3. Book of Purification
٣۔ كِتَابُ الطَّهَارَةِ
[Machine] On the authority of Busrah bint Safwan, who was a companion of the Prophet ﷺ , she said: The Messenger of Allah ﷺ said, "If one of you touches his private parts, he should not perform the prayer until he performs ablution." Urwah disapproved of this and asked Busrah, and she confirmed it. Al-Hazm Al-Ansari, Muhammad ibn Muslim Al-Zuhri, Abu Al-Zinad Abdullah ibn Zakwan Al-Qurashi, Muhammad ibn Abdullah ibn Urwah, Abu Al-Aswad Muhammad ibn Abdur Rahman ibn Nawfal Al-Qurashi, and Abd Al-Hameed ibn Jafar Al-Ansari, Hassan ibn Muslim ibn Yannaqin, and others among the Tabi'een and their followers are all in agreement on this. As for Busrah bint Safwan, she is from the noble women of the Quraysh.
عَنْ بُسْرَةَ بِنْتِ صَفْوَانَ وَقَدْ كَانَتْ صَحِبَتِ النَّبِيَّ ﷺ قَالَتْ قَالَ رَسُولُ اللَّهِ ﷺ «إِذَا مَسَّ أَحَدُكُمْ ذَكَرَهُ فَلَا يُصَلِّ حَتَّى يَتَوَضَّأَ» «فَأَنْكَرَ ذَلِكَ عُرْوَةُ فَسَأَلَ بُسْرَةَ فَصَدَّقَتْهُ حَزْمٍ الْأَنْصَارِيُّ وَمُحَمَّدُ بْنُ مُسْلِمٍ الزُّهْرِيُّ وَأَبُو الزِّنَادِ عَبْدُ اللَّهِ بْنُ ذَكْوَانَ الْقُرَشِيُّ وَمُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ عُرْوَةَ وَأَبُو الْأَسْوَدَ مُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ نَوْفَلٍ الْقُرَشِيُّ وَعَبْدُ الْحَمِيدِ بْنُ جَعْفَرٍ الْأَنْصَارِيُّ وَالْحَسَنُ بْنُ مُسْلِمِ بْنِ يَنَّاقٍ وَغَيْرِهِمْ مِنِ التَّابِعِينَ وَأَتْبَاعِهِمْ فَأَمَّا بُسْرَةُ بِنْتُ صَفْوَانَ فَإِنَّهَا مِنْ سَيِّدَاتِ قُرَيْشٍ»
[Machine] "We have Malik ibn Anas. Do you know who is Busrah bint Safwan? She is the grandmother of Abd al-Malik ibn Marwan, the mother of his mother. Therefore, recognize her."
لَنَا مَالِكُ بْنُ أَنَسٍ «أَتَدْرُونَ مَنْ بُسْرَةُ بِنْتُ صَفْوَانَ؟ هِيَ جَدَّةُ عَبْدِ الْمَلِكِ بْنِ مَرْوَانَ أُمُّ أُمِّهِ فَاعْرِفُوهَا»
[Machine] About the Prophet ﷺ , there are five hadiths apart from this hadith (mentioned above) that have been proven to be famous through the narration of Busrabint Safwan. The name of ignorance has been lifted from her with these narrations. We have also narrated the obligation of performing ablution from touching the private parts, from a group of companions and female companions, from the Messenger of Allah ﷺ among them Abdullah bin Umar, Abu Huraira, Zaid bin Khalid Al-Juhani, Saad bin Abi Waqqas, Jabir bin Abdullah, Umm Habiba, Umm Salama, and I have also narrated a sound hadith.
عَنِ النَّبِيِّ ﷺ خَمْسَةَ أَحَادِيثَ غَيْرِ هَذَا الْحَدِيثِ وَقَدْ ثَبَتَ بِمَا ذَكَرْنَاهُ اشْتِهَارَ بُسْرَةَ بِنْتِ صَفْوَانَ وَارْتَفَعَ عَنْهَا اسْمُ الْجَهَالَةِ بِهَذِهِ الرِّوَايَاتِ وَقَدْ رَوِينَا إِيجَابَ الْوُضُوءِ مِنْ مَسِّ الذَّكَرِ عَنْ جَمَاعَةٍ مِنَ الصَّحَابَةِ وَالصَّحَابِيَّاتِ عَنْ رَسُولِ اللَّهِ ﷺ مِنْهُمْ عَبْدُ اللَّهِ بْنُ عُمَرَ وَأَبُو هُرَيْرَةَ وَزَيْدُ بْنُ خَالِدٍ الْجُهَنِيُّ وَسَعْدُ بْنُ أَبِي وَقَّاصٍ وَجَابِرُ بْنُ عَبْدِ اللَّهِ وَأُمُّ حَبِيبَةَ وَأُمُّ سَلَمَةَ وَأَرْوَى حديث صحيح
[Machine] "If a woman touches her private parts with her hand, then she must perform ablution (wudu')." Sahih.
«إِذَا مَسَّتِ الْمَرْأَةُ فَرْجَهَا بِيَدِهَا فَعَلَيْهَا الْوُضُوءُ» صحيح
[Machine] "When a woman touches her private parts, she must perform ablution." "And this is a debate that took place among the guardians in this matter."
«إِذَا مَسَّتِ الْمَرْأَةُ فَرْجَهَا تَوَضَّأَتْ» «وَهَذِهِ مُنَاظَرَةٌ جَرَتْ بَيْنَ أَئِمَّةِ الْحُفَّاظِ فِي هَذَا الْبَابِ»
[Machine] Yahya was not convinced of that until he brought Busra and asked her, and she confirmed it through conversation. Then Yahya said, "People have talked a lot about Qais ibn Talq and that his narration is not reliable." Ahmad ibn Hanbal said, "Both statements are accepted." Then Yahya said, "Malik narrated from Nafi' that Ibn 'Umar performed ablution after touching his private parts." Ali said, "Ibn Mas'ud used to say, 'You do not need to perform ablution after touching it; it is just a part of your body.'" Yahya said, "Who narrated from whom?" He said, "Sufyan related from Abu Qais, from Huzail, from Abdullah." Ibn Mas'ud and Ibn 'Umar disagreed, and Ibn Mas'ud had more right to be followed. Ahmad bin Hanbal said to him, "Yes, but Abu Qais Al-Awdi's narration is not reliable." Ali said, "Abu Nuaym told me, narrated by Misaar, from Umayr bin Sa'id, from Ammar bin Yasir, he said, 'I do not care if I touch it or not.'" Ahmad said, "Both Umayr and Ammar hold equal positions, so whoever wishes can follow this opinion, and whoever wishes can follow that opinion." Then Yahya said, "Between Umayr bin Sa'id and Ammar bin Yasir, there is a difference of opinion."
يَحْيَى ثُمَّ لَمْ يُقْنِعْ ذَلِكَ عُرْوَةَ حَتَّى أَتَى بُسْرَةَ فَسَأَلَهَا وَشَافَهَتْهُ بِالْحَدِيثِ ثُمَّ قَالَ يَحْيَى وَلَقَدْ أَكْثَرَ النَّاسُ فِي قَيْسِ بْنِ طَلْقٍ وَأَنَّهُ لَا يُحْتَجُّ بِحَدِيثِهِ فَقَالَ أَحْمَدُ بْنُ حَنْبَلٍ كِلَا الْأَمْرَيْنِ عَلَى مَا قُلْتُمَا فَقَالَ يَحْيَى مَالِكٌ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّهُ تَوَضَّأَ مِنْ مَسِّ الذَّكَرِ فَقَالَ عَلِيٌّ كَانَ ابْنُ مَسْعُودٍ يَقُولُ لَا يُتَوَضَّأُ مِنْهُ وَإِنَّمَا هُوَ بَضْعَةٌ مِنْ جَسَدِكَ فَقَالَ يَحْيَى عَنْ مَنْ فَقَالَ عَنْ سُفْيَانَ عَنْ أَبِي قَيْسٍ عَنْ هُزَيْلٍ عَنْ عَبْدِ اللَّهِ وَإِذَا اجْتَمَعَ ابْنُ مَسْعُودٍ وَابْنُ عُمَرَ وَاخْتَلَفَا فَابْنُ مَسْعُودٍ أَوْلَى أَنْ يُتَّبَعَ فَقَالَ لَهُ أَحْمَدُ بْنُ حَنْبَلٍ نَعَمْ وَلَكِنْ أَبُو قَيْسٍ الْأَوْدِيُّ لَا يُحْتَجُّ بِحَدِيثِهِ فَقَالَ عَلِيٌّ حَدَّثَنِي أَبُو نُعَيْمٍ ثنا مِسْعَرٌ عَنْ عُمَيْرِ بْنِ سَعِيدٍ عَنْ عَمَّارِ بْنِ يَاسِرٍ قَالَ مَا أُبَالِي مَسِسْتُهُ أَوْ أتَّقِي فَقَالَ أَحْمَدُ عَمَّارُ وَابْنُ عُمَرَ اسْتَوَيَا فَمَنْ شَاءَ أَخَذَ بِهَذَا وَمَنْ شَاءَ أَخَذَ بِهَذَا فَقَالَ يَحْيَى بَيْنَ عُمَيْرِ بْنِ سَعِيدٍ وَعَمَّارِ بْنِ يَاسِرٍ مَفَازَةٌ
[Machine] "We used to pray with the Prophet ﷺ without performing ablution from the place where we were sitting." Abu Mu'awiya and Abdullah ibn Idris reported this narration from Al-A'mash. "As for the Hadith of Abu Mu'awiya," according to their condition.
«كُنَّا نُصَلِّي مَعَ النَّبِيِّ ﷺ فَلَا نَتَوَضَّأُ مِنْ مَوْطِئٍ» تَابَعَهُ أَبُو مُعَاوِيَةَ وَعَبْدُ اللَّهِ بْنُ إِدْرِيسَ عَنِ الْأَعْمَشِ «أَمَا حَدِيثُ أَبِي مُعَاوِيَةَ» على شرطهما
[Machine] Abu Mu'awiya praised him and mentioned him with his chain of narration similar to him: "As for the hadith of Abu Idris"
ثنا أَبُو مُعَاوِيَةَ فَذَكَرَهُ بِإِسْنَادِهِ نَحْوَهُ «وَأَمَّا حَدِيثُ أَبِي إِدْرِيسَ»
[Machine] Regarding Al-A'mash, so he mentioned it like this.
عَنِ الْأَعْمَشِ فَذَكَرَهُ نَحْوَهُ
[Machine] The Prophet ﷺ never took off his shoes in prayer except for once. When he removed them, the people followed his example. He then asked, "Why did you do that?" They replied, "You took off your shoes, so we did too." The Prophet ﷺ said, "Indeed, Gabriel informed me that there was some impurity or harm in them."
أَنَّ النَّبِيَّ ﷺ لَمْ يَخْلَعْ نَعْلَيْهِ فِي الصَّلَاةِ قَطُّ إِلَّا مَرَّةً وَاحِدَةً خَلَعَ فَخَلَعَ النَّاسُ فَقَالَ «مَا لُكُمْ» قَالُوا خَلَعْتَ فَخَلَعْنَا فَقَالَ «إِنَّ جِبْرِيلَ أَخْبَرَنِي أَنَّ فِيهِمَا قَذَرًا أَوْ أَذًى»
[Machine] The Prophet ﷺ took off his shoes and said, "Gabriel informed me that..."
خَلَعَ النَّبِيُّ ﷺ نَعْلَهُ فَقَالَ «إِنَّ جِبْرِيلَ أَخْبَرَنِي أَنَّ »
عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ
[Machine] "When the Messenger of Allah ﷺ wanted to fulfill his need, he would go far away so that no one could see him."
«كَانَ رَسُولُ اللَّهِ ﷺ إِذَا أَرَادَ أَنْ يَقْضِيَ حَاجَتَهُ أَبْعَدَ حَتَّى لَا يَرَاهُ أَحَدٌ»
[Machine] The Prophet ﷺ was asked about the water of the sea, and he said, "The water of the sea is purifying."
سُئِلَ النَّبِيُّ ﷺ عَنْ مَاءِ الْبَحْرِ فَقَالَ «مَاءُ الْبَحْرِ طَهُورٌ»
[Machine] The narrator Al-Qa'nabi mentioned that all of them, from Malik, heard from Safwan bin Sulaiman, who heard from Sa'id bin Salamah, a man from the tribe of Azraq, that Al-Mughirah bin Abi Burdah, a man from the Banu Abd al-Dar, informed him that he heard Abu Hurairah saying: "A man asked the Messenger of Allah ﷺ , 'O Messenger of Allah, we travel on the sea and carry a small amount of water with us. If we perform ablution with it, we become thirsty. Can we perform ablution with seawater?' The Messenger of Allah ﷺ replied, 'Its water is pure, and its dead creatures are lawful food.' Malik bin Anas also narrated this hadith from Safwan bin Sulaiman, who heard it from Abdul Rahman bin Ishaq, who heard it from Abdul Rahman bin Ishaq, who heard it from Safwan bin Sulaiman. Abdul Rahman bin Ishaq narrated it from his father, and his father narrated it from Abdullah bin Ayyub bin Zadhan. Muhammad bin Al-Minhall narrated it from Yazid bin Zurai', who narrated it from Abdul Rahman bin Ishaq, who narrated it from Safwan bin Sulaiman, who said that Abu Yusuf bin Ya'qub narrated it from Muhammad bin Abi Bakr, who narrated it from Yazid bin Zurai', who narrated it from Abdul Rahman bin Ishaq, who narrated it from Safwan bin Sulaiman, who narrated it from Sa'id bin Salamah, who narrated it from Al-Mughirah bin Abi Burdah, who narrated it from Abu Hurairah, who narrated it from the Prophet ﷺ ."
ثنا الْقَعْنَبِيُّ كُلُّهُمْ عَنْ مَالِكٍ عَنْ صَفْوَانَ بْنِ سُلَيْمٍ عَنْ سَعِيدِ بْنِ سَلَمَةَ مَوْلًى لِآلِ الْأَزْرَقِ أَنَّ الْمُغِيرَةَ بْنَ أَبِي بُرْدَةَ رَجُلٌ مِنْ بَنِي عَبْدِ الدَّارِ أَخْبَرَهُ أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ يَقُولُ سَأَلَ رَجُلٌ رَسُولَ اللَّهِ ﷺ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّا نَرْكَبُ الْبَحْرَ وَنَحْمِلُ مَعَنَا الْقَلِيلَ مِنَ الْمَاءِ فَإِنْ تَوَضَّأْنَا بِهِ عَطِشْنَا أَفَنَتَوَضَّأُ بِمَاءِ الْبَحْرِ؟ فَقَالَ رَسُولُ اللَّهِ ﷺ «هُوَ الطَّهُورُ مَاؤُهُ الْحِلُّ مَيْتَتُهُ» وَقَدْ تَابَعَ مَالِكَ بْنَ أَنَسٍ عَلَى رِوَايَتِهِ عَنْ صَفْوَانَ بْنِ سُلَيْمٍ عَبْدُ الرَّحْمَنِ بْنُ إِسْحَاقَ وَإِسْحَاقُ بْنُ إِبْرَاهِيمَ الْمُزَنِيُّ أَمَا حَدِيثُ عَبْدِ الرَّحْمَنِ بْنِ إِسْحَاقَ فَحَدَّثَنَاهُ أَبُو بَكْرِ بْنُ إِسْحَاقَ أَنْبَأَ عَبْدُ اللَّهِ بْنُ أَيُّوبَ بْنِ زَاذَانَ ثنا مُحَمَّدُ بْنُ الْمِنْهَالِ ثنا يَزِيدُ بْنُ زُرَيْعٍ ثنا عَبْدُ الرَّحْمَنِ بْنُ إِسْحَاقَ عَنْ صَفْوَانَ بْنِ سُلَيْمٍ قَالَ وَأَنْبَأَ أَبُو يُوسُفَ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ أَبِي بَكْرٍ ثنا يَزِيدُ بْنُ زُرَيْعٍ ثنا عَبْدُ الرَّحْمَنِ بْنُ إِسْحَاقَ ثنا صَفْوَانُ بْنُ سُلَيْمٍ عَنْ سَعِيدِ بْنِ سَلَمَةَ عَنِ الْمُغِيرَةِ بْنِ أَبِي بُرْدَةَ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ ﷺ نَحْوَهُ
This hadith has been narrated on the authority of Abu Huraira with another chain of transmitters. (Using translation from Muslim 1716b)
عَنْ أَبِي هُرَيْرَةَ
[Machine] He informed him that he heard Abu Huraira say, "We were with the Messenger of Allah ﷺ one day when a hunter came to him and said, 'O Messenger of Allah, we go out to sea to seek game, and one of us carries a water skin, hoping to catch the game soon. Perhaps he will find it as he hopes, or perhaps he will not find the game until he reaches a place in the sea that he never expected to reach. He might then become thirsty or be in need of performing ablution. If he performs ablution or uses this water, will any of us be harmed by thirst? Do you see it permissible for us to perform ablution or use this water if we fear that?' It is reported that the Messenger of Allah ﷺ said, 'Perform ablution with it and use it, for its water is pure and its dead are lawful.' Muslim, with the authority of Jullah ibn Kathir, followed Yahya ibn Sa`id al-Ansari and Yazid ibn Muhammad al-Qurashi, who followed Sa`id ibn Salama al-Makhzumi in narrating this Hadith, but they differed on this Hadith."
أَخْبَرَهُ أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ يَقُولُ كُنَّا عِنْدَ رَسُولِ اللَّهِ ﷺ يَوْمًا فَجَاءَهُ صَيَّادٌ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّا نَنْطَلِقُ فِي الْبَحْرِ نُرِيدُ الصَّيْدَ فَيَحْمِلُ مَعَهُ أَحَدُنَا الْإِدَاوَةَ وَهُوَ يَرْجُو أَنْ يَأْخُذَ الصَّيْدَ قَرِيبًا فَرُبَّمَا وَجَدَهُ كَذَلِكَ وَرُبَّمَا لَمْ يَجِدِ الصَّيْدَ حَتَّى يَبْلُغَ مِنَ الْبَحْرِ مَكَانًا لَمْ يَظُنَّ أَنْ يَبْلُغَهُ فَلَعَلَّهُ يَحْتَلِمُ أَوْ يَتَوَضَّأُ فَإِنِ اغْتَسَلَ أَوْ تَوَضَّأَ بِهَذَا الْمَاءِ فَلَعَلَّ أَحَدُنَا يُهْلِكُهُ الْعَطَشُ فَهَلْ تَرَى فِي مَاءِ الْبَحْرِ أَنْ نَغْتَسِلَ به أَوْ نَتَوَضَّأَ بِهِ إِذَا خِفْنَا ذَلِكَ فَزُعِمَ أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «اغْتَسِلُوا مِنْهُ وَتَوَضَّئُوا بِهِ فَإِنَّهُ الطَّهُورُ مَاؤُهُ الْحِلُّ مَيْتَتُهُ» «وَقَدِ احْتَجَّ مُسْلِمٌ بِالْجُلَاحِ أَبِي كَثِيرٍ وَقَدْ تَابَعَ يَحْيَى بْنُ سَعِيدٍ الْأَنْصَارِيُّ وَيَزِيدُ بْنُ مُحَمَّدٍ الْقُرَشِيُّ سَعِيدَ بْنَ سَلَمَةَ الْمَخْزُومِيَّ عَلَى رِوَايَةِ هَذَا الْحَدِيثِ وَاخْتُلِفَ عَلَيْهِ فِيهِ»
This tradition has also been narrated on the authority of ‘A’ishah through a different chain. (Using translation from Abū Dāʾūd 99)
عَنِ النَّبِيِّ ﷺ نَحْوَهُ
[Machine] From the Prophet ﷺ, a narration was reported that Sulaiman ibn Bilal narrated from Yahya ibn Sa'id, who narrated from Abdullah ibn Al-Mughirah, who narrated from his father, that Muslim sought the judgment with the weapon.
عَنِ النَّبِيِّ ﷺ نَحْوَهُ وَقَالَ سُلَيْمَانُ بْنُ بِلَالٍ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ عَبْدِ اللَّهِ بْنِ الْمُغِيرَةِ عَنْ أَبِيهِاحتج مسلم بالجلاح
