ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا زُجِرَ عَنْ كِرَاءِ الْمَزَارِعِ

"The Messenger of Allah ﷺ did not prohibit share-cropping. But he ordered that they be helpful with each other." (Using translation from Tirmidhī 1385)   

ابن حبّان:٥١٩٥ – أَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ بْنِ إِسْمَاعِيلَ بِبُسْتٍ قَالَ حَدَّثَنَا عَلِيُّ بْنُ حُجْرٍ السَّعْدِيُّ قَالَ حَدَّثَنَا الْفَضْلُ بْنُ مُوسَى عَنْ شَرِيكٍ عَنْ شُعْبَةَ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ طَاوُسٍ عَنِ ابْنِ عَبَّاسٍ قَالَ

«لَمْ يُحَرِّمْ رَسُولُ اللَّهِ ﷺ الْمُزَارَعَةَ وَلَكِنْ أَمَرَ النَّاسَ أَنْ يَرْفُقَ بَعْضُهُمْ بَعْضًا»

أَنَّ رَسُولَ اللَّهِ ﷺ لَمْ يُحَرِّمِ الْمُزَارَعَةَ وَلَكِنْ أَمَرَ أَنْ يَرْفُقَ بَعْضُهُمْ بِبَعْضٍ  

قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَحَدِيثُ رَافِعٍ فِيهِ اضْطِرَابٌ يُرْوَى هَذَا الْحَدِيثُ عَنْ رَافِعِ بْنِ خَدِيجٍ عَنْ عُمُومَتِهِ وَيُرْوَى عَنْهُ عَنْ ظُهَيْرِ بْنِ رَافِعٍ وَهُوَ أَحَدُ عُمُومَتِهِ وَقَدْ رُوِيَ هَذَا الْحَدِيثُ عَنْهُ عَلَى رِوَايَاتٍ مُخْتَلِفَةٍ وَفِي الْبَابِ عَنْ زَيْدِ بْنِ ثَابِتٍ وَجَابِرٍ ؓ
