السيوطي:٧٠٥-٤٣b

"عَنْ طَاوُوسٍ قَالَ: إِنَّ الوَصِيَّةَ كَانتْ قَبْلَ المِيرَاثِ، فَلَمَّا نَزَلَ المِيرَاثُ نسَخَ المِيرَاثُ مَنْ يَرِثُ وَبَقِيَتِ الوَصِيَّةُ لِمَنْ لَا يَرِثُ، فَهِى بَاقِيَةٌ [ثَابِتَةٌ] [فَمَنْ أَوْصَى لِذِى قَرَابَةٍ لَمْ تَجُزْ وَصِيَّتُهُ]، لأَنَّ رَسُولَ اللَّهِ ﷺ قَالَ: لَا تَجُوزُ وَصِيَّةٌ لِوَارِثٍ".

[Machine] He used to say that the will came before inheritance, so when inheritance came, it abrogated the one who inherits, and the will remained for the one who does not inherit, so it is binding. So whoever makes a will for someone who is not a relative, his will is not valid.
