41.6 [Machine] The right of women over men

٤١۔٦ بَابُ حَقِّ الْمَرْأَةِ عَلَى الرَّجُلِ

[Machine] The Messenger of Allah ﷺ said, "Whoever believes in Allah and the Last Day, when they witness something, they should speak good or remain silent. Treat women well, for indeed, woman was created from a rib, and the most crooked part of the rib is its uppermost. If you try to straighten it, you will break it, and if you leave it, it will remain crooked."  

البيهقي:١٤٧٢٢أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ نا إِبْرَاهِيمُ بْنُ إِسْحَاقَ نا هَارُونُ بْنُ عَبْدِ اللهِ نا حُسَيْنُ بْنُ عَلِيٍّ عَنْ زَائِدَةَ عَنْ مَيْسَرَةَ عَنْ أَبِي حَازِمٍ عَنْ أَبِي هُرَيْرَةَ ؓ قَالَ

قَالَ رَسُولُ اللهِ ﷺ مَنْ كَانَ يُؤْمِنُ بِاللهِ وَالْيَوْمِ الْآخِرِ فَإِذَا شَهِدَ أَمْرًا فَلْيَتَكَلَّمْ بِخَيْرٍ أَوْ لِيَسْكُتْ اسْتَوْصُوا بِالنِّسَاءِ خَيْرًا فَإِنَّ الْمَرْأَةَ خُلِقَتْ مِنْ ضِلَعٍ وَإِنَّ أَعْوَجَ شَيْءٍ مِنَ الضِّلَعِ أَعْلَاهُ فَإِنْ ذَهَبْتَ تُقِيمُهُ كَسَرْتَهُ وَإِنْ تَرَكْتَهُ لَمْ يَزَلْ أَعْوَجَ  

رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ إِسْحَاقَ بْنِ نَصْرٍ عَنْ حُسَيْنٍ الْجُعْفِيِّ وَرَوَاهُ مُسْلِمٌ عَنْ أَبِي بَكْرِ بْنِ أَبِي شَيْبَةَ عَنْ حُسَيْنٍ

[Machine] The Messenger of Allah ﷺ said: "Indeed, woman was created from a rib, and she will never be straightened for you on a straight path. So if you enjoy her, you enjoy her with her crookedness. And if you try to straighten her, you will break her, and breaking her is divorcing her."  

البيهقي:١٤٧٢٣وَأَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ الْحَافِظُ نا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ نا إِبْرَاهِيمُ بْنُ مُحَمَّدٍ وَإِبْرَاهِيمُ بْنُ أَبِي طَالِبٍ قَالَا نا ابْنُ أَبِي عُمَرَ نا سُفْيَانُ عَنْ أَبِي الزِّنَادِ عَنِ الْأَعْرَجِ عَنْ أَبِي هُرَيْرَةَ ؓ قَالَ

قَالَ رَسُولُ اللهِ ﷺ إِنَّ الْمَرْأَةَ خُلِقَتْ مِنْ ضِلَعٍ لَنْ تَسْتَقِيمَ لَكَ عَلَى طَرِيقَةٍ فَإِنِ اسْتَمْتَعْتَ بِهَا اسْتَمْتَعْتَ وَبِهَا عِوَجٌ وَإِنْ ذَهَبْتَ تُقِيمُهَا كَسَرْتَهَا وَكَسْرُهَا طَلَاقُهَا  

رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ عَنِ ابْنِ أَبِي عُمَرَ وَأَخْرَجَهُ الْبُخَارِيُّ مِنْ حَدِيثِ مَالِكٍ عَنْ أَبِي الزِّنَادِ

[Machine] Regarding the story of the Prophet's pilgrimage and sermon at Arafat, Jabir said: "Fear Allah regarding women, for you have taken them as a trust from Allah and made their private parts lawful by the word of Allah. You have rights over them and they have rights over you. Do not, therefore, be so harsh towards them that you bring about dislike for them, but if you dislike them, then perhaps you dislike something in which Allah has placed much good. Beat them lightly if they disobey you, but do not beat them severely. And remember that they have a right to their provision and clothing according to the common norms."  

البيهقي:١٤٧٢٤أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ نا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ نا أَبِي نا عَمْرُو بْنُ زُرَارَةَ نا حَاتِمُ بْنُ إِسْمَاعِيلَ نا جَعْفَرُ بْنُ مُحَمَّدٍ عَنْ أَبِيهِ

عَنْ جَابِرٍ فِي قِصَّةِ حَجِّ النَّبِيِّ ﷺ وَخُطْبَتِهِ بِعَرَفَةَ قَالَ فَاتَّقُوا اللهَ فِي النِّسَاءِ فَإِنَّكُمْ أَخَذْتُمُوهُنَّ بِأَمَانَةِ اللهِ وَاسْتَحْلَلْتُمْ فُرُوجَهُنَّ بِكَلِمَةِ اللهِ وَإِنَّ لَكُمْ عَلَيْهِنَّ أَنْ لَا يُوطِئْنَ فُرُشَكُمْ أَحَدًا تَكْرَهُونَهُ فَإِنْ فَعَلْنَ فَاضْرِبُوهُنَّ ضَرْبًا غَيْرَ مُبَرِّحٍ وَلَهُنَّ عَلَيْكُمْ رِزْقُهُنَّ وَكِسْوَتُهُنَّ بِالْمَعْرُوفِ  

أَخْرَجَهُ مُسْلِمٌ فِي الصَّحِيحِ مِنْ حَدِيثِ حَاتِمِ بْنِ إِسْمَاعِيلَ

[Machine] I came to the Messenger of Allah ﷺ and when I was brought up to him, he said, "Indeed, I have asked Allah to appoint me over you with the Sunnah, so that I may frighten you with it and with terror, by putting it in your hearts." He then said, holding both of his hands, "Indeed, I have sworn an oath such and such that I will not believe in you, nor follow you. But the Sunnah still frightens me and terror is still placed in my heart until I stood in front of you. Is it not Allah who sent you? Is it not He who sent you with what you say?" He said, "Yes." He said, "Did He command you with what you command us?" He said, "Yes." He said, "What do you say about our women?" He said, "They are your fields, so come to your fields in any manner you please and give them from what you eat and clothe them from what you wear, and do not beat them or revile them." He said, "Does one of us look at the nakedness of his brother when we gather?" He said, "No." He said, "What if we disperse?" He said, "Then one of you should put his thigh against the thigh of his brother." Then, the Messenger of Allah ﷺ said, "Allah is more deserving that you should be shy of Him." And I heard him say, "People will be gathered on the Day of Resurrection with remnants of lewdness hanging over them, and the first thing that will speak of the human beings will be his hand and his thigh."  

البيهقي:١٤٧٢٥أَخْبَرَنَا أَبُو طَاهِرٍ الْفَقِيهُ نا أَبُو بَكْرٍ مُحَمَّدُ بْنُ الْحُسَيْنِ الْقَطَّانُ نا أَحْمَدُ بْنُ يُوسُفَ نا عُمَرُ بْنُ عَبْدِ اللهِ بْنِ رَزِينٍ نا سُفْيَانُ لَفْظًا عَنْ دَاوُدَ الْوَرَّاقِ عَنْ سَعِيدِ بْنِ حَكِيمٍ عَنْ أَبِيهِ عَنْ جَدِّهِ مُعَاوِيَةَ بْنِ حَيْدَةَ الْقُشَيْرِيِّ قَالَ

أَتَيْتُ رَسُولَ اللهِ ﷺ فَلَمَّا رُفِعْتُ إِلَيْهِ قَالَ أَمَا إِنِّي سَأَلْتُ اللهَ ﷻ أَنْ يُعَيِّنِّي عَلَيْكُمْ بِالسُّنَّةِ نُخِيفُكُمْ وَبِالرُّعْبِ أَنْ يَجْعَلَهُ فِي قُلُوبِكُمْ قَالَ فَقَالَ بِيَدَيْهِ جَمِيعًا أَمَا إِنِّي قَدْ حَلَفْتُ هَكَذَا وَهَكَذَا أَنْ لَا أُؤْمِنَ بِكَ وَلَا أَتَّبِعَكَ فَمَا زَالَتِ السُّنَّةُ تُخِيفُنِي وَالرُّعْبُ يُجْعَلُ فِي قَلْبِي حَتَّى قُمْتُ بَيْنَ يَدَيْكَ أَمَا لِلَّهِ الَّذِي أَرْسَلَكَ أَهُوَ الَّذِي أَرْسَلَكَ بِمَا تَقُولُ؟ قَالَ نَعَمْ قَالَ فَهُوَ أَمَرَكَ بِمَا تَأْمُرُنَا؟ قَالَ نَعَمْ قَالَ فَمَا تَقُولُ فِي نِسَائِنَا؟ قَالَ هُنَّ حَرْثٌ لَكُمْ فَأْتُوا حَرْثَكُمْ أَنَّى شِئْتُمْ وَأَطْعِمُوهُنَّ مِمَّا تَأْكُلُونَ وَاكْسُوهُنَّ مِمَّا تَكْسُونَ وَلَا تَضْرِبُوهُنَّ وَلَا تُقَبِّحُوهُنَّ قَالَ فَيَنْظُرُ أَحَدُنَا إِلَى عَوْرَةِ أَخِيهِ إِذَا اجْتَمَعْنَا؟ قَالَ لَا قَالَ فَإِذَا تَفَرَّقْنَا؟ قَالَ فَضَمَّ رَسُولُ اللهِ ﷺ إِحْدَى فَخِذَيْهِ إِلَى الْأُخْرَى ثُمَّ قَالَ اللهُ أَحَقُّ أَنْ تَسْتَحْيُوا مِنْهُ قَالَ وَسَمِعْتُهُ يَقُولُ يُحْشَرُ النَّاسُ يَوْمَ الْقِيَامَةِ عَلَيْهِمُ الْقُدَامُ فَأَوَّلُ مَا يَنْطِقُ مِنَ الْإِنْسَانِ كَفُّهُ وَفَخِذُهُ

a man asked the Prophet ﷺ: “What are the right of the woman over her husband?” He said: “That he should feed her as he feeds himself and clothe her as he clothes himself; he should not strike her on the face nor disfigure her, and he should not abandon her except in the house (as a form of discipline).” (Hassan) (Using translation from Ibn Mājah 1850)   

البيهقي:١٤٧٢٦أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ نا يَحْيَى بْنُ أَبِي طَالِبٍ أنا يَزِيدُ بْنُ هَارُونَ أنا شُعْبَةُ عَنْ أَبِي قَزَعَةَ عَنْ حَكِيمِ بْنِ مُعَاوِيَةَ عَنْ أَبِيهِ

أَنَّ رَجُلًا سَأَلَ رَسُولَ اللهِ ﷺ مَا حَقُّ الْمَرْأَةِ عَلَى الزَّوْجِ؟ قَالَ أَنْ يُطْعِمَهَا إِذَا طَعِمَ وَيَكْسُوَهَا إِذَا اكْتَسَى وَلَا يَهْجُرُ إِلَّا فِي الْبَيْتِ وَلَا يَضْرِبُ الْوَجْهَ وَلَا يُقَبِّحُ

[Machine] The Messenger of Allah ﷺ said, "A believer should not despise a believer, even if he dislikes some of his qualities, for there may be other qualities in him that he finds pleasing." Ibn Al-Muthanna said, "Despising is to hold animosity towards someone."  

البيهقي:١٤٧٢٧أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا أَبُو الْحُسَيْنِ مُحَمَّدُ بْنُ أَحْمَدَ بْنِ تَمِيمٍ الْقَنْطَرِيُّ بِبَغْدَادَ أنا أَبُو قِلَابَةَ نا عَبْدُ اللهِ بْنُ حُمْرَانَ نا عَبْدُ الْحَمِيدِ بْنُ جَعْفَرٍ ح وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ أنا أَبُو بَكْرِ بْنُ إِسْحَاقَ الْفَقِيهُ وَأَبُو عَبْدِ اللهِ بْنُ يَعْقُوبَ الْحَافِظُ وَأَبُو الْفَضْلِ بْنُ إِبْرَاهِيمَ الْمُزَكِّي قَالُوا نا أَحْمَدُ بْنُ سَلَمَةَ نا مُحَمَّدُ بْنُ الْمُثَنَّى نا أَبُو عَاصِمٍ نا عَبْدُ الْحَمِيدِ بْنُ جَعْفَرٍ ثنا عِمْرَانُ بْنُ أَبِي أَنَسٍ عَنْ عُمَرَ بْنِ الْحَكَمِ عَنْ أَبِي هُرَيْرَةَ ؓ قَالَ

قَالَ رَسُولُ اللهِ ﷺ لَا يَفْرَكْ مُؤْمِنٌ مُؤْمِنَةً إِنْ كَرِهَ مِنْهَا خُلُقًا رَضِيَ آخَرَ لَفْظُ حَدِيثِهِمَا سِوَاهُ قَالَ ابْنُ الْمُثَنَّى الْفَرْكُ الْبُغْضُ

[Machine] "Allah says, 'And they [women] have rights similar to those [of men] over them in a just manner.' [Quran 2:228] And I do not like for her to seek all her rights from me, because Allah says, 'And men have a degree over them [women].' [Quran 2:228]"  

البيهقي:١٤٧٢٨أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ الْحَافِظُ وَمُحَمَّدُ بْنُ مُوسَى بْنِ الْفَضْلِ قَالَا نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ نا أَحْمَدُ بْنُ عَبْدِ الْجَبَّارِ ثنا وَكِيعٌ عَنْ بَشِيرِ بْنِ مُهَاجِرٍ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ ؓ قَالَ إِنِّي لَأُحِبُّ أَنْ أَتَزَيَّنَ لِلْمَرْأَةِ كَمَا أُحِبُّ أَنْ تَزَّيَّنَ لِي؛ لِأَنَّ

اللهَ ﷻ يَقُولُ {وَلَهُنَّ مِثْلُ الَّذِي عَلَيْهِنَّ بِالْمَعْرُوفِ} [البقرة 228] وَمَا أُحِبُّ أَنْ تَسْتَطِفَّ جَمِيعَ حَقٍّ لِي عَلَيْهَا؛ لِأَنَّ اللهَ ﷻ يَقُولُ {وَلِلرِّجَالِ عَلَيْهِنَّ دَرَجَةٌ} [البقرة 228]
