32. Gifts
٣٢۔ كِتَابُ الْهِبَاتِ
[Machine] That the Messenger of Allah ﷺ said, "Whichever man is given my lifespan and that of his successor, it will not go back to the one who gave it, as it was given as a gift and it includes inheritances." In another narration by Al-Shafi'i, "It belongs to the one who is given it, and the rest are equal."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَيُّمَا رَجُلٍ أُعْمِرَ عُمْرَى لَهُ وَلِعَقِبِهِ فَإِنَّهَا لِلَّذِي أُعْطِيَهَا لَا تَرْجِعُ إِلَى الَّذِي أَعْطَاهَا؛ لِأَنَّهُ أَعْطَى عَطَاءً وَقَعَتْ فِيهِ الْمَوَارِيثُ وَفِي رِوَايَةِ الشَّافِعِيِّ فَإِنَّهُ لِلَّذِي يُعْطَاهَا وَالْبَاقِي سَوَاءٌ
[Machine] I heard the Messenger of Allah ﷺ saying, "Whoever provides a person with a lifespan and good for his descendants, he has fulfilled his right towards them, and this applies to the one who has been given a lifespan and good for his descendants."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ أَعْمَرَ رَجُلًا عُمْرَى لَهُ وَلِعَقِبِهِ فَقَدْ قَطَعَ قَوْلُهُ حَقَّهُ فِيهَا وَهِيَ لِمَنْ أُعْمِرَ وَلِعَقِبِهِ
[Machine] The Messenger of Allah ﷺ said, "Abu Abdullah Al-Hafiz informed us that Abu Amr ibn Abi Ja'far told me that Abdullah ibn Muhammad ibn Shakir informed us that Abdur-Rahman ibn Bashar ibn Al-Hakam informed me that Ibn Juraij narrated to me that Ibn Shihab narrated to me from Al-Umari and its chain of narration from the hadith of Abu Salamah ibn Abdur-Rahman that Jabir ibn Abdullah informed him that the Messenger of Allah ﷺ said, "Whichever man is given my lifespan and that of his descendants, he would say, 'I have been given what you were given and your descendants will finish what remains of you.' Verily, it is for the one to whom it is given, and it does not go back to its owner because he gave a gift." The wording of their hadiths is the same except that in the hadith of Fuleih, the inheritances fall in it.
قَالَ رَسُولُ اللهِ ﷺ وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو عَمْرِو بْنُ أَبِي جَعْفَرٍ ثنا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ شَاكِرٍ ثنا عَبْدُ الرَّحْمَنِ بْنُ بِشْرِ بْنِ الْحَكَمِ أنبأ ابْنُ جُرَيْجٍ أَخْبَرَنِي ابْنُ شِهَابٍ عَنِ الْعُمْرَى وَسُنَّتِهَا عَنْ حَدِيثِ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ أَنَّ جَابِرَ بْنَ عَبْدِ اللهِ أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ أَيُّمَا رَجُلٍ أُعْمِرَ عُمْرَى لَهُ وَلِعَقِبِهِ قَالَ قَدْ أَعْطَيْتُكَهَا وَعَقِبَكَ مَا بَقِيَ مِنْكُمْ أَحَدٌ فَإِنَّهَا لِمَنْ أُعْطِيَهَا وَإِنَّهَا لَا تَرْجِعُ إِلَى صَاحِبِهَا مِنْ أَجْلِ أَنَّهُ أَعْطَى عَطَاءً وَقَعَتْ فِيهِ الْمَوَارِيثُ لَفْظُ حَدِيثِهِمَا سَوَاءٌ غَيْرَ أَنَّ فِي حَدِيثِ فُلَيْحٍ تَقَعُ فِيهِ الْمَوَارِيثُ
[Machine] The lifetime that the Messenger of Allah ﷺ allowed himself to say is for you and your descendants. As for when he said it is for you as long as you live, it returns to its owner. This was informed to us by Abu Abdullah Al-Hafiz, who narrated to us Abu Al-Fadl Ibn Ibrahim, who narrated to us Ahmad Ibn Salamah, who narrated to us Ishaq Ibn Ibrahim, who narrated to us Abdul Razzaq, who mentioned it in a similar way. Ma'mar said that Al-Zuhri used to issue rulings on it.
إِنَّمَا الْعُمْرَى الَّتِي أَجَازَ رَسُولُ اللهِ ﷺ أَنْ يَقُولَ هِيَ لَكَ وَلِعَقِبِكَ فَأَمَّا إِذَا قَالَ هِيَ لَكَ مَا عِشْتَ فَإِنَّهَا تَرْجِعُ إِلَى صَاحِبِهَا 11965 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو الْفَضْلِ بْنُ إِبْرَاهِيمَ ثنا أَحْمَدُ بْنُ سَلَمَةَ ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ثنا عَبْدُ الرَّزَّاقِ فَذَكَرَهُ بِمِثْلِهِ زَادَ قَالَ مَعْمَرٌ وَكَانَ الزُّهْرِيُّ يُفْتِي بِهِ
[Machine] That the Messenger of Allah ﷺ had decided regarding a person who was granted a lifespan for himself and his descendants, it is a gift for him in which the giver cannot impose conditions or restrictions. Abu Salamah said: Because he gave a gift and it involved inheritance, so the conditions of the gift were severed. This is the wording of the hadith of Ibn Abi Fudayk, and in the narration of Abdullah: Whoever is granted a lifespan, it is a gift for him and his descendants without any conditions or restrictions. Abu Salamah's opinion is not mentioned.
أَنَّ رَسُولَ اللهِ ﷺ قَضَى فِيمَنْ أُعْمِرَ عُمْرَى لَهُ وَلِعَقِبِهِ فَهُوَ لَهُ بَتْلَةً لَا يَجُوزُ لِلْمُعْطِي فِيهَا شَرْطٌ وَلَا ثُنْيَا قَالَ أَبُو سَلَمَةَ لِأَنَّهُ أَعْطَى عَطَاءً وَقَعَتْ فِيهِ الْمَوَارِيثُ فَقَطَعَتِ الْمَوَارِيثُ شَرْطَهُ لَفْظُ حَدِيثِ ابْنِ أَبِي فُدَيْكٍ وَفِي رِوَايَةِ عَبْدِ اللهِ مَنْ أُعْمِرَ عُمْرَى فَهِيَ لَهُ وَلِعَقِبِهِ بَتْلًا لَيْسَ لِلْمُعْطِي فِيهَا شَرْطٌ وَلَا شَيْءٌ فَلَمْ يَذْكُرْ قَوْلَ أَبِي سَلَمَةَ
[Machine] The Messenger of Allah ﷺ ruled that a man should donate to another man and his descendants, except if it happens to be your descendant, then it is for me and my descendants. Indeed, it is for whoever is given it and his descendants. Al-Uqail also narrated it in the sense of narrating from these people, while Al-Awza'i disagreed with them and narrated it from Al-Zuhri.
أَنَّ رَسُولَ اللهِ ﷺ قَضَى بِالْعُمْرَى أَنْ يَهَبَ الرَّجُلُ لِلرَّجُلِ وَلِعَقِبِهِ وَاسْتَثْنَى إِنْ حَدَثَ بِعَقِبِكَ فَهُوَ إِلِيَّ وَإِلَى عَقِبِي إِنَّهَا لِمَنْ أُعْطِيَهَا وَلِعَقِبِهِ وَرَوَاهُ أَيْضًا عُقَيْلٌ بِمَعْنَى رِوَايَةِ هَؤُلَاءِ وَخَالَفَهُمُ الْأَوْزَاعِيُّ فَرَوَاهُ عَنِ الزُّهْرِيِّ
[Machine] That the Messenger of Allah ﷺ said: "Whoever is given a good lifespan, it will be for him and for his descendants who inherit it from him."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ أُعْمِرَ عُمْرَى فَهِيَ لَهُ وَلِعَقِبِهِ يَرِثُهَا مَنْ يَرِثُهُ مِنْ عَقِبِهِ وَكَذَلِكَ
[Machine] "When the Prophet ﷺ was asked about who should the 'Umra be performed for, in another narration, Shiban ruled that it should be performed for the one it was gifted to."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْعُمْرَى لِمَنْ وُهِبَتْ لَهُ وَفِي رِوَايَةِ شَيْبَانَ قَضَى فِي الْعُمْرَى أَنَّهَا لِمَنْ وُهِبَتْ لَهُ
أَنَّ النَّبِيَّ ﷺ قَالَ الْعُمْرَى جَائِزَةٌ
Keep your property to yourselves and do not squander it, for he who conferred a life grant upon another that property will belong to him upon whom it is conferred whether he lives or dies, and (would pass on) to his successors (as heritage). (Using translation from Muslim 1625i)
قَالَ رَسُولُ اللهِ ﷺ أَمْسِكُوا عَلَيْكُمْ أَمْوَالَكُمْ وَلَا تُفْسِدُوهَا؛ فَإِنَّهُ مِنْ أُعْمِرَ عُمْرَى فَهِيَ لِلَّذِي أُعْمِرُهَا حَيًّا وَمَيِّتًا وَلِعَقِبِهِ
[Machine] From the Prophet ﷺ , he said, "Hold onto your wealth and do not give it to anyone. Whoever builds something, it is for him."
عَنِ النَّبِيِّ ﷺ قَالَ أَمْسِكُوا عَلَيْكُمْ أَمْوَالَكُمْ لَا تُعْطُوهَا أَحَدًا فَمَنْ أُعْمِرَ شَيْئًا فَهُوَ لَهُ
[Machine] The Messenger of Allah, ﷺ , said: "Hold on to your wealth and do not spend it, for whoever spends something, his life will be improved, and it will be for his heirs when he dies."
رَسُولُ اللهِ ﷺ أَمْسِكُوا أَمْوَالَكُمْ لَا تُعْمِرُوهَا؛ فَإِنَّهُ مَنْ أُعْمِرَ شَيْئًا حَيَاتَهُ فَإِنَّهُ لِوَرَثَتِهِ إِذَا مَاتَ
This garden has returned to us. The sons of the one who had been given life grant said: This belonged to our father, during his lifetime and in case of his death. They took their dispute to Tariq, the freed slave of 'Uthman. He called Jabir and he gave testimony of Messenger of Allah ﷺ having said: Life grant belongs to one who is conferred upon this (privilege). Tariq gave this decision and then wrote to Abd al-Malik and informed him, Jabir bearing witness to it. Abd al-Malik said: Jabir has told the truth. Then Tariq gave a decree and, as a result thereof, it is to this day that the garden belongs to descendants of one who was conferred upon the life grant. (Using translation from Muslim 1625k)
أَعْمَرَتِ امْرَأَةٌ بِالْمَدِينَةِ حَائِطًا لَهَا ابْنًا لَهَا ثُمَّ تُوُفِّيَ وَتُوُفِّيَتْ بَعْدَهُ وَتَرَكَ وَلَدًا وَلَهُ أُخْوَةٌ بَنُو الْمُعْمِرَةِ فَقَالَ وَلَدُ الْمُعْمِرَةِ رَجَعَ الْحَائِطُ إِلَيْنَا وَقَالَ بَنُو الْمُعْمَرِ بَلْ كَانَ لِأَبِينَا حَيَاتَهُ وَمَوْتَهُ فَاخْتَصَمُوا إِلَى طَارِقٍ مَوْلَى عُثْمَانَ فَدَعَا جَابِرًا فَشَهِدَ عَلَى النَّبِيِّ ﷺ بِالْعُمْرَى لِصَاحِبِهَا فَقَضَى بِذَلِكَ طَارِقٌ ثُمَّ كَتَبَ إِلَى عَبْدِ الْمَلِكِ فَأَخْبَرَهُ بِذَلِكَ وَأَخْبَرَ بِشَهَادَةِ جَابِرٍ قَالَ عَبْدُ الْمَلِكِ صَدَقَ جَابِرٌ وَأَمْضَى ذَلِكَ طَارِقٌ فَإِنَّ ذَلِكَ الْحَائِطَ لِبَنِي الْمُعْمَرِ حَتَّى الْيَوْمِ
عَنِ النَّبِيِّ ﷺ
[Machine] The Messenger of Allah ﷺ decided a case involving a woman from the Ansar who was given a garden of palm trees by her son. However, she passed away. Her son said, "I only gave her the gift of her life, and she has brothers." The Messenger of Allah ﷺ said, "That garden belonged to her in her life and in her death." The son replied, "But I had given it to her as a charity." The Messenger of Allah ﷺ said, "That is even more distant for you."
قَضَى رَسُولُ اللهِ ﷺ فِي امْرَأَةٍ مِنَ الْأَنْصَارِ أَعْطَاهَا ابْنُهَا حَدِيقَةً مِنْ نَخْلٍ فَمَاتَتْ فَقَالَ ابْنُهَا إِنَّمَا أَعْطَيْتُهَا حَيَاتَهَا وَلَهُ أُخْوَةٌ فَقَالَ رَسُولُ اللهِ ﷺ هِيَ لَهَا حَيَاتَهَا وَمَوْتَهَا قَالَ فَإِنِّي كُنْتُ تَصَدَّقْتُ بِهَا عَلَيْهَا قَالَ ذَلِكَ أَبْعَدُ لَكَ
[Machine] If you eat it, it is good for you, and there is no need for ablution. And if you vomit it, it is impure, and you need to perform ablution. Then he said, "I only see the two of you disagreeing. Is there anyone else in the town?" I said, "Yes, the oldest man in the Arabian Peninsula." He asked, "Who?" I said, "Ata." So he sent for him, and he came. Then he said, "These two have differed upon me. What do you say?" He said, "Jabir bin Abdullah told me that they ate bread and meat with Abu Bakr, then he stood up to pray without performing ablution. He asked me, 'What do you say about Al Umrah?' I said, 'Nadhr bin Anas narrated from Bashir bin Nahik from Abu Hurairah that the Prophet ﷺ said, Al Umrah is a reward.' Then Az-Zuhri said, 'It does not count as Al Umrah until it is performed with a sacrifice.' Abu Hurairah said to Ata, 'What do you say?' He said, 'Jabir bin Abdullah told me that the Messenger of Allah ﷺ said, Al Umrah is a reward.' Az-Zuhri said, 'The caliphs do not decide based on that.' Ata said, 'No, Abd al-Malik bin Marwan decided upon it in such and such a way.'"
إِذَا أَكَلْتَهُ فَهُوَ طَيِّبٌ فَلَيْسَ عَلَيْكَ فِيهِ وُضُوءٌ وَإِذَا خَرَجَ فَهُوَ خَبِيثٌ عَلَيْكَ فِيهِ الْوُضُوءُ فَقَالَ مَا أُرَاكُمَا إِلَّا قَدِ اخْتَلَفْتُمَا فَهَلْ فِي الْبَلَدِ أَحَدٌ؟ قُلْتُ نَعَمْ أَقْدَمُ رَجُلٍ فِي جَزِيرَةِ الْعَرَبِ قَالَ مَنْ؟ قُلْتُ عَطَاءٌ فَأَرْسَلَ إِلَيْهِ فَجِيءَ بِهِ فَقَالَ إِنَّ هَذَيْنِ قَدِ اخْتَلَفَا عَلَيَّ فَمَا تَقُولُ؟ قَالَ حَدَّثَنِي جَابِرُ بْنُ عَبْدِ اللهِ أَنَّهُمْ أَكَلُوا مَعَ أَبِي بَكْرٍ خُبْزًا وَلَحْمًا ثُمَّ قَامَ فَصَلَّى وَلَمْ يَتَوَضَّأْ فَقَالَ لِي مَا تَقُولُ فِي الْعُمْرَى؟ قَالَ قُلْتُ حَدَّثَنِي النَّضْرُ بْنُ أَنَسٍ عَنْ بَشِيرِ بْنِ نَهِيكٍ عَنْ أَبِي هُرَيْرَةَ أَنَّ النَّبِيَّ ﷺ قَالَ الْعُمْرَى جَائِزَةٌ قَالَ فَقَالَ الزُّهْرِيُّ إِنَّهَا لَا تَكُونُ عُمْرَى حَتَّى تُجْعَلَ لَهُ وَلِعَقِبِهِ قَالَ فَقَالَ لِعَطَاءٍ مَا تَقُولُ؟ قَالَ حَدَّثَنِي جَابِرُ بْنُ عَبْدِ اللهِ أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْعُمْرَى جَائِزَةٌ قَالَ الزُّهْرِيُّ إِنَّ الْخُلَفَاءَ لَا يَقْضُونَ بِذَلِكَ قَالَ عَطَاءٌ بَلْ قَضَى بِهِ عَبْدُ الْمَلِكِ بْنُ مَرْوَانَ فِي كَذَا وَكَذَا
[Machine] On the authority of the Prophet ﷺ , Al-Umri said: "There is a reward."
عَنِ النَّبِيِّ ﷺ قَالَ الْعُمْرَى جَائِزَةٌ
[Machine] The Prophet ﷺ made Al-Umrah obligatory for the heir, and Ibn Abi Najeeh transmitted it from Tawoos.
أَنَّ النَّبِيَّ ﷺ جَعَلَ الْعُمْرَى لِلْوَارِثِ تَابَعَهُ ابْنُ أَبِي نَجِيحٍ عَنْ طَاوُسٍ
The Prophet ﷺ as saying: Life tenancy is permissible. (Using translation from Abū Dāʾūd 3548)
قَالَ رَسُولُ اللهِ ﷺ الْعُمْرَى جَائِزَةٌ
[Machine] The narrator said, "I was with Ibn Umar when a man from the desert came to him and said, 'I have given my son a she-camel as a gift, and it produces camels.' Ibn Umar replied, 'It is a gift for him both in life and death.' The man said, 'I gave it to him as a form of charity.' Ibn Umar said, 'That is even farther from what it is.'"
"Ibn Uyaynah informed me about Ibn Abi Najeeh, who related from Habib ibn Abu Thabit something similar to this, except that he said, 'It was exhausted and agitated.' And Abu Sulayman said, 'His statement 'exhausted' means it produces camels.' The Shaykh (referring to the narrator) said, 'This indicates that what was narrated from Ibn Umar is reliable regarding...'" (rest of the passage not provided)
قَالَ كُنْتُ عِنْدَ ابْنِ عُمَرَ فَجَاءَهُ رَجُلٌ مِنْ أَهْلِ الْبَادِيَةِ فَقَالَ إِنِّي وَهَبْتُ لِابْنِي نَاقَةً حَيَاتَهُ وَإِنَّهَا تَنَاتَجَتْ إِبِلًا فَقَالَ ابْنُ عُمَرَ هِيَ لَهُ حَيَاتَهُ وَمَوْتَهُ فَقَالَ إِنِّي تَصَدَّقْتُ عَلَيْهِ بِهَا فَقَالَ ذَاكَ أَبْعَدُ لَكَ مِنْهَا
11983 قَالَ وَأَخْبَرَنِي ابْنُ عُيَيْنَةَ عَنِ ابْنِ أَبِي نَجِيحٍ عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ مِثْلَهُ إِلَّا أَنَّهُ قَالَ أَضْنَتْ وَاضْطَرَبَتْ كَذَا رُوِيَ وَقَالَ أَبُو سُلَيْمَانَ صَوَابُهُ ضَنَتْ يَعْنِي تَنَاتَجَتْ قَالَ الشَّيْخُ وَهَذَا يَدُلُّ عَلَى أَنَّ الَّذِي رُوِيَ عَنِ ابْنِ عُمَرَ فِيمَا
[Machine] He has a rose in his garden, below the 'Umr tree, and Allah knows best.
لَهُ وَرَدَّ فِي الْعَارِيَةِ دُونَ الْعُمْرَى وَاللهُ أَعْلَمُ
[Machine] A relief that I did not solve for you, but Muhammad (PBUH) solved for you forty years ago. He said, "Whoever builds something, his life is for his successors when he dies."
شُرَيْحٌ لَسْتُ أَنَا قَضَيْتُ لَكَ وَلَكِنَّ مُحَمَّدًا ﷺ قَضَى لَكَ مُنْذُ أَرْبَعِينَ سَنَةً قَالَ مَنْ أُعْمِرَ شَيْئًا حَيَاتَهُ فَهُوَ لِوَرَثَتِهِ إِذَا مَاتَ
[Machine] A man built a house with his life, then he had a dispute over it with Shurayh. The man who built the house was blind, so Shurayh ruled in his favor and said, "Whoever owns something, his life and death belong to him." The man who built the house asked, "How did you rule against me, O Abu Umamah?" He replied, "I did not rule against you, but it was Allah who ruled through the tongue of the Messenger of Allah, ﷺ , fifty years ago, that whoever owns something, it belongs to him and his heirs after him."
أَنَّ رَجُلًا أَعْمَرَ رَجُلًا دَارًا حَيَاتَهُ فَخَاصَمَ فِيهَا بَعْدَ ذَلِكَ إِلَى شُرَيْحٍ وَكَانَ الَّذِي أُعْمِرَ الدَّارَ أَعْمَى فَقَضَى لَهُ شُرَيْحٌ بِهَا وَقَالَ مَنْ مَلَكَ شَيْئًا حَيَاتَهُ فَهُوَ لَهُ حَيَاتَهُ وَمَوْتَهُ فَقَالَ الْمُعْمَرُ كَيْفَ قَضَيْتَ لِي يَا أَبَا أُمَيَّةَ؟ فَقَالَ لَسْتُ أَنَا قَضَيْتُ وَلَكِنْ قَضَى الله عَلَى لِسَانِ رَسُولِ اللهِ ﷺ مُنْذُ خَمْسِينَ سَنَةً مَنْ مَلَكَ شَيْئًا حَيَاتَهُ فَهُوَ لَهُ وَلِوَرَثَتِهِ بَعْدَهُ
