41. Chapter
٤١۔ كِتَابُ الْقَسَمِ وَالنُّشُوزِ
[Machine] That the Messenger of Allah ﷺ married Umm Salamah, and when she came to him, he said to her, "There is no blame on you with regard to your family. If you wish, I will stay with you for seven days and stay with them for seven days. And if you wish, I will stay with you for three days." Then she said, "Three days." And in another narration of Al-Shafi'i, she said, "Three days, and then stay with them."
أَنَّ رَسُولَ اللهِ ﷺ حِينَ تَزَوَّجَ أُمَّ سَلَمَةَ وَأَصْبَحَتْ عِنْدَهُ فَقَالَ لَهَا لَيْسَ بِكِ عَلَى أَهْلِكِ هَوَانٌ إِنْ شِئْتِ سَبَّعْتُ عِنْدَكِ وَسَبَّعْتُ عِنْدَهُنَّ وَإِنْ شِئْتِ ثَلَّثْتُ ثُمَّ دُرْتُ قَالَتْ ثَلِّثْ وَفِي رِوَايَةِ الشَّافِعِيِّ ثَلَّثْتُ عِنْدَكِ وَدُرْتُ قَالَتْ ثَلِّثْ
[Machine] That the Messenger of Allah ﷺ when he married Umm Salamah, he entered upon her and when he wanted to leave, she held onto his garment. So the Messenger of Allah ﷺ said: "If you wish, I will increase you and calculate you as a maiden for seven and as a widow for three."
أَنَّ رَسُولَ اللهِ ﷺ حِينَ تَزَوَّجَ أُمَّ سَلَمَةَ فَدَخَلَ عَلَيْهَا فَأَرَادَ أَنْ يَخْرُجَ أَخَذَتْ بِثَوْبِهِ فَقَالَ رَسُولُ اللهِ ﷺ إِنْ شِئْتِ زِدْتُكِ وَحَاسَبْتُكِ بِهِ لِلْبِكْرِ سَبْعٌ وَلِلثَّيِّبِ ثَلَاثٌ
[Machine] The Messenger of Allah, ﷺ , when he married her, he stayed with her for three days and said, "It is not a disgrace for your family if I separate from you. If you wish, I will stay with you for a week, and if I stay with you for a week, I will have to stay with my wives." Sulaiman said, "This hadith has not been narrated from Sufyan except by Yahya ibn Sa'id al-Qattan." The Sheikh said,
رَسُولَ اللهِ ﷺ لَمَّا تَزَوَّجَهَا أَقَامَ عِنْدَهَا ثَلَاثَةَ أَيَّامٍ وَقَالَ إِنَّهُ لَيْسَ بِكِ عَلَى أَهْلِكِ هَوَانٌ فَإِنْ شِئْتِ سَبَّعْتُ لَكِ وَإِنْ سَبَّعْتُ لَكِ سَبَّعْتُ لِنِسَائِي قَالَ سُلَيْمَانُ لَمْ يَرْوِ هَذَا الْحَدِيثَ مُجَوَّدَ الْإِسْنَادِ عَنْ سُفْيَانَ إِلَّا يَحْيَى بْنُ سَعِيدٍ الْقَطَّانُ قَالَ الشَّيْخُ
If you desire that I spend a week with you, I shall have to spend a week with my (other) wives, and if spend a week with you, I shall have to spend a week with my (other) wives. (Using translation from Muslim 1460e)
رَسُولَ اللهِ ﷺ تَزَوَّجَهَا وَذَكَرَ أَشْيَاءَ هَذَا فِيهِ قَالَ إِنْ شِئْتِ أَنْ أُسَبِّعَ لَكِ وَأُسَبِّعَ لِنِسَائِي وَإِنْ سَبَّعْتُ لَكِ سَبَّعْتُ لِنِسَائِي هَكَذَا
[Machine] Um Salama, the wife of the Prophet ﷺ, informed him that when she arrived in Madinah, she told the people that she was the daughter of Abu Umama bin Al-Mughira. They accused her of lying and said, "No stranger tells such rare tales even until some people started talking about it during Hajj." They told her, "Write to your family," so she wrote with them. They returned to Madinah and confirmed her story, so their honor increased. She said, "When I gave birth to Zainab, the Messenger of Allah ﷺ came to me and asked for my hand in marriage. I said, 'No one like me should be married except to one with children, and I am a jealous woman with a family.' He said, 'I am older than you, and as for jealousy, Allah will remove it, and as for the family, it is with Allah and His Messenger.' So he married her to him. He used to come to her and say, 'How are you, Zunab? Where are the Zunabs?' Then Ammar bin Yasir came and disturbed her, so the Prophet ﷺ said, 'Where are the Zunabs?' She said, 'I am the daughter of Abu Umamah, and she is with me.' Ammar bin Yasir took her. The Prophet ﷺ said, 'I will come to you tonight.' She said, 'I cleaned myself and took grains of barley from a sack, and it was in a container, or according to another narration, a gourd, and I took some fat and applied it. Then I spent the night and in the morning, he said, 'You have honor among your people. If you wish, I will keep you.' And if you dislike, I will divorce you, but continue to be one of my wives."
أَنَّ أُمَّ سَلَمَةَ زَوْجَ النَّبِيِّ ﷺ أَخْبَرَتْهُ أَنَّهَا لَمَّا قَدِمَتِ الْمَدِينَةَ أَخْبَرَتْهُمْ أَنَّهَا ابْنَةُ أَبِي أُمَيَّةَ بْنِ الْمُغِيرَةِ فَكَذَّبُوهَا وَيَقُولُونَ مَا أَكْذَبَ الْغَرَائِبَ حَتَّى أَنْشَأَ نَاسٌ مِنْهُمْ فِي الْحَجِّ فَقَالُوا تَكْتُبِينَ إِلَى أَهْلِكِ فَكَتَبَتْ مَعَهُمْ فَرَجَعُوا إِلَى الْمَدِينَةِ فَصَدَّقُوهَا فَازْدَادَتْ عَلَيْهِمْ كَرَامَةً قَالَتْ فَلَمَّا وَضَعْتُ زَيْنَبَ جَاءَنِي رَسُولُ اللهِ ﷺ فَخَطَبَنِي فَقُلْتُ مَا مِثْلِي تُنْكَحُ أَمَّا أَنَا فَلَا وَلَدَ فِيَّ وَأَنَا غَيُورٌ ذَاتُ عِيَالٍ فَقَالَ أَنَا أَكْبَرُ مِنْكِ وَأَمَّا الْغَيْرَةُ فَيُذْهِبُهَا اللهُ وَأَمَّا الْعِيَالُ فَإِلَى اللهِ وَرَسُولِهِ فَتَزَوَّجَهَا فَجَعَلَ يَأْتِيهَا فَيَقُولُ كَيْفَ زُنَابُ؟ أَيْنَ زُنَابُ؟ فَجَاءَ عَمَّارُ بْنُ يَاسِرٍ فَاخْتَلَجَهَا فَقَالَ هَذِهِ تَمْنَعُ رَسُولَ اللهِ ﷺ وَكَانَتْ تُرْضِعُهَا فَجَاءَ النَّبِيُّ ﷺ فَقَالَ أَيْنَ زُنَابُ؟ فَقَالَتْ قُرَيْبَةُ ابْنَةُ أَبِي أُمَيَّةَ وَوَافَقَهَا عِنْدَهَا أَخَذَهَا عَمَّارُ بْنُ يَاسِرٍ فَقَالَ النَّبِيُّ ﷺ إِنِّي آتِيكُمُ اللَّيْلَةَ قَالَتْ فَوَضَعْتُ ثِقَالِي وَأَخْرَجْتُ حَبَّاتٍ مِنْ شَعِيرٍ وَكَانَتْ فِي جَرٍّ وَفِي رِوَايَةِ أَبِي عَبْدِ اللهِ فِي جَرِيبٍ وَأَخْرَجْتُ شَحْمًا فَعَصَدْتُهُ فَبَاتَ ثُمَّ أَصْبَحَ فَقَالَ حِينَ أَصْبَحَ إِنَّ لَكِ عَلَى أَهْلِكِ كَرَامَةً فَإِنْ شِئْتِ سَبَّعْتُ لَكِ وَإِنْ أُسَبِّعْ أُسَبِّعْ لِنِسَائِي
[Machine] If a virgin woman marries a previously married man, he must pay her seven days' worth of expenses. But if a previously married man marries a virgin woman, he must pay her three days' worth of expenses. Even if you say he raised the amount, you would be correct, but he said it is the sunnah (tradition) like this.
إِذَا تَزَوَّجَ الْبِكْرَ عَلَى الثَّيِّبِ أَقَامَ عِنْدَهَا سَبْعًا وَإِذَا تَزَوَّجَ الثَّيِّبَ عَلَى الْبِكْرِ أَقَامَ عِنْدَهَا ثَلَاثًا وَلَوْ قُلْتَ إِنَّهُ رَفَعَهُ صَدَقْتَ وَلَكِنَّهُ قَالَ السُّنَّةُ كَذَلِكَ
[Machine] From the Sunnah, if a virgin marries a non-virgin, he should stay with her for seven nights. And if a non-virgin marries a virgin, he should stay with her for three nights. Khalid said, "If you say that he raised it, then you are truthful," and in a hadith from Abdul Razzaq, "If you want, you can say that he raised it to the Prophet ﷺ ."
مِنَ السُّنَّةِ إِذَا تَزَوَّجَ الْبِكْرَ عَلَى الثَّيِّبِ أَقَامَ عِنْدَهَا سَبْعًا وَإِذَا تَزَوَّجَ الثَّيِّبَ عَلَى الْبِكْرِ أَقَامَ عِنْدَهَا ثَلَاثًا قَالَ خَالِدٌ وَلَوْ قُلْتَ إِنَّهُ رَفَعَهُ لَصَدَقْتَ وَفِي حَدِيثِ عَبْدِ الرَّزَّاقِ وَلَوْ شِئْتَ قُلْتَ رَفَعَهُ إِلَى النَّبِيِّ ﷺ
[Machine] The Messenger of Allah ﷺ said, "When a virgin woman marries a man who has previous experience and is not a virgin, he should spend seven nights with her. And when a man who has previous experience and is not a virgin marries a virgin woman, he should spend three nights with her."
قَالَ رَسُولُ اللهِ ﷺ إِذَا تَزَوَّجَ الْبِكْرَ عَلَى الثَّيِّبِ أَقَامَ عِنْدَهَا سَبْعًا وَإِذَا تَزَوَّجَ الثَّيِّبَ عَلَى الْبِكْرِ أَقَامَ عِنْدَهَا ثَلَاثًا
[Machine] The bachelor has seven days, and the married has three days.
لِلْبِكْرِ سَبْعَةُ أَيَّامٍ وَلِلثَّيِّبِ ثَلَاثَةُ أَيَّامٍ
[Machine] If a man marries a virgin woman, she is entitled to seven (days). Then, if he marries her while she is not a virgin, she is entitled to three days. Then, he (further) divides (the time).
إِذَا تَزَوَّجَ الرَّجُلُ الْمَرْأَةَ بِكْرًا فَلَهَا سَبْعٌ ثُمَّ يَقْسِمُ فَإِذَا تَزَوَّجَهَا ثَيِّبًا فَلَهَا ثَلَاثَةُ أَيَّامٍ ثُمَّ يَقْسِمُ
[Machine] He said that he would stay with the virgin for seven nights, and then divide [his time], and if she was not a virgin, he would stay with her for three nights and then divide [his time].
أَنَّهُ قَالَ يُقِيمُ عِنْدَ الْبِكْرِ سَبْعًا ثُمَّ يَقْسِمُ وَإِنْ كَانَتْ ثَيِّبًا أَقَامَ عِنْدَهَا ثَلَاثًا ثُمَّ يَقْسِمُ
[Machine] When the Prophet ﷺ entered Safiyyah's tent and stayed with her, Uthman increased [the number of tents]. Thiyya was among them.
أَنَّ النَّبِيَّ ﷺ لَمَّا دَخَلَ بِصَفِيَّةَ أَقَامَ عِنْدَهَا ثَلَاثًا زَادَ عُثْمَانُ وَكَانَتْ ثَيِّبًا
