32. Gifts (1/3)
٣٢۔ كِتَابُ الْهِبَاتِ ص ١
[Machine] That the Prophet ﷺ said: "O Muslim women, do not belittle a neighbor for her neighbor, even if it is a sheep."
أَنَّ النَّبِيَّ ﷺ قَالَ يَا نِسَاءَ الْمُسْلِمَاتِ لَا تَحْقِرَنَّ جَارَةٌ لِجَارَتِهَا وَلَوْ فِرْسِنَ شَاةٍ
[Machine] The Messenger of Allah ﷺ said, "If I am handed a gift, even if it is as small as a palm's length, I would accept it. And if I am invited to a feast, even if it is as simple as a sheep's shoulder, I would respond." 11941 Abu Abdullah Al-Hafiz informed us, narrating from Abu Al-Abbas Muhammad ibn Ya'qub, narrating from Al-Abbas ibn Muhammad Ad-Duri, narrating from Wahb ibn Jarir, from Shu'bah, from Al-A'mash, who mentioned it.
قَالَ رَسُولُ اللهِ ﷺ لَوْ أُهْدِيَ إِلِيَّ ذِرَاعٌ لَقَبِلْتُ وَلَوْ دُعِيتُ إِلَى كُرَاعٍ لَأَجَبْتُ 11941 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا الْعَبَّاسُ بْنُ مُحَمَّدٍ الدُّورِيُّ ثنا وَهْبُ بْنُ جَرِيرٍ عَنْ شُعْبَةَ عَنِ الْأَعْمَشِ فَذَكَرَهُ
Son of my sister, by Allah, I used to see the new moon, then the new moon, then the new moon, i. e. three moons in two months, and fire was not kindled in the house of Messenger of Allah ﷺ. I ('Urwa) said: Auntie, then what were your means of sustenance? She said: Dates and water. But it (so happened) that Messenger of Allah ﷺ had some Ansar as his neighbours and they had milch animals and they used to send to Messenger of Allah ﷺ some milk of their (animals) and he served that to us. أَنَّهَا كَانَتْ تَقُولُ وَاللهِ يَا ابْنَ أُخْتِي إِنْ كُنَّا لَنَنْظُرُ إِلَى الْهِلَالِ ثُمَّ الْهِلَالِ ثُمَّ الْهِلَالِ ثَلَاثَةَ أَهِلَّةٍ فِي شَهْرَيْنِ وَمَا أُوقِدَتْ فِي أَبْيَاتِ رَسُولِ اللهِ ﷺ نَارٌ قَالَ قُلْتُ يَا خَالَةُ مَا كَانَ يُعِيشُكُمْ؟ قَالَتِ الْأَسْوَدَانِ التَّمْرُ وَالْمَاءُ إِلَّا أَنَّهُ قَدْ كَانَ لِرَسُولِ اللهِ ﷺ جِيرَانٌ مِنَ الْأَنْصَارِ وَكَانَتْ لَهُمْ مَنَائِحُ فَكَانُوا يُرْسِلُونَ إِلَى رَسُولِ اللهِ ﷺ مِنْ أَلْبَانِهَا فَيَسْقِينَاهُ
[Machine] People used to present their gifts to Aisha on the day of Aisha seeking thereby the pleasure of the Messenger of Allah ﷺ .
كَانَ النَّاسُ يَتَحَرَّوْنَ بِهَدَايَاهُمْ يَوْمَ عَائِشَةَ يَبْتَغُونَ بِذَلِكَ مَرْضَاةَ رَسُولِ اللهِ ﷺ
[Machine] He used to present gifts to the Prophet ﷺ from the desert, so the Messenger of Allah ﷺ would prepare it when he wanted to go out. The Prophet ﷺ said, "Indeed, Zaher is our desert, and we are present with it." And he mentioned the hadith.
كَانَ يُهْدِي لِلنَّبِيِّ ﷺ الْهَدِيَّةَ مِنَ الْبَادِيَةِ فَيُجَهِّزُهُ رَسُولُ اللهِ ﷺ إِذَا أَرَادَ أَنْ يَخْرُجَ فَقَالَ النَّبِيُّ ﷺ إِنَّ زَاهِرًا بَادِيَتُنَا وَنَحْنُ حَاضِرُوهُ وَذَكَرَ الْحَدِيثَ
[Machine] The Messenger of Allah ﷺ said, "If I am given a gift, I would accept it, and if I am invited to a gift, I would respond. He used to encourage us to give gifts as a means of maintaining relationships between people and he said, 'If people were to embrace Islam, they would exchange gifts without any hunger.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَوْ أُهْدِيَ إِلِيَّ كُرَاعٌ لَقَبِلْتُ وَلَوْ دُعِيتُ إِلَى كُرَاعٍ لَأَجَبْتُ وَكَانَ يَأْمُرُنَا بِالْهَدِيَّةِ صِلَةً بَيْنَ النَّاسِ وَقَالَ لَوْ قَدْ أَسْلَمَ النَّاسُ قَدْ تَهَادَوْا مِنْ غَيْرِ جُوعٍ
Exchanging gifts increases love
from the Prophet Muhammad ﷺ who said, "Exchange gifts and you will love one another."
عَنِ النَّبِيِّ ﷺ قَالَ تَهَادُوا تَحَابُّوا
[Machine] I heard Abu Abdullah Al Bushanji saying about the saying of the Prophet ﷺ, "Exchange gifts, as that will lead to increasing love between you. And when he said to do it in moderation, it is to avoid burdening one another."
سَمِعْتُ أَبَا عَبْدِ اللهِ الْبُوشَنْجِيَّ يَقُولُ فِي قَوْلِ النَّبِيِّ ﷺ تَهَادُوا تَحَابُّوا بِالتَّشْدِيدِ مِنَ الْمَحَبَّةِ وَإِذَا قَالَ بِالتَّخْفِيفِ فَإِنَّهُ مِنَ الْمُحَابَاةِ
32.2 [Machine] The condition of acquiring in the gift
٣٢۔٢ بَابُ شَرْطِ الْقَبْضِ فِي الْهِبَةِ
[Machine] The wife of the Prophet ﷺ said: "Verily, Abu Bakr As-Siddiq, may Allah be pleased with him, married me with twenty gold coins from his own money. When his death approached, he said to me: 'By Allah, O my daughter, no one from the people is dearer to me in terms of wealth after me than you, nor is anyone more beloved to me in terms of poverty after me than you. I married you with twenty gold coins from my own money. If you wish to keep it and preserve it, then it belongs to you. But indeed, it is the wealth of the inheritor, and it is your brothers and sisters, so divide it according to the Book of Allah.' I said, 'O my father, by Allah, if it was like this and that, I would leave it. This is only names, so who is the other one?' He said, 'Dhu Batn bint Kharijah, whom I see as a maid servant.' Ibn Wahb informed me that Abdullah bin Umar narrated from Abdul Rahman bin Al-Qasim from his father, who narrated from Aisha, may Allah be pleased with her, that she said: 'Ibn Wahb also informed me that Hanzala bin Abi Sufyan narrated that he heard Qasim bin Muhammad narrating the same, except that he said, 'It is a piece of land called Tamrad, which he did not sell.'"
ؓ زَوْجِ النَّبِيِّ ﷺ أَنَّهَا قَالَتْ إِنَّ أَبَا بَكْرٍ الصِّدِّيقَ ؓ نَحَلَهَا جِدَادَ عِشْرِينَ وَسْقًا مِنْ مَالٍ بِالْغَابَةِ فَلَمَّا حَضَرَتْهُ الْوَفَاةُ قَالَ وَاللهِ يَا بُنَيَّةُ مَا مِنَ النَّاسِ أَحَدٌ أَحَبَّ إِلِيَّ غِنًى بَعْدِي مِنْكِ وَلَا أَعَزَّ عَلَيَّ فَقْرًا بَعْدِي مِنْكِ وَإِنِّي كُنْتُ نَحَلْتُكِ مِنْ مَالِي جِدَادَ عِشْرِينَ وَسْقًا فَلَوْ كُنْتِ جَدَدْتِيهِ وَاحْتَزْتِيهِ كَانَ لَكِ ذَلِكَ وَإِنَّمَا هُوَ مَالُ الْوَارِثِ وَإِنَّمَا هُوَ أَخَوَاكِ وَأُخْتَاكِ فَاقْتَسِمُوهُ عَلَى كِتَابِ اللهِ فَقَالَتْ يَا أَبَتِ وَاللهِ لَوْ كَانَ كَذَا وَكَذَا لَتَرَكْتُهُ إِنَّمَا هُوَ أَسْمَاءُ فَمَنِ الْأُخْرَى؟ قَالَ ذُو بَطْنِ بِنْتِ خَارِجَةَ أُرَاهَا جَارِيَةً قَالَ وَأَنْبَأَ ابْنُ وَهْبٍ أَخْبَرَنِي عَبْدُ اللهِ بْنُ عُمَرَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ عَنْ أَبِيهِ عَنْ عَائِشَةَ بِذَلِكَ قَالَ وَأَخْبَرَنِي ابْنُ وَهْبٍ قَالَ سَمِعْتُ حَنْظَلَةَ بْنَ أَبِي سُفْيَانَ يُحَدِّثُ أَنَّهُ سَمِعَ الْقَاسِمَ بْنَ مُحَمَّدٍ يُحَدِّثُ بِذَلِكَ أَيْضًا إِلَّا أَنَّهُ قَالَ أَرْضًا يُقَالُ لَهَا تَمْرَدُ وَكَانَتْ عِنْدَهُ لَمْ تَقْبِضْهَا
[Machine] I had given it to him who did not fulfill its purpose until it reaches its rightful heir, if he dies it becomes invalid. Abu Zakariya and Abu Bakr informed us, narrating from Abu al-Abbas Muhammad ibn Wahb, who informed me that Yunus ibn Yazid narrated from Ibn Shihab, who narrated from Ibn al-Sabbaq, who narrated from Abd al-Rahman ibn Abd al-Qari, who narrated from Umar ibn al-Khattab. This is what happened.
قَدْ كُنْتُ أَعْطَيْتُهُ إِيَّاهُ مَنْ نَحَلَ نِحْلَةً لَمْ يَحُزْهَا الَّذِي نَحَلَهَا حَتَّى تَكُونَ إِنْ مَاتَ لِوَارِثِهِ فَهِيَ بَاطِلٌ 11950 وَأَخْبَرَنَا أَبُو زَكَرِيَّا وَأَبُو بَكْرٍ قَالَا ثنا أَبُو الْعَبَّاسِ أنبأ مُحَمَّدٌ أنبأ ابْنُ وَهْبٍ أَخْبَرَنِي يُونُسُ بْنُ يَزِيدَ عَنِ ابْنِ شِهَابٍ عَنِ ابْنِ السَّبَّاقِ عَنْ عَبْدِ الرَّحْمَنِ بْنِ عَبْدٍ الْقَارِيِّ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ بِذَلِكَ
[Machine] And Ibn Umar and Ibn Abbas said that they said, "Charity cannot be given until it is received." And Muadh ibn Jabal and Shuraih also said that they did not allow it until it was received.
وَابْنِ عُمَرَ وَابْنِ عَبَّاسٍ ؓ أَنَّهُمْ قَالُوا لَا تَجُوزُ صَدَقَةٌ حَتَّى تُقْبَضَ وَعَنْ مُعَاذِ بْنِ جَبَلٍ وَشُرَيْحٍ أَنَّهُمَا كَانَا لَا يُجِيزَانِهَا حَتَّى تُقْبَضَ
32.3 [Machine] His father holds the child.
٣٢۔٣ بَابُ يَقْبِضُ لِلطِّفْلِ أَبُوهُ
[Machine] To possess his beehive, he declared it and testified to it, so it is valid, even if his father owns it.
أَنْ يَحُوزَ نَحْلُهُ فَأَعْلَنَ بِهَا وَأَشْهَدَ عَلَيْهَا فَهِيَ جَائِزَةٌ وَإِنْ وَلِيَهَا أَبُوهُ
[Machine] What is the matter with people who dissolve their children like sugar, but when one of them dies, they say, "What do I have in my hand?" But when he dies, he says, "I have nurtured him and my children will not receive anything except what the child has inherited from the father."
مَا بَالُ أَقْوَامٍ يَنْحَلُونَ أَوْلَادَهُمْ نِحْلَةً فَإِذَا مَاتَ أَحَدُهُمْ قَالَ مَالِي فِي يَدِي وَإِذَا مَاتَ هُوَ قَالَ قَدْ كُنْتُ نَحَلْتُهُ وَلَدِي لَا نُحْلَةَ إِلَّا نُحْلَةً يَحُوزُهَا الْوَلَدُ دُونَ الْوَالِدِ فَإِنْ مَاتَ وَرِثَهُ
[Machine] That the parent cares for their child when they are small.
أَنَّ الْوَالِدَ يَحُوزُ لِوَلَدِهِ إِذَا كَانُوا صِغَارًا
32.4 [Machine] The gift in the hands of the talented one.
٣٢۔٤ بَابُ هِبَةِ مَا فِي يَدَيِ الْمَوْهُوبِ لَهُ
We were accompanying the Prophet ﷺ on a journey and I was riding an unmanageable camel belonging to 'Umar (ra), and I could not bring it under my control. So, it used to go ahead of the party and 'Umar would check it and force it to retreat, and again it went ahead and again 'Umar forced it to retreat. The Prophet ﷺ asked 'Umar to sell that camel to him. 'Umar replied, "It is for you O Messenger of Allah !" Messenger of Allah ﷺ told 'Umar to sell that camel to him (not to give it as gift). So, 'Umar sold it to Messenger of Allah ﷺ. Then the Prophet ﷺ said to 'Abdullah bin 'Umar "This camel is for you O 'Abdullah (as a present) and you could do with it whatever you like." (Using translation from Bukhārī 2115)
كُنَّا مَعَ النَّبِيِّ ﷺ فِي سَفَرٍ وَكُنْتُ عَلَى بَكْرٍ صَعْبٍ لِعُمَرَ وَكَانَ يَغْلِبُنِي فَيَتَقَدَّمُ أَمَامَ الْقَوْمِ فَيُؤَخِّرُهُ عُمَرُ فَيَرُدُّهُ فَقَالَ النَّبِيُّ ﷺ لِعُمَرَ بِعْنِيهِ فَقَالَ هُوَ لَكَ يَا رَسُولَ اللهِ قَالَ بِعْنِيهِ فَبَاعَهُ مِنْ رَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ هُوَ لَكَ يَا عَبْدَ اللهِ فَاصْنَعْ بِهِ مَا شِئْتَ
32.5 [Machine] What is in the donation of the audience?
٣٢۔٥ بَابُ مَا جَاءَ فِي هِبَةِ الْمُشَاعِ
[Machine] I came to the Prophet ﷺ while he was in the mosque, I think he said Dhuhā (forenoon prayer). He told me to pray it or to pray two units of prayer. And I had a debt to him, so he settled it for me and gave me more.
أَتَيْتُ النَّبِيَّ ﷺ وَهُوَ فِي الْمَسْجِدِ أَظُنُّهُ قَالَ ضُحًى فَقَالَ لِي صَلِّهْ أَوْ صَلِّ رَكْعَتَيْنِ وَكَانَ لِي عَلَيْهِ دَيْنٌ فَقَضَانِي وَزَادَنِي
[Machine] I heard Jaber bin Abdullah say that I sent a camel from the Messenger of Allah ﷺ and it weighed more than the expected weight for me. Some of those dirhams remained with me until the day of Al-Harrah, when they were mentioned in the authentic narration of Shu'bah.
سَمِعْتُ جَابِرَ بْنَ عَبْدِ اللهِ يَقُولُ بِعْتُ بَعِيرًا مِنْ رَسُولِ اللهِ ﷺ فَوَزَنَ فَأَرْجَحَ لِي فَمَا زَالَ بَعْضُ تِلْكَ الدَّرَاهِمِ مَعِي حَتَّى أُصِيبَتْ يَوْمَ الْحَرَّةِ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ شُعْبَةَ
the Messenger of Allah set out for Makkah and was in Ihram. When they were in Ar-Rawha, they saw a wounded onager. Mention of that was made to the messenger of Allah and he said: "Leave it, for soon its owner will come." Then Al-Bahzi, who was its owner, came to the Messenger of Allah, it is up to you what you want to do with this onager." The Messenger of Allah Commanded Abu Bakr to share it out among the company then he moved on, and when he was in Al-Uthayah, between Ar-Ruwaythah and Al-Arj, They was a gazelle sleeping in the Shade with an arrow in it. It was said that the Messenger of Allah told a man to stand by it and not let anyone disturb it until everyone had passed by." (Using translation from Nasāʾī 2818)
أَنَّ رَسُولَ اللهِ ﷺ خَرَجَ يُرِيدُ مَكَّةَ وَهُوَ مُحْرِمٌ حَتَّى إِذَا كَانَ بِالرَّوْحَاءِ إِذَا حِمَارُ وَحْشٍ عَقِيرٌ فَذُكِرَ لِرَسُولِ اللهِ ﷺ فَقَالَ دَعُوهُ؛ فَإِنَّهُ يُوشِكُ أَنْ يَأْتِيَ صَاحِبُهُ فَجَاءَ الْبَهْزِيُّ وَهُوَ صَاحِبُهُ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ شَأْنَكُمْ بِهَذَا الْحِمَارِ فَأَمَرَ رَسُولُ اللهِ ﷺ أَبَا بَكْرٍ ؓ فَقَسَمَهُ بَيْنَ الرِّفَاقِ ثُمَّ مَضَى حَتَّى إِذَا كَانَ بِالْأُثَايَةِ بَيْنَ الرُّويْبَةِ وَالْعَرْجِ إِذَا ظَبْيٌ حَاقِفٌ فِي ظِلٍّ وَفِيهِ سَهْمٌ فَزَعَمَ أَنَّ رَسُولَ اللهِ ﷺ أَمَرَ رَجُلًا يَثْبُتُ عِنْدَهُ لَا يُرِيبُهُ أَحَدٌ مِنَ النَّاسِ حَتَّى يُجَاوِزَهُ وَرَوَى مُسْلِمٌ الْبَطِينُ أَنَّ الْحُسَيْنَ بْنَ عَلِيٍّ وَرِثَ مَوَارِيثَ فَتَصَدَّقَ بِهَا قَبْلَ أَنْ تُقْسَمَ فَأُجِيزَتْ
[Machine] "That which is taken from him is lawful, and that which is not taken is inheritance," he said. "So I called upon Yazid to divide it."
أَنَّ مَا قُبِضَ مِنْهُ فَهُوَ جَائِزٌ وَمَا لَمْ يُقْبَضْ فَهُوَ مِيرَاثٌ قَالَ فَدَعَوْتُ يَزِيدَ الرِّشْكَ فَقَسَمَهَا
32.6 [Machine] Al-Umrah
٣٢۔٦ بَابُ الْعُمْرَى
[Machine] That the Messenger of Allah ﷺ said, "Whichever man is given my lifespan and that of his successor, it will not go back to the one who gave it, as it was given as a gift and it includes inheritances." In another narration by Al-Shafi'i, "It belongs to the one who is given it, and the rest are equal."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَيُّمَا رَجُلٍ أُعْمِرَ عُمْرَى لَهُ وَلِعَقِبِهِ فَإِنَّهَا لِلَّذِي أُعْطِيَهَا لَا تَرْجِعُ إِلَى الَّذِي أَعْطَاهَا؛ لِأَنَّهُ أَعْطَى عَطَاءً وَقَعَتْ فِيهِ الْمَوَارِيثُ وَفِي رِوَايَةِ الشَّافِعِيِّ فَإِنَّهُ لِلَّذِي يُعْطَاهَا وَالْبَاقِي سَوَاءٌ
[Machine] I heard the Messenger of Allah ﷺ saying, "Whoever provides a person with a lifespan and good for his descendants, he has fulfilled his right towards them, and this applies to the one who has been given a lifespan and good for his descendants."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ أَعْمَرَ رَجُلًا عُمْرَى لَهُ وَلِعَقِبِهِ فَقَدْ قَطَعَ قَوْلُهُ حَقَّهُ فِيهَا وَهِيَ لِمَنْ أُعْمِرَ وَلِعَقِبِهِ
[Machine] The Messenger of Allah ﷺ said, "Abu Abdullah Al-Hafiz informed us that Abu Amr ibn Abi Ja'far told me that Abdullah ibn Muhammad ibn Shakir informed us that Abdur-Rahman ibn Bashar ibn Al-Hakam informed me that Ibn Juraij narrated to me that Ibn Shihab narrated to me from Al-Umari and its chain of narration from the hadith of Abu Salamah ibn Abdur-Rahman that Jabir ibn Abdullah informed him that the Messenger of Allah ﷺ said, "Whichever man is given my lifespan and that of his descendants, he would say, 'I have been given what you were given and your descendants will finish what remains of you.' Verily, it is for the one to whom it is given, and it does not go back to its owner because he gave a gift." The wording of their hadiths is the same except that in the hadith of Fuleih, the inheritances fall in it.
قَالَ رَسُولُ اللهِ ﷺ وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو عَمْرِو بْنُ أَبِي جَعْفَرٍ ثنا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ شَاكِرٍ ثنا عَبْدُ الرَّحْمَنِ بْنُ بِشْرِ بْنِ الْحَكَمِ أنبأ ابْنُ جُرَيْجٍ أَخْبَرَنِي ابْنُ شِهَابٍ عَنِ الْعُمْرَى وَسُنَّتِهَا عَنْ حَدِيثِ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ أَنَّ جَابِرَ بْنَ عَبْدِ اللهِ أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَيُّمَا رَجُلٍ أُعْمِرَ عُمْرَى لَهُ وَلِعَقِبِهِ قَالَ قَدْ أَعْطَيْتُكَهَا وَعَقِبَكَ مَا بَقِيَ مِنْكُمْ أَحَدٌ فَإِنَّهَا لِمَنْ أُعْطِيَهَا وَإِنَّهَا لَا تَرْجِعُ إِلَى صَاحِبِهَا مِنْ أَجْلِ أَنَّهُ أَعْطَى عَطَاءً وَقَعَتْ فِيهِ الْمَوَارِيثُ لَفْظُ حَدِيثِهِمَا سَوَاءٌ غَيْرَ أَنَّ فِي حَدِيثِ فُلَيْحٍ تَقَعُ فِيهِ الْمَوَارِيثُ
[Machine] The lifetime that the Messenger of Allah ﷺ allowed himself to say is for you and your descendants. As for when he said it is for you as long as you live, it returns to its owner. This was informed to us by Abu Abdullah Al-Hafiz, who narrated to us Abu Al-Fadl Ibn Ibrahim, who narrated to us Ahmad Ibn Salamah, who narrated to us Ishaq Ibn Ibrahim, who narrated to us Abdul Razzaq, who mentioned it in a similar way. Ma'mar said that Al-Zuhri used to issue rulings on it.
إِنَّمَا الْعُمْرَى الَّتِي أَجَازَ رَسُولُ اللهِ ﷺ أَنْ يَقُولَ هِيَ لَكَ وَلِعَقِبِكَ فَأَمَّا إِذَا قَالَ هِيَ لَكَ مَا عِشْتَ فَإِنَّهَا تَرْجِعُ إِلَى صَاحِبِهَا 11965 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو الْفَضْلِ بْنُ إِبْرَاهِيمَ ثنا أَحْمَدُ بْنُ سَلَمَةَ ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ثنا عَبْدُ الرَّزَّاقِ فَذَكَرَهُ بِمِثْلِهِ زَادَ قَالَ مَعْمَرٌ وَكَانَ الزُّهْرِيُّ يُفْتِي بِهِ
[Machine] That the Messenger of Allah ﷺ had decided regarding a person who was granted a lifespan for himself and his descendants, it is a gift for him in which the giver cannot impose conditions or restrictions. Abu Salamah said: Because he gave a gift and it involved inheritance, so the conditions of the gift were severed. This is the wording of the hadith of Ibn Abi Fudayk, and in the narration of Abdullah: Whoever is granted a lifespan, it is a gift for him and his descendants without any conditions or restrictions. Abu Salamah's opinion is not mentioned.
أَنَّ رَسُولَ اللهِ ﷺ قَضَى فِيمَنْ أُعْمِرَ عُمْرَى لَهُ وَلِعَقِبِهِ فَهُوَ لَهُ بَتْلَةً لَا يَجُوزُ لِلْمُعْطِي فِيهَا شَرْطٌ وَلَا ثُنْيَا قَالَ أَبُو سَلَمَةَ لِأَنَّهُ أَعْطَى عَطَاءً وَقَعَتْ فِيهِ الْمَوَارِيثُ فَقَطَعَتِ الْمَوَارِيثُ شَرْطَهُ لَفْظُ حَدِيثِ ابْنِ أَبِي فُدَيْكٍ وَفِي رِوَايَةِ عَبْدِ اللهِ مَنْ أُعْمِرَ عُمْرَى فَهِيَ لَهُ وَلِعَقِبِهِ بَتْلًا لَيْسَ لِلْمُعْطِي فِيهَا شَرْطٌ وَلَا شَيْءٌ فَلَمْ يَذْكُرْ قَوْلَ أَبِي سَلَمَةَ
[Machine] The Messenger of Allah ﷺ ruled that a man should donate to another man and his descendants, except if it happens to be your descendant, then it is for me and my descendants. Indeed, it is for whoever is given it and his descendants. Al-Uqail also narrated it in the sense of narrating from these people, while Al-Awza'i disagreed with them and narrated it from Al-Zuhri.
أَنَّ رَسُولَ اللهِ ﷺ قَضَى بِالْعُمْرَى أَنْ يَهَبَ الرَّجُلُ لِلرَّجُلِ وَلِعَقِبِهِ وَاسْتَثْنَى إِنْ حَدَثَ بِعَقِبِكَ فَهُوَ إِلِيَّ وَإِلَى عَقِبِي إِنَّهَا لِمَنْ أُعْطِيَهَا وَلِعَقِبِهِ وَرَوَاهُ أَيْضًا عُقَيْلٌ بِمَعْنَى رِوَايَةِ هَؤُلَاءِ وَخَالَفَهُمُ الْأَوْزَاعِيُّ فَرَوَاهُ عَنِ الزُّهْرِيِّ
[Machine] That the Messenger of Allah ﷺ said: "Whoever is given a good lifespan, it will be for him and for his descendants who inherit it from him."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ أُعْمِرَ عُمْرَى فَهِيَ لَهُ وَلِعَقِبِهِ يَرِثُهَا مَنْ يَرِثُهُ مِنْ عَقِبِهِ وَكَذَلِكَ
[Machine] "When the Prophet ﷺ was asked about who should the 'Umra be performed for, in another narration, Shiban ruled that it should be performed for the one it was gifted to."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْعُمْرَى لِمَنْ وُهِبَتْ لَهُ وَفِي رِوَايَةِ شَيْبَانَ قَضَى فِي الْعُمْرَى أَنَّهَا لِمَنْ وُهِبَتْ لَهُ
أَنَّ النَّبِيَّ ﷺ قَالَ الْعُمْرَى جَائِزَةٌ
Keep your property to yourselves and do not squander it, for he who conferred a life grant upon another that property will belong to him upon whom it is conferred whether he lives or dies, and (would pass on) to his successors (as heritage). (Using translation from Muslim 1625i)
قَالَ رَسُولُ اللهِ ﷺ أَمْسِكُوا عَلَيْكُمْ أَمْوَالَكُمْ وَلَا تُفْسِدُوهَا؛ فَإِنَّهُ مِنْ أُعْمِرَ عُمْرَى فَهِيَ لِلَّذِي أُعْمِرُهَا حَيًّا وَمَيِّتًا وَلِعَقِبِهِ
[Machine] From the Prophet ﷺ , he said, "Hold onto your wealth and do not give it to anyone. Whoever builds something, it is for him."
عَنِ النَّبِيِّ ﷺ قَالَ أَمْسِكُوا عَلَيْكُمْ أَمْوَالَكُمْ لَا تُعْطُوهَا أَحَدًا فَمَنْ أُعْمِرَ شَيْئًا فَهُوَ لَهُ
[Machine] The Messenger of Allah, ﷺ , said: "Hold on to your wealth and do not spend it, for whoever spends something, his life will be improved, and it will be for his heirs when he dies."
رَسُولُ اللهِ ﷺ أَمْسِكُوا أَمْوَالَكُمْ لَا تُعْمِرُوهَا؛ فَإِنَّهُ مَنْ أُعْمِرَ شَيْئًا حَيَاتَهُ فَإِنَّهُ لِوَرَثَتِهِ إِذَا مَاتَ
This garden has returned to us. The sons of the one who had been given life grant said: This belonged to our father, during his lifetime and in case of his death. They took their dispute to Tariq, the freed slave of 'Uthman. He called Jabir and he gave testimony of Messenger of Allah ﷺ having said: Life grant belongs to one who is conferred upon this (privilege). Tariq gave this decision and then wrote to Abd al-Malik and informed him, Jabir bearing witness to it. Abd al-Malik said: Jabir has told the truth. Then Tariq gave a decree and, as a result thereof, it is to this day that the garden belongs to descendants of one who was conferred upon the life grant. (Using translation from Muslim 1625k)
أَعْمَرَتِ امْرَأَةٌ بِالْمَدِينَةِ حَائِطًا لَهَا ابْنًا لَهَا ثُمَّ تُوُفِّيَ وَتُوُفِّيَتْ بَعْدَهُ وَتَرَكَ وَلَدًا وَلَهُ أُخْوَةٌ بَنُو الْمُعْمِرَةِ فَقَالَ وَلَدُ الْمُعْمِرَةِ رَجَعَ الْحَائِطُ إِلَيْنَا وَقَالَ بَنُو الْمُعْمَرِ بَلْ كَانَ لِأَبِينَا حَيَاتَهُ وَمَوْتَهُ فَاخْتَصَمُوا إِلَى طَارِقٍ مَوْلَى عُثْمَانَ فَدَعَا جَابِرًا فَشَهِدَ عَلَى النَّبِيِّ ﷺ بِالْعُمْرَى لِصَاحِبِهَا فَقَضَى بِذَلِكَ طَارِقٌ ثُمَّ كَتَبَ إِلَى عَبْدِ الْمَلِكِ فَأَخْبَرَهُ بِذَلِكَ وَأَخْبَرَ بِشَهَادَةِ جَابِرٍ قَالَ عَبْدُ الْمَلِكِ صَدَقَ جَابِرٌ وَأَمْضَى ذَلِكَ طَارِقٌ فَإِنَّ ذَلِكَ الْحَائِطَ لِبَنِي الْمُعْمَرِ حَتَّى الْيَوْمِ
عَنِ النَّبِيِّ ﷺ
[Machine] The Messenger of Allah ﷺ decided a case involving a woman from the Ansar who was given a garden of palm trees by her son. However, she passed away. Her son said, "I only gave her the gift of her life, and she has brothers." The Messenger of Allah ﷺ said, "That garden belonged to her in her life and in her death." The son replied, "But I had given it to her as a charity." The Messenger of Allah ﷺ said, "That is even more distant for you."
قَضَى رَسُولُ اللهِ ﷺ فِي امْرَأَةٍ مِنَ الْأَنْصَارِ أَعْطَاهَا ابْنُهَا حَدِيقَةً مِنْ نَخْلٍ فَمَاتَتْ فَقَالَ ابْنُهَا إِنَّمَا أَعْطَيْتُهَا حَيَاتَهَا وَلَهُ أُخْوَةٌ فَقَالَ رَسُولُ اللهِ ﷺ هِيَ لَهَا حَيَاتَهَا وَمَوْتَهَا قَالَ فَإِنِّي كُنْتُ تَصَدَّقْتُ بِهَا عَلَيْهَا قَالَ ذَلِكَ أَبْعَدُ لَكَ
[Machine] If you eat it, it is good for you, and there is no need for ablution. And if you vomit it, it is impure, and you need to perform ablution. Then he said, "I only see the two of you disagreeing. Is there anyone else in the town?" I said, "Yes, the oldest man in the Arabian Peninsula." He asked, "Who?" I said, "Ata." So he sent for him, and he came. Then he said, "These two have differed upon me. What do you say?" He said, "Jabir bin Abdullah told me that they ate bread and meat with Abu Bakr, then he stood up to pray without performing ablution. He asked me, 'What do you say about Al Umrah?' I said, 'Nadhr bin Anas narrated from Bashir bin Nahik from Abu Hurairah that the Prophet ﷺ said, Al Umrah is a reward.' Then Az-Zuhri said, 'It does not count as Al Umrah until it is performed with a sacrifice.' Abu Hurairah said to Ata, 'What do you say?' He said, 'Jabir bin Abdullah told me that the Messenger of Allah ﷺ said, Al Umrah is a reward.' Az-Zuhri said, 'The caliphs do not decide based on that.' Ata said, 'No, Abd al-Malik bin Marwan decided upon it in such and such a way.'"
إِذَا أَكَلْتَهُ فَهُوَ طَيِّبٌ فَلَيْسَ عَلَيْكَ فِيهِ وُضُوءٌ وَإِذَا خَرَجَ فَهُوَ خَبِيثٌ عَلَيْكَ فِيهِ الْوُضُوءُ فَقَالَ مَا أُرَاكُمَا إِلَّا قَدِ اخْتَلَفْتُمَا فَهَلْ فِي الْبَلَدِ أَحَدٌ؟ قُلْتُ نَعَمْ أَقْدَمُ رَجُلٍ فِي جَزِيرَةِ الْعَرَبِ قَالَ مَنْ؟ قُلْتُ عَطَاءٌ فَأَرْسَلَ إِلَيْهِ فَجِيءَ بِهِ فَقَالَ إِنَّ هَذَيْنِ قَدِ اخْتَلَفَا عَلَيَّ فَمَا تَقُولُ؟ قَالَ حَدَّثَنِي جَابِرُ بْنُ عَبْدِ اللهِ أَنَّهُمْ أَكَلُوا مَعَ أَبِي بَكْرٍ خُبْزًا وَلَحْمًا ثُمَّ قَامَ فَصَلَّى وَلَمْ يَتَوَضَّأْ فَقَالَ لِي مَا تَقُولُ فِي الْعُمْرَى؟ قَالَ قُلْتُ حَدَّثَنِي النَّضْرُ بْنُ أَنَسٍ عَنْ بَشِيرِ بْنِ نَهِيكٍ عَنْ أَبِي هُرَيْرَةَ أَنَّ النَّبِيَّ ﷺ قَالَ الْعُمْرَى جَائِزَةٌ قَالَ فَقَالَ الزُّهْرِيُّ إِنَّهَا لَا تَكُونُ عُمْرَى حَتَّى تُجْعَلَ لَهُ وَلِعَقِبِهِ قَالَ فَقَالَ لِعَطَاءٍ مَا تَقُولُ؟ قَالَ حَدَّثَنِي جَابِرُ بْنُ عَبْدِ اللهِ أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْعُمْرَى جَائِزَةٌ قَالَ الزُّهْرِيُّ إِنَّ الْخُلَفَاءَ لَا يَقْضُونَ بِذَلِكَ قَالَ عَطَاءٌ بَلْ قَضَى بِهِ عَبْدُ الْمَلِكِ بْنُ مَرْوَانَ فِي كَذَا وَكَذَا
[Machine] On the authority of the Prophet ﷺ , Al-Umri said: "There is a reward."
عَنِ النَّبِيِّ ﷺ قَالَ الْعُمْرَى جَائِزَةٌ
[Machine] The Prophet ﷺ made Al-Umrah obligatory for the heir, and Ibn Abi Najeeh transmitted it from Tawoos.
أَنَّ النَّبِيَّ ﷺ جَعَلَ الْعُمْرَى لِلْوَارِثِ تَابَعَهُ ابْنُ أَبِي نَجِيحٍ عَنْ طَاوُسٍ
The Prophet ﷺ as saying: Life tenancy is permissible. (Using translation from Abū Dāʾūd 3548)
قَالَ رَسُولُ اللهِ ﷺ الْعُمْرَى جَائِزَةٌ
[Machine] The narrator said, "I was with Ibn Umar when a man from the desert came to him and said, 'I have given my son a she-camel as a gift, and it produces camels.' Ibn Umar replied, 'It is a gift for him both in life and death.' The man said, 'I gave it to him as a form of charity.' Ibn Umar said, 'That is even farther from what it is.'"
"Ibn Uyaynah informed me about Ibn Abi Najeeh, who related from Habib ibn Abu Thabit something similar to this, except that he said, 'It was exhausted and agitated.' And Abu Sulayman said, 'His statement 'exhausted' means it produces camels.' The Shaykh (referring to the narrator) said, 'This indicates that what was narrated from Ibn Umar is reliable regarding...'" (rest of the passage not provided)
قَالَ كُنْتُ عِنْدَ ابْنِ عُمَرَ فَجَاءَهُ رَجُلٌ مِنْ أَهْلِ الْبَادِيَةِ فَقَالَ إِنِّي وَهَبْتُ لِابْنِي نَاقَةً حَيَاتَهُ وَإِنَّهَا تَنَاتَجَتْ إِبِلًا فَقَالَ ابْنُ عُمَرَ هِيَ لَهُ حَيَاتَهُ وَمَوْتَهُ فَقَالَ إِنِّي تَصَدَّقْتُ عَلَيْهِ بِهَا فَقَالَ ذَاكَ أَبْعَدُ لَكَ مِنْهَا
11983 قَالَ وَأَخْبَرَنِي ابْنُ عُيَيْنَةَ عَنِ ابْنِ أَبِي نَجِيحٍ عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ مِثْلَهُ إِلَّا أَنَّهُ قَالَ أَضْنَتْ وَاضْطَرَبَتْ كَذَا رُوِيَ وَقَالَ أَبُو سُلَيْمَانَ صَوَابُهُ ضَنَتْ يَعْنِي تَنَاتَجَتْ قَالَ الشَّيْخُ وَهَذَا يَدُلُّ عَلَى أَنَّ الَّذِي رُوِيَ عَنِ ابْنِ عُمَرَ فِيمَا
[Machine] He has a rose in his garden, below the 'Umr tree, and Allah knows best.
لَهُ وَرَدَّ فِي الْعَارِيَةِ دُونَ الْعُمْرَى وَاللهُ أَعْلَمُ
[Machine] A relief that I did not solve for you, but Muhammad (PBUH) solved for you forty years ago. He said, "Whoever builds something, his life is for his successors when he dies."
شُرَيْحٌ لَسْتُ أَنَا قَضَيْتُ لَكَ وَلَكِنَّ مُحَمَّدًا ﷺ قَضَى لَكَ مُنْذُ أَرْبَعِينَ سَنَةً قَالَ مَنْ أُعْمِرَ شَيْئًا حَيَاتَهُ فَهُوَ لِوَرَثَتِهِ إِذَا مَاتَ
[Machine] A man built a house with his life, then he had a dispute over it with Shurayh. The man who built the house was blind, so Shurayh ruled in his favor and said, "Whoever owns something, his life and death belong to him." The man who built the house asked, "How did you rule against me, O Abu Umamah?" He replied, "I did not rule against you, but it was Allah who ruled through the tongue of the Messenger of Allah, ﷺ , fifty years ago, that whoever owns something, it belongs to him and his heirs after him."
أَنَّ رَجُلًا أَعْمَرَ رَجُلًا دَارًا حَيَاتَهُ فَخَاصَمَ فِيهَا بَعْدَ ذَلِكَ إِلَى شُرَيْحٍ وَكَانَ الَّذِي أُعْمِرَ الدَّارَ أَعْمَى فَقَضَى لَهُ شُرَيْحٌ بِهَا وَقَالَ مَنْ مَلَكَ شَيْئًا حَيَاتَهُ فَهُوَ لَهُ حَيَاتَهُ وَمَوْتَهُ فَقَالَ الْمُعْمَرُ كَيْفَ قَضَيْتَ لِي يَا أَبَا أُمَيَّةَ؟ فَقَالَ لَسْتُ أَنَا قَضَيْتُ وَلَكِنْ قَضَى الله عَلَى لِسَانِ رَسُولِ اللهِ ﷺ مُنْذُ خَمْسِينَ سَنَةً مَنْ مَلَكَ شَيْئًا حَيَاتَهُ فَهُوَ لَهُ وَلِوَرَثَتِهِ بَعْدَهُ

٣٢۔٧ بَابُ الرُّقْبَى
The Prophet ﷺ said: Do not give property to go to the survivor and do not give life-tenancy. If anyone is given something to the survivor or given life-tenancy, it goes to his heirs. (Using translation from Abū Dāʾūd 3556)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا تُعْمِرُوا وَلَا تُرْقِبُوا فَمَنْ أُعْمِرَ شَيْئًا أَوْ أُرْقِبَهُ فَهُوَ سَبِيلُ الْمِيرَاثِ
“Umra belongs to the one to whom it is given, and Ruqba belongs to the one to whom it is given.” (Using translation from Ibn Mājah 2383)
قَالَ رَسُولُ اللهِ ﷺ الْعُمْرَى جَائِزَةٌ لِمَنْ أُعْمِرَهَا وَالرُّقْبَى جَائِزَةٌ لِمَنْ أُرْقِبَهَا
The Prophet ﷺ said: If anyone gives something in life-tenancy, it belongs to the one to whom it is given, in his life and after his death; and do not give property to go to the survivor, for if anyone gives something to to to the survivor, it belongs to him. (Using translation from Abū Dāʾūd 3559)
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَعْمَرَ شَيْئًا فَهُوَ لِمُعْمَرِهِ مَحْيَاهُ وَمَمَاتَهُ وَلَا تُرْقِبُوا فَمَنْ أَرْقَبَ شَيْئًا فَهُوَ سَبِيلُهُ وَفِي رِوَايَةِ شِبْلٍ فَهُوَ سَبِيلُ الْمِيرَاثِ
32.8 [Machine] What came in the interpretation of Al-'Umran and Ar-Rukbah that came in the absolute news?
٣٢۔٨ بَابُ مَا جَاءَ فِي تَفْسِيرِ الْعُمْرَى وَالرُّقْبَى الَّتِي وَرَدَتْ فِي الْأَخْبَارِ الْمُطْلَقَةِ
[Machine] That a man says to another man, "This house is yours for your lifetime," or he says to him, "This house is mine for my lifetime." Qatadah said: "Ar-Ruqba is for a person to say, 'If I die before you, it will return to me, and if you die before me, it will be yours.'
أَنْ يَقُولَ الرَّجُلُ لِلرَّجُلِ هَذِهِ الدَّارُ لَكَ عُمُرَكَ أَوْ يَقُولَ لَهُ هَذِهِ الدَّارُ لَكَ عُمُرِي قَالَ وَقَدْ حَدَّثَنِي حَجَّاجٌ عَنِ ابْنِ جُرَيْجٍ عَنْ عَطَاءٍ فِي تَفْسِيرِ الْعُمْرَى بِمِثْلِ ذَلِكَ أَوْ نَحْوِهِ 11990 قَالَ أَبُو عُبَيْدٍ وَأَمَّا الرُّقْبَى فَإِنَّ ابْنَ عُلَيَّةَ حَدَّثَنِي عَنْ حَجَّاجِ بْنِ أَبِي عُثْمَانَ قَالَ سَأَلْتُ أَبَا الزُّبَيْرِ عَنِ الرُّقْبَى فَقَالَ هُوَ أَنْ يَقُولَ الرَّجُلُ إِنْ مُتَّ قَبْلِي رَجَعَ إِلِيَّ وَإِنْ مُتُّ قَبْلَكَ فَهُوَ لَكَ وَقَالَ حَدَّثَنَا ابْنُ عُلَيَّةَ أَيْضًا عَنْ سَعِيدِ بْنِ أَبِي عَرُوبَةَ عَنْ قَتَادَةَ قَالَ الرُّقْبَى أَنْ يَقُولَ كَذَا وَكَذَا لِفُلَانٍ فَإِنْ مَاتَ فَهُوَ لِفُلَانٍ

الشَّيْخُ رَحِمَهُ اللهُ وَكَانَ الشَّافِعِيُّ رَحِمَهُ اللهُ يَذْهَبُ فِي الْقَدِيمِ إِلَى ظَاهِرِ مَا

[Machine] He said, "Indeed, his father brought him to the Messenger of Allah ﷺ and said, 'I have dedicated my son as a servant for you.'" The Messenger of Allah ﷺ then asked, "Did you also dedicate your own child as a servant like this?" He said, "No." The Messenger of Allah ﷺ then said, "Return him."
أَنَّهُ قَالَ إِنَّ أَبَاهُ أَتَى بِهِ رَسُولَ اللهِ ﷺ فَقَالَ إِنِّي نَحَلْتُ ابْنِي هَذَا غُلَامًا كَانَ لِي فَقَالَ رَسُولُ اللهِ ﷺ أَكُلَّ وَلَدِكَ نَحَلْتَهُ مِثْلَ هَذَا؟ قَالَ لَا فَقَالَ رَسُولُ اللهِ ﷺ فَارْجِعْهُ
أَنْ أَذْهَبَ بِهِ إِلَى النَّبِيِّ ﷺ فَأُشْهِدُهُ عَلَى ذَلِكَ فَقَالَ أَكُلَّ وَلَدِكَ أَعْطَيْتَهُ؟ قَالَ لَا قَالَ فَارْدُدْهُ
I heard An-Nuʿman bin Bashir on the pulpit saying, "My father gave me a gift but ʿAmra bint Rawaha (my mother) said that she would not agree to it unless he made Messenger of Allah ﷺ as a witness to it. So, my father went to Messenger of Allah ﷺ and said, 'I have given a gift to my son from ʿAmra bint Rawaha, but she ordered me to make you as a witness to it, O Messenger of Allah ﷺ!' Messenger of Allah ﷺ asked, 'Have you given (the like of it) to everyone of your sons?' He replied in the negative. Messenger of Allah ﷺ said, 'Be afraid of Allah, and be just to your children.' My father then returned and took back his gift." (Using translation from Bukhārī 2587)
لَهُ عَمْرَةُ بِنْتُ رَوَاحَةَ لَا أَرْضَى حَتَّى تُشْهِدَ رَسُولَ اللهِ ﷺ قَالَ فَأَتَى النَّبِيَّ ﷺ فَقَالَ إِنِّي أَعْطَيْتُ ابْنَ عَمْرَةَ بِنْتِ رَوَاحَةَ عَطِيَّةً وَأَمَرَتْنِي أَنْ أُشْهِدَكَ يَا رَسُولَ اللهِ قَالَ أَعْطَيْتَ سَائِرَ وَلَدِكَ مِثْلَ هَذَا؟ قَالَ لَا قَالَ فَاتَّقُوا اللهَ وَاعْدِلُوا بَيْنَ أَوْلَادِكُمْ قَالَ فَرَجَعَ فَرَدَّ عَطِيَّتَهُ
