البيهقي:٢١٤٦٩ – أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا يَحْيَى بْنُ مُحَمَّدِ بْنِ يَحْيَى ثنا أَبُو عُمَرَ ثنا شُعْبَةُ عَنِ الْحَكَمِ عَنْ إِبْرَاهِيمَ عَنِ الْأَسْوَدِ عَنْ عَائِشَةَ ؓ فِي قِصَّةِ بَرِيرَةَ قَالَتْ فَقَالَ

النَّبِيُّ ﷺ اشْتَرِيهَا فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ  

رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ أَبِي عُمَرَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ لَمْ يَخُصَّ النَّبِيُّ ﷺ وَاحِدًا مِنْهُمَا دُونَ الْآخَرِ وَإِنْ مَاتَ الْمُعْتِقُ لَمْ يَرِثْهُ مَوْلَاهُ بِاخْتِلَافِ الدِّينَيْنِ
