اللهُ عَلَيْهِ وَسَلَّمَ قَالَ مَنْ قتل في عميا بحجر أو عصا فهو خطأ عقله عقل خطأ وَمَنْ قُتِلَ عَمْدًا فَهُوَ قَوْدٌ وَمَنْ حَالَ دونه فعليه لعنة الله وغضبه لا يُقْبَلُ مِنْهُ صَرْفٌ وَلا عَدْلٌوَهَذَا الحديثُ قد رواه سُلَيْمَانُ بْنُ كَثِيرٍ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ طَاوُسٍ عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللهُ عَنْهُمَامجاهد عنه
"Whoever is killed in the blind or by something thrown, with a rock, a whip, or a stick, then the blood money to be paid for him is the blood money for accidental killing. Whoever kills deliberately, then retaliation is upon him, and whoever tries to prevent that, upon him is the curse of Allah, the Angels and all the people, and Allah will not accept any Sarf nor 'Adl from him."
مَنْ قُتِلَ فِي عِمِّيَّةٍ أَوْ رِمِّيَّةٍ بِحَجَرٍ أَوْ سَوْطٍ أَوْ عَصًا فَعَقْلُهُ عَقْلُ الْخَطَإِ وَمَنْ قُتِلَ عَمْدًا فَهُوَ قَوَدٌ وَمَنْ حَالَ بَيْنَهُ وَبَيْنَهُ فَعَلَيْهِ لَعْنَةُ اللَّهِ وَالْمَلاَئِكَةِ وَالنَّاسِ أَجْمَعِينَ لاَ يَقْبَلُ اللَّهُ مِنْهُ صَرْفًا وَلاَ عَدْلاً
If anyone is killed. Ibn 'Ubaid in his version said: The Messenger of Allah ﷺ said: If anyone is killed in error (blindly) when people are throwing stones, or by beating with whips, or striking with a stick, it is accidental and the compensation for accidental death is due. But if anyone is killed deliberately, retaliation is due. Ibn 'Ubaid in his version: Retaliation of the man is due. The agreed version then goes: If anyone comes in (between the two parties) to prevent it, Allah's curse and anger will rest on him, and neither supererogatory nor obligatory acts will be accepted from him. The version of the tradition of Sufyan is more perfect.
قَالَ رَسُولُ اللَّهِ ﷺ مَنْ قُتِلَ فِي عِمِّيَّا فِي رَمْىٍ يَكُونُ بَيْنَهُمْ بِحِجَارَةٍ أَوْ ضَرْبٍ بِالسِّيَاطِ أَوْ ضَرْبٍ بِعَصًا فَهُوَ خَطَأٌ وَعَقْلُهُ عَقْلُ الْخَطَإِ وَمَنْ قُتِلَ عَمْدًا فَهُوَ قَوَدٌ وَقَالَ ابْنُ عُبَيْدٍ قَوَدُ يَدٍ ثُمَّ اتَّفَقَا وَمَنْ حَالَ دُونَهُ فَعَلَيْهِ لَعْنَةُ اللَّهِ وَغَضَبُهُ لاَ يُقْبَلُ مِنْهُ صَرْفٌ وَلاَ عَدْلٌ وَحَدِيثُ سُفْيَانَ أَتَمُّ
“Whoever kills out of folly or for tribal motives, using a rock, a whip, or a stick; he must pay the blood money for killing by mistake. Whoever kills deliberately, he is to be killed in retaliation. Whoever tries to prevent that, upon him is the curse of Allah, the angels and all the people, and no change nor equitable exchange will be accepted from him.”

The Prophet ﷺ said: If anyone is killed blindly or, when people are throwing stones, by a stone or a whip, his blood-wit is the blood-wit for an accidental murder. But if anyone is killed intentionally, retaliation is due. If anyone tries to prevent it, the curse of Allah, of angels, and of all the people will rest on him. عِمِّيَّةٍ أَوْ قَالَ عَصَبِيَّةٍ بِحَجَرٍ أَوْ سَوْطٍ أَوْ عَصًا فَعَلَيْهِ عَقْلُ الْخَطَأِ وَمَنْ قَتَلَ عَمْدًا فَهُوَ قَوَدٌ وَمَنْ حَالَ بَيْنَهُ وَبَيْنَهُ فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلاَئِكَةِ وَالنَّاسِ أَجْمَعِينَ لاَ يُقْبَلُ مِنْهُ صَرْفٌ وَلاَ عَدْلٌوَهَذَا الْحَدِيثُ لاَ نعلمُهُ يُرْوَى عَنِ ابْنِ عَبَّاسٍ بِهَذَا اللَّفْظِ إلاَّ مِن هَذَا الْوَجْهِ بِهَذَا الإِسْنَادِ ولاَ نَعْلَمُ أَسْنَدَهُ عَنْ عَمْرو بن دِينار عَن طاووس عَنِ ابْنِ عَبَّاسٍ إلاَّ سُلَيْمَانُ بْنُ كَثِيرٍ وَرَوَاهُ غَيْرُ سُلَيْمَانَ عَنْ عَمْرو بْنِ دِينَارٍ عَن طاوُوس عَنِ النَّبِيّ صَلَّى اللَّهُ عَلَيه وَسَلَّم مُرْسَلًا
"مَنْ قتِلَ في عمِّيَّا في رمِّيَّا يَكُونُ بَينَهُمْ بِحِجَارَةٍ أَوْ بالسِّياطِ أَوْ ضَرْبا بِعَصًا فَهُوَ خَطَأٌ، وَعَقْلُهُ عَقْلُ الْخَطَإِ، وَمَنْ قُتِلَ عَمْدًا فَهُوَ قَوَدُ يَدٍ، وَمَنْ حَال دُونَهُ فَعَلَيهِ لعْنَةُ اللهِ وغَضَبُهُ، لا يَقْبَلُ اللهُ مِنْهُ صَرْفًا وَلا عَدْلًا".
