[Machine] He appoints a judge from his people and a judge from her people, and they speak to one of them and advise him. If he returns, then they speak to the other and advise him. If he returns, and if not, they both decide. Whatever they decide is valid.  

البيهقي:١٤٧٩٢أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو قَالَا نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ نا إِبْرَاهِيمُ بْنُ مَرْزُوقٍ نا وَهْبُ بْنُ جَرِيرٍ نا شُعْبَةُ عَنْ عَمْرِو بْنِ مُرَّةَ قَالَ سَأَلْتُ سَعِيدَ بْنَ جُبَيْرٍ عَنِ الْحَكَمَيْنِ فَقَالَ لَمْ أُدْرِكْ إِذْ ذَاكَ فَقُلْتُ إِنَّمَا أَسْأَلُكَ عَنِ الْحَكَمَيْنِ اللَّذَيْنِ فِي كِتَابِ اللهِ أَعْنِي الْقُرْآنَ قَالَ

يَبْعَثُ حَكَمًا مِنْ أَهْلِهِ وَحَكَمًا مِنْ أَهْلِهَا فَيُكَلِّمُونَ أَحَدَهُمَا وَيَعِظُونَهُ فَإِنْ رَجَعَ وَإِلَّا كَلَّمُوا الْآخَرَ وَوَعَظُوهُ فَإِنْ رَجَعَ وَإِلَّا حَكَمَا فَمَا حَكَمَا مِنْ شَيْءٍ فَهُوَ جَائِزٌ
