15. Chapter

١٥۔ كِتَابُ التَّفْلِيسِ

15.5 [Machine] A free person is not obliged to pay a debt, and they are not held accountable if they do not possess anything. Allah says, "And if someone is in hardship, then let there be postponement until [a time of] ease." [Quran 2:280]

١٥۔٥ بَابُ لَا يُؤَاجَرُ الْحُرُّ فِي دَيْنٍ عَلَيْهِ، وَلَا يُلَازَمُ إِذَا لَمْ يُوجَدْ لَهُ شَيْءٌ قَالَ اللهُ تَعَالَى {وَإِنْ كَانَ ذُو عُسْرَةٍ فَنَظِرَةٌ إِلَى مَيْسَرَةٍ} [البقرة: 280]

In the time of the Messenger of Allah ﷺ a man suffered loss affecting fruits he had bought and owed a large debt, so the Messenger of Allah ﷺ said: Give him sadaqah (alms). So the people gave him sadaqah (alms), but as that was not enough to pay the debt in full, the Messenger of Allah ﷺ said: Take what you find. But that is all you may have. (Using translation from Abū Dāʾūd 3469)   

البيهقي:١١٢٦٩أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ ثنا ابْنُ مِلْحَانَ ثنا ابْنُ بُكَيْرٍ ثنا اللَّيْثُ ح قَالَ وَأنبأ أَحْمَدُ بْنُ عُبَيْدٍ ثنا عَبَّاسُ بْنُ الْفَضْلِ ثنا أَبُو الْوَلِيدِ ثنا اللَّيْثُ بْنُ سَعْدٍ عَنْ بُكَيْرِ بْنِ عَبْدِ اللهِ بْنِ الْأَشَجِّ عَنْ عِيَاضِ بْنِ عَبْدِ اللهِ بْنِ سَعْدٍ عَنْ أَبِي سَعِيدٍ قَالَ

أُصِيبَ رَجُلٌ فِي عَهْدِ رَسُولِ اللهِ ﷺ فِي ثِمَارٍ ابْتَاعَهَا فَكَثُرَ دَيْنُهُ فَقَالَ رَسُولُ اللهِ ﷺ تَصَدَّقُوا عَلَيْهِ فَتَصَدَّقَ النَّاسُ عَلَيْهِ فَلَمْ يَبْلُغْ ذَلِكَ وَفَاءَ دَيْنِهِ فَقَالَ رَسُولُ اللهِ ﷺ خُذُوا مَا وَجَدْتُمْ وَلَيْسَ لَكُمْ إِلَّا ذَلِكَ

[Machine] That Mu'adh bin Jabal, who was one of his people from the tribe of Banu Salimah, had a large debt on the time of the Messenger of Allah ﷺ. The Messenger of Allah ﷺ did not add to his debt burden on them, but rather took away his wealth.  

البيهقي:١١٢٧٠أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْأَصْبَهَانِيُّ أنبأ أَبُو مُحَمَّدِ بْنُ حَيَّانَ ثنا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ زَكَرِيَّا ثنا مُحَمَّدُ بْنُ بُكَيْرٍ ثنا ابْنُ وَهْبٍ عَنْ يُونُسَ بْنِ يَزِيدَ عَنِ الزُّهْرِيِّ قَالَ أَخْبَرَنِي عَبْدُ الرَّحْمَنِ بْنُ كَعْبٍ

أَنَّ مُعَاذَ بْنَ جَبَلٍ وَهُوَ أَحَدُ قَوْمِهِ مِنْ بَنِي سَلِمَةَ كَثُرَ دَيْنُهُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَلَمْ يَزِدْ رَسُولُ اللهِ ﷺ غُرَمَاءَهُ عَلَى أَنْ خَلَعَ لَهُمْ مَالَهُ

[Machine] Muadh ibn Jabal was one of the best-looking people, and had the best character and the most generous among them. He used to invite them to many debts, so he stayed with them until he disappeared from them for several days in his house. When the Messenger of Allah ﷺ assumed his debts, Muadh and his debts came to him and they said, "O Messenger of Allah, take our right from him." The Messenger of Allah ﷺ said, "May Allah have mercy on whoever gives alms to him." Some people gave alms to him and others refused. They said, "O Messenger of Allah, take our right from him." The Messenger of Allah ﷺ said, "Be patient with them, O Muadh." The Messenger of Allah ﷺ removed the money from his property and gave it to his debtors, and they divided it among themselves. They received five fifths of their rights. They said, "O Messenger of Allah, compromise with us." The Messenger of Allah ﷺ said, "Leave him, for you have no right over him in any of his words."  

البيهقي:١١٢٧١حَدَّثَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ عَبْدِ اللهِ الْأَصْبَهَانِيُّ ثنا الْحَسَنُ بْنُ الْجَهْمِ الْأَصْبَهَانِيُّ ثنا الْحُسَيْنُ بْنُ الْفَرَجِ ثنا مُحَمَّدُ بْنُ عُمَرَ حَدَّثَنِي عِيسَى بْنُ النُّعْمَانِ عَنْ مُعَاذِ بْنِ رِفَاعَةَ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ قَالَ

كَانَ مُعَاذُ بْنُ جَبَلٍ مِنْ أَحْسَنِ النَّاسِ وَجْهًا وَأَحْسَنِهِمْ خُلُقًا وَأَسْمِحِهِمْ كَفًّا فَادَّانَ دَيْنًا كَثِيرًا فَلَزِمَهُ غُرَمَاؤُهُ حَتَّى تَغَيَّبَ عَنْهُمْ أَيَّامًا فِي بَيْتِهِ حَتَّى اسْتَأْدَى رَسُولَ اللهِ ﷺ غُرَمَاؤُهُ فَأَرْسَلَ إِلَيْهِ يَدْعُوهُ فَجَاءَهُ وَمَعَهُ غُرَمَاؤُهُ فَقَالُوا يَا رَسُولَ اللهِ خُذْ لَنَا حَقَّنَا مِنْهُ فَقَالَ رَسُولُ اللهِ ﷺ رَحِمَ اللهُ مَنْ تَصَدَّقَ عَلَيْهِ قَالَ فَتَصَدَّقَ عَلَيْهِ نَاسٌ وَأَبَى آخَرُونَ وَقَالُوا يَا رَسُولَ اللهِ خُذْ لَنَا بِحَقِّنَا مِنْهُ قَالَ رَسُولُ اللهِ ﷺ اصْبِرْ لَهُمْ يَا مُعَاذُ قَالَ فَخَلَعَهُ رَسُولُ اللهِ ﷺ مِنْ مَالِهِ فَدَفَعَهُ إِلَى غُرَمَائِهِ فَاقْتَسَمُوهُ بَيْنَهُمْ فَأَصَابَهُمْ خَمْسَةُ أَسْبَاعِ حُقُوقِهِمْ قَالُوا يَا رَسُولَ اللهِ بِعْهُ لَنَا قَالَ رَسُولُ اللهِ ﷺ خَلُّوا عَنْهُ فَلَيْسَ لَكُمْ عَلَيْهِ سَبِيلٌ تَفَرَّدَ بِبَعْضِ أَلْفَاظِهِ الْوَاقِدِيُّ
