29. Chapter of Yā (Male)
٢٩۔ بَابُ الْيَاءِ
يَزِيدُ بْنُ قَتَادَةَ
[Machine] A man from his family died while he was not a Muslim. My sister inherited him instead of me, and she was on his religion. Then my father became a Muslim and witnessed with the Messenger of Allah ﷺ in the Battle of Hunayn, and he died. So she took possession of his inheritance, and he left behind a servant and date palm trees. Then my sister became Muslim and she disputed with me regarding the inheritance, so I took the matter to Uthman. Abdullah ibn al-Arqam narrated to him that Umar decreed that whoever accepts Islam before the division of the inheritance will have a share. Therefore, Uthman ruled according to it. The first case was settled, and she shared with me in it. This wording is from the hadith of Abu Rabi al-Zahrani.
أَنَّ رَجُلًا مِنْ أَهْلِهِ مَاتَ وَهُو عَلَى غَيْرِ دِينِ الْإِسْلَامِ قَالَ فَوَرِثَتْهُ أُخْتِي دُونِي وَكَانَتْ عَلَى دِينِهِ ثُمَّ إِنَّ أَبِي أَسْلَمَ فَشَهِدَ مَعَ رَسُولِ اللهِ ﷺ حُنَيْنًا فَمَاتَ فَأَحْرَزَتْ مِيرَاثَهُ وَكَانَ تَرَكَ غُلَامًا وَنَخْلًا ثُمَّ إِنَّ أُخْتِي أَسْلَمَتْ فَخَاصَمَتْنِي فِي الْمِيرَاثِ إِلَى عُثْمَانَ فَحَدَّثَهُ عَبْدُ اللهِ بْنُ الْأَرْقَمِ أَنَّ عُمَرَ قَضَى أَنَّهُ مَنْ أَسْلَمَ عَلَى مِيرَاثٍ قَبْلَ أَنْ يُقْسَمَ فَلَهُ نَصِيبُهُ فَقَضَى بِهِِ عُثْمَانُ فَذَهَبَتْ بِذَلِكَ الْأُولَى وَشَارَكَتْنِي فِي هَذَا وَاللَّفْظُ لِحَدِيثِ أَبِي الرَّبِيعِ الزَّهْرَانِيِّ
