13. Book of Pilgrimage (Ḥajj)
١٣۔ كِتَابُ الْحَجِّ
[Machine] "They used to enter the Kaaba from its back during the time of ignorance. Then Allah revealed, 'It is not righteousness that you enter the houses from the back, but righteousness is [in] one who fears [Allah]'"
«كَانُوا فِي الْجَاهِلِيَّةِ إِذَا أَحْرَمُوا أَتَوْا الْبَيْتَ مِنْ ظَهْرِهِ فَأَنْزَلَ اللَّهُ {وَلَيْسَ الْبِرُّ بِأَنْ تَأْتُوا الْبُيُوتَ مِنْ ظُهُورِهَا وَلَكِنَّ الْبِرَّ مَنِ اتَّقَى} »
ذِكْرُ الْإِبَاحَةِ لِلْمُحْرِمِ أَنْ يَغْسِلَ رَأْسَهُ فِي إِحْرَامِهِ
Pour water. He poured water on his head and Abu Ayyub moved his head with his hands. He carried his hands forward and backward. He then said I saw him doing similarly. (Using translation from Abū Dāʾūd 1840)
وَقَالَ الْمِسْوَرُ لَا يَغْسِلُ الْمُحْرِمُ رَأْسَهُ فَأَرْسَلَنِي إِلَى أَبِي أَيُّوبَ الْأَنْصَارِيِّ أَسْأَلُهُ عَنْ ذَلِكَ فَوَجَدْتُهُ يَغْتَسِلُ بَيْنَ الْقَرْنَيْنِ وَهُوَ يَسْتَتِرُ بِثَوْبٍ قَالَ فَسَلَّمْتُ عَلَيْهِ فَقَالَ مَنْ هَذَا فَقُلْتُ أَنَا عَبْدُ اللَّهِ بْنُ حُنَيْنٍ أَرْسَلَنِي إِلَيْكَ ابْنُ عَبَّاسٍ أَسْأَلُكَ كَيْفَ كَانَ رَسُولُ اللَّهِ ﷺ يَغْسِلُ رَأْسَهُ وَهُوَ مُحْرِمٌ قَالَ فَوَضَعَ أَبُو أَيُّوبَ يَدَهُ عَلَى الثَّوْبِ وَطَأْطَأَهُ حَتَّى بَدَا لِي رَأْسَهُ ثُمَّ قَالَ لِإِنْسَانٍ يَصُبُّ عَلَيْهِ اصْبُبْ فَصَبَّ عَلَى رَأْسِهِ ثُمَّ حَرَّكَ رَأْسَهُ بِيَدَيْهِ فَأَقْبَلَ بِهِمَا وَأَدْبَرَ ثُمَّ قَالَ «هَكَذَا رَأَيْتُ رَسُولَ اللَّهِ ﷺ يَفْعَلُهُ»
ذِكْرُ الْإِبَاحَةِ لِلْمُحْرِمِ عِنْدَ إِرَادَتِهِ الْجَمْرَةَ أَنْ يَسْتَتِرَ مِنَ الْحَرِّ
Umm al Hussain said We performed the Farewell Pilgrimage along with the Prophet ﷺ . I saw Usamah and Bilal one of them holding the halter of the she-Camel of the Prophet ﷺ, while the other raising his garment and sheltering from the heat till he had thrown pebbles at the jamrah of the ‘Aqabah. «حَجَجْتُ مَعَ النَّبِيِّ ﷺ حَجَّةَ الْوَدَاعِ فَرَأَيْتُ أُسَامَةَ وَبِلَالًا أَحَدُهُمَا آخِذٌ بِخِطَامِ نَاقَةِ النَّبِيِّ ﷺ وَالْآخَرُ رَافِعٌ ثَوْبَهُ يَسْتُرُهُ مِنَ الْحَرِّ حَتَّى رَمَى جَمْرَةَ الْعَقَبَةِ»
ذِكْرُ جَوَازِ احْتِجَامِ الْمَرْءِ الْمُحْرِمِ لِعِلَّةٍ تَعْتَرِضَهُ
The Messenger of Allah ﷺ had himself cupped in his head when he was in the sacred state (wearing ihram due to a disease from which he was suffering. (Using translation from Abū Dāʾūd 1836)
«أَنَّ رَسُولَ اللَّهِ ﷺ احْتَجَمَ وَهُوَ مُحْرِمٌ مِنْ أَذًى كَانَ بِرَأْسِهِ»
ذِكْرُ الْإِبَاحَةِ لِلْمُحْرِمِ أَنْ يَحْتَجِمَ لِعِلَّةٍ تَحْدُثُ بِهِ مَا لَمْ يَقْطَعْ شَعَرًا
That the Messenger of Allah was treated by means of cupping when he was in Ihram. (Using translation from Nasāʾī 2845)
«أَنَّ رَسُولَ اللَّهِ ﷺ احْتَجَمَ وَهُوَ مُحْرِمٌ»
ذِكْرُ الْمَوْضِعِ الَّذِي احْتَجَمَ النَّبِيُّ ﷺ مِنْ بُدْنِهِ فِي إِحْرَامِهِ
[Machine] "Indeed, the Prophet ﷺ underwent hijama (cupping therapy) while being in a state of ihram (sacral state) for pain he was experiencing in the back of his foot."
«أَنَّ النَّبِيَّ ﷺ احْتَجَمَ وَهُوَ مُحْرِمٌ عَلَى ظَهْرِ الْقَدَمِ مِنْ وَجَعٍ كَانَ بِهِ»
ذِكْرُ الْخَبَرِ الدَّالِّ عَلَى أَنَّ هَذَا الْفِعْلَ كَانَ مِنَ الْمُصْطَفَى ﷺ غَيْرَ مَرَّةٍ
“I heard ‘Abdullah bin Buhainah say: ‘The Messenger of Allah ﷺ was cupped in Lahyi Jamal,* in the middle of his head, while he was a Muhrim.” (Using translation from Ibn Mājah 3481)
أَنَّهُ سَمِعَ عَبْدَ اللَّهِ بْنَ بُحَيْنَةَ يَقُولُ «احْتَجَمَ رَسُولُ اللَّهِ ﷺ بِلَحْيِ جَمَلٍ مِنْ طَرِيقِ مَكَّةَ وَهُوَ مُحْرِمٌ فِي وَسَطِ رَأْسِهِ»
ذِكْرُ الْإِبَاحَةِ لِلْمُحْرِمِ مُدَاوَاةَ عَيْنَيْهِ إِذَا رَمِدَتْ
[Machine] Narrated by Nu'ayh ibn Wahb from Aban ibn Uthman, who reported from Uthman, that the Prophet of Allah ﷺ said, "When the pilgrim complains of his eyes, he should bandage it with patience."
عَنْ نُبَيْهِ بْنِ وَهْبٍ عَنْ أَبَانَ بْنِ عُثْمَانَ أَخْبَرَهُ عَنْ عُثْمَانَ عَنْ نَبِيِّ اللَّهِ ﷺ «أَنَّ الْمُحْرِمَ إِذَا اشْتَكَى عَيْنَهُ ضَمَّدَهَا بِالصَّبِرِ»
ذِكْرُ الزَّجْرِعَنْ لُبْسِ الْمُحْرِمِ أَجْنَاسًا مِنَ الثِّيَابِ الْمَعْلُومَةِ
a man asked the Messenger of Allah what garments we should wear when we enter Ihram. He said: "Do not wear shirts, or pants, or 'Imamahs, or burnouses, or Khuffs unless someone does not have any sandals, in which case he should wear Khuffs that come beneath the ankles. And do not wear any garment that has been touched by (dyed with) Wars or saffron. (Using translation from Nasāʾī 2675)
رَجُلٌ يَا رَسُولَ اللَّهِ مَا نَلْبَسُ مِنَ الثِّيَابِ إِذَا أَحْرَمْنَا قَالَ «لَا تَلْبَسُوا الْقُمُصَ وَلَا السَّرَاوِيلَاتِ وَلَا الْعَمَائِمَ وَلَا الْبَرَانِسَ وَلَا الْخِفَافَ إِلَّا أَنْ يَكُونَ لَيْسَ لَهُ نَعْلَانِ فَلْيَلْبَسِ الْخُفَّيْنِ أَسْفَلَ مِنَ الْكَعْبَيْنِ وَلَا تَلْبَسُوا مِنَ الثِّيَابِ شَيْئًا مَسَّهُ الزَّعْفَرَانُ وَالْوَرْسُ»
13.21.9 Subsection
١٣۔٢١۔٩ ذِكْرُ الزَّجْرِ عَنْ لُبْسِ الْمُحْرِمِ الْمَصْبُوغَ مِنَ الثِّيَابِ
"The Messenger of Allah forbade the Muhrim to wear clothes dyed with saffron or Wars." (Using translation from Nasāʾī 2666)
«نَهَى رَسُولُ اللَّهِ ﷺ أَنْ يَلْبَسَ الْمُحْرِمُ ثَوْبًا مَصْبُوغًا بِزَعْفَرَانٍ أَوْ وَرْسٍ»
A man wearing ihram was thrown by his she-camel and had his neck broken and he died. He was brought to the Messenger of Allah ﷺ, and he said: Wash and shroud him, but do not cover his head and do not put any perfume on him, for he will be raised on the Day of Resurrection saying the talbiyah. (Using translation from Abū Dāʾūd 3241)
وَقَصَتْ بِرَجُلٍ مُحْرِمٍ نَاقَتُهُ فَقَتَلَتْهُ فَأُتِيَ بِهِ رَسُولُ اللَّهِ ﷺ فَقَالَ «اغْسِلُوهُ وَكَفِّنُوهُ وَلَا تُغَطُّوا رَأْسَهُ وَلَا تُقَرِّبُوهُ طِيبًا فَإِنَّهُ يُبْعَثُ يُهِلُّ»
13.21 [Machine] A chapter, what is permissible for the prohibited, and what is not permissible.
١٣۔٢١ بَابٌ، مَا يُبَاحُ لِلْمُحْرِمِ، وَمَا لَا يُبَاحُ
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجَلِهَا أَمَرَ بِهَذَا الْأَمْرِ
[Machine] A man's camel threw him off and injured him while he was in a state of ihram (for Hajj or Umrah). The Messenger of Allah ﷺ said, "Clothe him with two garments and wash him with water and sidr, and do not cover his head, for Allah will resurrect him on the Day of Judgment in a state of ihram."
أَنْ رَجُلًا صَرَعَهُ بَعِيرُهُ فَوَقَصَهُ وَهُوَ مُحْرِمٌ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَلْبِسُوهُ ثَوْبَيْنِ وَاغْسِلُوهُ بِمَاءٍ وَسِدْرٍ وَلَا تُغَطُّوا رَأْسَهُ فَإِنَّ اللَّهَ يَبْعَثُهُ يَوْمَ الْقِيَامَةِ يُلَبِّي»
ذِكْرُ الْبَيَانِ بِأَنَّ قَوْلَهُ ﷺ «أَلْبِسُوهُ ثَوْبَيْنِ» أَرَادَ بِهِ الثَّوْبَيْنِ اللَّذَيْنِ كَانَ قَدْ أَحْرَمَ فِيهِمَا
A man was in the company of the Prophet ﷺ and his she-camel crushed his neck while he was in a state of Ihram and he died Messenger of Allah ﷺ said, "Wash him with water and Sidr and shroud him in his two garments; neither perfume him nor cover his head, for he will be resurrected on the Day of Resurrection, reciting Talbiya." أَنْ رَجُلًا كَانَ مُحْرِمًا مَعَ رَسُولِ اللَّهِ ﷺ فَوَقَصَتْهُ نَاقَتُهُ فَمَاتَ فَقَالَ رَسُولُ اللَّهِ ﷺ «اغْسِلُوهُ بِمَاءٍ وَسِدْرٍ وَكَفِّنُوهُ فِي ثَوْبَيْهِ وَلَا تُخَمِّرُوا رَأْسَهُ وَلَا تُمِسُّوهُ طَيِّبًا فَإِنَّهُ يُبْعَثُ يَوْمَ الْقِيَامَةِ مُلَبِّيًا»
ذِكْرُ الزَّجْرِ عَنْ تَغْطِيَةِ وَجْهِ الْمُحْرِمِ وَرَأْسِهِ مَعًا، عِنْدَ تَكْفِينِهِ إِذَا مَاتَ
[Machine] "A man came on a camel, and he was in a state of ihram. The camel injured him, and he died. So the Messenger of Allah ﷺ ordered him to be washed with water and sidr, and to be shrouded in his two garments without any perfume being applied to him, and his face and head should not be covered."
جَاءَ رَجُلٌ عَلَى نَاقَةٍ وَهُوَ مُحْرِمٌ فَأَوْقَصَتْهُ فَمَاتَ «فَأَمَرَ رَسُولُ اللَّهِ ﷺ أَنْ يُغَسَّلَ بِمَاءٍ وَسِدْرٍ وَأَنْ يُكَفَّنَ فِي ثَوْبَيْهِ وَلَا يَمَسَّ طَيِّبًا وَلَا يُخَمَّرَ وَجْهُهُ وَرَأْسُهُ»
ذِكْرُ الْإِخْبَارِ عَمَّا يَجِبُ عَلَى الْمُحْرِمِ اجْتِنَابُهُ مِنْ قَتْلِ صَيْدٍ مِنَ الدَّوَابِّ وَغَيْرِهَا
"There are five which the Muhrim may kill: snakes, mice, kites, speckled crows and vicious dogs." (Using translation from Nasāʾī 2829)
أَنَّ النَّبِيَّ ﷺ سُئِلَ مَا يَقْتُلُ الْمُحْرِمُ؟ قَالَ «الْفَأْرَةَ وَالْحِدَأَةَ وَالْكَلْبَ الْعَقُورَ وَالْغُرَابَ الْأَبْقَعَ»
ذِكْرُ الْإِبَاحَةِ لِلْمُحْرِمِ قَتْلَ الضَّرَّارَاتِ مِنَ الدَّوَابِّ
“There are five animals, for which there is no sin on a person if he kills them” – or he said: “if he kills them when in Ihram – the scorpion, the crow, the kite, the mouse and the vicious dog.” (Using translation from Ibn Mājah 3088)
قَالَ رَسُولُ اللَّهِ ﷺ «خَمْسٌ مَنْ قَتَلَهُنَّ وَهُوَ حَرَامٌ فَلَا جُنَاحَ عَلَيْهِ فِيهِنَّ الْعَقْرَبُ وَالْفَأْرَةُ وَالْكَلْبُ الْعَقُورُ وَالْغُرَابُ وَالْحِدَأَةُ»
ذِكْرُ إِبَاحَةِ إِطْلَاقِ اسْمِ الْفِسْقَ عَلَى غَيْرِ أَوْلَادِ آدَمَ وَالشَّيَاطِينَ
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «الْوَزَغُ فُوَيْسِقٌ»
ذِكْرُ الْبَيَانِ بِأَنَّ اصْطِيَادَ الْمُحْرِمِ الضَّبُعَ صَيْدٌ وَفِيهِ جَزَاءٌ
[Machine] The translation of the sentence "سُئِلَ رَسُولُ اللَّهِ ﷺ عَنِ الضَّبُعِ فَقَالَ هِيَ صَيْدٌ وَفِيهَا كَبْشٌ" into English is: "The Messenger of Allah ﷺ was asked about the wolf, and he said it is a game [i.e., hunted animal] and contains a lamb [i.e., preys on lambs]."
«سُئِلَ رَسُولُ اللَّهِ ﷺ عَنِ الضَّبُعِ فَقَالَ هِيَ صَيْدٌ وَفِيهَا كَبْشٌ»
ذِكْرُ الْخَبَرِ الْمُدْحِضِ قَوْلَ مَنْ زَعَمَ أَنَّ هَذَا الْخَبَرَ تَفَرَّدَ بِهِ جَرِيرُ بْنُ حَازِمٍ
“I asked Jabir bin ‘Abdullah about hyenas: ‘Are they game (that can be hunted)?’ He said: ‘Yes.’ I said: ‘Can I eat them?’ He said: ‘Yes.’ I said: ‘Is this something that you heard from the Messenger of Allah ﷺ?’ He said: ‘Yes.’” (Using translation from Ibn Mājah 3236)

13.21.18 Subsection
١٣۔٢١۔١٨ ذِكْرُ إِبَاحَةِ أَكْلِ الْمُحْرِمِ لَحْمَ صَيْدِ الْبَرِّ إِذَا تَعَرَّى عَنْ مَعُونَتِهِ عَلَيْهِ
[Machine] Abu Qatada belonged to a group of prohibited people while he himself was permissible. He offered his companions a wild donkey but they did not give permission to slaughter it until they had seen it. While he was sitting, he secretly took a whip from one of them and struck the animal with it until he killed it. Then he brought it to them and they ate from it and carried some with them. They went to the Messenger of Allah ﷺ and asked him about it. He said, "Did anyone of you indicate to it?" They said, "No." He said, "Then eat it."
كَانَ أَبُو قَتَادَةَ فِي قَوْمٍ مُحْرِمِينَ وَهُوَ حَلَالٌ فَعَرَضَ لِأَصْحَابِهِ حِمَارٌ وَحْشِيٌّ فَلَمْ يُؤْذِنُوهُ حَتَّى أَبْصَرَهُ وَهُوَ جَالِسٌ فَاخْتَلَسَ مِنْ بَعْضِهِمِ سَوْطًا فَحَمَلَ عَلَيْهِ فَصَرَعَهُ فَأَتَاهُمْ بِهِ فَأَكَلُوا وَحَمَلُوا مَعَهُمْ فَأَتَوْا رَسُولُ اللَّهِ ﷺ فَسَأَلُوهُ؟ فَقَالَ «هَلْ أَشَارَ إِلَيْهِ إِنْسَانٌ مِنْكُمْ؟ » قَالُوا لَا قَالَ «فَكُلُوهُ»
[Machine] "He presented to the Messenger of Allah ﷺ a wild donkey, either from al-Abwa' or from Waddan, so the Messenger of Allah ﷺ returned it to me. That hurt me deeply and when he saw the expression on my face, he said, 'We are not rejecting you, but we are forbidden from accepting it.'"
أَنَّهُ أَهْدَى لِرَسُولِ اللَّهِ ﷺ حِمَارَ وَحْشِيٍّ بِالْأَبْوَاءِ أَوْ بِوَدَّانَ قَالَ فَرَدَّهُ عَلَيَّ رَسُولُ اللَّهِ ﷺ فَاشْتَدَّ ذَلِكَ عَلَيَّ فَلَمَّا عَرَفَ ذَلِكَ فِي وَجْهِي قَالَ «لَيْسَ بِنَا رَدٌّ عَلَيْكَ وَلَكِنَّا حُرُمٌ»
[Machine] The translation of the Arabic phrase "أَنَّ رَسُولَ اللَّهِ ﷺ أُهْدِيَ لَهُ عُضْوُ صَيْدٍ وَهُوَ مُحْرِمٌ فَرَدَّهُ؟ قَالَ نَعَمْ" into English is:
"That the Messenger of Allah ﷺ was given a hunted animal as a gift, but it was prohibited, so he returned it? He said, yes."
«أَنَّ رَسُولَ اللَّهِ ﷺ أُهْدِيَ لَهُ عُضْوُ صَيْدٍ وَهُوَ مُحْرِمٌ فَرَدَّهُ؟ قَالَ نَعَمْ»
13.21 [Machine] A chapter, what is permissible for the prohibited, and what is not permissible.
١٣۔٢١ بَابٌ، مَا يُبَاحُ لِلْمُحْرِمِ، وَمَا لَا يُبَاحُ
ذِكْرُ اسْمِ الْمُهْدِيِّ لِرَسُولِ اللَّهِ ﷺ الصَّيْدَ الَّذِي رَدَّهُ عَلَيْهِ
he gave the Messenger of Allah an onager when he was in Al-Abwa or in Waddan, but the Messenger of Allah gave it back to him. "And when the Messenger of Allah saw the expression on my face he said: "We only gave it back to you because we are in Ihram.'" (Using translation from Nasāʾī 2819)
أَنَّهُ أَهْدَى لِرَسُولِ اللَّهِ ﷺ حِمَارًا وَحْشِيًّا وَهُوَ بِالْأَبْوَاءِ أَوْ بِوَدَّانَ فَرَدَّهُ عَلَيْهِ رَسُولُ اللَّهِ ﷺ فَلَمَّا رَأَى رَسُولُ اللَّهِ ﷺ مَا فِي وَجْهِي قَالَ «إِنَّا لَمْ نَرُدَّهُ عَلَيْكَ إِلَّا أَنَّا حُرُمٌ»
ذِكْرُ خَبَرٍ أَوْهَمَ مَنْ لَمْ يَحْكُمْ صِنَاعَةَ الْحَدِيثِ أَنَّهُ مُضَادُّ لِخَبَرِ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ الَّذِي ذَكَرْنَاهُ
[Machine] "That Sa'd ibn Jathamaah presented to the Messenger of Allah ﷺ a weak and wild donkey tied with a rope, and it was a forbidden (animal for sacrifice). So the Messenger of Allah ﷺ returned it."
أَنَّ الصَّعْبَ بْنَ جَثَّامَةَ «أَهْدَى لِرَسُولِ اللَّهِ ﷺ عَجَزَ حِمَارَ وَحْشٍ بِقُدَيْدٍ وَكَانَ مُحْرِمًا فَرَدَّهُ رَسُولُ اللَّهِ ﷺ»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجَلِهَا رَدَّ ﷺ لَحْمَ الصَّيْدِ عَلَى الصَّعْبِ بْنِ جَثَّامَةَ
[Machine] I heard the Messenger of Allah ﷺ saying, "Hunting animals on land is permissible as long as you have not caught them or they have been caught for you."
سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «صَيْدُ الْبِرِّ حَلَالٌ مَا لَمْ تَصِيدُوهُ أَوْ يُصَادْ لَكُمْ»
ذِكْرُ خَبَرٍ أَوْهَمَ مَنْ لَمْ يَحْكُمْ صِنَاعَةَ الْأَخْبَارِ وَلَا تَفَقَّهَ فِي صَحِيحِ الْآثَارِ أَنَّهُ مُضَادٌّ لِخَبَرِ الصَّعْبِ بْنِ جَثَّامَةَ الَّذِي ذَكَرْنَاهُ
[Machine] "To eat it until when he woke up we said it is a gift for you, so he said, "What is the matter with you? Why did you not eat?" They said, "We waited to see what you would say about it." He said, "We have eaten something similar to this with the Messenger of Allah ﷺ, so eat and enjoy."
أَنْ نَأْكُلَهُ حَتَّى إِذَا اسْتَيْقَظَ قُلْنَا صَيْدٌ أُهْدِيَ لَكَ فَقَالَ مَا شَأْنُكُمْ لَمْ تَأْكُلُوا؟ قَالُوا انْتَظَرْنَا حَتَّى نَنْظُرَ مَا تَقُولُ فِيهِ قَالَ «أَكَلْنَا مِثْلَ هَذَا مَعَ رَسُولِ اللَّهِ ﷺ كُلُوا فَأَكَلُوا وَأَكَلَ»
ذِكْرُ خَبَرٍ قَدْ يُوهِمُ عَالَمًا مِنَ النَّاسِ أَنَّ ابْنَ الْمُنْكَدِرِ لَمْ يَسْمَعْ هَذَا الْخَبَرِ مِنْ عَبْدِ الرَّحْمَنِ بْنِ عُثْمَانَ التَّيْمِيِّ
“We were with Talhah bin ‘Ubaidullah ؓ and we were in ihram. We were given a bird as a gift whilst Talhah was sleeping. Some of us ate and some of us refrained and did not eat. When Talhah woke up, he approved of those who had eaten it and said: “We ate it with the Messenger of Allah ﷺ.” (Using translation from Aḥmad 1383)
وَقَالَ «أَكَلْنَاهُ مَعَ رَسُولِ اللَّهِ ﷺ»
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُحْرِمَ لَهُ أَكْلُ مَا أُهْدِيَ لَهُ مِنَ الصَّيْدِ، مَا لَمْ يَكُنْ بِأَمْرِهِ أَوْ بِإِشَارَتِهِ
[Machine] Abu Qatadah was in a group of prohibited people, while Abu Qatadah was in a group of permissible people. The people saw a wild donkey, but they did not allow it until Abu Qatadah saw it and sat on the back of a horse. He secretly took a whip from some of them and used it on the donkey until he subdued it. He then brought it to them, and they ate it and carried it. They met the Messenger of Allah and asked him about what Abu Qatadah did. He ﷺ asked, "Did any of you indicate anything to him or command him?" They said no. He said, "Then eat it."
كَانَ أَبُو قَتَادَةَ فِي نَاسٍ مُحْرِمِينَ وَأَبُو قَتَادَةَ حِلٌّ فَأَبْصَرَ الْقَوْمُ حِمَارَ وَحْشٍ فَلَمْ يُؤْذِنُوهُ حَتَّى أَبْصَرَهُ أَبُو قَتَادَةَ فَقَعَدَ عَلَى ظَهْرِ فَرَسٍ وَاخْتَلَسَ مِنْ بَعْضِهِمْ سَوْطًا فَحَمَلَ عَلَى الْحِمَارِ فَصَرَعَهُ فَأَتَاهُمْ بِهِ فَأَكَلُوهُ وَحَمَلُوا فَلَقُوا رَسُولَ اللَّهِ فَسَأَلُوهُ عَمَّا صَنَعَ أَبُو قَتَادَةَ فَقَالَ ﷺ «هَلْ أَشَارَ إِلَيْهِ إِنْسَانٌ مِنْكُمْ بِشَيْءٍ أَوْ أَمَرَهُ؟ » قَالُوا لَا قَالَ «فَكُلُوهُ»

١٣۔٢١۔٢٥ ذِكْرُ الْإِبَاحَةِ لِلْمُحْرِمِ أَكَلَ لَحْمَ الصَّيْدِ إِذَا لَمْ يَكُنْ أَعَانَ عَلَيْهِ بِشَيْءٍ
Abu Qatadah said that he accompanied the Apostle of Allaah ﷺ and he stayed behind on the way to Makkah with some of his companions who were wearing ihram, although he was not. When he saw a wild ass he mounted his horse and asked them to hand him his whip, but they refused. He then asked them to hand him his lance. When they refused, he took it, chased the while ass and killed it. Some of the Companions of the Apostle of Allaah ﷺ ate it and some refused (to eat). When they met the Apostle of Allaah ﷺ they asked him about it. He said that was the food that Allaah provided you for eating. (Using translation from Abū Dāʾūd 1852)
أَنَّهُ كَانَ مَعَ رَسُولِ اللَّهِ ﷺ حَتَّى إِذَا كَانَ بِبَعْضِ طَرِيقِ مَكَّةَ تَخَلَّفَ مَعَ أَصْحَابٍ لَهُ مُحْرِمِينَ وَهُوَ غَيْرُ مُحْرِمٍ فَرَأَى حِمَارًا وَحْشِيًّا فَاسْتَوَى عَلَى فَرَسِهِ وَسَأَلَ أَصْحَابَهُ أَنْ يُنَاوِلُوهُ سَوْطَهُ فَأَبَوْا فَسَأَلَهُمْ رُمْحَهُ فَأَبَوْا فَأَخَذَهُ ثُمَّ شَدَّ عَلَى الْحِمَارِ فَقَتَلَهُ فَأَكَلَ مِنْهُ بَعْضُ أَصْحَابِ النَّبِيِّ ﷺ وَأَبَى بَعْضُهُمْ فَلَمَّا أَدْرَكُوا رَسُولَ اللَّهِ ﷺ سَأَلُوهُ عَنْ ذَلِكَ فَقَالَ رَسُولُ اللَّهِ ﷺ «إِنَّمَا هِيَ طُعْمَةٌ أَطْعَمَكُمُوهَا اللَّهُ»
[Machine] The Messenger of Allah ﷺ sent Abu Qatadah al-Ansari to collect charity. The Messenger of Allah ﷺ and his companions left in a state of ihram until they reached Thaniyat al-Wada', where they found a wild donkey. Abu Qatadah came while it was permissible to hunt, so they covered their heads out of dislike for looking at it. He saw it and mounted his horse, took his spear, and dropped his whip. He said, "Give me it." We said, "We will not help you with it at all." So he carried it and rode on it, and then he tied it up. Then they cooked it, and they said, "O Messenger of Allah ﷺ , it is between our stomachs (i.e., it is prepared food)." 'Ubaydullah had doubts about this last statement.
بَعَثَ رَسُولُ اللَّهِ ﷺ أَبَا قَتَادَةَ الْأَنْصَارِيَّ عَلَى الصَّدَقَةَ وَخَرَجَ رَسُولُ اللَّهِ ﷺ وَأَصْحَابُهُ مُحْرِمُونَ حَتَّى نَزَلُوا بِعُسْفَانَ ثَنِيَّةِ الْغَزَّالِ فَإِذَا هُمْ بِحِمَارٍ وَحْشِيٍّ فَجَاءَ أَبُو قَتَادَةَ وَهُوَ حِلٌّ فَنَكَّسُوا رُءُوسَهُمْ كَرَاهِيَةَ أَنْ يُحِدُّوا أَبْصَارَهُمْ فَيَفْطَنَ فَرَآهُ فَرَكِبَ فَرَسَهُ وَأَخَذَ الرُّمْحَ فَسَقَطَ مِنْهُ السَّوْطُ فَقَالَ نَاوِلْنِيهِ فَقُلْنَا لَا نُعِينُكَ عَلَيْهِ بِشَيْءٍ فَحَمَلَ عَلَيْهِ فَعَقَرَهُ قَالَ ثُمَّ جَعَلُوا يَشْوُونَ مِنْهُ ثُمَّ قَالُوا رَسُولُ اللَّهِ ﷺ بَيْنَ أَظْهُرِنَا وَكَانَ تَقَدَّمَهُمْ فَأَتَوْهُ فَسَأَلُوهُ فَلَمْ يَرَ بِهِ بَأْسًا وَأَظُنُّهُ قَالَ «مَعَكُمْ مِنْهُ شَيْءٌ» شَكَّ عُبَيْدُ اللَّهِ
13.21 [Machine] A chapter, what is permissible for the prohibited, and what is not permissible.
١٣۔٢١ بَابٌ، مَا يُبَاحُ لِلْمُحْرِمِ، وَمَا لَا يُبَاحُ
ذِكْرُ الْبَيَانِ بِأَنَّ الْمُصْطَفَى ﷺ أَكَلَ مِنْ لَحْمِ الْحِمَارِ الْوَحْشِيِّ الَّذِي عَقَرَهُ أَبُو قَتَادَةَ فِي ذَلِكَ السَّفَرِ
[Machine] "I went out with the Messenger of Allah ﷺ and everyone except me put on ihram. We saw a wild donkey, so I saddled it and tamed it. Then I mounted it and took a spear, but I forgot my whip. I asked them to give it to me, but they refused. So, I got down and took my whip. Then I whipped the donkey and it kicked me. Some people ate from it, while others left it. When the Messenger of Allah ﷺ came, he asked, 'Did any of you eat from it?' We said, 'Yes, this man did.' So, the Messenger of Allah ﷺ ate from it."
خَرَجْتُ مَعَ رَسُولِ اللَّهِ ﷺ فَأَحْرَمَ الْقَوْمُ كُلُّهُمْ غَيْرِي فَرَأَيْنَا حِمَارَ وَحْشٍ فَأَسْرَجْتُ وَأَلْجَمْتُ ثُمَّ رَكِبْتُ وَأَخَذْتُ الرُّمْحَ وَنَسِيتُ السَّوْطَ فَسَأَلْتُهُمْ أَنْ يُنَاوِلُونِيهِ فَأَبَوْا فَنَزَلْتُ فَأَخَذْتُ سَوْطِي ثُمَّ ضَرَبْتُ الْحِمَارَ فَعَقَرْتُهُ فَأَكَلَ مِنْهُ بَعْضُ الْقَوْمِ وَتَرَكَ بَعْضٌ فَلَمَّا أَتَى رَسُولُ اللَّهِ ﷺ قَالَ «قَدْ أَصَابَ الَّذِينَ أَكَلُوا هَلْ مَعَكُمْ مِنْهُ شَيْءٌ» قَالَ قُلْنَا نَعَمْ هَذِهِ رِجْلٌ فَأَكَلَ مِنْهُ رَسُولُ اللَّهِ ﷺ
