٢٢۔ كِتَابُ الْوَصَايَا ص ٣
[Machine] "From a female bear and her cubs, one-third each."
عَنْ دُبُرٍ وَوَلَدُهَا مِنَ الثُّلُثِ»
عَنْ دُبُرٍ مِنَ الثُّلُثِ»
[Machine] On the authority of Abu Abdullah Ash-Shaqiry and Abu Hashim, on the authority of Ibrahim who said, "The one responsible for managing all the wealth."
عَنْ أَبِي عَبْدِ اللَّهِ الشَّقَرِيِّ وَأَبِي هَاشِمٍ عَنْ إِبْرَاهِيمَ قَالَ «الْمُدَبَّرُ مِنْ جَمِيعِ الْمَالِ»
«مِنَ الثُّلُثِ»
22.36 [Machine] Who Said: "Do Not Witness a Will Until It Is Recited to You
٢٢۔٣٦ بَابُ: مَنْ قَالَ: لَا تَشْهَدْ عَلَى وَصِيَّةٍ حَتَّى تُقْرَأَ عَلَيْكَ
[Machine] "Do not testify to a will until it is read to you, and do not testify to someone you do not know."
«لَا تَشْهَدْ عَلَى وَصِيَّةٍ حَتَّى تُقْرَأَ عَلَيْكَ وَلَا تَشْهَدْ عَلَى مَنْ لَا تَعْرِفُ»
22.37 [Machine] Who advises/directs the mothers of their children?
٢٢۔٣٧ بَابُ: مَنْ أَوْصَى لِأُمَّهَاتِ أَوْلَادِهِ
[Machine] Omar ibn Al-Khattab advised the mothers of his children to receive four thousand (dirhams) each.
أَنَّ عُمَرَ بْنَ الْخَطَّابِ «أَوْصَى لِأُمَّهَاتِ أَوْلَادِهِ بِأَرْبَعَةِ آلَافٍ أَرْبَعَةِ آلَافٍ لِكُلِّ امْرَأَةٍ مِنْهُنَّ»
22.38 [Machine] The boy's will.
٢٢۔٣٨ بَابُ: وَصِيَّةِ الْغُلَامِ
«أَنَّهُ أَجَازَ وَصِيَّةَ ابْنِ ثَلَاثَ عَشْرَةَ سَنَةً»
[Machine] The saying goes: "If a boy is hit on his back, it's permissible." Abu Muhammad said, "I approve of it, but judges do not permit it."
شُرَيْحٌ «إِذَا أَصَابَ الْغُلَامُ فِي وَصِيَّتِهِ جَازَتْ» قَالَ أَبُو مُحَمَّد «يُعْجِبُنِي وَالْقُضَاةُ لَا يُجِيزُونَ»
[Machine] He witnessed a legal declaration from Abbas bin Ismail bin Marthad, regarding his will for his property in Zhirah, from the people of Hira, and Abbas is a young boy.
أَنَّهُ «شَهِدَ شُرَيْحًا أَجَازَ وَصِيَّةَ عَبَّاسِ بْنِ إِسْمَاعِيلَ بْنِ مَرْثَدٍ لِظِئْرِهِ مِنْ أَهْلِ الْحِيرَةِ وعَبَّاسٌ صَبِيٌّ»
[Machine] "Shurayh said, 'If a child performed the ritual ablution properly, then his prayer is acceptable.'"
شُرَيْحٌ «إِذَا اتَّقَى الصَّبِيُّ الرَّكِيَّةَ جَازَتْ وَصِيَّتُهُ»
[Machine] It is said that he is a wise man who advised a confused person from the people of Haarta with forty dirhams. So Shurayh affirmed it and said, "Whoever achieves the truth, we will affirm it."
يُقَالُ لَهُ مَرْثَدٌ أَوْصَى لِظِئْرٍ لَهُ مِنْ أَهْلِ الْحِيرَةِ بِأَرْبَعِينَ دِرْهَمًا فَأَجَازَهُ شُرَيْحٌ وَقَالَ «مَنْ أَصَابَ الْحَقَّ أَجَزْنَاهُ»
[Machine] He informed them that a boy in the city had died and his inheritance was in Sham (Syria). They mentioned to Umar that he was going to die, so they asked him to make a will. Umar ordered him to make a will. So he made a will for a well called the well of Jusham, and its people sold it for thirty thousand (dinars). Abu Bakr mentioned that the boy was either ten or twelve years old.
أَخْبَرَهُ أَنَّ غُلَامًا بِالْمَدِينَةِ حَضَرَهُ الْمَوْتُ وَوَرَثَتُهُ بِالشَّامِ وَأَنَّهُمْ ذَكَرُوا لِعُمَرَ أَنَّهُ يَمُوتُ فَسَأَلُوهُ أَنْ يُوصِيَ «فَأَمَرَهُ عُمَرُ أَنْ يُوصِيَ» فَأَوْصَى بِبِئْرٍ يُقَالُ لَهَا بِئْرُ جُشَمَ وَأنَّ أَهْلَهَا بَاعُوهَا بِثَلَاثِينَ أَلْفًا ذَكَرَ أَبُو بَكْرٍ «أَنَّ الْغُلَامَ كَانَ ابْنَ عَشْرِ سِنِينَ أَوْ ثِنْتَيْ عَشْرَةَ»
[Machine] "It is permissible for the minor to make a will regarding his wealth in the third of his estate or less, and only his guardian can prevent him from doing so for the sake of the fear of poverty upon him. However, at the time of death, he has no right to prevent him."
«يَجُوزُ وَصِيَّةُ الصَّبِيِّ فِي مَالِهِ فِي الثُّلُثِ فَمَا دُونَهُ وَإِنَّمَا يَمْنَعُهُ وَلِيُّهُ ذَلِكَ فِي الصِّحَّةِ رَهْبَةَ الْفَاقَةِ عَلَيْهِ فَأَمَّا عِنْدَ الْمَوْتِ فَلَيْسَ لَهُ أَنْ يَمْنَعَهُ»
[Machine] "It was said about a neighboring girl that they made fun of her, so he said, 'Whoever has harmed her, we will reward them.'"
أَنَّهُ أُتِيَ فِي جَارِيَةٍ أَوْصَتْ فَجَعَلُوا يُصَغِّرُونَهَا فَقَالَ «مَنْ أَصَابَ الْحَقَّ أَجَزْنَاهُ»
[Machine] Abu Muhammad says: Amr ibn Sulaim is what people say.
أَبُو مُحَمَّد النَّاسُ يَقُولُونَ عَمْرُو بْنُ سُلَيْمٍ
[Machine] From his two sons, Abdullah and Muhammad, the sons of Abu Bakr, from their father, the same was narrated, except that one of them said "at the age of thirteen" and the other said "before he reached puberty." Abu Muhammad said about his two sons, meaning the sons of Abu Bakr.
عَنِ ابْنَيْهِ عَبْدِ اللَّهِ وَمُحَمَّدٍ ابْنَيْ أَبِي بَكْرٍ عَنْ أَبِيهِمَا مِثْلَ ذَلِكَ غَيْرَ أَنَّ أَحَدَهُمَا قَالَ ابْنُ ثَلَاثَ عَشْرَةَ وَقَالَ الْآخَرُ قَبْلَ أَنْ يَحْتَلِمَ قَالَ أَبُو مُحَمَّد عَنِ ابْنَيْهِ يَعْنِي ابْنَيْ أَبِي بَكْرٍ
22.39 [Machine] Who said: It is not permissible
٢٢۔٣٩ بَابُ: مَنْ قَالَ: لَا يَجُوزُ
[Machine] He used to say, "His will is not rewarded except what is difficult," meaning the boy, before he reaches puberty.
أَنَّهُ كَانَ يَقُولُ «وَصِيَّتُهُ لَيْسَتْ بِجَائِزَةٍ إِلَّا مَا لَيْسَ بِذِي بَالٍ» يَعْنِي الْغُلَامَ قَبْلَ أَنْ يَحْتَلِمَ
[Machine] "It is not permissible to divorce a minor, nor can his guardianship, gift, charity, or emancipation be carried out until he reaches the age of puberty."
«لَا يَجُوزُ طَلَاقُ الْغُلَامِ وَلَا وَصِيَّتُهُ وَلَا هِبَتُهُ وَلَا صَدَقَتُهُ وَلَا عَتَاقَتُهُ حَتَّى يَحْتَلِمَ»
[Machine] Divorce, emancipation, bequeathing, selling, and anything else are not permissible for a child.
«لَا يَجُوزُ طَلَاقُ الصَّبِيِّ وَلَا عِتْقُهُ وَلَا وَصِيَّتُهُ وَلَا شِرَاؤُهُ وَلَا بَيْعُهُ وَلَا شَيْءٌ»
[Machine] Divorce and wills are not permissible except in a state of sound mind, meaning not intoxicated. If someone is intoxicated, their divorce is permissible and they are to be struck on the back.
لَا يَجُوزُ طَلَاقٌ وَلَا وَصِيَّةٌ إِلَّا فِي عَقْلٍ إِلَّا النَّشْوَانَ يَعْنِي السَّكْرَانَ فَإِنَّهُ يَجُوزُ طَلَاقُهُ وَيُضْرَبُ ظَهْرُهُ
22.40 [Machine] If he commands the liberation of a servant who remains
٢٢۔٤٠ بَابُ: إِذَا أَوْصَى بِعَتْقِ عَبْدٍ لَهُ آبِقٍ
[Machine] "In his will, every slave is free for me, and he has a permanent slave." So they both said, "He is free." However, Al-Hasan, Iyas, and Bakr ibn Abdullah said, "He is not free."
فِي وَصِيَّتِهِ كُلُّ مَمْلُوكٍ لِي حُرٌّ وَلَهُ مَمْلُوكٌ آبِقٌ فَقَالَا «هُوَ حُرٌّ» وقَالَ الْحَسَنُ وَإِيَاسٌ وَبَكْرُ بْنُ عَبْدِ اللَّهِ «لَيْسَ بِحُرٍّ»
22.41 [Machine] The will for women.
٢٢۔٤١ بَابُ: الْوَصِيَّةِ لِلنِّسَاءِ
[Machine] "That Umar advised Hafsah, the Mother of the Believers."
«أَنَّ عُمَرَ أَوْصَى إِلَى حَفْصَةَ أُمِّ الْمُؤْمِنِينَ»
22.42 [Machine] The Will for People of the Dhimma
٢٢۔٤٢ بَابُ: الْوَصِيَّةِ لِأَهْلِ الذِّمَّةِ
[Machine] "That Safiyyah made a will for her Jewish relative."
«أَنَّ صَفِيَّةَ أَوْصَتْ لِنَسِيبٍ لَهَا يَهُودِيٍّ»
[Machine] "Shurayh said, 'If a boy is hit in his shin, it is permissible, and it is only recommended to the one who has the right.' Abu Muhammad said, 'I agree with it.'"
شُرَيْحٌ «إِذَا أَصَابَ الْغُلَامُ فِي وَصِيَّتِهِ جَازَتْ وَإِنَّمَا أَوْصَى لِذِي حَقٍّ» قَالَ أَبُو مُحَمَّد «أَنَا أَقُولُ بِهِ»
22.43 [Machine] In the pause
٢٢۔٤٣ بَابُ: فِي الْوَقْفِ
[Machine] Indeed, Zubayr made his endowment as a charity for his sons that cannot be sold or inherited. And it is that the return of it from his daughters should live in a dwelling that is neither harmful nor causing harm, and if she is self-sufficient with a husband, then he has no right [over her].
أَنَّ الزُّبَيْرَ «جَعَلَ دُورَهُ صَدَقَةً عَلَى بَنِيهِ لَا تُبَاعُ وَلَا تُوَرَّثُ وَأَنَّ لِلْمَرْدُودَةِ مِنْ بَنَاتِهِ أَنْ تَسْكُنَ غَيْرَ مُضِرَّةٍ وَلَا مُضَارٍّ بِهَا فَإِنْ هِيَ اسْتَغْنَتْ بِزَوْجٍ فَلَا حَقَّ لَهَا»
22.44 [Machine] If the beneficiary dies before the one making the will
٢٢۔٤٤ بَابُ: إِذَا مَاتَ الْمُوصَى لَهُ قَبْلَ الْمُوصِي
[Machine] About a drunkard man who advises another man to give dinars in the way of Allah, but the advised one dies before he can spend it. He said, "It is for the inheritors (of the advised one) to carry out this in the way of Allah."
عَنْ مَكْحُولٍ فِي الرَّجُلِ يُوصِي لِلرَّجُلِ بِدَنَانِيرَ فِي سَبِيلِ اللَّهِ فَيَمُوتُ الْمُوصَى لَهُ قَبْلَ أَنْ يَخْرُجَ بِهَا مِنْ أَهْلِهِ قَالَ «هِيَ إِلَى أَوْلِيَاءِ الْمُتَوَفَّى الْمُوصِي يُنْفِذُونَهَا فِي سَبِيلِ اللَّهِ»
[Machine] "Concerning Al-Hassan's statement about a man who advises another man with a will, and then the advised man dies before the advisor. He said, 'It is a reward for the heirs of the advised.'"
عَنْ الْحَسَنِ فِي الرَّجُلِ يُوصِي لِلرَّجُلِ بِالْوَصِيَّةِ فَيَمُوتُ الْمُوصَى لَهُ قَبْلَ الْمُوصِي قَالَ «هِيَ جَائِزَةٌ لِوَرَثَةِ الْمُوصَى لَهُ»
[Machine] Ali used to permit it, similar to the saying of Hassan.
أَنَّ عَلِيًّا كَانَ يُجِيزُهَا مِثْلَ قَوْلِ الْحَسَنِ
22.45 [Machine] When one is entrusted with something in the way of Allah
٢٢۔٤٥ بَابُ: إِذَا أَوْصَى بِشَيْءٍ فِي سَبِيلِ اللَّهِ
[Machine] Indeed, a man advised me and gave me a camel for the sake of Allah, and it is not a time for going out for battle, so should I use it for Hajj? Ibn Umar replied, "Hajj and Umrah are for the sake of Allah."
إِنَّ رَجُلًا أَوْصَى إِلَيَّ وَجَعَلَ نَاقَةً فِي سَبِيلِ اللَّهِ وَلَيْسَ هَذَا زَمَانًا يُخْرَجُ إِلَى الْغَزْوِ فَأَحْمِلُ عَلَيْهَا فِي الْحَجِّ؟ فَقَالَ ابْنُ عُمَرَ «الْحَجُّ وَالْعُمْرَةُ فِي سَبِيلِ اللَّهِ»
[Machine] A man bequeathed his wealth in the cause of Allah, and the recipient of the bequest asked Umar about it. Umar said, "Give it to the workers of Allah." The recipient asked, "Who are the workers of Allah?" Umar replied, "The pilgrims to the House of Allah."
أَنَّ رَجُلًا أَوْصَى بِمَالِهِ فِي سَبِيلِ اللَّهِ فَسَأَلَ الْوَصِيُّ عَنْ ذَلِكَ عُمَرَ فَقَالَ «أَعْطِهِ عُمَّالَ اللَّهِ» قَالَ وَمَنْ عُمَّالُ اللَّهِ؟ قَالَ «حَاجُّ بَيْتِ اللَّهِ»
