bukhari:2523ʿUbayd b. Ismāʿīl > Abū Usāmah > ʿUbaydullāh > Nāfiʿ > Ibn ʿUmar

Messenger of Allah ﷺ said, "Whoever manumits his share of a slave, then it is essential for him to get that slave manumitted' completely as long as he has the money to do so. If he has not sufficient money to pay the price of the other shares (after the price of the slave is evaluated justly), the manumitted manumits the slave partially in proportion to his share. ʿUbaidullah narrated as above in brief.  

البخاري:٢٥٢٣حَدَّثَنَا عُبَيْدُ بْنُ إِسْمَاعِيلَ عَنْ أَبِي أُسَامَةَ عَنْ عُبَيْدِ اللَّهِ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ ؓ

قَالَ رَسُولُ اللَّهِ ﷺ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي مَمْلُوكٍ فَعَلَيْهِ عِتْقُهُ كُلِّهِ إِنْ كَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَهُ فَإِنْ لَمْ يَكُنْ لَهُ يُقَوَّمُ عَلَيْهِ قِيمَةَ عَدْلٍ فَأُعْتِقَ مِنْهُ مَا أَعْتَقَ حَدَّثَنَا مُسَدَّدٌ حَدَّثَنَا بِشْرٌ عَنْ عُبَيْدِ اللَّهِ اخْتَصَرَهُ

He who emancipates his share in the slave, it is his responsibility to secure full freedom for him provided he (the slave) has enough money to pay the (remaining) price, but it he has not so much money he would be emancipated to the extent that the first man emancipated.

If anyone emancipates his share in a slave, he should emancipate him completely if he has enough money to pay the full price ; but if he has none, he will be emancipated to the extent of his share.

قَالَ رَسُولُ اللَّهِ ﷺ مَنْ أَعْتَقَ شِرْكًا مِنْ مَمْلُوكٍ لَهُ فَعَلَيْهِ عِتْقُهُ كُلُّهُ إِنْ كَانَ لَهُ مَا يَبْلُغُ ثَمَنَهُ وَإِنْ لَمْ يَكُنْ لَهُ مَالٌ عَتَقَ نَصِيبُهُ

“Whoever frees his share of a slave, the price of the slave should be fairly evaluated, and he (the partner who initiated this process) should free him (in full, by giving the rest of his price to the other co-owners), if he has enough wealth to do so. Otherwise, he will have freed whatever he freed.”  

ابن ماجة:٢٥٢٨bحَدَّثَنَا يَحْيَى بْنُ حَكِيمٍ حَدَّثَنَا عُثْمَانُ بْنُ عُمَرَ حَدَّثَنَا مَالِكُ بْنُ أَنَسٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ أُقِيمَ عَلَيْهِ بِقِيمَةِ عَدْلٍ فَأَعْطَى شُرَكَاءَهُ حِصَصَهُمْ إِنْ كَانَ لَهُ مِنَ الْمَالِ مَا يَبْلُغُ ثَمَنَهُ وَعَتَقَ عَلَيْهِ الْعَبْدُ وَإِلاَّ فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ  

malik:38-1Mālik > Nāfiʿ > ʿAbdullāh b. ʿUmar

Malik related to me from Nafi from Abdullah ibn Umar that the Messenger of Allah ﷺsaid, "If a man frees his share of a slave and has enough money to cover the full price of the slave justly evaluated for him, he must buy out his partners so that the slave is completely freed. If he doesn't have the money, he partially frees him.  

مالك:٣٨-١حَدَّثَنِي مَالِكٌ عَنْ نَافِعٍ عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ

أنَّ رَسُولَ اللَّهِ ﷺ قالَ: «مَن أعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ. فَكانَ لَهُ مالٌ يَبْلُغُ ثَمَنَ العَبْدِ، قُوِّمَ عَلَيْهِ قِيمَةَ العَدْلِ. فَأعْطى شُرَكاءَهُ حِصَصَهُمْ. وعَتَقَ عَلَيْهِ العَبْدُ. وإلّا فَقَدْ عَتَقَ مِنهُ ما عَتَقَ»

[Machine] "From the Messenger of Allah ﷺ , he said: Whoever frees a slave that belongs to him must free him completely, if he has the means to pay his value. But if he does not have the means, then he should free him according to what he can free."

[Machine] "Whoever frees a partner he has in a slave, he has freed all of him. And if the one who is freed has a share of wealth that is worth his value, then he is obligated to free all of him."

عَنِ النَّبِيِّ ﷺ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي مَمْلُوكٍ فَقَدْ عَتَقَ كُلُّهُ فَإِنْ كَانَ لِلَّذِي أَعْتَقَ نَصِيبَهُ مِنَ الْمَالِ مَا يَبْلُغُ ثَمَنَهُ فَعَلَيْهِ عِتْقُهُ كُلُّهُ  

ذِكْرُ الْبَيَانِ بِأَنَّ الْمُعْتِقَ نَصِيبَهُ مِنْ مَمْلُوكِهِ، إِذَا كَانَ مُعْدِمًا كَانَ نَصِيبُهُ الَّذِي أَعْتَقَ جَائِزًا عِتْقُهُ

ibnhibban:4316al-Ḥusayn b. Idrīs al-Anṣārī > Aḥmad b. Abū Bakr > Mālik > Nāfiʿ > Ibn ʿUmar

Messenger of Allah ﷺ said, "Whoever frees his share of a common slave and he has sufficient money to free him completely, should let its price be estimated by a just man and give his partners the price of their shares and manumit the slave; otherwise (i.e. if he has not sufficient money) he manumits the slave partially." ابن حبّان:٤٣١٦أَخْبَرَنَا الْحُسَيْنُ بْنُ إِدْرِيسَ الْأَنْصَارِيُّ أَخْبَرَنَا أَحْمَدُ بْنُ أَبِي بَكْرٍ عَنْ مَالِكٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ فَكَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَ الْعَبْدِ قُوِّمَ عَلَيْهِ قِيمَةَ الْعَدْلِ وَأَعْطَى شُرَكَاءَهُ حِصَصَهُمْ وَأَعْتَقَ عَلَيْهِ الْعَبْدُ وَإِلَّا فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ»

الكبرى للنسائي:٤٩٢٥أَخْبَرَنَا عَبْدَةُ بْنُ عَبْدِ اللهِ الصَّفَارُ الْبَصْرِيُّ قَالَ أَخْبَرَنَا سُوَيْدٌ قَالَ حَدَّثَنَا زُهَيْرٌ قَالَ حَدَّثَنَا عُبَيْدُ اللهِ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ قَالَ

قَالَ رَسُولُ اللهِ ﷺ «مَنْ أَعْتَقَ شَيْئًا مِنْ مَمْلُوكٍ فَعَلَيْهِ عِتْقُهُ كُلُّهُ إِنْ كَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَهُ فَإِنْ لَمْ يَكُنْ لَهُ مَالٌ عَتَقَ مِنْهُ نَصِيبُهُ»

[Machine] The Prophet ﷺ said, "Whoever emancipates a slave in part ownership, then he has emancipated all of him, if the slave has the means to pay for himself, an equivalent to his value will be taken from his wealth. But if he does not have any wealth, then he should emancipate whatever he can emancipate."  

الكبرى للنسائي:٤٩٢٦أَخْبَرَنِي عَلِيُّ بْنُ مُحَمَّدِ بْنِ عَلِيٍّ قَالَ حَدَّثَنَا خَلَفُ بْنُ تَمِيمٍ قَالَ حَدَّثَنَا زَائِدَةُ قَالَ حَدَّثَنَا عُبَيْدُ اللهِ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ

عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ أَعْتَقَ شِرْكًا فِي عَبْدٍ فَقَدْ أَعْتَقَ كُلَّهُ إِنْ كَانَ الَّذِي أَعْتَقَ نَصِيبَهُ مِنَ الْمَالِ مَا يَبْلُغُ ثَمَنَهُ يُقَامُ فِي مَالِهِ قِيمَةَ عَدْلٍ فَإِنْ لَمْ يَكُنْ لَهُ مَالٌ عَتَقَ مِنْهُ مَا عَتَقَ»

[Machine] The Prophet Muhammad ﷺ said, "Whoever has a share in a slave, let him set him free, for he has indeed freed him. And if he has wealth, let him pay its fair value. And if he does not have wealth, then he has freed him from what he may have owed."
