البزّار:٥٢٢٤حَدَّثنا عَبد الله بن شَبِيب حَدَّثنا عَبد العزيز بن عَبد الله حَدَّثنا عَبد الْعَزِيزِ بْنُ الْمُطَّلِبِ عَن يَحْيَى بْنِ سَعِيد م وحَدَّثناه مُحَمد بن عَبد الملك حَدَّثنا خالد بن الحارث حَدَّثنا مُؤَمَّل بن هشام حَدَّثنا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ عَن ابْنِ عَوْنٍ عَن نافعٍ عَن ابْنِ عُمَر أَن عُمَر أَتَى النَّبِيّ صَلَّى اللَّهُ عَلَيه وَسَلَّم فَقَالَ إِنِّي

أَصَبْتُ أَرْضًا بِخَيْبَرَ وَقَالَ ابْنُ عَوْنٍ فِي حديثه أصبتُ مالا بخيبر لم أُصِبت مَالا هُوَ أَنْفَسُ عِنْدِي مِنْهُ فَقَالَ النَّبِيّ صَلَّى اللَّهُ عَلَيه وَسَلَّم إِنْ شِئْتَ تَصَدَّقْتَ بِثَمَرَتِهَا وَحَبَسْتَ أَصْلَهَا فَتَصَدَّقَ بِهَا لا تُباعُ ولاَ تُوهَبُ ولاَ تُوَرَّثُ وجعلَهَا فِي الْمَسَاكِينِ وابنِ السَّبِيلِ والرقابِ والقَرَابة وَالضَّيْفِ لا جُنَاحَ عَلَى مَنْ وَلِيهَا أَنْ يَأْكُلَ بِالْمَعْرُوفِ غَيْرَ مُتَأَثِّلٍ مِنْهُوَهَذَا اللَّفْظُ لَفْظُ ابْنِ عون وَقال ابن عُلَيَّة في حديثه فَقَالَ لَهُ النَّبِيّ صَلَّى اللَّهُ عَلَيه وَسَلَّم احْبِسْ أَصْلَهَا وَتَصَدَّقْ بِثَمَرَتِهَاوَهَذَا الْحَدِيثُ لا نعلَمُ أحَدًا يَرْوِيهِ إلاَّ ابْنُ عَوْنٍ وهُو الَّذِي يُعرف بِهِ وَأَمَّا حَدِيثُ يَحْيَى بْنِ سَعِيد فَإِنَّمَا رَوَاهُ عَبد الْعَزِيزِ بْنُ الْمُطَّلِبِ عنه

Umar bin Khattab got some land in Khaibar and he went to the Prophet ﷺ to consult him about it saying, "O Messenger of Allah ﷺ I got some land in Khaibar better than which I have never had, what do you suggest that I do with it?" The Prophet ﷺ said, "If you like you can give the land as endowment and give its fruits in charity." So ʿUmar gave it in charity as an endowment on the condition that would not be sold nor given to anybody as a present and not to be inherited, but its yield would be given in charity to the poor people, to the Kith and kin, for freeing slaves, for Allah's Cause, to the travelers and guests; and that there would be no harm if the guardian of the endowment ate from it according to his need with good intention, and fed others without storing it for the future."

Umar acquired a land at Khaibar. He came to Allah's Apostle ﷺ and sought his advice in regard to it. He said: Messenger of Allah, I have acquired land in Khaibar. I have never acquired property more valuable for me than this, so what do you command me to do with it? Thereupon he (Allah's Apostle) said: If you like, you may keep the corpus intact and give its produce as Sadaqa. So 'Umar gave it as Sadaqa declaring that property must not be sold or inherited or given away as gift. And Umar devoted it to the poor, to the nearest kin, and to the emancipation of slaves, aired in the way of Allah and guests. There is no sin for one, who administers it if he eats something from it in a reasonable manner, or if he feeds his friends and does not hoard up goods (for himself). He (the narrator) said: I narrated this hadith to Muhammad, but as I reached the (words)" without hoarding (for himself) out of it." he (Muhammad' said:" without storing the property with a view to becoming rich." Ibn 'Aun said: He who read this book (pertaining to Waqf) informed me that in it (the words are)" without storing the property with a view to becoming rich."

“Umar bin Khattab acquired some land at Khaibar, and he came to the Prophet ﷺ and consulted him. He said: 'O Messenger of Allah ﷺ, I have been given some wealth at Khaibar and I have never been given any wealth that is more precious to me than it. What do you command me to do with it? He said: 'If you wish, you can make it an endowment and give (its produce) in charity.' So 'Umar gave it on the basis that it would not be sold, given away or inherited, and (its produce) was to be given to the poor, to relatives, for freeing slaves, in the cause of Allah, to way fares and to guests; and there was nothing wrong if a person appointed to be in charge of it consumed from it on a reasonable basis or feeding a fried, without accumulating it for himself.”

[Machine] I acquired land from Khaybar, which I have not acquired any wealth equivalent to it. So, I went to the Messenger of Allah ﷺ seeking his guidance. I said, "O Messenger of Allah, I have acquired land from Khaybar that I have not acquired any wealth equivalent to. He said, 'If you wish, you can keep its original state and donate it. So, Umar (may Allah be pleased with him) donated it, stipulating that it should not be sold, given as a gift, or inherited. He said, 'Donate it to the poor, close relatives, in the way of Allah, in the freeing of slaves, and to the wayfarer. There is no blame on anyone who is its guardian and eats from it in a good way and gives in a good way, without being extravagant.' Ibn Awun said, 'And I mentioned it to Ibn Sirin, and he said, 'Without being a hoarder of wealth.'

البيهقي:١١٨٨٩أَخْبَرَنَا عَلِيُّ بْنُ مُحَمَّدِ بْنِ عَبْدِ اللهِ بْنِ بِشْرَانَ الْعَدْلُ بِبَغْدَادَ أنبأ أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمِصْرِيُّ ثنا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ أَبِي مَرْيَمَ ثنا مُحَمَّدُ بْنُ يُوسُفَ الْفِرْيَابِيُّ ثنا سُفْيَانُ الثَّوْرِيُّ عَنِ ابْنِ عَوْنٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ عَنْ عُمَرَ ؓ قَالَ

أَخْرَجَهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ إِسْحَاقَ بْنِ إِبْرَاهِيمَ عَنْ أَبِي دَاوُدَ الْحَفَرِيِّ عَنْ سُفْيَانَ
