[AI] "From the Messenger of Allah ﷺ , he said: Whoever frees a slave that belongs to him must free him completely, if he has the means to pay his value. But if he does not have the means, then he should free him according to what he can free."

Messenger of Allah ﷺ said, "Whoever frees his share of a common slave and he has sufficient money to free him completely, should let its price be estimated by a just man and give his partners the price of their shares and manumit the slave; otherwise (i.e. if he has not sufficient money) he manumits the slave partially."

Messenger of Allah ﷺ said, "Whoever manumits his share of a slave, then it is essential for him to get that slave manumitted' completely as long as he has the money to do so. If he has not sufficient money to pay the price of the other shares (after the price of the slave is evaluated justly), the manumitted manumits the slave partially in proportion to his share. ʿUbaidullah narrated as above in brief.

The Prophet ﷺ said, "He who manumits his share of a slave and has money sufficient to free the remaining portion of that slave's price (justly estimated) then he should manumit him (by giving the rest of his price to the other co-owners)." Nafiʿ added, "Otherwise the slave is partially free." Aiyub is not sure whether the last statement was said by Nafiʿ or it was a part of the Hadith.

If anyone emancipates his share ina slave and has enough money to pay the full price for him, a fair price for the slave should be fixed, his partners given their shares, and the slave be thus emancipated, otherwise he is emancipated only to the extent of the first man's share.

" If he (one of the joint owners emancipating the slave) has not (enough) money (to secure freedom for the other half) a fair price for the slave should be fixed, and he will be required to work to pay for his freedom, but must not be over-burdened.

He who gives up his share in a slave, and has enough money to pay the full price of the slave, then full emancipation devolves upon him; but if he has not the money, then he emancipated what he emancipated.

He who emancipates his share in the slave, it is his responsibility to secure full freedom for him provided he (the slave) has enough money to pay the (remaining) price, but it he has not so much money he would be emancipated to the extent that the first man emancipated.

He who emancipates his portion in a slave, full emancipation may be secured for him out of his property (if he has money) if he has enough property to meet (the required expenses), but if he has not enough property, the slave should be put to extra labour (in order to earn money for buying his freedom), but he should not be overburdened.

If anyone emancipates his share in a slave, he is to be completely emancipated by his money if he has money. But if he has no money, a fair price for the slave should be fixed, and the slave is required to work for his master according to the proportion of his price, but he must not be overburdened. Abu Dawud said: In the version of both the narrators the words are "he will be required to work and must not be overburdened". This is the version of 'Ali.

أبو داود:٣٩٣٨حَدَّثَنَا نَصْرُ بْنُ عَلِيٍّ أَخْبَرَنَا يَزِيدُ يَعْنِي ابْنَ زُرَيْعٍ ح وَحَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ حَدَّثَنَا مُحَمَّدُ بْنُ بِشْرٍ وَهَذَا لَفْظُهُ عَنْ سَعِيدِ بْنِ أَبِي عَرُوبَةَ عَنْ قَتَادَةَ عَنِ النَّضْرِ بْنِ أَنَسٍ عَنْ بَشِيرِ بْنِ نَهِيكٍ عَنْ أَبِي هُرَيْرَةَ

عَنْ رَسُولِ اللَّهِ ﷺ قَالَ مَنْ أَعْتَقَ شِقْصًا لَهُ أَوْ شَقِيصًا لَهُ فِي مَمْلُوكٍ فَخَلاَصُهُ عَلَيْهِ فِي مَالِهِ إِنْ كَانَ لَهُ مَالٌ فَإِنْ لَمْ يَكُنْ لَهُ مَالٌ قُوِّمَ الْعَبْدُ قِيمَةَ عَدْلٍ ثُمَّ اسْتُسْعِيَ لِصَاحِبِهِ فِي قِيمَتِهِ غَيْرَ مَشْقُوقٍ عَلَيْهِ

قَالَ أَبُو دَاوُدَ فِي حَدِيثِهِمَا جَمِيعًا فَاسْتُسْعِيَ غَيْرَ مَشْقُوقٍ عَلَيْهِ وَهَذَا لَفْظُ عَلِيٍّ

If anyone emancipates his share in slave, a fair price for the slave should be fixed, give his partners their shares, and the slave be thus emancipated. Otherwise he is emancipated to the extent of the share which he emancipated.

If anyone emancipates his share in a slave, he should emancipate him completely if he has enough money to pay the full price ; but if he has none, he will be emancipated to the extent of his share.

If a man emancipates his share in a slave, the rest will be emancipated by his money if he has enough money to pay the full price for him.

"Whoever frees a portion" or, he said: "a part" or he said: "a share he owns of a slave, then he can afford the remainder of the price according to the reasonable price, then he will be free. Otherwise he has freed as much as he has freed (only)." Ayyub (one of the narrators) said: "Perhaps Nafi said in this Hadith: 'Meaning he has freed as much of him as he has freed.'"

قَالَ أَبُو عِيسَى حَدِيثُ ابْنِ عُمَرَ حَدِيثٌ حَسَنٌ صَحِيحٌ وَقَدْ رَوَاهُ سَالِمٌ عَنْ أَبِيهِ عَنِ النَّبِيِّ ﷺ نَحْوَهُ

"Whoever frees a portion of a slave he owns, then he can afford the remainder of the price, then he should free him with his wealth."

Abū ʿĪsá said that this Ḥadīth is Ṣaḥīḥ.

"Whoever frees a portion" or he said: "a part of a slave, then he should finish paying his price if he can afford it. If he can not afford to pay reasonable price then he should be allowed to work to earn the amount that will free him without overburdening him." (Another chain) similar, and he said: "a part".

قَالَ أَبُو عِيسَى وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَهَكَذَا رَوَى أَبَانُ بْنُ يَزِيدَ عَنْ قَتَادَةَ مِثْلَ رِوَايَةِ سَعِيدِ بْنِ أَبِي عَرُوبَةَ وَرَوَى شُعْبَةُ هَذَا الْحَدِيثَ عَنْ قَتَادَةَ وَلَمْ يَذْكُرْ فِيهِ أَمْرَ السِّعَايَةِ وَاخْتَلَفَ أَهْلُ الْعِلْمِ فِي السِّعَايَةِ فَرَأَى بَعْضُ أَهْلِ الْعِلْمِ السِّعَايَةَ فِي هَذَا وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ وَأَهْلِ الْكُوفَةِ وَبِهِ يَقُولُ إِسْحَاقُ وَقَدْ قَالَ بَعْضُ أَهْلِ الْعِلْمِ إِذَا كَانَ الْعَبْدُ بَيْنَ الرَّجُلَيْنِ فَأَعْتَقَ أَحَدُهُمَا نَصِيبَهُ فَإِنْ كَانَ لَهُ مَالٌ غَرِمَ نَصِيبَ صَاحِبِهِ وَعَتَقَ الْعَبْدَ مِنْ مَالِهِ وَإِنْ لَمْ يَكُنْ لَهُ مَالٌ عَتَقَ مِنَ الْعَبْدِ مَا عَتَقَ وَلاَ يُسْتَسْعَى وَقَالُوا بِمَا رُوِيَ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ وَهَذَا قَوْلُ أَهْلِ الْمَدِينَةِ وَبِهِ يَقُولُ مَالِكُ بْنُ أَنَسٍ وَالشَّافِعِيُّ وَأَحْمَدُ

"Whoever sets free his share of a slave should set him free completely from his own wealth, if he has enough wealth to cover the price of the slave."

"The Messenger of Allah said: 'Whoever sets free his share of a slave, and he has sufficient wealth to set him free completely by paying the price of the slave, then he should set him free with his own wealth."'

“Whoever frees his share of a slave or part of his share, must pay from his wealth if he has any wealth if he has any wealth (in order to buy the rest of the slave's freedom). If he does not have wealth, then the slave should be asked to work for the price (of his freedom), without that causing him too much hardship.”

“Whoever frees his share of a slave, the price of the slave should be fairly evaluated, and he (the partner who initiated this process) should free him (in full, by giving the rest of his price to the other co-owners), if he has enough wealth to do so. Otherwise, he will have freed whatever he freed.”

[AI] "Whoever frees a partner he has in a slave, he has freed all of him. And if the one who is freed has a share of wealth that is worth his value, then he is obligated to free all of him."

[AI] The Messenger of Allahﷺ said: "Whoever frees a share for himself in a person or a slave, he is tasked with freeing the rest. If he does not have the means to do so, then it is permissible for him to free whatever he can."

[AI] The Prophet Muhammad ﷺ said, "Whoever frees a slave that belongs to him, if he has enough wealth to cover its value, he should estimate its value and set it free accordingly. Otherwise, he has freed whatever he has freed."

أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ أَعْتَقَ شَقِيصًا لَهُ فِي عَبْدٍ فَإِنْ كَانَ لَهُ مِنَ الْمَالِ مَا يَبْلُغُ قِيمَتَهُ قُوِّمَ عَلَيْهِ قِيمَةَ عَدْلٍ وَإِلَّا فَقَدْ أَعْتَقَ مَا أَعْتَقَ

Malik related to me from Nafi from Abdullah ibn Umar that the Messenger of Allah ﷺsaid, "If a man frees his share of a slave and has enough money to cover the full price of the slave justly evaluated for him, he must buy out his partners so that the slave is completely freed. If he doesn't have the money, he partially frees him.

Messenger of Allah ﷺ said, "Whoever frees his share of a common slave and he has sufficient money to free him completely, should let its price be estimated by a just man and give his partners the price of their shares and manumit the slave; otherwise (i.e. if he has not sufficient money) he manumits the slave partially."
