The Prophet ﷺ said, "He who cultivates land that does not belong to anybody is more rightful (to own it)." ʿUrwa said, "ʿUmar gave the same verdict in his Caliphate."
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ أَعْمَرَ أَرْضًا لَيْسَتْ لأَحَدٍ فَهْوَ أَحَقُّ قَالَ عُرْوَةُ قَضَى بِهِ عُمَرُ ؓ فِي خِلاَفَتِهِ
The Prophet ﷺ said: If anyone brings barren land into cultivation, it belongs to him, and the unjust vein has no right.
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ أَحْيَا أَرْضًا مَيْتَةً فَهِيَ لَهُ وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ
The Prophet ﷺ said: If anyone surrounds a land with a wall, it belongs to him.
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ أَحَاطَ حَائِطًا عَلَى أَرْضٍ فَهِيَ لَهُ
that the Prophet ﷺ said: "Whoever revives a barren land then it is for him, and there is no right for the unjust root."
عَنِ النَّبِيِّ ﷺ قَالَ مَنْ أَحْيَى أَرْضًا مَيِّتَةً فَهِيَ لَهُ وَلَيْسَ لِعِرْقِ ظَالِمٍ حَقٌّ

[AI] He informed him that the Messenger of Allah ﷺ said, "Whoever revives a dead land, for him is a reward in it, and whatever is eaten by a wild animal from it, for him is a charity." Abu Muhammad Al-Afia said, "This includes birds and others."
أَخْبَرَهُ أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ أَحْيَا أَرْضًا مَيْتَةً فَلَهُ فِيهَا أَجْرٌ وَمَا أَكَلَتِ الْعَافِيَةُ مِنْهَا فَلَهُ فِيهَا صَدَقَةٌ» قَالَ أَبُو مُحَمَّد الْعَافِيَةُ الطَّيْرُ وَغَيْرُ ذَلِكَ

[AI] The Messenger of Allah ﷺ said, "Whoever revives a dead land, he will have a reward from it, and whatever the wild animals eat from it, it will be considered as charity for him."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَحْيَا أَرْضًا مَيْتَةً فَلَهُ مِنْهَا يَعْنِي أَجْرًا وَمَا أَكَلَتِ الْعَوَافِي مِنْهَا فَهُوَ لَهُ صَدَقَةٌ

"I entered upon 'Abdullah bin 'Ukaim Abu Mabad Al-Juhani to visit him, while he had Humrah. I said:'Why don't you hang something?' He said: 'Death is better than that. Yahya related from Malik from Hisham ibn Urwa from his father that the Messenger of Allah ﷺ said, "If anyone revives dead land, it belongs to him, and the unjust root has no right." Malik explained, "The unjust root is whatever is taken, or planted without right."
الله عليه وسلم قَالَ مَنْ أَحْيَا أَرْضًا مَيِّتَةً فَهِيَ لَهُ وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ
