22. Book of Wills/Testaments
٢٢۔ كِتَابُ الْوَصَايَا
«أَنَّهُ أَجَازَ وَصِيَّةَ ابْنِ ثَلَاثَ عَشْرَةَ سَنَةً»
[Machine] The saying goes: "If a boy is hit on his back, it's permissible." Abu Muhammad said, "I approve of it, but judges do not permit it."
شُرَيْحٌ «إِذَا أَصَابَ الْغُلَامُ فِي وَصِيَّتِهِ جَازَتْ» قَالَ أَبُو مُحَمَّد «يُعْجِبُنِي وَالْقُضَاةُ لَا يُجِيزُونَ»
[Machine] He witnessed a legal declaration from Abbas bin Ismail bin Marthad, regarding his will for his property in Zhirah, from the people of Hira, and Abbas is a young boy.
أَنَّهُ «شَهِدَ شُرَيْحًا أَجَازَ وَصِيَّةَ عَبَّاسِ بْنِ إِسْمَاعِيلَ بْنِ مَرْثَدٍ لِظِئْرِهِ مِنْ أَهْلِ الْحِيرَةِ وعَبَّاسٌ صَبِيٌّ»
[Machine] "Shurayh said, 'If a child performed the ritual ablution properly, then his prayer is acceptable.'"
شُرَيْحٌ «إِذَا اتَّقَى الصَّبِيُّ الرَّكِيَّةَ جَازَتْ وَصِيَّتُهُ»
[Machine] It is said that he is a wise man who advised a confused person from the people of Haarta with forty dirhams. So Shurayh affirmed it and said, "Whoever achieves the truth, we will affirm it."
يُقَالُ لَهُ مَرْثَدٌ أَوْصَى لِظِئْرٍ لَهُ مِنْ أَهْلِ الْحِيرَةِ بِأَرْبَعِينَ دِرْهَمًا فَأَجَازَهُ شُرَيْحٌ وَقَالَ «مَنْ أَصَابَ الْحَقَّ أَجَزْنَاهُ»
[Machine] He informed them that a boy in the city had died and his inheritance was in Sham (Syria). They mentioned to Umar that he was going to die, so they asked him to make a will. Umar ordered him to make a will. So he made a will for a well called the well of Jusham, and its people sold it for thirty thousand (dinars). Abu Bakr mentioned that the boy was either ten or twelve years old.
أَخْبَرَهُ أَنَّ غُلَامًا بِالْمَدِينَةِ حَضَرَهُ الْمَوْتُ وَوَرَثَتُهُ بِالشَّامِ وَأَنَّهُمْ ذَكَرُوا لِعُمَرَ أَنَّهُ يَمُوتُ فَسَأَلُوهُ أَنْ يُوصِيَ «فَأَمَرَهُ عُمَرُ أَنْ يُوصِيَ» فَأَوْصَى بِبِئْرٍ يُقَالُ لَهَا بِئْرُ جُشَمَ وَأنَّ أَهْلَهَا بَاعُوهَا بِثَلَاثِينَ أَلْفًا ذَكَرَ أَبُو بَكْرٍ «أَنَّ الْغُلَامَ كَانَ ابْنَ عَشْرِ سِنِينَ أَوْ ثِنْتَيْ عَشْرَةَ»
[Machine] "It is permissible for the minor to make a will regarding his wealth in the third of his estate or less, and only his guardian can prevent him from doing so for the sake of the fear of poverty upon him. However, at the time of death, he has no right to prevent him."
«يَجُوزُ وَصِيَّةُ الصَّبِيِّ فِي مَالِهِ فِي الثُّلُثِ فَمَا دُونَهُ وَإِنَّمَا يَمْنَعُهُ وَلِيُّهُ ذَلِكَ فِي الصِّحَّةِ رَهْبَةَ الْفَاقَةِ عَلَيْهِ فَأَمَّا عِنْدَ الْمَوْتِ فَلَيْسَ لَهُ أَنْ يَمْنَعَهُ»
[Machine] "It was said about a neighboring girl that they made fun of her, so he said, 'Whoever has harmed her, we will reward them.'"
أَنَّهُ أُتِيَ فِي جَارِيَةٍ أَوْصَتْ فَجَعَلُوا يُصَغِّرُونَهَا فَقَالَ «مَنْ أَصَابَ الْحَقَّ أَجَزْنَاهُ»
[Machine] Abu Muhammad says: Amr ibn Sulaim is what people say.
أَبُو مُحَمَّد النَّاسُ يَقُولُونَ عَمْرُو بْنُ سُلَيْمٍ
[Machine] From his two sons, Abdullah and Muhammad, the sons of Abu Bakr, from their father, the same was narrated, except that one of them said "at the age of thirteen" and the other said "before he reached puberty." Abu Muhammad said about his two sons, meaning the sons of Abu Bakr.
عَنِ ابْنَيْهِ عَبْدِ اللَّهِ وَمُحَمَّدٍ ابْنَيْ أَبِي بَكْرٍ عَنْ أَبِيهِمَا مِثْلَ ذَلِكَ غَيْرَ أَنَّ أَحَدَهُمَا قَالَ ابْنُ ثَلَاثَ عَشْرَةَ وَقَالَ الْآخَرُ قَبْلَ أَنْ يَحْتَلِمَ قَالَ أَبُو مُحَمَّد عَنِ ابْنَيْهِ يَعْنِي ابْنَيْ أَبِي بَكْرٍ
