قَالَ لَمَّا نَزَلَتْ هَذِهِ الآية { فَاحْكُمْ بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ} قَالَ فَكَانَ مُخَيَّرًا إِنْ شَاءَ حَكَمَ وَإن شَاءَ أَعْرَضَ عَنْهُمْ وَرَدَّهُمْ إِلَى أَحْكَامِهِمْ قَالَ فَنَزَلَتْ { وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللَّهُ وَلاَ تَتَّبِعْ أَهْوَاءَهُمْ} قَالَ فأُمِر أَنْ يَحْكُمَ بَيْنَهُمْ بِمَا فِي كِتَابِنَا وَهَذَا الْحَدِيثُ قَدْ رُوِيَ عَنِ ابْنِ عَبَّاسٍ مِنْ غَيْرِ وَجْهٍ فَاقْتَصَرْنَا عَلَى هَذَا الإِسْنَادِ مِنْهَا وَالإِسْنَادُ صَحِيحٌ سُفْيَانُ بْنُ حُسَيْنٍ وَاسِطِيٌّ ثِقَةٌ وَعَبَّادُ بْنُ الْعَوَّامِ وَاسِطِيٌّ ثِقَةٌ وَسَعِيدُ بْنُ سُلَيْمَانَ وَاسِطِيٌّ انْتَقَلَ إِلَى بَغْدَادَ وهُو أَحَدُ الثِّقَاتِ
[AI] Two verses of this Surah were abrogated, which are the verse of the ornaments and his saying, "So if they come to you, then judge between them or turn away from them." He returned them to their rulers until the verse was revealed, "And judge between them by what Allah has revealed." [Surah Al-Ma'idah 49] He said, "So the Messenger of Allah ﷺ was commanded to judge between them by what Allah has revealed."

[AI] Two verses were abrogated from this Surah, meaning the verse of Al-Qalaid (liabilities) and His saying, "So if they come to you, judge between them or turn away from them," returning them to their rulers, until the revelation of "And judge between them by what Allah has revealed" [Surah Al-Ma'idah: 49]. [AI] There are two verses in this Surah that have been abrogated, meaning Surah Al-Ma'idah, verse 42: "So judge between them or turn away from them." The Prophet ﷺ was given the choice to either judge between them or turn away from them and leave their affairs to their rulers. Then verse 49 was revealed: "And judge between them by what Allah has revealed and do not follow their inclinations." The Prophet ﷺ was commanded to judge between them by what was revealed in our Book. This was also narrated by 'Atiyyah al-'Awfi from Ibn 'Abbas in regards to ruling, and 'Ikrimah also mentioned it.
