The Prophet ﷺ said, "When an adulterer commits illegal sexual intercourse, then he is not a believer at the time, he is doing it, and when a drinker of an alcoholic liquor drinks it, then he is not a believer at the time of drinking it, and when a thief steals, then he is not a believer at the time of stealing, and when a robber robs, and the people look at him, then he is not a believer at the time of doing robbery.

قَالَ النَّبِيُّ ﷺ لاَ يَزْنِي الزَّانِي حِينَ يَزْنِي وَهْوَ مُؤْمِنٌ وَلاَ يَشْرَبُ الْخَمْرَ حِينَ يَشْرَبُ وَهْوَ مُؤْمِنٌ وَلاَ يَسْرِقُ حِينَ يَسْرِقُ وَهْوَ مُؤْمِنٌ وَلاَ يَنْتَهِبُ نُهْبَةً يَرْفَعُ النَّاسُ إِلَيْهِ فِيهَا أَبْصَارَهُمْ حِينَ يَنْتَهِبُهَا وَهْوَ مُؤْمِنٌ وَعَنْ سَعِيدٍ وَأَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ ﷺ مِثْلَهُ إِلاَّ النُّهْبَةَ

Messenger of Allah ﷺ said, "When an adulterer commits illegal sexual intercourse, then he is not a believer at the time he is doing it; and when somebody drinks an alcoholic drink, then he is not believer at the time of drinking, and when a thief steals, he is not a believer at the time when he is stealing; and when a robber robs and the people look at him, then he is not a believer at the time of doing it." Abu Huraira in another narration, narrated the same from the Prophet ﷺ with the exclusion of robbery.

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ لاَ يَزْنِي الزَّانِي حِينَ يَزْنِي وَهْوَ مُؤْمِنٌ وَلاَ يَشْرَبُ الْخَمْرَ حِينَ يَشْرَبُ وَهْوَ مُؤْمِنٌ وَلاَ يَسْرِقُ حِينَ يَسْرِقُ وَهْوَ مُؤْمِنٌ وَلاَ يَنْتَهِبُ نُهْبَةً يَرْفَعُ النَّاسُ إِلَيْهِ فِيهَا أَبْصَارَهُمْ وَهْوَ مُؤْمِنٌ وَعَنِ ابْنِ شِهَابٍ عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ وَأَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ ﷺ بِمِثْلِهِ إِلاَّ النُّهْبَةَ

The Prophet ﷺ said, "An adulterer, at the time he is committing illegal sexual intercourse is not a believer; and a person, at the time of drinking an alcoholic drink is not a believer; and a thief, at the time of stealing, is not a believer."

Ibn Shihab said: ʿAbdul Malik bin Abi Bakr bin ʿAbdur-Rahman bin Al- Harith bin Hisham told me that Abu Bakr used to narrate that narration to him on the authority of Abu Huraira. He used to add that Abu Bakr used to mention, besides the above cases, "And he who robs (takes illegally something by force) while the people are looking at him, is not a believer at the time he is robbing (taking).

إِنَّ النَّبِيَّ ﷺ قَالَ: «لاَ يَزْنِي الزَّانِي حِينَ يَزْنِي وَهْوَ مُؤْمِنٌ، وَلاَ يَشْرَبُ الْخَمْرَ حِينَ يَشْرَبُهَا وَهْوَ مُؤْمِنٌ، وَلاَ يَسْرِقُ السَّارِقُ حِينَ يَسْرِقُ وَهْوَ مُؤْمِنٌ۔»

قَالَ ابْنُ شِهَابٍ وَأَخْبَرَنِي عَبْدُ الْمَلِكِ بْنُ أَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ أَنَّ أَبَا بَكْرٍ كَانَ يُحَدِّثُهُ عَنْ أَبِي هُرَيْرَةَ ثُمَّ يَقُولُ كَانَ أَبُو بَكْرٍ يُلْحِقُ مَعَهُنَّ: وَلاَ يَنْتَهِبُ نُهْبَةً ذَاتَ شَرَفٍ يَرْفَعُ النَّاسُ إِلَيْهِ أَبْصَارَهُمْ فِيهَا حِينَ يَنْتَهِبُهَا وَهْوَ مُؤْمِنٌ

The fornicator who fornicates is not a believer so long as he commits it and no thief who steals is a believer as long as he commits theft, and no drunkard who drinks wine is a believer as long as he drinks it. 'Abdul-Malik b. Abi Bakr' narrated this on the authority of Abu Bakr b. Abdur-Rahman b. Harith and then said: Abu Huraira made this addition: No plunderer who plunders a valuable thing that attracts the attention of people is a believer so long as he commits this act.

أَبُو هُرَيْرَةَ إِنَّ رَسُولَ اللَّهِ ﷺ قَالَ لاَ يَزْنِي الزَّانِي حِينَ يَزْنِي وَهُوَ مُؤْمِنٌ وَلاَ يَسْرِقُ السَّارِقُ حِينَ يَسْرِقُ وَهُوَ مُؤْمِنٌ وَلاَ يَشْرَبُ الْخَمْرَ حِينَ يَشْرَبُهَا وَهُوَ مُؤْمِنٌ قَالَ ابْنُ شِهَابٍ فَأَخْبَرَنِي عَبْدُ الْمَلِكِ بْنُ أَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ أَنَّ أَبَا بَكْرٍ كَانَ يُحَدِّثُهُمْ هَؤُلاَءِ عَنْ أَبِي هُرَيْرَةَ ثُمَّ يَقُولُ وَكَانَ أَبُو هُرَيْرَةَ يُلْحِقُ مَعَهُنَّ وَلاَ يَنْتَهِبُ نُهْبَةً ذَاتَ شَرَفٍ يَرْفَعُ النَّاسُ إِلَيْهِ فِيهَا أَبْصَارَهُمْ حِينَ يَنْتَهِبُهَا وَهُوَ مُؤْمِنٌ

The Prophet ﷺ said, "When an adulterer commits illegal sexual intercourse, then he is not a believer at the time, he is doing it, and when a drinker of an alcoholic liquor drinks it, then he is not a believer at the time of drinking it, and when a thief steals, then he is not a believer at the time of stealing, and when a robber robs, and the people look at him, then he is not a believer at the time of doing robbery. أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا يَزْنِي الزَّانِي حِينَ يَزْنِي وَهُوَ مُؤْمِنٌ وَلَا يَشْرَبُ الْخَمْرَ شَارِبُهَا حِينَ يَشْرَبُهَا وَهُوَ مُؤْمِنٌ وَلَا يَسْرِقُ السَّارِقُ حِينَ يَسْرِقُ وَهُوَ مُؤْمِنٌ وَلَا يَنْتَهِبُ نُهْبَةً يَرْفَعُ النَّاسُ إِلَيْهِ فِيهَا أَبْصَارَهُمْ حِينَ يَنْتَهِبُهَا وَهُوَ مُؤْمِنٌ» 7094 أَخْبَرَنَا عِيسَى بْنُ حَمَّادٍ قَالَ أَخْبَرَنَا اللَّيْثُ عَنْ عَقِيلٍ عَنِ ابْنِ شِهَابٍ عَنْ سَعِيدٍ وَأَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ عَنْ رَسُولِ اللهِ ﷺ مِثْلَ حَدِيثِ أَبِي بَكْرٍ هَذَا إِلَّا النُّهْبَةَ

[Machine] The Messenger of Allah ﷺ said, "The adulterer does not commit adultery while he is a believer, the drinker of alcohol does not drink it while he is a believer, the thief does not steal while he is a believer, the robber does not loot [and] raise people's gaze towards him while he is a believer. This hadith is narrated by Abu Qil, who narrates from Ibn Shihab, who narrates from Sa'id ibn al-Musayyib and Abu Salamah ibn Abd al-Rahman, who narrate from Abu Hurairah, who narrates from the Messenger of Allah ﷺ, in a similar manner to the hadith of Abu Bakr, except for the looting.

قَالَ رَسُولُ اللهِ ﷺ لَا يَزْنِي الزَّانِي حِينَ يَزْنِي وَهُوَ مُؤْمِنٌ وَلَا يَشْرَبُ الْخَمْرَ حِينَ يَشْرَبُهَا وَهُوَ مُؤْمِنٌ وَلَا يَسْرِقُ السَّارِقُ حِينَ يَسْرِقُهَا وَهُوَ مُؤْمِنٌ وَلَا يَنْتَهِبُ نُهْبَةً يَرْفَعُ النَّاسُ إِلَيْهِ فِيهَا أَبْصَارَهُمْ حِينَ يَنْتَهِبُهَا وَهُوَ مُؤْمِنٌ وَعَنْ عُقَيْلٍ عَنِ ابْنِ شِهَابٍ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ وَأَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ عَنْ أَبِي هُرَيْرَةَ ؓ عَنْ رَسُولِ اللهِ ﷺ بِمِثْلِ حَدِيثِ أَبِي بَكْرٍ هَذَا إِلَّا النُّهْبَةَ

اللَّهُ عَلَيه وَسَلَّم لا يزني الزاني حين يزني وهُو مؤمن ولاَ يسرق السارق وهُو مؤمن ولاَ يشرب الخمر حين يشربها وهُو مؤمن ولاَ ينتهب نهبة ذات شرف حين ينتهبها وهُو مؤمنوهذا الحديث لا نعلم رواه عن صفوان عَن عَطاء بن سيار عَن أبي هُرَيرة إلاَّ عَبد العزيز بن المطلب وهُو رجل من أهل المدينة وقد رُوِيَ كلام هذا الحديث عن رسول الله من وجوه

اللهُ عَلَيْهِ وَسَلَّمَ قَالَ لا يزني الزاني حين وهو مؤمن ولا يسرق حين يسرق وهو مؤمن أحسبه قال ولا ينتهب نهبة ذات شرف وهو مؤمنوَهَذَا الحديثُ لا نَعْلَمُ أَحَدًا رَوَاهُ عَنْ قتادة يجمع فيه سعيد بن المسيب والحَسَن وعطاء عن أبي هريرة رَضِيَ اللهُ عَنْهُ إلا الحكم بن عبد الملك ولم يكن بالحافظ وحدث عَنْهُ جَمَاعَةٌ مِنْ أَهْلِ الْعِلْمِ وَاحْتَمَلُوا حَدِيثَهُ

اللَّهُ عَلَيه وَسَلَّم قَال لاَ يزني الزاني حين يزني وهُو مؤمن ولاَ يسرق حين يسرق وهُو مؤمن ولاَ يشرب الخمر حين يشربها وهُو مؤمنوهذا الحديث لا أعلم أحدًا جمع فيه بين سَعِيد وَأَبي سَلَمة وعبيد الله وحميد إلاَّ الأَوزَاعِيّ ولاَ عنه إلا مُحَمد بن كثير
