإِنْ كَانَ غَائِبًا إِذَا كَانَ طَرِيقُهُمَا وَاحِدًا»
[Machine] "To fulfill the neighbor's right through intercession."
أَنْ أَقْضِيَ لِلْجَارِ بِالشُّفْعَةِ
[Machine] "The partner has more right than the neighbor, and the neighbor has more right than others."
«الشَّرِيكُ أَحَقُّ مِنَ الْجَارِ وَالْجَارُ أَحَقُّ مِنْ غَيْرِهِ»
[Machine] "The mixture is fairer than the advocate, and the advocate is fairer than anyone else."
«الْخَلِيطُ أَحَقُّ مِنَ الشَّفِيعِ وَالشَّفِيعُ أَحَقُّ مِمَّنْ سِوَاهُ»
[Machine] About the common people in a man who bought a rock and built on it, then the intercessor comes and says, "He should take the value," meaning the value of the building.
عَنِ الشَّعْبِيِّ فِي رَجُلٍ اشْتَرَى صَخْرًا فَابْتَنَي فِيهَا ثُمَّ يَجِيءُ الشَّفِيعُ قَالَ «يَأْخُذُ بِالْقِيمَةِ» يَعْنِي قِيمَةَ الْبِنَاءِ
[Machine] "لا شفعة لغائب" is an Arabic proverb. The translation is: "There is no intercession for the absent."
As for the mention of "الشيباني" referenced in the passage, it seems to refer to a specific individual but without further context, it is difficult to provide an accurate translation.

[Machine] Umar ibn Abdul Aziz passed away after a few weeks, and he was absent.
