Return to your people ; if you like that I make payment for the purchase of your freedom on your behalf and I shall have the right to inherit from you, I shall do so. Barirah mentioned it to her people, but they refused and said: If she wants to purchase your freedom for reward from Allah, she may do so, but the right to inherit from her shall be ours. She mentioned it to the Messenger of Allah ﷺ. The Messenger of Allah ﷺ said: Purchase her (freedom) and set her free, for the right of inheritance belongs to only to the one who set a person free. The Messenger of Allah ﷺ then stood up and said: If anyone makes a condition which is not in Allah's Book, he has no right to it, even if he stipulates it hundred times. Narrated 'Aishah (ra) that Barira came to seek her help writing of emancipation and she had to pay five Uqiya (of gold) by five yearly installments. 'Aishah said to her, "Do you think that if I pay the whole sum at once, your masters will sell you to me, and I will free you and your Wala' will be for me." Barira went to her masters and told them about that offer. They said that they would not agree to it unless her Wala' would be for them. 'Aishah further said, "I went to Messenger of Allah ﷺ and told him about it." Allah Messenger ﷺ said to her, "Buy Barira and manumit her and the Wala' will be for the liberator." Messenger of Allah ﷺ then got up and said, "What about those people who stipulate conditions that are not present in Allah's Laws? If anybody stipulates a condition which is not in Allah's Laws, then what he stipulates is invalid. Allah's Condition (Laws) are the truth and are more solid."

That ʿAisha told him that Barirah came to seek her help in her writing of emancipation (for a certain sum) and that time she had not paid anything of it. ʿAisha said to her, "Go back to your masters, and if they agree that I will pay the amount of your writing of emancipation and get your Wala', I will do so." Barirah informed her masters of that but they refused and said, "If she (i.e. ʿAisha) is seeking Allah's reward, then she can do so, but your Wala' will be for us." ʿAisha mentioned that to Allah's Apostle who said to her, "Buy and manumit (free) her, as the Wala' is for the liberator." Messenger of Allah ﷺ then got up and said, "What about the people who stipulate conditions which are not present in Allah's Laws? Whoever imposes conditions which are not present in Allah's Laws, then those conditions will be invalid, even if he imposed these conditions a hundred times. Allah's conditions (Laws) are the truth and are more solid."

Messenger of Allah ﷺ came to me and I told him about the slave-girl (Barirah) Messenger of Allah ﷺ said, "Buy and manumit her, for the Wala is for the one who manumits." In the evening the Prophet ﷺ got up and glorified Allah as He deserved and then said, "Why do some people impose conditions which are not present in Allah's Book (Laws)? Whoever imposes such a condition as is not in Allah's Laws, then that condition is invalid even if he imposes one hundred conditions, for Allah's conditions are more binding and reliable."

Aisha told me that Barirah came to seek her help in writing for emancipation and at that time she had not paid any part of her price. ʿAisha said to her, "Go to your masters and if they agree that I will pay your price (and free you) on condition that your Wala' will be for me, I will pay the money." Barirah told her masters about that, but they refused, and said, "If ʿAisha wants to do a favor she could, but your Wala will be for us." Aisha informed Messenger of Allah ﷺ of that and he said to her, "Buy and manumit Barirah as the Wala' will go to the manumitted."

If she (Hadrat 'A'isha) wants to do good to You for the sake of Allah, she may do it, but the right of inheritance will be ours. She (Hadrat 'A'isha) made a mention of that to Messenger of Allah ﷺ, and he said to her: Buy her, and emancipate her, for the right of inheritance vests with one who emancipates (the slave). Messenger of Allah, may peace be upon him) then stood up and said: What has happened to the people that they lay down conditions which are not (found) in the Book of Allah? And he who laid down a condition not found in the Book of Allah, that is not valid. even if it is laid down hundred times. The condition laid down by Allah is the most weighty and the most valid.

"Go back to your masters, and if they agree to let me pay off your contract of manumission, and let your loyalty be to me, then I will do it" Barirah told her masters about that, but they refused and said: "If she wants to seek reward (with Allah) by freeing you, let her do so, but your loyalty will be to us." She told the Messenger of Allah about that , and the Messenger of Allah said to her; "Buy her and set her free, and loyalty belongs to the one who set the slave free," Then the Messenger of Allah said: "What is the matter with people who stipulate conditions that are not in the Book of Allah? Whoever stipulates something that is not in the Book of Allah, it is not valid even if he stipulates one hundred conditions? The condition of Allah is more deserving of being followed and is more hinting."

'Aishah had informed him that Barrirah came to her ('Aishah) seeking her help for her writ of emancipation, and she had not yet paid anything for her writ of emancipation. So 'Aishah said to her: 'Return to your people, and if they agree to me paying for your writ of emancipation and that your Wala will be for me, then I will do so." So Barrirah mentioned that to her people and they refused. They said: "If she wants the reward for (freeing) you while the Wala is for us, then let her do it." So I mentioned that to the Messenger of Allah ﷺ and the Messenger of Allah ﷺ said: "Buy her, then free her, for the Wala is only for the one who frees." Then the Messenger of Allah ﷺ stood and said: "What is the case of people who make conditions that are not in Allah's Book? Whoever makes a condition that is not in Allah's Book, then it will not be so for him, even if he were to make a condition a hundred times."  

الترمذي:٢١٢٤حَدَّثَنَا قُتَيْبَةُ حَدَّثَنَا اللَّيْثُ عَنِ ابْنِ شِهَابٍ عَنْ عُرْوَةَ أَنَّ عَائِشَةَ أَخْبَرَتْهُ

أَنَّ بَرِيرَةَ جَاءَتْ تَسْتَعِينُ عَائِشَةَ فِي كِتَابَتِهَا وَلَمْ تَكُنْ قَضَتْ مِنْ كِتَابَتِهَا شَيْئًا فَقَالَتْ لَهَا عَائِشَةُ ارْجِعِي إِلَى أَهْلِكِ فَإِنْ أَحَبُّوا أَنْ أَقْضِيَ عَنْكِ كِتَابَتَكِ وَيَكُونَ لِي وَلاَؤُكِ فَعَلْتُ فَذَكَرَتْ ذَلِكَ بَرِيرَةُ لأَهْلِهَا فَأَبَوْا وَقَالُوا إِنْ شَاءَتْ أَنْ تَحْتَسِبَ عَلَيْكِ وَيَكُونَ لَنَا وَلاَؤُكِ فَلْتَفْعَلْ فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ ﷺ فَقَالَ لَهَا رَسُولُ اللَّهِ ﷺ ابْتَاعِي فَأَعْتِقِي فَإِنَّمَا الْوَلاَءُ لِمَنْ أَعْتَقَ ثُمَّ قَامَ رَسُولُ اللَّهِ ﷺ فَقَالَ مَا بَالُ أَقْوَامٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ مَنِ اشْتَرَطَ شَرْطًا لَيْسَ فِي كِتَابِ اللَّهِ فَلَيْسَ لَهُ وَإِنِ اشْتَرَطَ مِائَةَ مَرَّةٍ  

قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَقَدْ رُوِيَ مِنْ غَيْرِ وَجْهٍ عَنْ عَائِشَةَ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ أَنَّ الْوَلاَءَ لِمَنْ أَعْتَقَ
ibnmajah:2521Abū Bakr b. Abū Shaybah And ʿAlī b. Muḥammad > Wakīʿ > Hishām b. ʿUrwah from his father

that Barirah came to her when she was came to her when she was Muktabah, and her masters had written a contract of manumission for nine Uqiyyah. She (ʿAishah) said: “If your masters wish I will pay them that in one sum, and the right of inheritance will belong to me.” He said: “So she went to her masters and told them about that, but they insisted that the right of inheritance should belong to them. ʿAishah mentioned that to the Prophet ﷺ and he said: 'Do it.' Then the Prophet ﷺ stood up and addressed the people. He praised and glorified Allah (SWT), then he said: 'What is the matter with some people who stipulated conditions that are not in the Book of Allah (SWT)? Every conditions that is not in the Book of Allah (SWT) is invalid, even if there are one hundred conditions. The Book of Allah(SWT) is more deserving of being followed and the conditions of Allah (SWT) are more binding. And the Wala belongs to the one who manumits (the slave).”  

ابن ماجة:٢٥٢١حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ وَعَلِيُّ بْنُ مُحَمَّدٍ قَالاَ حَدَّثَنَا وَكِيعٌ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ

عَنْ عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ أَنَّ بَرِيرَةَ أَتَتْهَا وَهِيَ مُكَاتَبَةٌ قَدْ كَاتَبَهَا أَهْلُهَا عَلَى تِسْعِ أَوَاقٍ فَقَالَتْ لَهَا إِنْ شَاءَ أَهْلُكِ عَدَدْتُ لَهُمْ عَدَّةً وَاحِدَةً وَكَانَ الْوَلاَءُ لِي قَالَ فَأَتَتْ أَهْلَهَا فَذَكَرَتْ ذَلِكَ لَهُمْ فَأَبَوْا إِلاَّ أَنْ تَشْتَرِطَ الْوَلاَءَ لَهُمْ فَذَكَرَتْ عَائِشَةُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ افْعَلِي قَالَتْ فَقَامَ النَّبِيُّ ﷺ فَخَطَبَ النَّاسَ فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ مَا بَالُ رِجَالٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ كُلُّ شَرْطٍ لَيْسَ فِي كِتَابِ اللَّهِ فَهُوَ بَاطِلٌ وَإِنْ كَانَ مِائَةَ شَرْطٍ كِتَابُ اللَّهِ أَحَقُّ وَشَرْطُ اللَّهِ أَوْثَقُ وَالْوَلاَءُ لِمَنْ أَعْتَقَ

Return to your people ; if you like that I make payment for the purchase of your freedom on your behalf and I shall have the right to inherit from you, I shall do so. Barirah mentioned it to her people, but they refused and said: If she wants to purchase your freedom for reward from Allah, she may do so, but the right to inherit from her shall be ours. She mentioned it to the Messenger of Allah ﷺ. The Messenger of Allah ﷺ said: Purchase her (freedom) and set her free, for the right of inheritance belongs to only to the one who set a person free. The Messenger of Allah ﷺ then stood up and said: If anyone makes a condition which is not in Allah's Book, he has no right to it, even if he stipulates it hundred times. Allah's condition is more valid and binding. (Using translation from Abū Dāʾūd 3929)
