41. Chapter
٤١۔ كِتَابُ الْقَسَمِ وَالنُّشُوزِ
[Machine] He said about this verse {And if you fear dissension between the two, send an arbitrator from his people and an arbitrator from her people} [Surah An-Nisa: Verse 35]. He said, "A man and a woman came to Ali, and each of them had a group of people with them. So Ali commanded them and they sent an arbitrator from his people and an arbitrator from her people. Then he said to the two arbitrators, 'Do you know what is upon you? If you see that they should reconcile, then reconcile. And if you see that they should separate, then separate.' The woman said, 'I am satisfied with the Book of Allah and what is upon me.' And the man said, 'As for separation, no.' So Ali said, 'You lie, by Allah, until you are satisfied with what she is satisfied with.' And he narrated to us Abu Nasr Umar ibn Abdul Aziz, that Abu Mansur Abbas ibn Al-Fadl An-Nadri informed us, that Ahmad ibn Najdah informed us, that Sa'id ibn Mansur informed us, that Hammad ibn Zaid reported to us from Ayyub. He mentioned it with its chain of narration, except that he said, 'Ali said, 'No, by Allah, you will not turn away until you are satisfied with what you have been satisfied with.'" And Abu Abdur Rahman As-Salami and Abu Bakr ibn Al-Harith Al-Faqih narrated to us, saying, "I am Ali ibn Umar Al-Hafiz, narrated to us Ahmed ibn Ali ibn Al-Alaa, narrated to us Ziyad ibn Ayyub, narrated to us Yahya ibn Zakariya ibn Abi Zaidah, Ibn 'Awn informed me from Ibn Sireen, from 'Ubaidah. So he mentioned the hadith with its meaning, except that he said, 'Then he approached the woman and said, 'Are you satisfied with their ruling?' She said, 'Yes, I am satisfied with the Book of Allah and what is upon me.' Then he approached the man and said, 'Are you satisfied with their ruling?' He said, 'No, but I am satisfied with them reconciling and I am not satisfied with them separating.' So Ali said to him, 'You lie, by Allah, you will not leave until you are satisfied with what she is satisfied with.'"
أَنَّهُ قَالَ فِي هَذِهِ الْآيَةِ {وَإِنْ خِفْتُمْ شِقَاقَ بَيْنِهِمَا فَابْعَثُوا حَكَمًا مِنْ أَهْلِهِ وَحَكَمًا مِنْ أَهْلِهَا} [سورة النساء آية رقم 35] قَالَ جَاءَ رَجُلٌ وَامْرَأَةٌ إِلَى عَلِيٍّ ؓ وَمَعَ كُلِّ وَاحِدٍ مِنْهُمَا فِئَامٌ مِنَ النَّاسِ فَأَمَرَهُمْ عَلِيٌّ ؓ فَبَعَثُوا حَكَمًا مِنْ أَهْلِهِ وَحَكَمًا مِنْ أَهْلِهَا ثُمَّ قَالَ لِلْحَكَمَيْنِ تَدْرِيَانِ مَا عَلَيْكُمَا عَلَيْكُمَا إِنْ رَأَيْتُمَا أَنْ تَجْمَعَا أَنْ تَجْمَعَا وَإِنْ رَأَيْتُمَا أَنْ تُفَرِّقَا أَنْ تُفَرِّقَا قَالَتِ الْمَرْأَةُ رَضِيتُ بِكِتَابِ اللهِ بِمَا عَلَيَّ فِيهِ وَلِي وَقَالَ الرَّجُلُ أَمَّا الْفُرْقَةُ فَلَا فَقَالَ عَلِيٌّ ؓ كَذَبْتَ وَاللهِ حَتَّى تُقِرَّ بِمِثْلِ مَا أَقَرَّتْ بِهِ 14783 وَأَخْبَرَنَا أَبُو نَصْرٍ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ بْنِ قَتَادَةَ أنا أَبُو مَنْصُورٍ الْعَبَّاسُ بْنُ الْفَضْلِ النَّضْرَوِيُّ أنا أَحْمَدُ بْنُ نَجْدَةَ نا سَعِيدُ بْنُ مَنْصُورٍ نا حَمَّادُ بْنُ زَيْدٍ عَنْ أَيُّوبَ فَذَكَرَهُ بِإِسْنَادِهِ وَمَعْنَاهُ إِلَّا أَنَّهُ قَالَ قَالَ عَلِيٌّ ؓ كَلَّا وَاللهِ لَا تَنْقَلِبُ حَتَّى تُقِرَّ بِمِثْلِ مَا أَقَرَّتْ بِهِ 14784 وَبِإِسْنَادِهِ نا سَعِيدٌ نا هُشَيْمٌ أنا مَنْصُورٌ وَهِشَامٌ عَنِ ابْنِ سِيرِينَ عَنْ عُبَيْدَةَ بِمِثْلِهِ فَقَالَتِ الْمَرْأَةُ رَضِيتُ وَسَلَّمْتُ فَقَالَ الرَّجُلُ أَمَّا الْفُرْقَةُ فَلَا فَقَالَ عَلِيٌّ ؓ لَيْسَ ذَلِكَ لَكَ لَسْتُ بِبَارِحٍ حَتَّى تَرْضَى بِمِثْلِ مَا رَضِيَتْ بِهِ 14785 وَأَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ وَأَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ قَالَا أنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ نا أَحْمَدُ بْنُ عَلِيِّ بْنِ الْعَلَاءِ نا زِيَادُ بْنُ أَيُّوبَ نا يَحْيَى بْنُ زَكَرِيَّا بْنِ أَبِي زَائِدَةَ أَخْبَرَنِي ابْنُ عَوْنٍ عَنِ ابْنِ سِيرِينَ عَنْ عُبَيْدَةَ فَذَكَرَ الْحَدِيثَ بِمَعْنَاهُ إِلَّا أَنَّهُ قَالَ ثُمَّ أَقْبَلَ عَلَى الْمَرْأَةِ وَقَالَ أَرَضِيتِ بِمَا حَكَمَا؟ قَالَتْ نَعَمْ قَدْ رَضِيتُ بِكِتَابِ اللهِ عَلَيَّ وَلِي ثُمَّ أَقْبَلَ عَلَى الرَّجُلِ فَقَالَ قَدْ رَضِيتَ بِمَا حَكَمَا؟ قَالَ لَا وَلَكِنْ أَرْضَى أَنْ يَجْمَعَا وَلَا أَرْضَى أَنْ يُفَرِّقَا فَقَالَ لَهُ عَلِيٌّ ؓ كَذَبْتَ وَاللهِ لَا تَبْرَحُ حَتَّى تَرْضَى بِمِثْلِ الَّذِي رَضِيَتْ بِهِ
[Machine] Mu'awiyah: I would not separate between two elderly men from the tribe of Banu Abd Manaf. So he came to both of them and found that they had tightened their clothes and had reconciled their affair. Ikrimah ibn Khalid narrated from Ibn Abbas, who said: "Mu'awiyah and I were appointed as judges. It was said to us, 'If you see it appropriate to separate them, then separate them. And if you see it appropriate to gather them, then gather them.'"
مُعَاوِيَةُ مَا كُنْتُ لِأُفَرِّقَ بَيْنَ شَيْخَيْنِ مِنْ بَنِي عَبْدِ مَنَافٍ قَالَ فَأَتَاهُمَا فَوَجَدَهُمَا قَدْ شَدَّا عَلَيْهِمَا أَثْوَابَهُمَا وَأَصْلَحَا أَمْرَهُمَا وَرَوَى عِكْرِمَةُ بْنُ خَالِدٍ عَنِ ابْنِ عَبَّاسٍ قَالَ بُعِثْتُ أَنَا وَمُعَاوِيَةُ حَكَمَيْنِ فَقِيلَ لَنَا إِنْ رَأَيْتُمَا أَنْ تُفَرِّقَا فَرَّقْتُمَا وَإِنْ رَأَيْتُمَا أَنْ تَجْمَعَا جَمَعْتُمَا
[Machine] They can separate or unite, so their decision is permissible.
يُفَرِّقَا أَوْ يَجْمَعَا فَأَمْرُهُمَا جَائِزٌ
[Machine] This passage translates to: "It means the judges."
يَعْنِي الْحَكَمَيْنِ
[Machine] If one of the two judges makes a ruling and the other does not, then his ruling is not valid until they both agree.
إِذَا حَكَمَ أَحَدُ الْحَكَمَيْنِ وَلَمْ يَحْكُمِ الْآخَرُ فَلَيْسَ حُكْمُهُ بِشَيْءٍ حَتَّى يَجْتَمِعَا
[Machine] Shuraih asked for a judge from their people and a judge from their people, and they did so. The two judges looked into their matter and saw that they should separate between them. That man disliked it and Shuraih said, "How were we today and why did he allow their matter?"
شُرَيْحٌ ابْعَثُوا حَكَمًا مِنْ أَهْلِهِ وَحَكَمًا مِنْ أَهْلِهَا فَفَعَلُوا فَنَظَرَ الْحَكَمَانِ إِلَى أَمْرِهِمَا فَرَأَيَا أَنْ يُفَرِّقَا بَيْنَهُمَا فَكَرِهَ ذَلِكَ الرَّجُلُ فَقَالَ شُرَيْحٌ فَفِيمَ كُنَّا فِيهِ الْيَوْمَ وَأَجَازَ أَمْرَهُمَا
[Machine] I heard Al-Sha'bi say, "Whatever the two judges rule, whether it is to separate or unite, it is permissible." And something similar was said by Ubaydah.
سَمِعْتُ الشَّعْبِيَّ يَقُولُ مَا يَحْكُمُ الْحَكَمَانِ مِنْ شَيْءٍ جَازَ إِنْ فَرَّقَا أَوْ جَمَعَا وَعَنْ عُبَيْدَةَ مِثْلُهُ
[Machine] He appoints a judge from his people and a judge from her people, and they speak to one of them and advise him. If he returns, then they speak to the other and advise him. If he returns, and if not, they both decide. Whatever they decide is valid.
يَبْعَثُ حَكَمًا مِنْ أَهْلِهِ وَحَكَمًا مِنْ أَهْلِهَا فَيُكَلِّمُونَ أَحَدَهُمَا وَيَعِظُونَهُ فَإِنْ رَجَعَ وَإِلَّا كَلَّمُوا الْآخَرَ وَوَعَظُوهُ فَإِنْ رَجَعَ وَإِلَّا حَكَمَا فَمَا حَكَمَا مِنْ شَيْءٍ فَهُوَ جَائِزٌ
[Machine] About this verse, Al-Hasan said: "They are only responsible for reconciliation and mediation between the parties, and they should consider that, and not the separation being in their hands. This is contrary to what has passed and it is the most correct statement of Ash-Shafi'i, may Allah have mercy on him. This is supported by what we have narrated from Ali, except that they should bring it to them. And Allah knows best."
عَنِ الْحَسَنِ فِي هَذِهِ الْآيَةِ {فَابْعَثُوا حَكَمًا مِنْ أَهْلِهِ وَحَكَمًا مِنْ أَهْلِهَا} [النساء 35] قَالَ إِنَّمَا عَلَيْهِمَا أَنْ يُصْلِحَا وَأَنْ يَنْظُرَا فِي ذَلِكَ وَلَيْسَ الْفُرْقَةُ فِي أَيْدِيهِمَا هَذَا خِلَافُ مَا مَضَى وَهُوَ أَصَحُّ قَوْلِ الشَّافِعِيِّ رَحِمَهُ اللهُ وَعَلَيْهِ يَدُلُّ ظَاهِرُ مَا رُوِّينَا عَنْ عَلِيٍّ ؓ إِلَّا أَنْ يَجْعَلَاهَا إِلَيْهِمَا وَاللهُ أَعْلَمُ
