[Machine] The Messenger of Allah ﷺ decided a case involving a woman from the Ansar who was given a garden of palm trees by her son. However, she passed away. Her son said, "I only gave her the gift of her life, and she has brothers." The Messenger of Allah ﷺ said, "That garden belonged to her in her life and in her death." The son replied, "But I had given it to her as a charity." The Messenger of Allah ﷺ said, "That is even more distant for you."

قَضَى رَسُولُ اللهِ ﷺ فِي امْرَأَةٍ مِنَ الْأَنْصَارِ أَعْطَاهَا ابْنُهَا حَدِيقَةً مِنْ نَخْلٍ فَمَاتَتْ فَقَالَ ابْنُهَا إِنَّمَا أَعْطَيْتُهَا حَيَاتَهَا وَلَهُ أُخْوَةٌ فَقَالَ رَسُولُ اللهِ ﷺ هِيَ لَهَا حَيَاتَهَا وَمَوْتَهَا قَالَ فَإِنِّي كُنْتُ تَصَدَّقْتُ بِهَا عَلَيْهَا قَالَ ذَلِكَ أَبْعَدُ لَكَ  

رَوَاهُ أَبُو دَاوُدَ فِي السُّنَنِ عَنْ عُثْمَانَ بْنِ أَبِي شَيْبَةَ نَحْوَ رِوَايَةِ ابْنِهِ عَنْهُ وَلَيْسَ بِالْقَوِيِّ وَقَدْ رَوَاهُ ابْنُ عُيَيْنَةَ بِخِلَافِ ذَلِكَ وَهُوَ مَذْكُورٌ فِي هَذَا الْبَابِ
