41. Chapter
٤١۔ كِتَابُ الْقَسَمِ وَالنُّشُوزِ
[Machine] The Prophet ﷺ forbade both men and women from entering the bathrooms. However, he allowed men to enter while wearing clothes, but he did not allow women. This is stated in the narration of Al-Muqri and in the narration of Ar-Rawdabari.
النَّبِيَّ ﷺ نَهَى الرِّجَالَ وَالنِّسَاءَ عَنْ دُخُولِ الْحَمَّامَاتِ ثُمَّ رَخَّصَ لِلرِّجَالِ أَنْ يَدْخُلُوا وَعَلَيْهِمُ الْأُزُرُ وَلَمْ يُرَخِّصْ لِلنِّسَاءِ لَفْظُ حَدِيثِ الْمُقْرِئِ وَفِي رِوَايَةِ الرُّوذْبَارِيِّ نَهَى عَنْ دُخُولِ الْحَمَّامَاتِ ثُمَّ رَخَّصَ لِلرِّجَالِ أَنْ يَدْخُلُوهَا فِي الْمَيَازِرِ
that some women from the inhabitants of Hims, or from the inhabitants of Ash-Sham entered upon 'Aishah, so she said: "Are you those whose women enter the Hammamat? I heard the Messenger of Allah ﷺ saying: 'No woman removes her garments in other than the house of her husband except that she has torn the screen between herself and her Lord.'" أَهْلِ حِمْصٍ أَوْ مِنْ أَهْلِ الشَّامِ دَخَلْنَ عَلَى عَائِشَةَ ؓ فَقَالَتْ أَنْتُنَّ اللَّاتِي يَدْخُلْنَ نِسَاؤُكُنَّ الْحَمَّامَاتِ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَا مِنَ امْرَأَةٍ تَضَعُ ثِيَابَهَا فِي غَيْرِ بَيْتِ زَوْجِهَا إِلَّا هَتَكَتِ السِّتْرَ بَيْنَهَا وَبَيْنَ اللهِ ﷻ وَرُوِيَ ذَلِكَ عَنْ أَبِي مُسْلِمٍ الْخَوْلَانِيِّ عَنْ عَائِشَةَ ؓ وَعَنِ السَّائِبِ عَنْ أَبِي سَلَمَةَ ؓ مَرْفُوعًا
The Prophet ﷺ said: After some time the lands of the non-Arabs will be conquered for you, and there you will find houses called hammamat (hot baths). so men should not enter them (to wash) except in lower garments, and forbid the women to enter them except a sick or one who is in a child-bed. قَالَ رَسُولُ اللهِ ﷺ إِنَّهَا سَتُفْتَحُ لَكُمْ أَرْضُ الْأَعَاجِمِ وَسَتَجِدُونَ فِيهَا بُيُوتًا يُقَالُ لَهَا الْحَمَّامَاتُ فَلَا يَدْخُلَنَّهَا الرِّجَالُ إِلَّا بِالْأُزُرِ وَامْنَعُوا النِّسَاءَ أَنْ يَدْخُلْنَهَا إِلَّا مَرِيضَةً أَوْ نُفَسَاءَ
قَالَ رَسُولُ اللهِ ﷺ احْذَرُوا بَيْتًا يُقَالُ لَهُ الْحَمَّامُ قِيلَ فَإِنَّهُ يَذْهَبُ بِالْوَسَخِ وَيَنْفَعُ قَالَ فَمَنْ دَخَلَهُ فَلْيَسْتَتِرْ قَالَ سُلَيْمَانُ هَكَذَا
[Machine] The Messenger of Allah, ﷺ , said: "Beware of a house known as Al-Hamam." They said: "O Messenger of Allah, indeed we benefit from it and it cleans dirt." He said: "Then cover yourselves." The Sheikh said.
قَالَ رَسُولُ اللهِ ﷺ احْذَرُوا بَيْتًا يُقَالُ لَهُ الْحَمَّامُ قَالُوا يَا رَسُولَ اللهِ إِنَّهُ يُنْتَفَعُ بِهِ وَيُنَقِّي الْوَسَخَ قَالَ فَاسْتَتِرُوا قَالَ الشَّيْخُ
[Machine] The Messenger of Allah ﷺ said, "Whoever believes in Allah and the Last Day should not enter the bathhouse except wearing a waist wrap, and whoever believes in Allah and the Last Day from your wives should not enter the bathhouse." It is reported that this was mentioned to 'Umar ibn 'Abdul 'Aziz during his caliphate, so he wrote to Abu Bakr ibn Amr ibn Hazm, asking him to ask Muhammad ibn Thabit about his narration, as he is a trustworthy person. Abu Bakr ibn Amr ibn Hazm asked him, then he wrote to 'Umar ibn 'Abdul 'Aziz, who prohibited women from entering the bathhouse.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ كَانَ يُؤْمِنُ بِاللهِ وَالْيَوْمِ الْآخِرِ فَلَا يَدْخُلِ الْحَمَّامَ إِلَّا بِمِئْزَرٍ وَمَنْ كَانَ يُؤْمِنُ بِاللهِ وَالْيَوْمِ الْآخِرِ مِنْ نِسَائِكُمْ فَلَا تَدْخُلَنَّ الْحَمَّامَ قَالَ فَنُمِيَ ذَلِكَ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ ؓ فِي خِلَافَتِهِ فَكَتَبَ إِلَى أَبِي بَكْرِ بْنِ عَمْرِو بْنِ حَزْمٍ أَنْ سَلْ مُحَمَّدَ بْنَ ثَابِتٍ عَنْ حَدِيثِهِ فَإِنَّهُ رِضًا فَسَأَلَهُ ثُمَّ كَتَبَ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فَمَنَعَ عُمَرُ النِّسَاءَ مِنَ الْحَمَّامِ
[Machine] He used to enter the bathroom and say, "What a good bathroom! It removes dirt and reminds of the fire." He would then say, "What a bad bathroom! It exposes the modesty of its inhabitants."
أَنَّهُ كَانَ يَدْخُلُ الْحَمَّامَ فَيَقُولُ نِعْمَ الْبَيْتُ الْحَمَّامُ يُذْهِبُ الْوَسَخَ وَيُذَكِّرُ النَّارَ يَقُولُ بِئْسَ الْبَيْتُ الْحَمَّامُ؛ لِأَنَّهُ يَكْشِفُ عَنْ أَهْلِهِ الْحَيَاءَ
[Machine] Yes, the bathroom is good, it removes dirt and reminds of fire.
نِعْمَ الْبَيْتُ الْحَمَّامُ يُذْهِبُ الْوَسَخَ وَيُذَكِّرُ النَّارَ
