15. Chapter
١٥۔ كِتَابُ التَّفْلِيسِ
The Messenger of Allah ﷺ as saying: If anyone becomes insolvent and the man (i.e. creditor) finds his very property with him, he is more entitled to it than anyone else. (Using translation from Abū Dāʾūd 3519)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَيُّمَا رَجُلٍ أَفْلَسَ فَأَدْرَكَ الرَّجُلُ مَالَهُ بِعَيْنِهِ فَهُوَ أَحَقُّ بِهِ
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَدْرَكَ مَالَهُ بِعَيْنِهِ عِنْدَ رَجُلٍ أَوْ إِنْسَانٍ قَدْ أَفْلَسَ فَهُوَ أَحَقُّ بِهِ مِنْ غَيْرِهِ 11242 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَحْمَدُ بْنُ سَلْمَانَ الْفَقِيهُ ثنا الْحَسَنُ بْنُ مُكْرَمٍ الْبَزَّازُ ثنا يَزِيدُ بْنُ هَارُونَ ثنا يَحْيَى بْنُ سَعِيدٍ أَخْبَرَنِي أَبُو بَكْرِ بْنُ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ فَذَكَرَهُ بِمِثْلِهِ سَوَاءً إِلَّا أَنَّهُ قَالَ عِنْدَ رَجُلٍ لَمْ يَشُكَّ
[Machine] "About Yahya ibn Sa'id regarding the merchandise seller"
عَنْ يَحْيَى بْنِ سَعِيدٍ فِي مُبْتَاعِ السِّلْعَةِ
[Machine] The Prophet ﷺ said, "When a person buys a commodity and then becomes bankrupt while it is in his possession, he has more right to it than the creditors." The Shaykh stated that in his book, he mistakenly mentioned it as a narration from Yahya ibn Sa'id from Muhammad ibn Abi Bakr ibn 'Amr ibn Hazm, and this is incorrect. I was informed by Abu al-Hasan ibn 'Abdan that Ahmad ibn 'Ubaid narrated to us from 'Ali ibn al-Hasan ibn Bayan al-Muqri', who narrated from Abu Hudhayfah, who narrated from Sufyan, who narrated from Yahya ibn Sa'id, who narrated from Abu Bakr ibn 'Amr, who narrated from 'Umar ibn 'Abdul Aziz, who mentioned it, and said, "Whoever buys a commodity and then becomes bankrupt, its possessor has more right to it, and likewise."
عَنِ النَّبِيِّ ﷺ قَالَ إِذَا ابْتَاعَ الرَّجُلُ السِّلْعَةَ ثُمَّ أَفْلَسَ وَهِيَ عِنْدَهُ بِعَيْنِهَا فَهُوَ أَحَقُّ بِهَا مِنَ الْغُرَمَاءِ قَالَ الشَّيْخُ وَقَعَ فِي كِتَابِي عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ مُحَمَّدِ بْنِ أَبِي بَكْرِ بْنِ عَمْرِو بْنِ حَزْمٍ وَهُوَ غَلَطٌ 11245 وَقَدْ أَخْبَرَنَا أَبُو الْحَسَنِ بْنُ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ ثنا عَلِيُّ بْنُ الْحَسَنِ بْنِ بَيَانٍ الْمُقْرِئُ ثنا أَبُو حُذَيْفَةَ ثنا سُفْيَانُ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ أَبِي بَكْرِ بْنِ عَمْرٍو عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فَذَكَرَهُ وَقَالَ مَنِ اشْتَرَى سِلْعَةً ثُمَّ أَفْلَسَ فَصَاحِبُهَا أَحَقُّ بِهَا وَكَذَلِكَ
[Machine] The Messenger of Allah ﷺ said: "Whichever man finds his goods with someone who has gone bankrupt, he has more right to them than anyone else." Abu Sahl Muhammad bin Nasrawayh al-Kushmiyahni informed us, Abu Bakr Muhammad bin Ahmad bin Khanb narrated to us, Abu Muhammad Ubayd bin Abdul Wahid narrated to us, Sa'id ibn Abi Maryam meant Nafi' bin Yazid narrated to me, Ibn al-Had narrated to me, Abu Bakr ibn Hazm mentioned it, and so on.
قَالَ رَسُولُ اللهِ ﷺ أَيُّمَا رَجُلٍ أَدْرَكَ سِلْعَتَهُ بِعَيْنِهَا عِنْدَ رَجُلٍ قَدْ أَفْلَسَ فَهُوَ أَحَقُّ بِهَا مِنْ غَيْرِهِ أَخْبَرَنَاهُ أَبُو سَهْلٍ مُحَمَّدُ بْنُ نَصْرَوَيْهِ الْكُشْمِيهَنِيُّ أنبأ أَبُو بَكْرٍ مُحَمَّدُ بْنُ أَحْمَدَ بْنِ خَنْبٍ ثنا أَبُو مُحَمَّدٍ عُبَيْدُ بْنُ عَبْدِ الْوَاحِدِ ثنا سَعِيدٌ يَعْنِي ابْنَ أَبِي مَرْيَمَ أنبأ نَافِعُ بْنُ يَزِيدَ حَدَّثَنِي ابْنُ الْهَادِ حَدَّثَنِي أَبُو بَكْرِ بْنُ حَزْمٍ فَذَكَرَهُ وَكَذَلِكَ
[Machine] That the Messenger of Allah ﷺ said, "When a person becomes bankrupt and another person finds his belongings with him, then he is more deserving of them."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِذَا أَفْلَسَ الرَّجُلُ وَوَجَدَ الرَّجُلُ عِنْدَهُ سِلْعَتَهُ فَهُوَ أَحَقُّ بِهَا
[Machine] The Messenger of Allah ﷺ said: "If a man becomes bankrupt and another man finds his belonging, then he is more entitled to it." This is the saying of Yahya.
قَالَ رَسُولُ اللهِ ﷺ إِذَا أَفْلَسَ الرَّجُلُ فَوَجَدَ الرَّجُلُ عَيْنَ مَتَاعِهِ فَهُوَ أَحَقُّ بِهِ لَفْظُ حَدِيثِ يَحْيَى
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِذَا أَفْلَسَ الرَّجُلُ وَوَجَدَ الْبَائِعُ سِلْعَتَهُ بِعَيْنِهَا فَهُوَ أَحَقُّ بِهَا دُونَ الْغُرَمَاءِ
[Machine] He heard Sa'id bin Al-Musayyib saying that a slave of Umm Habibah, the wife of the Prophet ﷺ , became bankrupt and there was a dispute about him that was brought to Uthman. Uthman decided that whoever had a right due to him before his bankruptcy became apparent, then it belongs to him, and whoever knew his possession, then it belongs to him.
أَنَّهُ سَمِعَ سَعِيدَ بْنَ الْمُسَيِّبِ يَقُولُ أَفْلَسَ مَوْلًى لِأُمِّ حَبِيبَةَ زَوْجِ النَّبِيِّ ﷺ فَاخْتُصِمَ فِيهِ إِلَى عُثْمَانَ ؓ فَقَضَى عُثْمَانُ أَنَّ مَنْ كَانَ اقْتَضَى مِنْ حَقِّهِ شَيْئًا قَبْلَ أَنْ يَتَبَيَّنَ إِفْلَاسُهُ فَهُوَ لَهُ وَمَنْ عَرَفَ مَتَاعَهُ فَهُوَ لَهُ
