[Machine] Allah ﷺ said, "The one who started the conflict is responsible for what the oppressed person did, as long as the oppressed person did not transgress."  

البيهقي:٢١٠٨٩ – أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو عَبْدِ اللهِ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ نُعَيْمٍ ثنا قُتَيْبَةُ بْنُ سَعِيدٍ ثنا إِسْمَاعِيلُ بْنُ جَعْفَرٍ عَنِ الْعَلَاءِ عَنْ أَبِيهِ عَنْ أَبِي هُرَيْرَةَ ؓ أَنَّ رَسُولَ

اللهِ ﷺ قَالَ الْمُسْتَبَّانِ مَا قَالَا فَعَلَى الْبَادِئِ مَا لَمْ يَعْتَدِ الْمَظْلُومُ  

رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ قُتَيْبَةَ وَغَيْرِهِ وَرُوِيَ ذَلِكَ فِي حَدِيثِ أَنَسِ بْنِ مَالِكٍ وَفِيهِ دَلَالَةٌ عَلَى جَوَازِ الِانْتِصَارِ مِنْ غَيْرِ تَعَدٍّ وَلَا إِظْهَارِ فُحْشٍ وَحَدِيثُ عَائِشَةَ فِي قِصَّةِ زَيْنَبَ بِنْتِ جَحْشٍ ؓ دَلِيلٌ عَلَى إِبَاحَةِ الِانْتِصَارِ حَيْثُ قَالَتْ فَلَمْ تَبْرَحْ زَيْنَبُ بِنْتُ جَحْشٍ حَتَّى عَرَفْتُ أَنَّ رَسُولَ اللهِ ﷺ لَا يَكْرَهُ أَنْ أَنْتَصِرَ وَالْعَفْوُ وَتَرْكُ الِانْتِصَارِ أَوْلَى
