22.12 [Machine] In the accused's will

٢٢۔١٢ بَابُ: فِي الْوَصِيِّ الْمُتَّهَمِ

[Machine] "If the judge accuses the guardian, he does not remove him, but appoints someone else with him." This is the view of Al-Awza'i.  

الدارمي:٣٢٥٩أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُبَارَكِ حَدَّثَنَا الْوَلِيدُ عَنْ الْأَوْزَاعِيِّ عَنْ يَحْيَى قَالَ

«إِذَا اتَّهَمَ الْقَاضِي الْوَصِيَّ لَمْ يَعْزِلْهُ وَلَكِنْ يُوَكِّلُ مَعَهُ غَيْرَهُ» وَهُوَ رَأْيُ الْأَوْزَاعِيِّ
